REORGANIZATION ACT OF 1980",AS AMENDED, ANDAPPROPRIATING FUNDS THEREFOR

Be it enacted by the Senate and House of Representatives of thePhilippines in Confess assembled:

Section l. An additional branch of the Regional TrialCourt to be stationed in the City of San Joee, situated in theProvince of Nueva Ecija, is hereby created in the Third JudicialRegion.

Sec. 2. The Supreme Court shall assign the branch numberof the newly created branch of the Regional Trial Court in the

i Third Judicial Region.

Sec. 3. The Chief Justice of the Supreme Court, inI coordination with the Secretary of the Department of Justice,i shall immediately include in the Court's program the

operationalizationofthe additional branch ofthe RegionalTrialCourt to be stationed in the City of San Jose, situated in theProvince of Nueva Ecija, the funding ofwhich shall be includedin theAnnualGeneralAppropriations Act. Thefundsnecessaryforthe operation ofthe courthereincreatedshallbeappropriatedand released only upon the actual organization of the court andthe appointment ofits personnel.

Sec. 4. Section 14(c) of Batas Pambansa Big. 129,otherwise known as "TheJudiciary Reorganization Act of1980",as amended, and all other laws, executive orders, and rules andregulations which are inconsistent with this Act are herebyamended, repealed or modifiedaccordingly.

Sec. 5. This Act shall take effect fifteen (15) days after itscomplete publication in two (2)newspapers of general circulation.

The Chief Justice of the Supreme Court, incoordination with the Secretaryofthe Department ofJustice, shallimmediately include in the Court's program theoperationalizationofthe additional branch of the Regional Trial Court in the ProvinceofMisamis Oriental, with seat at Initao, the funding of which

shall be included in the Annual General Appropriations Act. Thefunds necessary for the operation of the court herein created shallbe appropriated and released only upon the actual organization ofthe court and the appointment of its personnel.

The Chief Justice of the Supreme Court, incoordination with the Secretary of the Department of Justice,shall immediately include in the Court's program theoperationalization of the Regional Trial Court branch to bestationed in the City of Meycauayan, Province ofBulacan, thefunding of which shall be included in the Annual GeneralAppropriations Act,Thefundsnecessaryfor the operationofthecourthereincreatedshallbeappropriated and releasedonly uponthe actu^ organization ofthecourt and the appointment ofitspersonnel.

AN ACT CREATING NINETEEN (19) ADDITION^BRANCHES OF THE REGIONALTRIAL COURT INNATIONAL CAPITAL JUDICIAL REGION TO BESTATIONED IN QUEZON CITY, METRO MANILA,FURTHER AMENDING FOR THE PURPOSE SECTION14, PARAGRAPH (D) OFBATASPAMBANSA BLG. 12ÔTHERWISE KNOWN AS "THE JUDICIARYREORGANIZATION ACT OF 1980", AS AMENDED, AND •APPROPRIATING FUNDS THEREFOR


Section l. Nineteen (19) additional branehes of theRegional Trial Court to be stationed in Quezon City, Metro Manilaare hereby created inthe National Capital Region.

Sec. 2. The Supreme Court shall assign the respectivebranch numbers for the newly created branches of the RegionalTrial Courts inthe National Capital Judicial Region.

Sec. 3. The Chief Justice of the Supreme Court, incoordination with the Secretary of the Department of Justice,shall immediately include in ®operationalization of the nineteen (19) additionalbranches ofthe

Regional Trial Court, the funding of which shall be included inthe Annual GeneralAppropriations Act. Thefunds necessaryforthe operation ofthe courts hereincreatedshallbe appropriatedand released only upon the actual organization ofthe courts andthe appointqient of its personnel.

Sec. 4. Section 14(d) of Batas Pambansa Big. 129,otherwise knownas "TheJudiciary ReorganizationActof1980",as amended, and all other laws, executive orders, and rules andregulations which are inconsistent with this Act are herebyamended, repealed, or modified accordingly.

Sec. 5. ThisActshalltakeeffectfifteen (15)days after itscompletepublicationin two (2)newspapers ofgeneral circulation.

AN ACT PROTECTING SEAFARERS AGAINSTAMBULANCE CHASING AND IMPOSITION OFEXCESSIVE FEES, AND PROVIDING PENALTIESTHEREFOR

Be it enacted by the Senate and House of Representatives of thePhilippines in Co^i^ress assembled:

Section l. This Act shall be known as the "SeafarersProtection Act".

Sec. 2. Declaration of Policy. - It shall be the policy,of the State to promote and protect every Filipino seafarerdesiring to work overseas by securing the best possible termsand conditions of employment. As some unscrupulousindividuals have talcen advantage of the plight of our seafarerswho met an accident, illness or death in the course of theirservice by exploiting the compensation system, our seafarershave fallen prey to an unfair scheme where ambulance

chasers charge exorbitant fees, with the promise of hugemonetary award. Towards this end, such practice shall bedeclared unlawful.

Sec. 3. Prohibition on Ambulance Chasing. - It shallbe unlawful for any person to engage in ambulance chasingor the act of soHciting, personally or through an agent, fromseafarers, or their heirs, the pursuit of any claim against theiremployers for the purpose of recovery of monetary rlairp orbenefit, induding legal interest, arising from accident, illnessor death, in exchange of an amount or fee which shall beretained or deducted from the monetsiry claim or benefitgranted to or awarded to the seafarers or their heirs.

Sec. 4. Imposition of Excessive Fees. - When anycontract or arrangement between a seafarer or his/her heirs,and a person who appears for or represents them in any casefor recovery of monetary claim or benefit, including legalinterest, arising from accident, illness or death before theNational Labor Relations Commission (NLRC) or any laborarbiter, the National Conciliation and Mediation Board (NCMB),the Phihppine Overseas Employment Administration (POEA),the Department of Labor and Employment (DOLE) or itsregional offices, or other quasi-judidal bodies bandling labordisputes stipulates that the person who appears for orrepresents them shall be entitled to fees, such fees shall notexceed ten percent (10%) of the compensation or benefitawarded to the seafarer or his/her heirs.

For purposes of this Act, fees referred to in this sectionshall mean the total amount of compensation of the personwho appears for or represents the seafarer, or his/her heirsfor services rendered.

Sec. 5. Penalties. —Any person who violates Section 3of this Act shall be punished by a fine of not less than fiftythousand pesos (P50,000.00) but not more than one hundredthousand pesos (P100,000.00), or by imprisonment of one (1)year but not more than two (2) years, or both fine andimprisonment. The same penalties shall be imposed upon anyperson who shall be in collusion in the commission of theprohibited act in Section 3 hereof.

Sec. 6. Implementing Rules and Regulations. —Within ninety (90) days from the approval of this Act, theSecretary of Labor and Emplo5nnent, in coordination with theMaritime Industry Authority (MARINA) and the POEA. shallpromulgate the necessary rules and regulations for the effectiveimplementation of the provisions of this Act.

Sec. 7. Repealing Clause. —All laws, orders, issuances,decrees, rules and regulations inconsistent with the provisionsof this Act are hereby repealed or modified accordingly.

Sec. 8. Effectivity Clause. — This Act shall tahe effectfifteen (15) days after its publication in the Official Gazetteor in at least two (2) newspapers of general circulation.

The Philippines will host the 3^^ Regional Forum on Sustainable AgriculturalMechanization in Asia and the Pacific (RFSAM-AP), and the Association ofSoutheast Asian Nations (ASEAN) Conference on Agricultural and BiosystemsEngineering (ACABE) (hereinafter "Conferences") on 09-11 December 2015 at CenturyPark Hotel, Manila. The Conferences will also include the 11*^ Session of the TechnicalCommittee of the United Nations for Economic and Social Commission for Asia and thePacific-Center for Sustainable Agricultural Mechanization (UNESCAP-CSAM), and the11^*^ Engineering Research and Development for Technology.

The Conferences are organized by the UNESCAP-CSAM, ASEAN Agriculturaland Biosystems Engineering Coordinating Committee, Board of AgriculturalEngineering of the Professional Regulation Commission, and Department of Scienceand Technology, among others.

With the theme, "Human Resource Development for Sustainable AgriculturalMechanization,"the RFSAM-AP and ACABE aim to support the implementation of theAgricultural and Fisheries Mechanization Law, Philippine Agricultural EngineeringCompetitiveness Road Map 2013-2020, and the ASEAN Agricultural and BiosystemsEngineering Cooperation Framework.

Ail heads of government departments, bureaus and offices, including GOCCs,LGUs, and SUCs, are hereby enjoined to extend full support and allow their agricuituraiengineers and concerned officials to participate In the Conferences, subject to theavailability of funds of their respective agencies/offices, and to the applicableaccounting and auditing rules and regulations.

Officials concerned shall adopt such measures as may be necessary to ensurethat there is no disruption of normal office activities/services in their respective officesby reasgn thereof.

This Circular shall take effect immediately. 13 November 2015

PROCLAIVIATION NO. 1160

DECLARING NOVEMBER 25 OF EVERY YEAR AS THE"NATIONAL DAY FOR YOUTH IN CLIMATE ACTION"

WHEREAS, Section 13. Article II of the 1987 Constitution declares that theState recognizes the vital role of the youth in nation-building and shall promote andprotect their physical, moral, spiritual, intellectual, and social v\/ell-being, and shallinculcate in the youth, patriotism and nationalism and encourage their involvement inpublic and civic affairs;

WHEREAS, Section 16, Article II of the 1987 Constitution provides that the Stateshall protect and advance the right ofthe people to a balanced and healthful ecology inaccord with the rhythm and harmony of nature;

WHEREAS, pursuant to Republic Act (RA) No. 8044 or the "Youth in Nation-Building Act of 1995," the National Youth Commission (NYC) was created to provideleadership in the formulation of policies and in setting the direction of all youthpromotion and development programs and activities, to encourage wide and activeparticipation of the youth in all governmental and non-governmental projects andactivities affecting them, and to harness and develop the full potential of the youth aspartners in nation-building;

WHEREAS, RA 9729 or the "Climate Change Act of 2009," mainstreamedclimate risk reduction into government policy formulations, established the frameworkstrategy and program to manage climate change, and created the Climate ChangeCommission (CCC) to serve as the sole policy-making body that shall coordinate,monitor and evaluate the programs and action plans of the government relating toclimate change;

WHEREAS, according to the 2014 World Risk Report published by the UnitedNations University Institute of Environment and Human Security, the Philippines rankedsecond (2"^) among countries in the world with the highest degree of risk andvulnerability in times of natural disasters;

WHEREAS, in consultation with various international organizations dedicated toclimate change management, the CCC formulated the National Climate Change ActionPlan, which outlines the country's climate change adaptation and mitigation agenda forthe years 2011 to 2028;

WHEREAS, the NYC formulated the Philippine Youth Development Plan 2012-2016, which seeks to strengthen disaster risk reduction and management and climatechange initiative especially in the area of humanitarian response for the youth in timesof calamities: and

WHEREAS, the NYC and the CCC, in cooperation with other governmentagencies, non-governmental organizations, and international partners, have launchedthe #NowPH (Not on our Watch) campaign, a comprehensive advocacy on climateaction, which aims to empower the youth in raising public consciousness on the scienceofclimate change and on ways to lead a climate-resilient and climate-smart lifestyle.

NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Republic ofthe Philippines, by virtue of the powers vested in me by law, do hereby declareNovember 25 of every year as the "National Day for Youth In Climate Action."

The NYC, in coordination with the CCC and other concerned agencies, shalldetermine the theme and identify the programs, projects, and activities for the yearlyobservance and celebration of the National Day for Youth in Climate Action.

All other agencies and instrumentalities of the National Government, includinggovernment-owned or -controlled corporations, are hereby directed and all localgovernment units, as well as the private sector, are hereby encouraged to collaborateand cooperate with the NYC in advocating and implementing programs and activitiespursuant to this Proclamation.
