INTRODUCTION Privada is committed to being a premier community in East Boise-Barber Valley – a place where aesthetics, architecture detail and landscape design matter. From the moment you pass through the elegant and prominent entryway, and notice the beautiful architectural walls designed to stand the test of time, and the generous tree-lined landscape drawing you in, you sense you have arrived at a special place. The Community of Privada lies in the heart of a high-plains setting, cradled by a natural rock amphitheater enveloped by the East Boise Foothills. The following is a summary of Privada’s Architectural Design Guidelines and Standards and Landscape Standards

(ADGS). Refer to the recorded CC&Rs and the complete ADGS documentation for the entire regulations and

guidelines to achieve the Community objectives and to moderate the design of all home construction within the

Community. The homesite owner should view the ADGS in the spirit of supportive guidelines that will help to protect

the unique characteristics of Privada to ensure a certain level of aesthetic quality – and not as a roadblock to

individual and creative design. The objective of the Privada Architectural Control Committee (ACC) through the

ADGS and CC&Rs are to protect, preserve and enhance the environment within the Community of Privada. It is the

responsibility of the homesite owner to provide this summary and the complete ADGS and CC&R materials to their

architect/designer and builder.

All materials can be downloaded and printed for review, and are available at the Community website: PrivadaViews.com. All building plans and landscape plans are to be reviewed and approved by the Privada Architectural Control Committee (ACC) prior to permitting and commencing construction. The Community of Privada lies within the City of Boise Hillside and Foothill Area Development ordinance (11-14-3.1A), and within the Wildland Urban Interface (WUI) Zone B, homeowners are to comply with Boise City Code (B.C.C.) 7-01-69. All builders are required to have recent demonstrated City of Boise Hillside Building experience.

Community Location

Privada encompasses an area of approximately 12 acres

overlooking the vast Barber Valley and surrounding East

Boise Foothills. The Community is located on the southern

slope of Via Privada Lane directly north of Warm Springs

Avenue. The Barber Valley Foothills terrain is

characterized by both gentle and dramatic slopes of

vegetated hillsides, rolling plateaus and valleys.

The site area is studded with sagebrush and numerous

and diverse types of native grass. Privada provides a one-

of-a-kind setting allowing nature and design to come

together in a beautiful setting.

The master site plan provides homesites that respond to

the sloping topography of the terrain offering panoramic

views in all directions.

‘QUALITY IN ARCHITECTURE’ OBJECTIVES The architecture at Privada strives to convey a strong sense of identity, style and place. The philosophy of Privada residential design goals are to encourage the creation of a homogenous and harmonious community expressed through compatible and high quality architectural design that aligns with the three approved Community architectural vernaculars (Modern, California Mission, Mediterranean) for the specific purpose:

▪ To enhance and protect the value, desirability and attractiveness of the entire property within its boundaries and to provide a strong Community identity;

▪ To construct quality custom homes which are harmonious with the natural foothills setting and with each other;

▪ To protect individual homeowner’s view and privacy, and to minimize the impact on each homesite's views as new homes are built within the Community;

▪ To preserve the privacy and tranquility of the Community setting; ▪ To preserve and enhance the natural environment and wildlife habitat within the property; ▪ To encourage sustainable building practices, including the use of carbon-sensitive, sustainable

materials where possible. ▪ To insure the design of each new residence will add to the overall character and quality of what makes

Privada desirable and a special Community for years to come.

Note: other architectural styles, that are complimentary and compatible may be approved on a case-by-case basis by the ACC. Contact the ACC in advance to discuss.

ARCHITECTURAL FEATURES SUMMARY

Approved Architectural Styles

Modern, California Mission, Mediterranean Vernaculars. Other styles by advance ACC approval.

Approved Builders All builders/general contractors must have recent City of Boise foothills building experience and be a registered general contractor. The ACC shall maintain a list of approved builders.

Architectural Design Refer to the complete ADGS documentation for specific building and landscape requirements.

Construction Timeline Construction to commence no later than one (1) year from Lot Purchase closing date, and to be completed no later than eighteen (18) months after date of commencement – unless a time extension approved in writing by the ACC.

New Construction Security Deposit

Refundable - $10,000 collected after plan review approval by the Architectural Control Committee (ACC), prior to construction, to insure construction completion according to approved plans, insure inspections are met and any remediation of potential site infrastructure damage or for use to pay for corrective measures associated with construction in the event the owner/builder refuses to make required corrections. Unused portion of deposit will be refunded upon satisfactory final inspection from a representative of the ACC. Refund upon written notice of completion (within 60 days) and proof of certificate of occupancy, subject to abiding by terms and conditions of CC&Rs.

Architecture Design Review Fee

$1,500 non-refundable design review fee to offset costs of professional architect and landscape review of submitted plans.

Residential Structure Design

Single-level living area, with optional daylight basement.

Approved Setbacks 20’ front yard, 30’ rear yard, 10’ side yard, or otherwise as City-Code Conditions, or noted for front yards on the recorded plat: Lots 1-3 & 5-7.

Maximum Building Height

Variable. Refer to CC&Rs for homesite-specific GPS elevations (indicated at curb-side and at the center of building envelope) and for roof height restrictions for all residential and garage structures.

Minimum Living Square Footage

2,800 sq. ft. living (single-story design with optional daylight basement).

Garage Size and Design Where possible per homesite layout and building envelope, de-emphasized side-loading garage orientation preferred. RV Garages are not allowed.

Exterior Lighting

All outdoor lighting to be dark-sky compliant. All homesites to include a light post monument (constructed from CMU and optional stucco/stone overlay) located at back of sidewalk - with an ACC-approved dark-sky post-mounted lighting fixture. All front and side exterior lighting to be on photocell.

Exterior Veneer/Masonry All residential improvements are required to incorporate at least 30% of front and side elevation in natural stone or stone veneer, or other composite masonry products approved the ACC.

Siding Full stucco surround only. Additional stone, veneer, woodgrain, timbers not to exceed 40% of exterior surface.

Roof Material 100% roof coverage with architectural concrete tile (Boral or Bartile), with slate and architectural metal accents. No asphalt shingle roofs permitted. Flat Roof (designed in layered sections) subject to a case-by-case ACC review and approval.

Roof Pitch Allowable roof pitch – 2:12 minimum and 4:12 maximum. Flat roof sections are permitted with a minimum ¼” per foot minimum slope, adequately screened behind parapets of sufficient height to allow for screening.

Windows Clad wood or fiberglass to resemble wood. Vinyl allowed if upgraded, colored and resemble wood, exterior colors must be champagne, dark brown or black finish. Other colors approved by ACC. Metal clad wood windows are allowed.

Driveways/Walkways Finished concrete with optional decorative or stamped concrete insets or borders, and/or concrete pavers are encouraged on all driveways, motor courts, walkways, paths and patio areas.

Fencing

Wrought iron (black finish), with top-railing, 4’ maximum height, in ACC-approved areas only. Masonry walls with ACC approval. PVC, Wood or metal fences are not permitted. Wrought iron fencing must be animal and deer-friendly. HVAC and trash/recycle containers must be behind masonry/stucco screening walls.

Recreation Equipment All recreational equipment, ATVS, campers, boats, trailers, etc. must be stored within enclosed garage bays at all times when not in actual use. Refer to CC&Rs for details.

Casitas and Shops Allowed with ACC approval and according to City Building ordinances. Must match home architectural exterior, materials, style & roof height/pitch. Casitas/shops must have a connecting roof line.

Dog Runs Allowed with ACC approval. Must be hidden from front view and constructed of wrought iron fencing and screened from neighboring properties.

Mailbox Monuments Upon completion of construction and certificate of occupancy obtained, each homesite will be provided a community-matched post and mailbox with address plate, according to the USPS pre-approved curb location.

Swimming Pools Allowed (in-ground only), location with ACC approval.

Landscape Requirements

Completed within 60 days (seasonal weather permitting) of home construction completion. A landscape plan must be submitted at the same time as building plans for ACC review. Refer to the complete ADGS for details. Native and xeric (low-water use) plant materials are highly encouraged. Rolled sod allowed for lawn sections. Extra deposit required if landscaping installed afterwards, outside the builder contract.

HOA DUES AND FEES – COLLECTED AT HOMESITE PURCHASE & RESALE CLOSING

HOA initial assessment/Setup/Transfer Fees $1,200 one-time at initial homesite & resale purchase.

HOA annual dues (includes maintenance of community landscape and equipment, private road, street lights, on-site storm-drain structures, community utilities, HOA insurance, annual tax preparation, filing & administrative costs and long-term reserve account budgets)

$1,200/year (prorated to end of calendar year), billed semi-annually thereafter.

New Construction Landscape Deposit $5,000 – Required if builder is not going to participate in the landscape construction of the home, but would like to have the New Construction Deposit released. In this case, the landscape deposit shall be submitted by the homeowner along with submitting a Transfer of Responsible Party Form

EXTERIOR – MINIMUM REQUIREMENTS

Refer to complete Architectural Design Guidelines and Standards for all architectural and building design details

Chimneys/Chimney Caps Chased, Required

Colors All material color palettes to be submitted with the Plan Review Application Form, including stucco, stone, rock and other exterior treatment materials. Exterior colors of light to neutral to warm earth tones, neutral to warm grey/beige tones shall be required for the exterior body of the house and garage. Bright, bold, very dark or trendy colors shall not be allowed.

Focal Features Decorative wood applications, such as longboard and woodgrain, timbers, columns, corbels, crown molding, dentil molding, wrought iron, metal, heavy window trim and front porches are encouraged. Outdoor living courtyards and living spaces are also encouraged.

Front Door Upgraded front door required. An upgraded front door has decorative glass and/or iron inserts, is stain-grade wood, steel, metal, or is otherwise improved by ACC.

Siding Stucco, Stone, Stone Veneer, Longboard or other woodgrain material

Soffit and Fascia Minimum Soffit 2’. Minimum Fascia 8”. Constructed of a nominal 1-1/4” minimal thick piece or solid material (Hardie Plank, wood or metal).

EXTERIOR LIGHTING

All homes must have exterior lights on a photocell, that automatically activate nightly.

All homes must have at least one entry light, garage lights, front yard light post monument optional (located at back of sidewalk, with an ACC-approved light fixture mounted on front face) and one of the following operating on a photocell:

Soffit lights or down lights Strongly encouraged

Low Voltage landscape lights Strongly encouraged (up-lighted)

Note: All exterior lighting fixtures to be dark-sky compliant, according to City of Boise Planning Area policy for the Barber Valley to protect night skies (BV-CNN 1.2). Refer to the ADGS for light post monument design criteria and approved Privada dark-sky light fixture.

ROOF – MINIMUM REQUIREMENTS

Roof Breaks Minimum of 5-6 architectural roof breaks required (as seen from the front of the house design). Minimum of 4 architectural roof breaks required on rear side.

Roof Vents/Pipes Hidden on backside or from view. Painted to match or blend with roof color.

Roof Pitch Minimum: 2/12, Maximum 4:12, Shed roof sections allowed. Flat roof sections are permitted with a minimum ¼” per foot minimum slope, adequately screened behind parapet walls of sufficient height to allow for screening.

Roofing Material Architectural Tile, Metal or Slate (fire-rated, must meet foothills fire codes). Non-Reflective Flat Roof Membrane and Materials are allowed (on a case-by-case basis with ACC approval). Other materials may be considered by ACC. Asphalt shingles not permitted.

Exterior Aesthetics Shrouded Chimney vent screening, Flat-pitch roof sections, Parapet Wall Projections, Boston-ridge framing on hip or ridge encouraged for venting and aesthetics. Proper and Proportional Window Size and Placement encouraged.

GARAGE

Garage Door Wayne Dalton residential garage door 8450, 8800, 8850, 9700, 9800 series, factory-stained or finished. Minimum 3 car garage (all single door preferred, or 1 double door and 1 single door). Maximum door height 9’. Maximum single-door width 10’. Other door options may be approved by ACC. Featureless plain metal-clad paneled doors are not allowed. RV garage doors are not allowed.

Interior Finish Taped, Sanded, Painted

Garage & Driveway Location Subject to lot width/depth restrictions and to minimize visual impact where possible, garages bays shall be preferred side-loaded. Driveway cuts onto street are pre-existing and shall be limited to one (1) cut per homesite. Alternative garage orientation and driveway cuts on certain homesites and plans may be approved by the ACC, subject to CC&R requirements.

Service/Utility Yards Screened walls, enclosing garbage, trash and recycle containers, firewood storage, landscape/yard equipment, and AC equipment. Must minimize visual impact on neighboring homesites.

Basketball Hoops Not allowed in street, on sidewalk or attached to the house or garage. Encouraged to be installed in less prominent areas such as side or rear yards. Must have prior ACC approval.

Accessory Buildings Exterior materials, colors, style and roof to match the home. Must be approved by ACC prior to installation. Larger buildings such as casitas (12’ or more in width) are to be attached to the home with a matching roof-line, per City Building ordinances. Additional landscape screening may be required.

Gutters/Downspouts ACC approval.

Building Height Restrictions Varies per individual homesite, GPS elevations pre-determined at lot boundaries, back of curb and the center of building envelope. Per CC&Rs, to protect view corridors, single-story with optional daylight basement design only.

CONSTRUCTION OPERATION, RULES & REGULATIONS

Construction, and related deliveries, shall not begin prior to 7:00 am or continue after sunset, and must comply with City ordinances, Monday – Saturday. Construction is not permitted on major holidays.

Each jobsite shall maintain an onsite trash dumpster, to be neatly kept and be emptied when full. Jobsite to be tidied up and free of scattered & blowing debris - each evening and prior to each weekend.

Construction Operation, Rules and Regulations

Refer to the Architectural Design Guidelines and Standards for complete details.

Street Clean Penalty Actual cost of street sweep plus a $300 penalty will be charged for additional street sweep required due to track out created by any subcontractor (and equipment) employed by builder or homesite owner. Streets to be swept nightly by Builder superintendent. Blowing debris to be placed in jobsite dumpster.

Trash Clean Penalty Actual cost of clean-up and/or trash dump plus a $300 penalty will be charged to the builder or homesite owner for clean-up due to lack of timely and orderly maintenance.

Note: Builders are strongly encouraged to stabilize their construction entry and any run-off to reduce dirt/dust, erosion and mud track out onto sidewalks and streets in cooperation with the EPA’s Storm Water Pollution Prevention Plan (SWPPP), and agree to except responsibility for an orderly and tidy homesite, and to prevent any homesite erosion and run-off (to sidewalks, streets, adjacent homesites and drainage structures) while under home construction and/or landscape installation.

NEW CONSTRUCTION – PLAN REVIEW SUBMITTALS

The Privada Architectural Control Committee (ACC) Approval is required prior to hillside, grading (erosion control)

and build permitting with City of Boise. Refer to the ADGS for the complete process, application form(s), fees and

submittal requirements. There are 4 progressive phases for new construction:

PHASE 1 – Preliminary Plan Review and Approval

PHASE 2 – Construction Plans Review and Approval

PHASE 3 – Construction Agreement & Security Deposit

PHASE 4 – Post Construction Compliance Review and Approval

Required submittals:

▪ Review Application Form(s) – submitted with drawings, specifications and materials

▪ Samples of Exterior Material and Finish Specifications, Proposed Exterior Colors

▪ Approved Builder/General Contractor

▪ Architecture Review Fee - $1,500 (non-refundable for professional review of plans)

▪ Provide fee payment and 3 full plan sets of the following:

(include a digital copy of all blueprints on a flash drive, CD, DVD or other digital media):

- Site Plan (showing building footprint and setbacks)

- Site Grading, Drainage and Erosion Control Plan

- Structural Plan

- Building Plans

- Floorplans and Elevations (front, rear and side view)

- Landscape, Irrigation and Lighting Plans

Upon ACC final construction plans approval and prior to commencing construction, the following performance fee
