(Gazetted16thSeptember,2020).

1. Citation. TheseRegulationsmaybecitedasthe

PUBLICHEALTH(COVID-19)REGULATIONS,2020.

2. Definitions.—(1)IntheseRegulations–

“coronavirus” means severe acute respiratory syndrome coronavirus 2(SARS-CoV-2);

“COVID-19” means the Novel Coronavirus (2019-nCov), which is aninfectiousdiseasecausedbyaviruswhich,havingemergedduring2019,wasdeclaredaglobalpandemicbytheWorldHealthOrganisationonthe11thMarch,2020;

“environmental health officer” means an environmental health officeremployedorcontractedbytheGovernmentanddesignatedtodischargefunctionsundertheseRegulationsbyChiefMedicalOfficer;

“event or gathering” means a wedding, a funeral, any other service ofa religious institution, a social activityor anyother activity inwhichpeoplewhoarenotofthesamehouseholdarepresent;

“healthcareprofessional”means–

(a) aregisteredhealthpractitioner;

(b) aregisterednurse;or

(c) suchotherregisteredhealthcareprofessionalasmaybedesignatedbyOrderbytheMinister;

“hiringcar”hasthemeaningassignedundertheRoadTrafficAct,Chapter289A;

“motor omnibus” has the meaning assigned under the Road TrafficAct,Chapter289A;

“publichealthofficer”meansa registeredhealthpractitioneror registerednurse,employedorcontractedbytheGovernment;

“taxi”hasthemeaningassignedundertheRoadTrafficAct,Chapter289A.

(2)ForthepurposesoftheseRegulations,apersonis“potentiallyinfectious”atanytimeifthepersonis,ormaybe,infectedorcontaminatedwithcoronavirus,andthereisariskthatthepersonmightinfectorcontaminateotherswithcoronavirus.

3. Application. These Regulations shall not apply in the individual case of amedicalemergency.

4. Requirement to wear masks in public.—(1)Nopersonshall,withoutreasonableexcuse,beinapublicspacewithoutwearingafacemask,faceshieldorface-coveringinamannerwhichcovershisorhermouth,noseandchin.

(2)Where the person under this regulation is a child accompanied by anindividualwhohasresponsibilityforthechild,theindividualshallprovideandensurethatthechildhasandwearsthefacemask,faceshieldorfacecoveringasrequiredbythisregulation.

(3)Theowner or operator of anybusiness, establishment or officewhichprovidesgoodsorservicestothepublicshallensurethatamemberofthepublicisnotpermittedentry to,orotherwise remainswithin,anyenclosedspacewithin thepremisesofthebusiness,establishmentorofficeunless,thememberofthepubliciswearingafacemask,faceshieldorfacecovering,inamannerwhichcovershisorhermouth,noseandchin.

(4)Subregulations(1)to(3)shallnotapplyto–

(a) childrenunderfiveyearsofage;

(b) employeesandagentsofthepersonresponsibleforthebusiness,establishmentorofficewithinanareadesignatedforthemandnotforpublicaccess,orwithinorbehindaphysicalbarrier;subjecttosuchguidelinesmadebytheMinistryofHealth;and

(c) those circumstances provided for in guidelines made by theMinistryofHealth.

(5) For the purposes of subregulation (1), the circumstances in which apersonhasareasonableexcuseincludethosewhere–

(a) thepersoncannotputon,wearorremoveafacemask,faceshieldorfacecovering–

(i) because of any medical, physical or mental illness orimpairment, or disability which inhibits their ability towearafacemask,faceshieldorfacecovering;or

(ii) withoutseveredistress;

(b) theperson is travellingwith,orprovidingassistance to,anotherpersonandsuchotherpersonreliesonlip-readingtocommunicatewiththefirstperson;

(c) the person removes his or her face mask, face shield or facecoveringtoavoidharmorinjury,ortheriskofharmorinjury,tohimselforothers;

(d) thepersonistravellingtoavoidinjury,ortoescapeariskofharm,anddoesnothaveafacemask,faceshieldorfacecoveringwithhim;

(e) if it is reasonably necessary for the person to eat or drink, thepersonremoveshisorherfacemask,faceshieldorfacecoveringtoeatordrink;

(f) thepersonhastoremovehisorherfacemask,faceshieldorfacecoveringtotakemedication;

(g) arequestismadeofthatpersontoremovehisorherfacemask,faceshieldorfacecoveringtemporarilyforsecurityandidentificationpurposesifnecessaryforthepurposeofreceivingservices;or

(h) thecircumstancesprovidedforinguidelinesissuedbytheMinistryofHealth.

(6) Subject to the exemptions in subregulation (4) (b), an employee shallwearafacemask,faceshieldorfacecoveringwhenworkinginanenclosedpublicspace.

(7)Subregulation(1)doesnotapplytoapersononabeachorpublicpark,ifheorshemaintainsphysicaldistancingofnolessthansixfeet(6ft.)fromanypersonoutsideofhisorherhousehold.

5. Physical distancing and sanitation protocols for businesses.—(1) Everybusiness,establishmentorofficeshall–

(a) ensure thatallcustomersandstaffmaintainphysicaldistancingofnoless than six feet (6ft.) in or outside their business, establishment oroffice;

(b) determinethenumberofpersonsthatmaybepermittedinthebusiness,establishment or office at any one time by permitting one person foreverythirtysquarefeet(30sqft)ofstorespace;

(c) placeprominentdistancemarkerssixfeet(6ft.)apart,indicatingwhereeachcustomermuststandonalineatacheckoutpoint;and

(d) placedistancemarkerssixfeet(6ft.)apartontheoutsideofthebusiness,establishment or office, indicatingwhere customersmust standwhilewaitingtoenterthebusiness,establishmentoroffice.

(2) Every business, establishment or office, including operators of motoromnibuses,hiringcarsandtaxis,shalladministerorensuresanitisationofthehandsofeverypersonuponentryintotheestablishmentorbusiness.

(3) Employees of a hospital or health care, medical, residential careestablishmentorfacilityandmembersoftheRoyalGrenadaPoliceForceshalltakereasonablestepstocomplywiththerequirementsundersubregulations(1)and(2),unlessitisreasonablyimpracticable.

6. Business and institutional operations.—(1)All businesses, establishmentsandofficesmaycommence,continueorresumetheirbusinessoperations,exceptthebusinesses, establishments and offices asmay be prescribed from time to time byOrderbytheMinister.

(2) Notwithstanding subregulation (1), every business, establishment orofficeshalloperateinaccordancewith

(a) regulation5andeveryprotocolestablishedbytheCabinetortheMinisterinrespectoftheindustryofthebusiness,establishmentoroffice;and

(b) anyconditionimposeduponthebusiness,establishmentorofficepursuanttoregulationsmadepursuanttotheEmergencyPowersAct,Chapter88inresponsetotheCOVID-19pandemic–

(i) whetherornotasaconditiontoanexemptiontooperate;and

(ii) whether imposed individually or upon a category ofbusinesses, establishments or offices, until the conditionhasbeendischargedinwriting.

(3)EducationalinstitutionsmayonlyoperateasauthorisedbytheMinisterwhichmayincludeoperationsremotelybyutilisingvirtualmeans.

(4)For theavoidanceofdoubt,anybusiness,establishmentorofficemaycommence,continueorresumetheirbusinessoperationsremotelybyutilisingvirtualmeans.

7. Restriction on events or gatherings.—(1)Nopersonshallhostorattend–

(a) any event or gathering of any description hosting more than twentypersons;

(b) a funeral hosting more than seventy-five persons in addition to theofficiantandessentialmortuarystaff;or

(c) a wedding hostingmore than seventy-five persons in addition to theofficiant,thebrideandthegroom.

(2)TheMinistermay,inconsultationwiththeChiefMedicalOfficer,forthepurposeof–

(a) preventing,protectingagainst,delayingorotherwisecontrollingtheincidenceortransmissionofcoronavirus;or

(b) facilitating the most appropriate deployment of medical oremergencypersonnelandresources,

byOrderpublishedintheGazetteprohibit,orimposerequirementsorrestrictionsinrelationto,theholdingofaneventorgathering.

(3)AnOrderundersubregulation(2)maybemadeinrespectof–

(a) aspecifiedeventorgathering;or

(b) eventsorgatheringsofaspecifieddescription.

(4)AnOrderundersubregulation(2)mayonlyhavetheeffectofimposingprohibitions,requirementsorrestrictionson–

(a) the owner or occupier of premises for an event or gathering towhichtheOrderrelates;

(b) theorganiserorpromoterofsuchaneventorgathering.

(5) An Order under subregulation (2) may, among other things, imposerequirements about informingpersonswhomaybe planning to attend an event orgatheringofitsprohibitionoranyrequirementsorrestrictionsimposedinrelationtotheholdingofit.

(6) An Order under subregulation (2) may grant exemption from theapplicationofspecifiedprovisionsoftheseRegulations,iftheMinisterinconsultationwiththeChiefMedicalOfficerissatisfiedthattheriskismitigated.

(7) For the purposes of subregulation (3), events or gatherings may bedescribed–

(a) byreferencetoanumberofpeopleattendingtheeventorgathering;

(b) byreferencetoarequirementformedicaloremergencyservicestoattendtheeventorgathering;or

(c) inanyotherway.

(8)TheMinistermay vary or revoke to any extent anOrdermade undersubregulation(1)inthesamemannerastheOrderwasmade.

8. Power to close premises or impose restrictions on persons entering or remaining on them.—(1)TheMinistermay,inconsultationwiththeChiefMedicalOfficer,forthepurposeof–

(a) preventing, protecting against, delaying or otherwise controlling theincidenceortransmissionofcoronavirusorCOVID-19;or

(b) facilitatingthemostappropriatedeploymentofmedicaloremergencypersonnelandresources,

byOrderpublishedintheGazette,imposeprohibitions,requirementsorrestrictionsinrelationtotheentryinto,departurefrom,orlocationofpersonsin,premises.

(2)AnOrderundersubregulation(1)maybemadeinrespectof–

(a) specifiedpremises;or

(b) premisesofaspecifieddescription.

(3)AnOrderundersubregulation(1)mayonlyhavetheeffectofimposingprohibitions,requirementsorrestrictionson–

(a) theowneroroccupierofpremisestowhichthedirectionrelates;

(b) any other person involved inmanaging entry into, or departurefrom,suchpremisesorthelocationofpersonsonthem.

(4) An Order under subregulation (1) may, among other things, imposerequirementsforthepurposeof–

(a) closingthepremises;

(b) restrictingentryintothepremises;and

(c) securingrestrictionsinrelationtothelocationofpersonsonthepremises.

(5)AnOrderundersubregulation(1)mayimposeprohibitions,requirementsorrestrictionsbyreferenceto–

(a) thenumberofpersonsonthepremises;

(b) thesizeofthepremises;

(c) thepurposeforwhichapersonisonthepremises;

(d) thefacilitiesinthepremises;

(e) aperiodoftime.

(6)WheretheOrderimposesprohibitions,requirementsorrestrictionsonapersonspecifiedbyname,theOrdershallbeservedonthatpersonnotlessthantwocalendardaysbeforepublicationintheGazette.

(7)TheMinistermay vary or revoke to any extent anOrdermade undersubregulation(1)inthesamemannerastheOrderwasmade.

9. Power to impose restrictions on travel in motor vehicles.—(1)TheMinistermay,inconsultationwiththeChiefMedicalOfficer,forthepurposeof–

(a) preventing, protecting against, delaying or otherwise controlling theincidenceortransmissionofcoronavirusorCOVID-19;or

(b) facilitatingthemostappropriatedeploymentofmedicaloremergencypersonnelandresources,

byOrderpublishedintheGazette,imposeprohibitions,requirementsorrestrictionsinrelationtotravelinmotorvehiclesandtheoperationofmotoromnibuses,hiringcarsandtaxis.

(2)TheMinistermay vary or revoke to any extent anOrdermade undersubregulation(1)inthesamemannerastheOrderwasmade.

10. Powers of public health officers and environmental health officers for screening and assessment, and of healthcare professionals.—(1)Whereapublichealthofficerorenvironmentalhealthofficerhasreasonablegroundstosuspectthataperson ispotentially infectious, thepublichealthofficeror environmentalhealthofficermay,subjecttosubregulation(2)–

(a) directthepersontogoimmediatelytoaplacespecifiedinthedirectionwhichissuitableforscreeningandassessment;or

(b) wherethepersonfailstocomplywithadirectionunderparagraph(a),request a police officer to remove the person to a place suitable forscreeningandassessment.

(2)Where a public health officer or environmental health officer exercises thepowersconferredbythisregulation,thepublichealthofficerorenvironmentalhealthofficershallinformthatperson–

(a) ofthereasonfordirectingorremovinghimorher;and

(b) thatitisanoffence–

(i) in a case where a person is directed, to fail withoutreasonableexcusetocomplywiththedirection;or

(ii) inacasewhereapersonisremovedbyapoliceofficer,toabscond.

(3)Adirectionimposedonapersonunderthisregulationmaybeenforcedbyapoliceofficertoremovethepersontoaplacesuitableforscreeningandassessment.

(4)Whereahealthcareprofessional,otherthanapublichealthofficer,hasreasonablegrounds tosuspect thataperson ispotentially infectious, thehealthcareprofessionalshallimmediately–

(a) informthepersonofthatfact;and

(b) makeareporttotheChiefMedicalOfficer.

11. Powers of public health officers and environmental health officers at screening and assessment places .—(1) Where–

(a) apersonisataplacesuitableforscreeningandassessment;and

(b) a public health officer or environmental health officer has reasonablegroundstosuspectthatthepersonispotentiallyinfectious,

thepublichealthofficeror environmentalhealthofficermay require theperson toremainattheplaceforscreeningandassessmentpurposesforaperiodnotexceeding72hours.

(2)Where a public health officer or environmental health officer requiresa person to remain at a place under this regulation, the public health officer orenvironmentalhealthofficershallinformthatperson–

(a) ofthereasonforimposingtherequirement;

(b) of the maximum period the personmay be required to remainthere;and

(c) thatitisanoffencetofailtocomplywiththerequirement.

(3)Arequirementimposedonapersonunderthisregulationmaybeenforcedbyapoliceofficertokeepthepersonattheplace.

(4)Apublichealthofficerorenvironmentalhealthofficermay–

(a) requirethepersontobescreenedandassessed;and

(b) imposeotherrequirementsonthepersoninconnectionwithhisorherscreeningandassessment.

(5) Requirements under subregulation (4) (a) may in particular includerequirementsonaperson–

(a) atsuchtimesasthepublichealthofficerorenvironmentalhealthofficermay specify to allowahealthcareprofessional to take abiologicalsamplebyappropriatemeans;and

(b) to answer questions and provide information about his or herhealthorotherrelevantmatters,includinghisorhertravelhistoryandotherindividualswithwhomheorshemayhavehadphysicalcontact.

(6)Requirementsundersubregulation(4)(b)mayincluderequirementsonaperson–

(a) to produce any documents which may assist in his or herassessment;

(b) toprovidedetailsbywhichheorshemaybecontactedduringsuchsubsequent period as the public health officer or environmentalhealthofficermayspecify.

(7) If a public health officer or environmental health officer considers itappropriatefor thepurposesofscreeningorassessingtheperson, thepublichealthofficerorenvironmentalhealthofficermay–

(a) direct the person to go immediately to another place which isspecifiedinthedirectionandissuitableforthosepurposes;or

(b) request a police officer to remove the person to another placesuitableforthosepurposes.

(8)Whereapublichealthofficerorenvironmentalhealthofficerexercisesthepowers conferredby this regulation, thepublichealthofficeror environmentalhealthofficershallinformthatperson–

(a) ofthereasonfordirectingorremovinghimorher;and

(b) thatitisanoffence–

(i) in a case where a person is directed, to fail withoutreasonableexcusetocomplywiththedirection;or

(ii) inacasewhereapersonisremovedbyapoliceofficer,toabscond.

(9)Wherethepowersinregulation10areexercisedinrelationtoapersoninaplacetodirecthimorhertogoto,orremovehimorherto,anotherplace,thisregulationshallapplyinrelationtothatpersonafreshinthatotherplace.

12. Powers exercisable after assessment.—(1)Thisregulationapplieswhere–

(a) apersonhasbeenscreenedandassessedbyapublichealthofficerorenvironmentalhealthofficer,underregulation11orotherwise,and–

(i) thescreeningconfirmedthatthepersonisinfectedorcontaminatedwithcoronavirus;or

(ii) thescreeningwasinconclusive;or

(b) apersonhasbeenassessedbyapublichealthofficerorenvironmentalhealthofficer,under regulation11orotherwise,and thepublichealthofficerorenvironmentalhealthofficerhasreasonablegroundstosuspectthatthepersonispotentiallyinfectious.

(2)Requirementsunderthisregulationmayincluderequirements–

(a) toprovideinformationtothepublichealthofficeroranyspecifiedperson;

(b) toprovidedetailsbywhichthepersonmaybecontactedduringaspecifiedperiod;

(c) togo for thepurposesof further screening andassessment to aspecifiedplace suitable for thosepurposesanddoanything thatmayberequiredunderregulation11(1);

(d) toremainataspecifiedplace,whichmaybeaplacesuitableforscreeningandassessment,foraspecifiedperiod;

(e) toremainataspecifiedplaceinisolationfromothersforaspecifiedperiod;

(f) to install on all mobile devices as far as possible and, for thedurationofaspecifiedperiod,tocomplywiththeinstructionsofthesurveillancemobileapplicationdesignatedbytheMinister.

(3)Restrictionsonapersonunderthisregulationmayincluderestrictions,foraspecifiedperiod,on–

(a) theperson’smovementsortravel;

(b) the person’s activities, including his or her work or businessactivities;

(c) the person’s contact with other persons or with other specifiedpersons.

(4)Whereapublichealthofficerimposesarequirementorrestrictiononapersonunderthisregulation,thepublichealthofficershallinformtheperson–

(a) ofthereasonfordoingso;and

(b) that it is an offence to fail to comply with the requirement orrestriction.

(5)Indecidingwhethertoimposearequirementreferredtoinsubregulation(2)(d)or(e)thepublichealthofficermusthaveregardtoaperson’swellbeingandpersonalcircumstances.

(6)Apublichealthofficermayvaryorrevokearequirementorrestrictionimposedonaperson,butmayonlyextendtheperiodtowhicharequirementreferredtoinsubregulation(2)(d)or(e)orarestrictionrelatesinaccordancewithregulation11.

13. Powers exercisable at a specified place for screening and assessment or isolation.—(1)Theperiodspecifiedinrelationtoanyrestrictionunderregulation11,maynotexceed14days.

(2)After the impositionof a requirement to remainor a restrictionunderregulation11,apublichealthofficershall–

(a) assessthepersonwithin72hours;and

(b) in the light of that assessment, reconsider which requirementsorrestrictionsarenecessaryandproportionatetoimposeonthatpersonunderregulation11.

(3)Thepublichealthofficermay,followingreconsiderationunderregulation(2)–

(a) revoke the requirement to remainor the restrictionor specify adifferentperiodnotexceeding14daysinrelationtoit;or

(b) substituteadifferent requirementor restrictionunder regulation11.

(4)Ifundersubregulation(3)thepublichealthofficerrevokestherequirementtoremainortherestriction,theChiefMedicalOfficermay,ifsatisfiedthatthepersonis potentially infectious, re-impose the requirement or restriction for the periodoriginallyspecified.

(5)Ifbeforetheendoftheperiodspecifiedinrelationtoarequirementtoremainorrestrictionunderregulation11(3)orsubregulation(3)(a)–

(a) apublichealthofficerreasonablysuspectsthatthepersonwillbepotentiallyinfectiousattheendofthatperiod;and

(b) the public health officer considers that the requirement orrestrictionisstillnecessaryandproportionate,

theofficermayextendtheperiodforafurtherspecifiedperiod.

(6)Exceptinthecaseofarequirementreferredtoinregulation11(2)(e),thefurtherperiodspecifiedundersubregulation(5)maynotexceed14days.

(7)Wheretheperiodtowhicharequirementtoremainorrestrictionunderregulation11relatesisextendedundersubregulation(5),apublichealthofficershallreviewtherequirementorrestrictionatleastonceineveryperiodof24hours.

(8)Ifonareviewundersubregulation(7)thepublichealthofficerconsidersthat the person is no longer potentially infectious, the officer shall revoke therequirementtoremainortherestriction.

(9)Ifonareviewundersubregulation(7–

(a) subregulation(8)doesnotapply;but

(b) thepublichealthofficerconsidersthattherequirementtoremainortherestrictionisnolongernecessaryandproportionate,

thepublichealthofficermaysubstituteadifferent requirementor restrictionunderregulation11,whichmaynotapplybeyond theendof the furtherperiodspecifiedundersubregulation(5).

14. Penalty.—(1) A person who contravenes or fails to comply with theseRegulations,oranydirectionforthepurposesoftheseRegulations,shallbeguiltyofanoffenceand,onsummaryconviction,liabletoafinenotexceedingfivehundreddollarsandtoimprisonmentforatermnotexceedingtwelvemonths.

(2)Withoutprejudicetosubregulation(1),apersonwhocommitsanoffenceisliableonserviceofafixedpenaltynoticebyapoliceofficer,ifthepersonsochooses,toafixedpenaltyofthreehundredandfiftydollars.

15. Fixed penalty notice.—(1)Whereapoliceofficerhasreasontobelievethatapersonhascommittedanoffencespecifiedunderregulation14(2),thepoliceofficermaydirectthepersontostatehisorhertruenameandplaceofresidenceandserveuponthepersonafixedpenalty.

(2)A person who refuses to comply with subregulation (1) commits anoffence.

(3)Whereapoliceofficerhasservedafixedpenaltynoticeuponaperson,thepoliceofficershall–

(a) chargethepersonwiththecommissionofanoffence;and

(b) notifythepersonthat,ifheorshedoesnotwishtobeprosecutedfor theallegedoffence incourt,heor shemaypay to theclerkoftheMagistrate’sCourtinthedistrictinwhichtheoffencewascommittedthefixedpenaltyprescribedfortheoffenceinthefixedpenaltynoticewithinthetimespecified.

(4)Apersonuponwhomafixedpenaltynoticeisservedmaydeclinetobedealtwithunderregulations15to20andwhereheorshefailstopaythefixedpenaltywithinthetimespecifiedinthefixedpenaltynotice,orwithinsuchfurthertimeasmaybeallowedinaparticularcase,hisorherconductconstitutesadeclinationtobedealtwithunderregulations15to20.

(5)Apoliceofficershallserveafixedpenaltynoticepersonallyuponapersonallegedtohavecommittedanoffencespecifiedunderregulation14(2)andshallsendaduplicateofthefixedpenaltynoticetotheMagistrate’sCourtofthedistrictinwhichtheoffenceisallegedtohavebeencommitted.

(6)Wherethefixedpenaltyisnotpaidwithinthetimespecifiedinaccordancewithregulation17(2),theduplicatesenttotheMagistrate’sCourtundersubregulation(5)shallconstituteacomplaintlaidbeforetheMagistratetoinstituteproceedingsinaccordancewiththeCriminalProcedureCode,Chapter72B.

(7)AfixedpenaltynoticeshallbesignedbythepoliceofficerandshallbeinthemannerspecifiedundertheSchedule,specifyingthefollowing–

(a) thedate,timeandplaceofserviceofthefixedpenaltynotice;

(b) the provision of theseRegulations creating the offence alleged,and such particulars of the offence as are required under theseRegulations;

(c) theamountofthefixedpenalty;

(d) thetimewithinwhichthefixedpenaltymaybepaidinaccordancewithregulation17(2);and

(e) theclerkoftheMagistrate’sCourttowhom,andtheaddressatortowhich,thefixedpenaltymaybepaidorremitted.

16. Payment of fixed penalty.—(1)PaymentofthefixedpenaltyshallbemadetotheclerkoftheMagistrate’sCourtasstatedinthefixedpenaltynotice,andshallbe

dealtwithinthesamemanneraspaymentofafineimposedforanoffenceundertheCriminalProcedureCode,Chapter72B.

(2)Paymentofthefixedpenaltyshallbeaccompaniedbythefixedpenaltynoticewhichshallbecompletedbythepersoninthemannerprescribed.

17. Payment of fixed penalty precludes prosecution.—(1)Apersonuponwhomafixedpenaltynoticeisservedmaypaythefixedpenaltyinaccordancewiththefixedpenalty notice.

(2)Thetimewithinwhichafixedpenaltyispayableisthirty-onedaysfromthedateofthefixedpenaltynotice.

(3)Where the fixed penalty is paid in accordancewith the fixed penaltynotice,nopersonshall thenbe liable tobeconvictedfor theoffenceforwhichthefixedpenaltynoticewasservedandthecomplaintlaidbeforetheMagistrateshallbenullandvoid.

18. Certificate of payment or non-payment of fixed penalty.Inanyproceedingsfor an offence specified under regulation 14 (2), a certificate that payment of thefixedpenaltywasorwasnotmadetotheclerkoftheMagistrate’sCourtbythedatespecifiedinthecertificateshall,ifthecertificatepurportstobesignedbysuchclerk,besufficientevidenceofthefactsstated,unlessthecontraryisproved.

19. Consequence of failure to pay.Whereafixedpenaltyisnotpaidwithinthetime specified in accordancewith regulation 17 (2), proceedings in respect of theoffencespecified in thefixedpenaltynoticeshall thereafterproceed in themannerprescribedbytheCriminalProcedureCode,Chapter72B.
