Τhe International instruments established to control export and import of wastes which may pose a risk or a hazard to human health and the environment are two:

BASEL CONVENTION, whose secretariat is administered by the United Nations Environment Programmed (UNEP), and

the Organization for Economic Co-operation and Development (OECD) Council Decision C(2001)107/FINAL (hereinafter “the OECD Decision”).

Wastes Controlled Under the Basel Convention Article 1 of the Convention states that the wastes that are subject to Transboundary movement shall be "hazardous wastes" for the purpose of the Convention

Since 1998 Basel Convention keeps two new annexes to the Convention namely Annex VIII (list A) and Annex IX (list B). The Conference of the Parties also instructed the Technical Working Group to keep the List A and List B of wastes under review. (a) List A. Wastes contained in this list are characterized as hazardous under Article 1, paragraph 1 (a), of the Convention, and their designation on this list does not preclude the use of the Annex III to demonstrate that a waste is not hazardous. (b) List B. Wastes contained in this list will not be wastes covered by Article 1, paragraph 1 (a), of this Convention unless they contain Annex I material to an extent causing them to exhibit an Annex III characteristic. http://www.basel.int

BASEL CONVENTION controls the Transboundary movement of hazardous and other wastes through its provisions for “Prior Informed Consent” (PIC) that must be met before any shipment of wastes is permitted.

The procedures to control waste transfrontier shipments of the Basel Convention and OECD are based on three main steps: -Notification, -Written Consent, -Transboundary movement with the accompanying Movement Document and finally the issuance of -Certificate of Disposal /Recovery

-Empty transformers or big capacitors should be placed in metallic tray/basin capable to contain all remaining liquids . The high of tray should be at least 80cm high and with a capacity to collect all liquids in case of lacking (1,25 more than the quantity of liquid PCB). In the tray should be placed adequate quantity of inert absorbent materials capable to absorb all quantity of liquid PCB.

OECD revised Decision (92) 39 2003 ?

The field of application of this decision is more restricted than the Basel Convention since it circumscribes movements of waste destined solely for recovery.

OECD with the revision of council decision C(92)39/FINAL on the control of Transboundary movements of wastes destined for recovery operations set all required terms and condition to import or to export waste for recovery operations.

Provides the called green and amber lists that are mostly marked as Basel Convention annexes VIII& IX.

In the revised OECD Control System, the lists of wastes subject to control have been harmonized with the lists of wastes of the Basel Convention, requiring different levels of control when destined for recovery in another OECD country.

The OECD Control System is now based on two types of control procedures: Green Control Procedure for wastes that present low risk for human health and the environment and, therefore, are not subject to any other controls than those normally applied in commercial transactions; and Amber Control Procedure for wastes presenting sufficient risk to justify their control.

BILATRAL AGREMENTS

Bilateral, multilateral and regional agreements on waste Transboundary movements:

The provisions of this Convention shall not affect Transboundary movements which take place pursuant to bilateral, multilateral or regional agreements, provided that such agreements are compatible with the environmentally sound management of hazardous wastes and other wastes as required by this Convention" (Article 11, paragraph 2).

Parties shall notify the Secretariat of any such agreement that they enter into regarding Transboundary movement of hazardous or other wastes, as well as "those which they have entered into prior to the entry into force of this Convention for them, for the purpose of controlling Transboundary movements of hazardous wastes and other wastes which take place entirely among the Parties to such agreements
