NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA: Section 1. That Subsections (f) and (g) of Section 30-33, Water Service rates, of the Code of Ordinances of the City of Naples are amended to read as follows (with underlining indicating additions and strikeout indicating deletions): Sec. 30-33. ORDINANCE 07-11859

AN ORDINANCE PERTAINING TO UTILITY RATES; AMENDING SUBSECTIONS (f) AND (g) OFSECTION 30-33, WATER SERVICE RATES, OF THE CODE OF ORDINANCES, CITY OF NAPLES;AMENDING CHAPTER 30, PUBLIC WORKS, OF APPENDIX "A" OF THE CODE OF ORDINANCES,CITY OF NAPLES; PROVIDING A SEVERABILITY CLAUSE, A REPEALER PROVISION AND ANEFFECTIVE DATE.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA:

Section 1. That Subsections (f) and (g) of Section 30-33, Water Service rates,of the Code of Ordinances of the City of Naples are amended to readas follows (with underlining indicating additions and strikeoutindicating deletions):

Sec. 30-33. Water service rates.

(f) Annual rate adjustment. For the Fiscal Years beginning October 1, 2008 and 2009, water rates shall be increased by the following amounts:

(f) (g) Annual rate adjustment by index. Effective and commencing on October1, 2000 20107- and for each annual anniversary thereafter, there shallbe an automatic water rate adjustment based upon and equal to the then-current percentage increase of the Florida Public Service CommissionDeflator Index. In the event that the Deflator Index exceeds 3 percent,the proposed increase in water rates shall be presented to city councilfor approval. (2) (3) Commodity costs. Each single-family dwelling shall have a cap of10,000 gallons monthly. A cap shall not apply if an irrigation meter,sub-meter, or reclaimed water meter serves the property. All othercustomers shall be charged per actual water usage gallons.

(3) (4) Customers outside city limits. Customers located outside the citylimits are subject to a 25 percent surcharge.

(5) Irrigation meters. No sewer charges are imposed on irrigation watermeter flows.

§ 30-373. Water service connections and main extensions.

(1) Water connection charges:

a. Single-family residences: $3.87 per front foot. This serviceconnection charge shall provide service to 1 building (single-family residence) on any lot, regardless of depth.

b. Multifamily, commercial and industrial uses: $3.87 per front footof each building lot for a maximum depth of 150 feet, plus$0.0155 per square foot thereafter.

c. Where a lot is more than 150 feet in depth, for each additionalbuilding constructed beyond the 150 feet, there shall be anadditional service connection charge based on the width and areaof the lot on which the building is built, as more fully setforth in subsection b above.

d. The city manager shall designate size of lot in the event of adispute as to the size of the lot.

5 30-375. Utility plan review and inspection fees.

(1) Construction document review fee: 0.75 percent of probable water and/orsewer construction costs shall be paid as a fee for document review.

(2) Construction inspection: 2.25 percent of probable cost of constructionactivities shall be paid as a fee for utility inspection of waterand/or sewer construction.

(3) Construction document resubmission or document modification: The fee forsubmittal of an insubstantial change shall be $150.00 for the firstsheet and $75.00 for each additional sheet.

Section 3. If any word, phrase, clause, subsection or section of thisordinance is for any reason held unconstitutional or invalid, theinvalidity thereof shall not affect the validity of any remainingportions of this ordinance.

Section 4. That all sections or parts of sections of the Code of Ordinances,City of Naples, all ordinances or parts of ordinances, and allresolutions or parts of resolutions in conflict herewith, be andthe same are hereby repealed to the extent of such conflict.

/Section 5. This ordinance shall take effect immediately upon adoption at

second reading.
