SUMMARY: On November 30, 2015, the Department of Labor (DOL) will submit the Mine Safety and Health Administration (MSHA) sponsored information collection request (ICR) revision titled, ‘‘Respirable Coal Mine Dust Sampling,’’ to the Office of Management and Budget (OMB) for review and approval for use in accordance with the Paperwork Reduction Act (PRA) of 1995 (44 U.S.C. 3501 et seq.). SUPPLEMENTARY INFORMATION: This ICR seeks approval under the PRA for revisions to the Respirable Coal Mine Dust Sampling. This information collection has been classified as a revision, because it increases burden based on provisions transferred to this collection from the request approved under ICR Reference Number, 201210– 1219–002. Federal Mine Safety and Health Act of 1977 section 103(h) authorizes this information collection. See 30 U.S.C. 813(h).

This information collection is subject to the PRA. A Federal agency generally cannot conduct or sponsor a collection of information, and the public is generally not required to respond to an information collection, unless it is approved by the OMB under the PRA and displays a currently valid OMB Control Number. In addition, notwithstanding any other provisions of law, no person shall generally be subject to penalty for failing to comply with a collection of information that does not display a valid Control Number. See 5 CFR 1320.5(a) and 1320.6. The DOL obtains OMB approval for this information collection under Control Number 1219–0011. The DOL notes that existing information collection requirements submitted to the OMB receive a month-to-month extension while they undergo review. New requirements would only take effect upon OMB approval. SUPPLEMENTARY INFORMATION: This ICR seeks to extend PRA authority for the 1,2-Dibromo-3-Chloropropane (DBCP) Standard information collection requirements codified in regulations 29 CFR 1910–1044. The Standard mandates an Occupational Safety and Health Act (OSH Act) covered employer subject to the Standard to train workers about the hazards of DBCP, to monitor worker exposure, to provide medical surveillance, and to maintain accurate records of worker exposure to DBCP. Employers, workers, physicians, and the Government use these records to ensure workers are not harmed by exposure to DBCP in the workplace. OSH Act sections 2(b)(9), 6, and 8(c) authorize this information collection. See 29 U.S.C. 651(b)(9), 655, and 657(c).

This information collection is subject to the PRA.
