SPECIAL USE PERMIT APPLICANT'S RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER

The proposed development is an outdoor storage facility for storage of construction equipment
overnight or during brief periods when the equipment is not being used. This activity is allowed
under the current zoning therefore no rezoning or change of land use permit is required. The
special use permit will allow the property be developed without any adverse impact to
surrounding or adjacent areas, which consists of commercial or light industrial activities.
(B) WHETHER A PROPOSED SPECIAL USE PERMIT WILL ADVERSELY AFFECT THE EXISTING USE
OR USABILITY OF ADJACENT OR NEARBY PROPERTY:
No. The special use permit will not adversely affect the existing use or suitability of adjacent or
nearby properties. The proposed development will be screened using combination of trees and
a screened perimeter fence.
(C) WHETHER THE PROPERTY TO BE AFFECTED BY A PROPOSED SPECIAL USE PERMIT HAS
REASONABLE ECONOMIC USE AS CURRENTLY ZONED:
The zoning will not change, and the proposed use is allowed under current zoning. Storing
equipment on the site will enhance the owner's business operations as a general contractor,
allowing him to expand his business and generate more tax dollars for the County.
(D) WHETHER THE PROPOSED SPECIAL USE PERMIT WILL RESULT IN A USE WHICH WILL OR
COULD CAUSE AN EXCESSIVE OR BURDENSOME USE OF EXISTING STREETS,
TRANSPORTATION FACILITIES, UTILITIES, OR SCHOOLS:
The proposed land use will not cause any burdensome or excessive use of existing streets
because there will be no ongoing activity on the site as there will be no activities on site to
attract heavy traffic. Traffic will be minimal, typically consisting of a few construction equipment
leaving the site in the mornings and returning in the evenings. Each will be leavi~n ~efVia~f
at different times so there will be no long line of equipment at any given time tr 1 o exit or
enter the site.

(E) WHETHER THE PROPOSED SPECIAL USE PERMIT IS IN CONFORMITY WITH THE POLICY AND
INTENT OF THE LAND USE PLAN:
Yes. The special use permit will allow the property to be used for activities that are consistent
with the current zoning.
(F) WHETHER THERE ARE OTHER EXISTING OR CHANGING CONDITIONS AFFECTING THE USE AND DEVELOPMENT OF THE PROPERTY WHICH GIVE SUPPORTING GROUNDS FOR EITHER APPROVAL OR DISAPPROVAL OF THE PROPOSED SPECIAL USE PERMIT: Activities on the site will be consistent with the current zoning. Day-time activities on the site
will be minimal, as the equipment will be either elsewhere working on construction sites, or
quietly resting on site. Therefore, the adjacent properties will not be subjected to any noise or
other undesirable activities. The property will be screened with a screened fence and trees and
activities on site will not be visible from adjacent properties. Denying the property owner the
special use permit will create great hardship to the owner. The property is only 87ft wide and if
the owner is to comply with the 25ft (width of the side setback) buffer along the sides, the
remaining width would be only 37ft, which would not make the project viable.

Re: Special Land Use Permit Application for 1213 Beaver Ruin Road
I am hereby applying for a Special Land Use Permit for my property located at 1213 Beaver Ruin
Road in City of Norcross, Gwinnett County. My intent is to develop the 1-acre property to store
construction equipment during the night time or for other short periods when they are not
being actively working on one of my job sites around the County. No building will be
constructed and there will be no activities related to customer service and no visitors to
transact business.
The site will be developed in conformance with all applicable development codes of Gwinnett
County, including asphalt pavement, screening fence, inter-parcel access, storm water
management practices and installation of planted 15ft-wide transitional buffers.
