In exercIse of the powers conferred under sectIon 4 of the emergency powers Act, chApter 88 for the purposes of sectIon 17 of the constItutIon, the cAbInet of grenAdA mAkes the followIng regulAtIons–

(Gazetted19thOctober,2021).

1. Citation and commencement.—(1)TheseRegulationsmaybecitedasthe

EMERGENCYPOWERS(COVID-19)(NO.6)REGULATIONS,2021.

(2)TheseRegulationsshallcomeintoforceonthe19thdayofOctober,2021andexpireat11:59p.m.onthe26thdayofOctober,2021.

2. Scope and application.—(1)TheseRegulationsshallnotapplyinthecaseofamedicalemergency.

(2) Where there is any inconsistency between the provisions of theseRegulationsandthePublicHealth(COVID-19)Regulations,2020,theprovisionsoftheseRegulationsshallprevailtotheextentoftheinconsistency.

3. Definitions. IntheseRegulations–

“curfewperiod”meanstheperiodofcurfewunderregulation4(1);

“essentialworker”means–

(a) amemberoftheRoyalGrenadaPoliceForce;

(b) a worker of the National Disaster ManagementAgency, or anypersonauthorisedbytheNationalDisasterManagementAgency;

(c) anofficerofHerMajesty’sPrison;

(d) anofficeroftheCustomandExciseDivision;

(e) anofficeroftheAccountant-General’sDivision;

(f) anofficeroftheMinistryofSocialServices;

(g) anofficeroftheOfficeofthePrimeMinister;

(h) anofficeroftheMinistryofNationalSecurity;

(i) anofficeroftheMinistryofAgriculture;

(j) a worker, director or manager of waste disposal and sanitationcompanies;

(k) aworker,directorormanagerofanyhospitalorhealthcare,medical,residentialcareestablishmentorfacility;

(l) aworker,directorormanageroftheAirportsAuthorityandPortsAuthority;

(m)an officer essential to the operations of the water sector or theelectricitysector;

(n) an officer essential to the operations of the telecommunicationsectororanyothersectorencompassingtheprovisionofelectroniccommunications;

(o) anofficeressentialtotheoperationsofanyprintorelectronicmediahouse;

(p) a private caregiver for the elderly or disabled, as authorised inwritingbytheCommissionerofPolice;and

(q) a registered or bona fide fishermen or farmer, as authorised inwritingbytheCommissionerofPolice;

(r) aMemberofParliament;

(s) theAttorney-GeneralandtheDirectorofPublicProsecutions;

(t) the Registrar of the Supreme Court, the Resident Judges of theSupremeCourtandtheMagistrates;

(u) aworkerattheGovernmentPrinter;

(v) aworkerorofficerofanyotherDepartmentorMinistryorofficerorcategoryofofficersorworkersas–

(i) inthecaseofpublicofficers,directedbytheSecretarytotheCabinet;

(ii) inanyothercase,approvedinwritingbytheCommissionerofPolice,

andanyotherofficerorcategoryofofficersasdirectedbytheSecretarytotheCabinet;

“grocerystore”includesasupermarketandashopthatsellgroceries.

4. Restriction on freedom of movement.—(1) Subject to sub-regulation (2),beginningat7:00p.m.onthe20thdayOctober,2021acurfewshallbeimposeddailyfromthehoursof7:00p.m.andendingat4:00a.m. thefollowingday,andduringthisperiodeverypersonshallremainconfinedtotheirplaceofresidence(inclusiveoftheiryardspace)toavoidcontactoutsideofhisorherhousehold,exceptasprovidedintheseRegulationsorasmaybeauthorisedinwritingbytheCommissionerofPoliceinconsultationwiththeChiefMedicalOfficer.

(2)Freedomofmovementmaybeexercisedfrom4:00a.m.to6:59p.m.eachdayinaccordancewiththeseRegulations.

(3) Notwithstanding sub-regulation (1), an essential worker is permittedfreedom ofmovement during the curfew period for the purpose of undertaking aserviceessentialtotheiroperations.

(4) Notwithstanding sub-regulation (1), the Commissioner of Police inconsultationwiththeChiefMedicalOfficermaygrantwrittenpermissiontoapersonorbusinesstooperateduringthecurfewperiod.

5. Shelter in place. InanefforttopreventthespreadofCOVID-19,everypersonshall remain confined to their place of residence (inclusive of their yard space) toavoidcontactoutsideoftheirfamilyexcept–

(a) essentialworkersreportingtowork;

(b) workersreportingtoworkinaccordancewithregulation9or14;

(c) foressentialtraveltoanestablishment,businessorofficeexemptedunderregulation9(1);

(d) for outdoor exercise, whether alone or together with familymemberslivingunderthesameroof,notexceedinganhourandahalfperdaybetweenthehoursof4:00a.m.to6:00p.m.

6. Requirement to wear masks in public.—(1) No person shall, withoutreasonableexcuse,beinapublicspacewithoutwearingafacemaskinamannerthatcovershisorhermouth,noseandchin.

(2)Nopersonshall,withoutreasonableexcuse,beinamotorvehiclewithanother person outside of his or her householdwithoutwearing a facemask in amannerthatcovershisorhermouth,noseandchin.

(3)Where the person under this regulation is a child accompanied by anindividualwhohasresponsibilityforthechild,theindividualshallprovideandensurethatthechildhasandwearsthefacemaskasrequiredbythisregulation.

(4)Theowner or operator of anybusiness, establishment or officewhichprovidesgoodsorservicestothepublicshallensurethatamemberofthepublicisnotpermittedentryto,ordoesnototherwiseremainwithin,anyenclosedspacewithinthepremisesofthebusiness,establishmentoroffice,unlessthememberofthepubliciswearingafacemaskinamannerthatcovershisorhermouth,noseandchin.

(5)Sub-regulations(1)to(4)shallnotapplyto–

(a) childrenundersevenyearsofage;

(b) anemployeeoragentofthepersonresponsibleforthebusiness,establishmentorofficewithinanareadesignatedfortheemployeeoragentandnotforpublicaccess,orwithinorbehindaphysicalbarrier,ifthereisnootherpersonintheareaandsubjecttosuchguidelinesmadebytheMinistryofHealth;and

(c) those circumstances provided for in guidelines made by theMinistryofHealth.

(6) For thepurposesof sub-regulations (1) and (2), the circumstances inwhichapersonhasareasonableexcuseincludewhere–

(a) thepersoncannotputon,wearorremoveafacemask–

(i) because of any medical, physical or mental illness orimpairment,ordisabilitythatinhibitshisorherabilitytowearafacemask;or

(ii) withoutseveredistress;

(b) theperson is travellingwith,orprovidingassistance to,anotherpersonandsuchotherpersonreliesonlip-readingtocommunicatewiththefirstperson;

(c) thepersonremoveshisorherfacemasktoavoidharmorinjury,ortheriskofharmorinjury,tohimselforherselforothers;

(d) thepersonistravellingtoavoidinjury,ortoescapeariskofharm,anddoesnothaveafacemaskwithhimorher;

(e) if it is reasonably necessary for the person to eat or drink, thepersonremoveshisorherfacemasktoeatordrink;

(f) thepersonhastoremovehisorherfacemasktotakemedication;

(g) arequestismadeofthatpersontoremovehisorherfacemasktemporarily for securityand identificationpurposes ifnecessaryforthepurposeofreceivingservices;or

(h) the circumstances are provided for in guidelines issued by theMinistryofHealth.

(7)Subject to theexemptions insub-regulation(5) (b),anemployeeshallwearafacemaskwhenworkinginanenclosedpublicspace.

(8)Sub-regulation(1)doesnotapplytoapersononabeach,riverorpublicpark,ifheorshemaintainsphysicaldistancingofnolessthansixfeet(6ft.)toanypersonoutsideofhisorherhousehold.

7. Physical distancing and sanitisation protocols for establishments.—(1)Everyestablishmentshall–

(a) ensure thatallcustomersandstaffmaintainphysicaldistancingofnoless than six feet (6 ft.) in or outside their business, establishmentoroffice;

(b) determinethenumberofpersonsthatmaybepermittedinthebusiness,establishment or office at any one time by permitting one person foreverythirtysquarefeet(30sq.ft.)ofstorespace;

(c) place distance markers six feet (6 ft.) apart, indicating where eachcustomermuststandonalineatacheckoutpoint;and

(d) placedistancemarkerssixfeet(6ft.)apartontheoutsideofthebusiness,establishment or office, indicatingwhere customersmust standwhilewaitingtoenterthebusiness,establishmentoroffice.

(2) Every business, establishment or office, including operators of motoromnibuses,hiringcarsandtaxis,shalladministerorensuresanitisationofthehandsofeverypersonuponentryintothebusiness,establishmentoroffice.

(3) Employees of a hospital or health care, medical, residential careestablishmentorfacilityandmembersoftheRoyalGrenadaPoliceForceshalltakereasonablestepstocomplywiththerequirementsundersub-regulations(1)and(2),unlessitisreasonablyimpracticable.

8. Work remotely from home.—(1)A business, establishment and officemaycontinue its businessoperationsby allowing its employees towork remotely fromhome utilising virtualmeans, unless their employees are permitted towork underregulation9or10ortheiremployeesareessentialworkers.

(2)Where a business is unable to continue its business operations by itsemployees working remotely from home, the business shall suspend or cease itsoperations.

9. Operation of establishments, businesses and offices.—(1)Everyestablishment,businessandofficeshallremainclosedexceptforthefollowing–

(a) offices of the Government, Statutory Bodies and State-ownedEnterprises;

(b) wholesaleor retailgrocery storesandcommercialbakeries,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(c) manufacturesand suppliers,whichmayoperatebetween thehoursof6:00a.m.and5:00p.m.;

(d) offices of registered medical practitioners, dental practitioners andopticians,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;

(e) hospitalsandmedicalfacilities;

(f) medicalsupplyestablishments,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(g) pharmacies,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(h) gasstations,operatingbetweenthehoursof6:00am.and5:00p.m.;

(i) hardwarestores,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(j) subjecttoregulation10,hotelsandguesthouses;

(k) banks,creditunionsandmoneyservicesbusinesses,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(l) commercialportsandrelatedbusinesses,operatingbetweenthehoursof6:00a.m.and5:00p.m.,subjecttoanyvariationbythePortsAuthority;

(m)airports;

(n) commercialcourierflights;

(o) foodvendors,restaurantsandbarsoffering–

(i) drive-thruortakeawayservicesonly;or

(ii) diningservices,subjecttoregulation10,

operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(p) registeredorbona fidefishermen,farmersandbutchersengagedintheirbusiness;

(q) veterinariansengagedintheirtrade,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(r) accountantsengagedintheirtrade,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;

(s) insurancecompanies,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;

(t) law offices and attorneys-at-law engaged in their trade, operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;

(u) worksofconstruction;

(v) laundromats,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(w) landscapersandgardenersengagedintheirbusiness,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(x) flowershops,operatingbetweenthehoursof6:00a.m.and5:00p.m.andwithonlypick-upanddeliveryservices;

(y) companiesofferingpaydayloans,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(z) businesseslicensedtoprovidesecurityguardservices;

(aa)theSaintGeorge’sUniversity;

(bb)motorvehiclerepairshopsandgarages,andsuppliersofmotorvehicletyresandotherparts,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(cc)suppliers of books for educational institutions, operating between thehoursof6:00a.m.and5:00p.m.;

(dd)retailstores,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(ee)officesofotherprofessionals,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;

(ff) subjecttoregulation10,gymsandfitnesscentres,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(gg)subject to regulation 10, businesses and establishments of the beautysalon industry including barbers, hairdressers, makeup artists,manicurists, pedicurists, nail technicians, shampoo technicians, haircolour specialists, cosmetologists, aestheticians, skincare specialists,laser hair removal specialists, electrologists, spa therapists, beautytherapists,tattooartists,andbodypiercingartists,operatingbetweenthehoursof6:00a.m.and5:00p.m.andbyappointmentonly;

(hh)drivingschools,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(ii) diveshops,operatingbetweenthehoursof6:00a.m.and5:00p.m.;

(jj) subjecttoregulation10,callcentres;

(kk)suchotherbusinessesorundertakingsasmaybespecificallyexemptedinwritingbytheCommissionerofPolice,

providedthattheowneroroperatoroftheestablishmentspecifiedinparagraphs(a)to(kk)shall–

(i) complywithphysicaldistancingandsanitisationprotocolsinaccordancewithregulation7;

(ii) comply with any other conditions imposed by the Commissioner ofPoliceonthedirectionoftheCabinet;and

(iii)comply with the requirements to wear masks in accordance withregulation6.

(2) If the manager, owner, other person in charge or employee of anyestablishment, business or office exempted under sub-regulation (1), aids, abetsor facilitates the contravention of these Regulations, the establishment shall beimmediatelyclosedwithoutprejudicetoanyotherpenaltyinlaw.

(3)Thereshallbenoconsumptionofalcoholinorinthevicinityofanyshop,grocerystoreorestablishmentorinanypublicplace.

10. Vaccination requirements for specified establishments, businesses and offices.—(1)An establishment, business or office that is subject to this regulationshallnotoperateunless itoperateswithonlyemployeeswhohaveproducedto theestablishment,businessorofficeaCOVID-19vaccinationcardevidencing that theemployeehasreceivedatleastonedoseofaCOVID-19vaccine.

(2) No establishment, business or office subject to this regulation maycontinuetooperateunless,uponrequestbytheChiefMedicalOfficer,itproduces,inrespectofeachemployeeattheoperations,aCOVID-19vaccinationcardevidencingthattheemployeehasreceived–

(a) in the caseof thePfizerCOVID-19vaccine, a seconddosenotmorethanthreeweeksafteropeningorreopening;

(b) inthecaseoftheAstraZenecaCOVID-19vaccine,aseconddosenotmorethaneightweeksafteropeningorreopening;

(c) inthecaseofanotherCOVID-19vaccinethathasbeenapprovedby the World Health Organization as requiring two doses, aseconddosewithin theperiodasapprovedby theWorldHealthOrganization;or

(d) aCOVID-19vaccinethathasbeenapprovedbytheWorldHealthOrganizationasrequiringonedose.

(3)Noresidentialcareestablishmentorfacility,includinganelderlynursinghome,shalloperateunlessitoperateswithonlyemployees,residentsandpatientswhohaveproducedtotheestablishment,businessorofficeaCOVID-19vaccinationcardevidencingthattheemployee,residentorpatienthasreceivedatleastonedoseofaCOVID-19vaccine.

(4)Noresidentialcareestablishmentorfacility,includinganelderlynursinghomemaycontinuetooperateunless,uponrequestbytheChiefMedicalOfficer,itproduces,inrespectofeachemployeeattheoperationsandeachresidentandpatient,aCOVID-19vaccinationcardevidencingthattheemployee,residentorpatienthasreceived–

(a) inthecaseofthePfizerCOVID-19vaccine,aseconddosenolaterthanthe1stdayofNovember,2021;

(b) inthecaseoftheAstraZenecaCOVID-19vaccine,aseconddosenolaterthanthe6thdayofDecember,2021;

(c) inthecaseofanotherCOVID-19vaccinethathasbeenapprovedby the World Health Organization as requiring two doses, aseconddosewithin theperiodasapprovedby theWorldHealthOrganization;or

(d) aCOVID-19vaccinethathasbeenapprovedbytheWorldHealthOrganizationasrequiringonedose.

(5)Notwithstandingregulation9(1)(b),inthecaseofemployeesofwholesaleorretailgrocerystoresandcommercialbakeriesforwhomfood-handlingcertificatesorhealth certificates are required, and in the caseof employeesof establishments,businessesorofficesthatareotherwisesubjecttothisregulation–

(a) anemployeeshallnotdischargehisorherfunctionsunlessheorsheproducesaCOVID-19vaccinationcardevidencingthatheorshehasreceivedatleastonedoseofaCOVID-19vaccine;

(b) anemployeeshallnotcontinuetodischargehisorherfunctionsunlessheorsheproducesaCOVID-19vaccinationcardevidencingthatheorshehasreceived–

(i) inthecaseofthePfizerCOVID-19vaccine,aseconddosenotmorethanthreeweeksafterthefirstdose;

(ii) in the case of the AstraZeneca COVID-19 vaccine, aseconddosenotmorethaneightweeksafterthefirstdose;

(iii)in the case of anotherCOVID-19 vaccine that has beenapprovedby theWorldHealthOrganizationas requiringtwodoses,aseconddosewithintheperiodasapprovedbytheWorldHealthOrganization;or

(iv)aCOVID-19vaccinethathasbeenapprovedbytheWorldHealthOrganizationasrequiringonedose.

(6)TheChiefMedicalOfficermayexemptanemployeefromtheapplicationofsub-regulation(1),(2),(3),(4)or(5)orregulation11(4),(5)or(6),if,uponwrittenapplicationtotheChiefMedicalOfficerandaccompaniedbyacertificateofalicensedmedicalpractitionercertifying thatvaccinationagainstCOVID-19 isnot advisableforthatemployeeonmedicalgrounds,theChiefMedicalOfficerissatisfiedthatthatemployeeshouldbeexemptedonmedicalgrounds.

(7) The Cabinet may exempt an employee from the application of sub-regulation (1), (2), (3), (4) or (5) or regulation 11 (4), (5) or (6) if, uponwrittenapplicationtotheChiefMedicalOfficerstatinghisorherobjectionstovaccinationonreligiousgrounds,theCabinetissatisfiedthatthatemployeeshouldbeexemptedonreligiousgrounds.

(8)Forthepurposeofdetermininganapplicationundersub-regulation(7),theCabinetmayrequestadditionalinformationfromtheemployeetofacilitatedueconsiderationoftheapplication.

(9)Wherea foodvendor, restaurantorbarprovidesdiningservices, theseservicesshallnotbeprovided–

(a) unlesstheestablishment,businessorofficeoperatesinaccordancewithsub-regulations(1)and(2);and

(b) to a customer unless the customer presents a COVID-19vaccinationcardevidencingthat–

(i) inthecaseofatypeofCOVID-19vaccinerequiringtwodoses,14dayshaveelapsedsinceheorshereceivedtheseconddoseoftheCOVID-19vaccine;

(ii) inthecaseofatypeofCOVID-19vaccinerequiringonedose, 14dayshave elapsed sinceheor she received thedoseoftheCOVID-19vaccine.

(10)For the avoidanceofdoubt, sub-regulation (9)doesnot preclude theprovidingofdrive-thruortakeawayservicestoacustomergenerally.

(11)Everyemployeesubjecttothisregulationshallhavehisorhervaccinationcardavailableforinspectionatalltimeswhiledischarginghisorherfunctions.

(12)Fortheavoidanceofdoubt,inthisregulation,“employee”includesanoperator,manager,supervisororstaffofanestablishment,businessoroffice.

11. Education instruction.—(1) Educational institutions may only operate asauthorised by the Minister with responsibility for Education which may includeoperationsremotelybyutilisingvirtualmeans.

(2) For the avoidance of doubt, sub-regulation (1) does not restrict anyactivityreferredtothereinbyelectronicorvirtualmeans.

(3)Adaycarecentreshallnotoperateunlessitoperateswithonlyemployeeswho have produced to the establishment, business or office a vaccination cardevidencingthattheemployeehasreceivedatleastonedoseofaCOVID-19vaccine.

(4)Nodaycarecentremaycontinuetooperateunlessitproduces,inrespectof each employee at the operations, to the Chief Medical Officer a COVID-19vaccinationcardevidencingthattheemployeehasreceived–

(a) in the caseof thePfizerCOVID-19vaccine, a seconddosenotmorethanthreeweeksafteritsopeningorreopening;

(b) inthecaseoftheAstraZenecaCOVID-19vaccine,aseconddosenotmorethaneightweeksafteritsopeningorreopening;

(c) inthecaseofanotherCOVID-19vaccinethathasbeenapprovedby the World Health Organization as requiring two doses, aseconddosewithin theperiodasapprovedby theWorldHealthOrganization;or

(d) havingreceivedaCOVID-19vaccinethathasbeenapprovedbytheWorldHealthOrganizationasrequiringonedose.

(5)AnemployeeofadaycarecentreshallnotdischargehisorherfunctionsunlessheorsheproducesaCOVID-19vaccinationcardevidencingthatheorshehasreceivedatleastonedoseofaCOVID-19vaccine.

(6)AnemployeeofadaycarecentreshallnotcontinuetodischargehisorherfunctionsunlessheorsheproducesaCOVID-19vaccinationcardevidencingthatheorshehasreceived–

(a) in the caseof thePfizerCOVID-19vaccine, a seconddosenotmorethanthreeweeksafterthefirstdose;

(b) inthecaseoftheAstraZenecaCOVID-19vaccine,aseconddosenotmorethaneightweeksafterthefirstdose;

(c) inthecaseofanotherCOVID-19vaccinethathasbeenapprovedby the World Health Organization as requiring two doses, aseconddosewithin theperiodasapprovedby theWorldHealthOrganization;or

(d) aCOVID-19vaccinethathasbeenapprovedbytheWorldHealthOrganizationasrequiringonedose.

(7)Fortheavoidanceofdoubt, inthisregulation,“employee”includesanoperator,manager,supervisororstaffofanestablishment,businessoroffice.

12. Religious instruction.—(1)Religiousinstitutionsmayoperateinaccordancewith the Public Health (COVID-19) (Restriction on Religious Institutions) Order,2020,SRONo.64of2020,butshalladhereto–

(a) therequirementstowearmasksinaccordancewithregulation6;and

(b) the six feet (6 ft.) physical distancing protocol in accordance withregulation7.

(2) For the avoidance of doubt, sub-regulation (1) does not restrict anyactivityreferredtothereinbyelectronicorvirtualmeans.

13. Restriction on social activities and funerals.—(1)Nopersonshallhostorattendanysocialactivityofanydescription,includingawedding.

(2)Nopersonshallhostorattendafuneralceremony–

(a) hostingmorethantwentypersonsinadditiontotheofficiantandessentialmortuarystaff;or

(b) commencingearlierthan9:00a.m.,concludinglaterthan12noon,orlastingformorethanonehour.

(3) For the avoidance of doubt, there shall be no wakes or happy houractivities.

(4) Notwithstanding sub-regulation (1), the Commissioner of Police inconsultation with the Chief Medical Officer may grant written permission for aweddingtobehosted.

(5) For the avoidance of doubt, sub-regulation (1) does not restrict anyentitlementorpowerconferredbytheMarriageAct,Chapter184.

14. West Indies Associated States Supreme Courts and Magistrate’s Courts.—(1)Subject tothePracticeDirectionsof theEasternCaribbeanSupremeCourt, theWestIndiesAssociatedStatesSupremeCourtshallremainaccessibleandshalladheretophysicaldistancingandsanitisationprotocolsinaccordancewithregulation7.

(2)Subject to rulesornoticesmadeor issuedpursuant to theMagistratesAct,Chapter177,theMagistrate’sCourtshallremainaccessibleandshalladheretophysicaldistancingandsanitisationprotocolsinaccordancewithregulation7.

15. Restriction on beaches and rivers.—(1)Beachesandriversmaybeaccessedasfollows–

(a) betweenthehoursof4:00a.m.and4:00p.m.;

(b) forswimmingandexerciseonly;and

(c) witheverypersonmaintainingphysicaldistancingofno less thansixfeet(6ft.)toanypersonoutsideofhisorherhousehold.

(2) Thereshallbenopicnic,partyorothergatheringatabeachorriver.

16. Restriction on domestic travel.—(1)InrespectoftravelbetweentheislandofGrenada,andtheislandofCarriacouorPetitMartinique,nopersonshallofferforhireorseektotravelonanyvessel,whetherbyairorbysea,except–

(a) fortransportoffreight;

(b) inthecaseofapersonwhoistravellingoutofthejurisdiction;or

(c) fortravelessentialfortrade,

andwiththeapprovalofthePortsAuthorityortheAirportAuthority,asthecasemaybe.

(2) In respect of travel between the island ofGrenada, and the island ofCarriacou or PetitMartinique, no person shall enter a vessel unless he or she hassubjectedhimselforherselftoarapidantigentestandtheresultoftherapidantigentestisnegative.

(3) For the purposes of this regulation, “rapid antigen test” means animmunoassaythatdetectthepresenceoftheantigenforSARS-CoV-2orCOVID-19.

(4) For the avoidance of doubt, this regulation does not apply to travelbetweentheislandofCarriacouandtheislandofPetitMartinique.

17. Restriction on road traffic.—(1)Nopersonshalldriveavehicleonanypublicorprivateroadexceptforapurposeexemptedunderregulation2(2)or5.

(2)TheRoyalGrenadaPoliceForceshallhavepowerstostopanyvehicleandinquireastothepurposesforwhichthatvehicleisbeingutilised,andtoarrestanyonefoundinviolationofthisrestriction.

(3)Forthepurposesofthisregulation,“vehicle”includesamotorvehicleormotorbike.

18. Public transportation.—(1)For the avoidance of doubt, regulation 7 shallapply in respect of every motor omnibus, hiring car and taxi, and every persontravellinginanymotoromnibus,hiringcarortaxishallpractisegoodhandhygieneandpropersanitarybehaviour.

(2)Notwithstandingregulation6(2),everypersontravellinginanymotoromnibus,hiringcarortaxishallwearafacemaskinamannerthatcovershisorhermouth,noseandchin.

(3)Nopersonshalleatordrinkwhiletravellinginanymotoromnibus,hiringcarortaxi.

(4)Operatorsofmotoromnibuses,hiringcarsandtaxismayonlyoperateasauthorisedbytheCommissionerofPoliceactingonthedirectionoftheCabinet.

(5) In this regulation, “motor omnibus”, “hiring car” and “taxi” have themeaningsassignedundertheRoadTrafficAct,Chapter289A.

19. Restriction on visitation.Nopersonshallvisitorbepermittedtovisit–

(a) anyplaceofquarantineorisolationstation;

(b) a resident or patient in a residential care establishment or facility,includinganelderlynursinghome;

(c) apatientinahospital;or

(d) adetaineeinaprison.

20. Mandatory reporting and isolation.—(1)Anypersonwhoisexhibitinganyflu-like symptoms shall immediately notify a police station in his or her parish inaccordancewiththeParishBoundariesAct,Chapter224.

(2)Anypersonwhohasobservedthatanyotherpersonisexhibitingflu-likesymptoms shall notify a police station in his or her parish in accordancewith theParishBoundariesAct,Chapter224.

(3)Anypersonwhoknowinglymakesafalsereportforthepurposesofsub-regulation(2)shallbeguiltyofanoffence.

(4)Anypersonwho is askedby anyofficial of theMinistry ofHealth tosubmithimselforherselftoanytestingforCOVID-19shallsubmittosuchtesting.

(5)AnypersonwhoisdirectedbytheMinistryofHealthtosubmithimselforherselftoself-isolationorquarantineshallcomplywiththedirection.

(6) For the purposes of this regulation, the Ministry of Health shall becontactedusingthefollowingCOVID-19Helplines–

(a) in the case of the island ofGrenada, at telephonenumber 458-4787;538-4787or438-4787;

(b) inthecaseoftheislandofCarriacouorPetitMartiniqueoranyotherdependencyattelephonenumber423-2812or423-2813.

21. Powers of the Chief Medical Officer.—(1)WheretheChiefMedicalOfficeris satisfied thatanestablishment,businessoroffice that is subject to regulation10is in contraventionof that regulation, in addition to anyother penalty under theseRegulations,theChiefMedicalOfficermaydirecttheclosureoftheestablishment,businessorofficeforsevencalendardaystofacilitatecompliancewiththatregulation.

(2) Where it appears to the Chief Medical Officer that a establishment,business or office is not complying with the protocols under the Public Health(COVID-19)Regulations,2020,SRONo.59of2020,theChiefMedicalOfficermaydirecttheclosureoftheestablishment,businessorofficeforaperiodnotexceedingsevenbusinessdays, tofacilitate the trainingof themanagementandstaff inordertoensurethatthebusiness,establishmentorofficecomplieswiththePublicHealthprotocols.

22. Duty and powers of Police Force.—(1)Itshallbethedutyofeverypoliceofficer to enforce (using reasonable force if necessary) compliance with theseRegulations and with any order, instruction or condition lawfully made, given orimposedbyanyofficerorotherpersonundertheauthorityoftheseRegulations,andforsuchpurposeanypoliceofficermayenteranypremiseswithoutawarrant.

(2)AnypoliceofficermayarrestwithoutawarrantanypersonwhomheorshehasreasonablecausetobelievehascommittedanoffenceagainsttheseRegulations.

23. Penalty.—(1) A person who contravenes or fails to comply with theseRegulations,oranydirectionforthepurposesoftheseRegulations,shallbeguiltyofanoffenceand,onsummaryconviction,isliabletoafinenotexceedingonethousanddollarsandtoimprisonmentforatermnotexceedingtwelvemonths.

(2)Withoutprejudicetosub-regulation(1),apersonwhocommitsanoffenceisliableonserviceofafixedpenaltynoticebyapoliceofficer,ifthepersonsochooses,toafixedpenaltyoffivehundredandfiftydollars.

24. Fixed penalty notice.—(1)Whereapoliceofficerhasreasontobelievethatapersonhascommittedanoffencespecifiedunderregulation23(1),thepoliceofficermaydirectthepersontostatehisorhertruenameandplaceofresidenceandserveuponthepersonafixedpenalty.

(2)A person who refuses to comply with sub-regulation (1) commits anoffence.

(3)Whereapoliceofficerhasservedafixedpenaltynoticeuponaperson,thepoliceofficershall–

(a) chargethepersonwiththecommissionofanoffence;and

(b) notifythepersonthat,ifheorshedoesnotwishtobeprosecutedfor theallegedoffence incourt,heor shemaypay to theclerkoftheMagistrate’sCourtinthedistrictinwhichtheoffencewascommittedthefixedpenaltyprescribedfortheoffenceinthefixedpenaltynoticewithinthetimespecified.

(4)Apersonuponwhomafixedpenaltynoticeisservedmaydeclinetobedealtwithunderregulations24to28andwhereheorshefailstopaythefixedpenaltywithinthetimespecifiedinthefixedpenaltynotice,orwithinsuchfurthertimeasmaybeallowedinaparticularcase,hisorherconductconstitutesadeclinationtobedealtwithunderregulations24to28.

(5)Apoliceofficershallserveafixedpenaltynoticepersonallyuponapersonallegedtohavecommittedanoffencespecifiedunderregulation23(2)andshallsendaduplicateofthefixedpenaltynoticetotheMagistrate’sCourtofthedistrictinwhichtheoffenceisallegedtohavebeencommitted.

(6)Wherethefixedpenaltyisnotpaidwithinthetimespecifiedinaccordancewithregulation26(2),theduplicatesenttotheMagistrate’sCourtundersub-regulation(5)shallconstituteacomplaintlaidbeforetheMagistratetoinstituteproceedingsinaccordancewiththeCriminalProcedureCode,Chapter72B.

(7)AfixedpenaltynoticeshallbesignedbythepoliceofficerandshallbeinthemannerspecifiedundertheSchedule,specifyingthefollowing–

(a) thedate,timeandplaceofserviceofthefixedpenaltynotice;

(b) the provision of theseRegulations creating the offence alleged,and such particulars of the offence as are required under theseRegulations;

(c) theamountofthefixedpenalty;

(d) thetimewithinwhichthefixedpenaltymaybepaidinaccordancewithregulation26(2);and

(e) theclerkoftheMagistrate’sCourttowhom,andtheaddressatortowhich,thefixedpenaltymaybepaidorremitted.

25. Payment of fixed penalty.—(1)PaymentofthefixedpenaltyshallbemadetotheclerkoftheMagistrate’sCourtasstatedinthefixedpenaltynotice,andshallbedealtwithinthesamemanneraspaymentofafineimposedforanoffenceundertheCriminalProcedureCode,Chapter72B.

(2)Paymentofthefixedpenaltyshallbeaccompaniedbythefixedpenaltynoticewhichshallbecompletedbythepersoninthemannerprescribed.

26. Payment of fixed penalty precludes prosecution.—(1)Apersonuponwhomafixedpenaltynoticeisservedmaypaythefixedpenaltyinaccordancewiththefixedpenalty notice.

(2)Thetimewithinwhichafixedpenaltyispayableisthirty-onedaysfromthedateofthefixedpenaltynotice.

(3)Where the fixed penalty is paid in accordancewith the fixed penaltynotice,nopersonshall thenbe liable tobeconvictedfor theoffenceforwhichthefixedpenaltynoticewasservedandthecomplaintlaidbeforetheMagistrateshallbenullandvoid.

27. Certificate of payment or non-payment of fixed penalty.Inanyproceedingsfor an offence specified under regulation 23 (2), a certificate that payment of thefixedpenaltywasorwasnotmadetotheclerkoftheMagistrate’sCourtbythedatespecifiedinthecertificateshall,ifthecertificatepurportstobesignedbysuchclerk,besufficientevidenceofthefactsstated,unlessthecontraryisproved.

28. Consequence of failure to pay.Whereafixedpenaltyisnotpaidwithinthetime specified in accordancewith regulation 26 (2), proceedings in respect of theoffencespecified in thefixedpenaltynoticeshall thereafterproceed in themannerprescribedbytheCriminalProcedureCode,Chapter72B.

29. Transitional provisions.—(1)Everyapprovalgrantedunder theEmergencyPowers(COVID-19)(No.3)Regulations,2021,SRONo.36of2021,theEmergencyPowers (COVID-19) (No. 4)Regulations, 2021, SRONo. 38 of 2021 and the theEmergencyPowers(COVID-19)(No.5)Regulations,2021,SRONo.42of2021shallapplyasifitweregrantedundertheseRegulations.

(2)Fortheavoidanceofdoubt,thereremainsineffectacurfewfrom7:00p.m.onthe19thdayofOctober,2021andending4:00a.m.onthe20thdayofOctober,2021.
