    AFFIDAVIT OF GORDON THOMAS PRATT

    GORDON THOMAS PRATT, being first duly sworn on oath, deposes and states asfollows.

    1.1 married Carol Jean Niemann, now known as Carol J. Spizzirri on February 24, 1968.1filed a petition for divorce in Milwaukee County Circuit Court, Family Court Branch,Milwaukee, Wisconsin on October 13,1980. A divorce was granted on November 5,1981 by Judge Patricia S. Curley, Case No. 533969.

    2. On or about September 5, 1979, my then wife, then known as Carol J. Pratt, was citedfor shoplifting at Fore More Food Stores, 10130 W. Appleton Avenue, Milwaukee, WI.

    2a. Attached hereto as Exhibit A is a true and correct copy of a September 15, 1979 letterto my then wife from her attorney and an accompanying September 12,1979 receipt for$100.00 paid to the Milwaukee County Clerk of Courts for the shoplifting criminalmisdemeanor fine.

    3. On May 9,1981, my then wife, then known as Carol J. Pratt, was arrested forshoplifting at the Boston Store, 7700 West Brown Deer Road, Milwaukee, WI, and wassubsequently indicted by Milwaukee County Circuit Court, Criminal Division, Case No.2-268035. On September 23,1981, my then-wife waived her right to a jury trial and pledguilty to all charges.

    3a. Attached hereto as Exhibit B are true and correct copies of all available documentspertaining to the case as maintained and certified August 21,2007 by the MilwaukeeCounty Clerk of Courts.

    in this criminal action, wish to enter a plea of guilty. I declare that:

    1. I am d-Z. years old.

    2. I have completed the _ grade in school .

    3. I have never been committed to a mental institution as mentally ill or incompetent.

    4. I am now in possess ion of all my faculties; I am not -currently using drags or alcohol to

    such an extent that it would interfere with my understanding of the court proceedings.

    5. 1 understand that by pleadi ng guil ty, 1 will be giving up the following constitutional rights:

    (a) I will be giving up my right to remain silent;

    (b) I will be giving up my right to cross-examine or ask questions ofthe State's witnesses;

    (c ) I will be giving up my right to call witnesses and make them come to court and testify

    for me;

    fd) Iwill be giving up my right to have my case decided by 12 people sitting as a jury; I

    understand that all 12 of those people would have to agree in order to reach a verdict;

    and

    (e ) i will be giving up my right to make th e State prove me guilty by evidence beyond a

    reasonable doubt.

    6. I wish to give up these constitutional rights and plead guilty.

    (a ) No one has made any threats against me to get me to give up these rights and plead

    guilty.

    (b) No one has made any promises to me, outside of any plea bargain in this case, to get

    me to give up these rights and plead guilty.

    7. I understand that th e Judge is not bound to follow-any plea bargain or any recommendation

    made by the district attorney; I understand that th e Judge i s free to sentence me to the maximum

    possible penalties in th is case .
