THE CLIENT AND THE INSPECTOR ACKNOWLEDGE AND AGREE AS FOLLOWS:Article 1 - Inspection1.1 The Client hereby requests that the Inspector perform an inspection of the Subject Property and provide a writtenreport no later than seven days from the date of the inspection. The Inspection and inspection report is subject to thefollowing limitations and conditions, each of which are acknowledged, understood and accepted by the Client.(a) The inspection shall be performed in accordance with the Standards of Practice of the Canadian Association of Home& Property Inspectors (Alberta), a copy of which is available upon request or at www.cahpi-ab.ca.(b) The Inspection Report is non-invasive and constitutes an opinion of the Present Condition of the property based on avisual inspection of the readily accessible and visible major systems and components of the Primary Residence on theProperty. Non-visible items such as buried pipes, well & septic systems or other underground systems or componentscannot be evaluated.(c) The inspection and Inspection Report do not constitute a guarantee, warranty or an insurance policy.(d) The Client is encouraged to participate in the visual inspection process and accepts responsibility for theconsequences of electing not to do so.(e) The condition of certain systems, components and equipment will be randomly sampled by the Inspector. Examplesinclude window/door operation, hardware and screens, electrical receptacles, switches and lights, cabinet, countertopmounts and functions, insulation depth, mortar, masonry, paint and caulking integrity and roof covering materials.(f) Weather conditions may limit the extent of the inspection process; the Client hereby releases and waives any claim itmay have against the Inspector for omissions or inaccuracies in the Inspection Report arising as a result of weatherconditions existing at the time of inspection.(g) If any utilities or their supply to any equipment are not on at the time of the inspection, such as water, electricity andgas, we cannot turn them on. We will also be unable to fully assess all systems since utilities may affect more than onesystem within the home.(h) The Inspection Report is for the confidential use of the Client only and will not be disclosed to third parties such asother real estate agents, sellers, or lenders without the express written consent of the Client. The Client shall protect andindemnify the Inspector from and against any claim against the Inspector by any such third party arising from disclosureof the Inspection Report thereto. The Client authorizes Inspector to disclose the Inspection Report to his/her Realtor.(i) The Client and the Inspector hereby agree that all disputes arising in relation to the inspection and Inspection Reportshall be referred to and resolved by binding arbitration pursuant to the applicable legislation governing commercialarbitrations. This does not prevent the client from taking any court actions arising out of unfair trade practices under theFair Trading Act or its regulations.(j) In the event that the Client claims damages against the Inspector and does not prove those damages, the Client shallpay all legal fees, arbitrators fees, legal expenses and costs incurred by the Inspector in defence of the claim. You agreeto indemnify and save the Company and inspector, as well as the Company's officers, employees, subcontractors andagents, or their successors and assigns, harmless from any claim arising out of the use of the Report by any otherperson or persons. You hereby agree to indemnify and hold harmless the Company and the inspector, as well as theCompany's officers, employees, subcontractors and agents, and their successors and assigns, from any claim advanced

by the owner or tenant of the Property arising out of the Inspection. Should the Company or the inspector be called on togive testimony, prepare to attend court, or assist in preparation for litigation as a result of the Inspection, additional feeswill be charged at the Company's then hourly rate for all time spent, including additional inspections, research, reportpreparation, consultation, traveling, court appearances and for time waiting (in our office or elsewhere) to testify. In theevent you commence legal proceedings against the Company in respect of anything arising in respect of the Inspectionor the Report, and if those proceedings are not ultimately decided in your favor, you agree that you shall be liable to theCompany for damages, including to the Company's reputation, and for all charges, expenses, disbursements and legalfees incurred by the Company or any of its representatives, on a complete indemnity basis, including a reasonable fee forall time spent by the Company's personnel in investigating, research, preparation for, and attendance at court hearingsand examinations(k) The Inspector shall not be liable to the Client for the cost of any repairs to or replacement of any system, component,or equipment undertaken by the Client without prior consultation with the Inspector.(l) The Inspection does not include an exhaustive or invasive inspection for pests, pollutants, toxic materials zoning,building code compliance, environmental hazards, mould and/or asbestos.
