Proposal for Kansas City Missouri School District for 2009-10

Instructional Services Scope of Project: EPGY Stanford University Mathematics Program on a district-wide basis within the Kansas City Missouri School District (KCMSD) to students in elementary and middle schools. We anticipate that approximately 10,000 students will be served. Provide professional development and training for the teachers at the schools in the use of the EPGY Stanford University Mathematics Program in both computer laboratory implementations, as part of extended day programs, and as self-study programs used by students outside of the extended school day. Provide continuing support of the program implementation, including professional development for teachers, technical support and software configuration, and weekly accountability reports illustrating program use at schools and identifying specific ways in which schools can improve the effectiveness of their implementations. Services to be Provided: Instructional Support for Students Using the EPGY Stanford Mathematics Program. Annual student use licenses for ten thousand students in classes using the EPGY Stanford Mathematics Program. EPGY will provide at no cost for 2009-10 the additional annual use licenses as needed to facilitate whole-class, whole-school, and whole-district implementation. Additionally, for 2009-10 EPGY will make available for use by KCMSD its English Language Arts and Writing Course. This will also be done at no cost. Local Professional Development and Support. EPGY will provide three full-time Stanford University employees who will be located in Kansas City during the 2009-10 school year and who will be responsible for training teachers at schools and for ensuring that the courses are properly implemented and supported. These employees will spend work days at the school sites, visiting each school approximately once per week. Remote Professional Development and Support. In addition to the staff on the ground in Kansas, EPGY will provide one dedicated FTE at Stanford University who will be responsible for providing remote professional development, administrative assistance, and technical support to Kansas City School personnel. Weekly Usage Reports, Quarterly Accountability Reports and End of Year Summary Report. EPGY will produce on a quarterly basis accountability reports and end of year summary reports. Summer Educator Workshops. During Summer 2009 and Summer 2010, EPGY will work with the District Mathematics Specialists and the Curriculum and Professional Development Office to provide credit-bearing professional development courses for KCMSD teachers aimed at deepening their ability to use the Stanford Math in their classroom teaching. These courses will also be offered via online methods during the academic year. Support to be Provided to EPGY by Kansas City Missouri School District KCMSD will provide the support of district-level mathematics specialists for the implementation of the EPGY Stanford Mathematics Program. 3. Student licenses cover one named student running the course for one year. In the event that a student leaves the district during the year, the student may be replaced without using a new license. 4. The additional annual use licenses over and above the 10,000 are provided on the condition that the KCMSD serves as an EPGY Reference District. This will require that KCMSD agrees to provide EPGY with the following services:

• Allow EPGY to conduct up to twenty site visits per year to demonstrate the software in use to prospective schools and districts;

• Provide letters of reference and support and be willing to take phone calls from prospective schools and districts interested in implementing EPGY;

• Allow EPGY to take photographs and other recordings of student use of the software in the schools, subject to review and approval of said photographs by KCMSD; and

• Provide active support of EPGY in making presentations or giving demonstrations at conferences and other events that members of KCMSD routinely attend, such as the annual Great City Schools conference

Exhibit II for Service Agreement between

Stanford University EPGY and the Kansas City Missouri School District

1. Definitions and Terms

1.1 “COURSES” will refer to the STANFORD EPGY web-based mathematics courses from Kindergarten level through Beginning Algebra and the STANFORD EPGY web-based Elementary Language Arts and Writing.

1.2 “SOFTWARE” will refer to the software that is used with the COURSES.

1.3 “SCHOOLS” will refer to the schools in KCMSD in which COURSES are being offered.

1.4 “STUDENTS” will refer to students enrolled in SCHOOLS.

1.5 “INSTRUCTIONAL MATERIALS” will refer to the course materials produced by STANFORD EPGY and which STANFORD EPGY uses in conjunction with SOFTWARE to offer the COURSES.

1.6 “INSTRUCTIONAL SERVICES” will refer to the use of COURSES, SOFTWARE, and INSTRUCTIONAL MATERIALS by STUDENTS.

1.7 “INSTRUCTIONAL SUPPORT” will refer to support provided by STANFORD EPGY to employees of KCMSD, to facilitate their use of COURSES, SOFTWARE, and INSTRUCTIONAL MATERIALS with STUDENTS. This includes professional development delivered to employees of KCMSD, as well as accountability reports, year end summary reports, and analyses of the performance of the STUDENTS and the effectiveness of the implementation of COURSES and SOFTWARE in KCMSD.

1.8 A “STUDENT USE LICENSE” will refer to a license allowing one STUDENT to receive INSTRUCTIONAL SERVICES.

2. Terms of Instructional Services and Support 2.1 STANFORD EPGY will establish procedures whereby KCMSD can assign STUDENT USE LICENSES

to STUDENTS, and register STUDENTS in COURSES.

2.2 STANFORD EPGY will provide KCMSD with STUDENT USE LICENSES and the accompanying INSTRUCTIONAL SERVICES and INSTRUCTIONAL SUPPORT together with accompanying COURSES, SOFTWARE, and INSTRUCTIONAL MATERIALS.

2.3 STANFORD EPGY will provide KCMSD with INSTRUCTIONAL SUPPORT as per the Scope of Services detailed in Exhibit I.

2.4 STANFORD EPGY will have full responsibility for hosting the SOFTWARE for COURSES and will host the SOFTWARE on its own servers or on third-party servers that it determines to be suitable for this purpose.

2.5 Each STUDENT enrolled in a course requires a unique STUDENT USE LICENSE and once assigned to a STUDENT, that STUDENT USE LICENSE remains assigned for the remainder of the academic year, or until the STUDENT is no longer enrolled in a KCMSD school, which ever comes first.

2.6 KCMSD agrees:

2.6.1. To provide adequate facilities for running the courses, including following STANFORD EPGY’s certification procedure for web-based courses;

2.6.2. To do such things as are reasonably necessary for the protection and maintenance of SOFTWARE and INSTRUCTIONAL MATERIALS in connection with its use of them;

2.6.3. To enroll in COURSES only students enrolled in SCHOOLS, and to remove them from

2.6.4. Provide the support of district-level mathematics specialists for the implementation of the EPGY Stanford Mathematics Program and to work closely with EPGY Stanford technical personnel on matters of network monitoring and course performance optimization.

2.6.5. To serve as an EPGY Reference School District. This will require that KCMSD agrees to provide EPGY with the following services:

2.6.6. To return all SOFTWARE and INSTRUCTIONAL MATERIALS to STANFORD EPGY upon termination of this Agreement.

2.7 SOFTWARE and MATERIALS remain the property of STANFORD EPGY at all times.

3. Restriction on Promotional Advertising and Publicity KCMSD agrees not to identify Stanford University or STANFORD EPGY in any promotional advertising or other promotional materials to be disseminated to the public or any portion thereof or to use the name of any non-consenting Stanford University faculty member, employee or student, or any trademark, service mark, trade name, or symbol of Stanford University or the Stanford Health Services, or that is associated with either of them, without prior written consent from STANFORD EPGY. Such advertising is to be submitted to STANFORD EPGY at least 10 days prior to the date of its intended use for review by STANFORD EPGY and is only to be used by KCMSD after KCMSD has received written approval concerning the suitability of the proposed use. This is to be done on a case-by-case basis.

4. Termination

This Agreement may be terminated immediately by STANFORD EPGY upon written notice to KCMSD in the event that KCMSD is in violation of Section 3.

Exhibit III for Service Agreement between

Stanford University EPGY and the Kansas City Missouri School District

5.5 The District understands that if the Agreement is terminated under Articles 3.2 or 3.3 hereunder, the District

shall compensate the University for any Remaining Fees due on any licenses provided through the date of termination.

10.3 The sub contractor is aware of its obligations and agrees to comply with the intent of the employment eligibility

provisions hereunder. 12.7 Research Information. The District understands that the University intends to conduct research by means of

data collection for external publication. To that end, The University covenants and agrees that it shall duly anonymize any student performance information obtained under the Agreement; i.e., all said data will be presented in aggregate form and no individual indentifying information received from or crated for the District and/or students will be included in said data in any report generated hereunder. The University covenants and agrees that it will hold all data to the confidentiality standard as set out in Article 11 of this Agreement and as a further step covenants and agrees that the data will be stored in a secure location with access by only those who require direct knowledge of such. Any compilation of data hereunder shall be provided to the District.
