Thank You for choosing MMA Insurance.

This policy is a Private Car contract between You and Us and is based on theinformation You gave Us when You applied for the insurance. If any of the informationYou have supplied is incorrect, You must inform Us as soon as possible as it mayinvalidate Your insurance and lead to a claim not being dealt with.

Please read this policy and its schedule to ensure that they meet Yourrequirements. If You have any query You should contact Your insurance broker orintermediary immediately.

In return for Your having agreed to pay the premium, including any tax applicableand subject to the policy terms and conditions, We will provide the insurancedescribed in this contract during the period of insurance.

Should You have to make a claim, telephone the MMA Motor Care Line on 0844902 2220 and they will manage all aspects of the claim regarding damage to Yourvehicle from the time it is reported. Please provide Us with the following information:

• Policy Number, Your name, driver’s name

• Vehicle make, model and registration number

• Nature of incident

• Police incident number if applicable (this is a requirement for theft claims)

• Accident police reference number (if police attended the scene)

How We Deal With Your Claim

We may choose to repair or replace Your Car or accessory or spare part or pay anamount up to the Market Value of Your Car or accessory or spare part at the timeof loss or damage.

If to Our knowledge Your Car is the subject of a hire purchase or leasing agreement,any payment for loss of or damage to Your Car which is not made good by repair,reinstatement or replacement, may, at Our discretion, be made to the owner whosereceipt shall be a full discharge of Our liability.

Should Your Car be uneconomical to repair and You pay Your premium byinstalments, We will deduct any outstanding balance from any settlement offered.

We will also pay for the reasonable costs of protection and removal to the nearestrepairers and re-delivery to You, at the address shown on the Schedule, following aclaim covered by this policy.

We will pay You the market value ofYour car if it is stolen and notrecovered or is damaged and beyondeconomical repair.

The market value is what You wouldhave to pay to buy a car of similar ageand condition to the one stolen ordamaged.

We may have asked You to give Us avalue when You applied for insurance.This is not necessarily the amount thatYou will receive. We will pay You themarket value at the time of the claim.

We use publications such as Glass’sGuide to set the market value of avehicle. Other factors that We wouldconsider are condition of the vehicle,mileage, current MOT (if applicable)and available service history.

The amount We offer may be less thanthe guide price if the car:

• Already has some damage thatoccurred prior to the fire, theft oraccident;

• Has high mileage for its age;

• Is over three years old but has noMOT (four years in Northern Ireland);

• Does not have a service history;

We may offer more than the guideprice if the car:

• Has low mileage for its age;

• Has evidence of manufacturerupgrades/modifications provided Wehad previously been advised andaccepted them.

Replacement of tyres andmechanical items required to keepthe car mobile and roadworthy willnot normally be counted asevidence of increased value. Theseare normal day to day running costsneeded to ensure a car does notlose its current market value due tolack of maintenance.

Do

• Get as much information as You can,as soon as possible.

• Ask the other drivers involved fortheir names, addresses andtelephone numbers.

• Request the name of their insurersand if possible their Policy orCertificate number.

• Send to Us any letters or documentsYou receive in connection with theclaim without replying to them.

• Make a note of the vehicleregistration numbers, along with themake, model and colours of theother vehicle involved. Also note allrelevant details such as weatherconditions.

• Make a note of any injuries ordamage to other property.

• Ask for the names and addresses ofany witnesses before they loseinterest and leave the scene.

• If the police attend the scene, obtainthe address of the police station andif possible their reference number.

• Contact MMA Motor Care Line on0844 902 2220 as soon as possibleto report the matter, even if Youdon’t intend to make a claim.

Don’t

• Discuss at the scene whose fault theaccident seems to have been.

• Apologise or admit any fault orliability.

• Forget to record the details ofdamage caused to any property orinjury to anyone involved.

What the Law Says

• If You are involved in any accidentinvolving an injury to any person ordamage to any other vehicle orproperty You must stop.

• Give Your name, address andinsurance details to anyone who hasa good reason for asking.

• If there is an injury or You do notgive Your details to anyone at thescene, You must report the matter tothe police within 24 hours.

• Call the Police immediately andobtain a crime reference number

• We will need the followingdocuments so please make sure Youhave these to hand:

– Vehicle Registration Document(V5 or Log book)

– Current MOT Certificate

– Purchase Receipt

– Service History

– Copy of Your Driving Licence

– Certificate of Motor Insurance

We will make an offer for the MarketValue of Your vehicle less any policyexcess that applies and send You Oursettlement cheque once We havereceived all the required documentsand any enquiries have beencompleted.

If Your vehicle is recovered at anystage, either before or after We havesent the settlement cheque to You,please contact Us immediately with thelocation of Your car. This will enable Usto move the vehicle to one of Ouragents. Failure to do this may result inYou becoming liable for any towing andstorage charges.

Certificate of Motor Insurance

Your current valid Certificate OfMotor Insurance which has the samenumber as this policy. The Certificatealso sets out who may drive Your Carand the purpose for which Your Carmay be used.

Your Car

The car whose make, model andregistration mark are specified on theSchedule and described in theCertificate Of Motor Insurance or anyreplacement car, details of which havebeen supplied to and accepted by Us.

Schedule

The document that describes details ofthe cover You have and informationthat You have supplied to Us.

Period of Insurance

The effective period of time shown onthe Schedule.

Excess

The amount You must pay followingloss of or damage to Your Car. Theactual amount is shown on theSchedule.

Endorsements

Special terms or restrictions whichaffect the policy cover. TheEndorsement numbers which apply areshown on the Schedule.

Territorial Limits

Great Britain, Northern Ireland, ChannelIslands, the Isle of Man and during seatransit between ports in these areas.

Inexperienced Driver

A person who has not held a full UnitedKingdom driving licence for the last 12months.

Market Value

The cost of replacing Your Car withone of similar make, model, conditionand mileage at the time of the loss ordamage, but not more than the amountYou paid for it.

Audio-Visual, Satellite Navigation andCommunication Equipment

Equipment that is permanently fitted inthe car, such as:

1. compact disc, MP3 player, radiocassette, mini disc or other audioequipment;

2. telephone or other communicationequipment;

3. television, DVD or other visualentertainment equipment;

4. visual navigation equipment

Any of the above equipment which isremovable is not consideredpermanently fitted.

Equipment which is not permanentlyfitted is not covered under this section.

3. Law Applicable to Contract

It is possible to choose the lawapplicable to a contract of insurancecovering a risk situated in the UnitedKingdom. We have chosen Scottish Lawif You live in Scotland, Jersey Law ifYou live in Jersey and English Law ifYou live elsewhere in the UnitedKingdom.

Payment of Your premium is evidenceof acceptance of Our choice. If anyother law is to apply, it must be agreedby both parties and evidenced inwriting.

4. Exchange of Information

Insurers pass information to the Claimsand Underwriting Exchange Register, runby Insurance Database Services Ltd(IDS Ltd) and the Motor InsuranceAnti-Fraud and Theft Register, run bythe Association of British Insurers (ABI).The aim is to help Us to checkinformation provided and also toprevent fraudulent claims. We will passinformation to the appropriateregister(s). In dealing with any claim Wemay search the register(s).

In order to prevent or detect fraud Wewill check Your details with fraudprevention agencies. If false orinaccurate information is provided andfraud is suspected details will be passedto these agencies to prevent fraud andmoney laundering. You can find outfurther details explaining how theinformation held by fraud preventionagencies may be used by contacting usat [email protected].

5. Administrative Charge

We reserve the right to apply anadministrative charge (subject toinsurance premium tax whereapplicable) for any adjustments Youmake to Your policy.

1.1 Accidental Damage

We will pay for loss of or damage,other than by fire, theft or attemptedtheft, to Your Car and its accessoriesand spare parts in or on Your Car or inYour private garage, occurring duringthe Period Of Insurance within theTerritorial Limits.

1.2 Fire and Theft

We will pay for loss of or damage toYour Car and its accessories and spareparts while in or on Your Car or inYour private garage, caused by fire,theft or attempted theft occurringduring the Period Of Insurance withinthe Territorial Limits.

1.3 Loss of or Damage to Your Car

We may choose to repair or replaceYour Car or accessory or spare part orpay an amount up to the Market Valueof Your Car or accessory or spare partat the time of loss or damage. MarketValue will not be more than theamount You paid for it.

If Your Car is less than one year oldfrom the date of first registration at thetime of loss or damage, We will, withYour agreement and that of anyinterested parties, replace it with a newcar of the same make, model andspecification if immediately available inthe United Kingdom provided that:

(a) Your Car is in current production;

(b) You are the first and only ownerand registered keeper of Your Car;

(c) Your Car is stolen and has notbeen recovered in the 28 daysfollowing written notification to Us,or;

(d) the cost of repairing any damagecovered by this policy is more than60% of Your Car’s current UK listprice (including car tax and VAT) atthe time the damage occurred.

If to Our knowledge Your Car is thesubject of a hire purchase or leasingagreement, any payment for loss of ordamage to Your Car which is not madegood by repair, reinstatement orreplacement, may, at Our discretion, bemade to the owner whose receipt shallbe a full discharge of Our liability.

Should Your Car be uneconomical torepair, and You pay Your premium byinstalments, We will deduct anyoutstanding balance from thesettlement figure.

We will also pay:

1.4 Permanently Fitted Audio-Visual,Satellite Navigation andCommunication Equipment

For permanently fitted audio-visual andcommunication equipment the mostWe will pay for any one claim is £500less the Excess.

1.5 The Company will not be liableunder this Section for:

(a) loss of use of Your Car;

(b) depreciation;

(c) loss caused by deception;

(d) any decrease in the value of YourCar following repair;

(e) any cost, or part of any cost ofrepair, which improves Your Carbeyond its condition before theloss or damage;

(f) wear and tear;

(g) mechanical, electrical, electronic,computer or computer softwarebreakdowns, failures, faults orbreakages;

(h) damage to tyres caused by braking,punctures, cuts or bursts;

(i) the Excess shown on theSchedule;

( j) the Excess shown below whenYour Car is being driven by, or is inthe custody of, a driver under theage of 25 or an InexperiencedDriver. This is in addition to anyother Excess You may have to pay;

(k) any claim under this Section of thepolicy while Your Car is beingdriven by, or is for the purposes of

being driven, in the charge of anyperson under 21 years of age,unless details of such person havebeen notified to, and accepted by,Us prior to the date of loss ordamage;

(l) any claim under this Section of thepolicy resulting from theft, or attempted theft, whilst theignition keys have been left in or onYour Car or if all the doors,windows and other openings havenot been closed and locked;

(m) any amount greater than themaker’s list price in the UnitedKingdom for the supply of anyspare part or accessory or, if YourCar was manufactured outside theUnited Kingdom and importedother than through themanufacturers normal importarrangement any amount greaterthan the cost of the similar sparepart or accessory for theequivalent United Kingdom vehiclemodel. At Our discretion a cashsettlement on this basis may bemade if such part or accessorycannot be obtained;

(n) any loss incurred followingconfiscation, requisition ordestruction of Your Car by, orunder the order of, anyGovernment, Public or LocalAuthority.

2.1 Your Liability

We will insure You against all sums Youare legally liable to pay arising from:

(a) death of or bodily injury to anyperson for an unlimited amount;

(b) damage to property up to£20,000,000;

(c) costs and expenses of up to£5,000,000.

The limits above apply in respect ofany one claim or number of claimscaused by or arising from one incidentinvolving the use of:

(d) Your Car;

(e) any other private car You aredriving which is neither owned norheld by You under a hire purchaseor leasing agreement, (excluding theuse to secure the release of amotor vehicle, which has beenseized by, or on behalf of anygovernment or public authority)provided that:

(i) You have the owner’spermission to drive the car;

(ii) You are not insured under anyother insurance to drive thecar;

(iii) there is a current and validpolicy of insurance in force forthe car in accordance with theRoad Traffic Acts;

(iv) the current Certificate OfMotor Insurance permits Youto drive and use this car;

(v) You still have Your Car and ithas not been declared asuneconomical to repair, orstolen and not recovered.

(f) a trailer attached to Your Car.

2.2 Liability of other persons drivingor using Your Car

On the same basis and limits that Weinsure You under this Section We willalso insure the following persons:

(a) any person allowed by theCertificate Of Motor Insurance todrive Your Car;

(b) any person who is using, but notdriving, Your Car with Yourpermission for social, domestic andpleasure purposes;

(c) any person, at Your request, who istravelling in, or getting into or outof, Your Car;

(d) the employer of the person usingany car insured by this Section forbusiness purposes permitted by thepolicy provided that the car:

(i) is neither the property of, norheld by, the employer under ahire purchase agreement orleasing agreement;

(ii) is being used in accordancewith the terms of theCertificate Of MotorInsurance.

2.3 Legal Personal Representatives

In the event of death of any personinsured by this Section, We will insurethe legal personal representatives ofthe deceased person against anyliability covered by this Section.

2.4 Emergency Treatment Fees

We will pay for Emergency TreatmentFees as required by the Road TrafficActs.

2.5 Legal Costs

In connection with any liability which isinsured by this Section, We will pay:

(a) the fees of any solicitor appointedby Us to represent anyone insuredunder this Section during proceedings in any court ofsummary jurisdiction or at anycoroner’s inquest or fatal accidentinquiry;

(b) the cost of legal services arrangedby Us to defend a charge ofmanslaughter or causing death by dangerous driving;

(c) other costs and expenses incurredwith Our written consent.

2.6 The insurance provided under thisSection will not apply:

(a) to the driver unless that personholds a licence to drive Your car, orhas held, and is not currentlydisqualified from holding or obtaining, such a licence;

(b) to any person who is not drivingYour car, if to the know ledge ofthat person the driver does nothold a licence to drive Your car,unless the driver has held and isnot currently disqualified fromholding or obtaining such a licence;

(c) to any person where the liability isinsured under another policy;

(d) to death of or bodily injury to anyperson arising out of, or in thecourse of, the employment of such person by any person We insureunder this Section, except asrequired by the Road Traffic Acts.

2.7 We shall not be liable for loss of ordamage to:

(a) property belonging to, or in thecustody or control of, any personinsured under this Section;

(b) any car which is insured under thisSection or any other private carYou are driving which is neitherowned nor held by You under ahire purchase or leasing agreement;

(c) any trailer attached to Your Car orattached to any car covered by thispolicy, which Your Certificate OfMotor Insurance permits You todrive, or any property carried in oron such luggage trailer.

2.8 We shall not be liable for anyliability, loss or damage arising directlyor indirectly from acts of terrorism asdefined in the UK Terrorism Act 2000,except where We need to provide theminimum insurance required by theRoad Traffic Acts.

We will pay for the repair orreplacement of damaged or brokenglass in Your car for:

(a) Windscreen;

(b) Side windows;

(c) Rear windows.

Section 3 – Exceptions that apply toWindscreen Cover

We shall not be liable under thisSection for:

(a) the Excess printed in the Schedulefor the replacement or repair ofdamaged or broken glass;

(b) any amount exceeding £100 wherethe repair or replacement is notcarried out by an MMA approvedwindscreen replacement or repairservice;

(c) damage to sunroofs.

You must produce Your Certificate ofMotor Insurance to Our nominatedwindscreen contractor to takeadvantage of these services.

Policy CoverSection 4 – Personal Effects

We will pay You, or if You request, theowner of the property up to £50 forpersonal effects in Your Car if:

(a) lost or damaged due to anaccident;

(b) fire;

(c) theft or attempted theft.

Section 4 – Exceptions that apply toPersonal Effects

We will not pay for:

(a) money, jewellery, furs, documents,securities, tickets or stamps;

(b) goods or samples carried inconnection with any trade orbusiness;

(c) property insured under any otherpolicy;

(d) any property that is left in anyconvertible or open top car whenthe hood or roof opening is notfully closed.

If You or Your spouse suffer accidentalbodily injury as a result of an accidentinvolving Your Car, We will pay £1000if, within 12 months, this injury is thecause of:

(a) death;

(b) the complete and irrecoverable lossof sight of one or both eyes;

(c) the loss by severance, at or abovethe wrist or ankle, of one or morelimbs.

We shall not pay:

(a) more than one of the abovebenefits for any of the injuriesdetailed above;

(b) in any Period Of Insurance, morethan £1000 in respect of any oneperson, or £2000 in total;

(c) any benefit in respect of death orbodily injury to any person bysuicide or attempted suicide;

Payment will be made direct to theinjured person or the legal personalrepresentatives of that person.

Section 5 – Exceptions that apply toPersonal Accident

(d) if the insured person was, at thetime the injury occurred, under theinfluence of drink or drugs or hadmore alcohol in their system thanthe limits set down in the RoadTraffic Acts;

(e) death of or injury to any person notwearing a seat belt when they haveto by law.

You do not need an international MotorInsurance card (green card)

7.1 Compulsory insurance coveroutside the Territorial Limits

Your policy provides the minimumcover You need by law to use Your Carin:

(a) any country which is a member ofthe European Union;

(b) any other country which theCommission of the European Unionapproves as meeting therequirements of Article 7(2) of theEuropean Community Directive onInsurance of Civil Liabilities arisingfrom the use of motor vehicles(no. 72/166 CEE) and which is listedon the reverse of Your Certificateof Insurance.

7.2 Full Policy cover outside theTerritorial Limits

Your policy automatically provides thecover shown on Your Schedule for upto 45 days in any one Period ofInsurance while You are using YourCar in the countries referred to inSection 7 1. above provided that:

(a) Your Car is taxed and registered inthe United Kingdom;

(b) Your Car is normally kept in theUnited Kingdom;

(c) You maintain a permanent home inthe United Kingdom.

If You intend to use Your Car outsidethe Territorial Limits for a period inexcess of 45 days (with a maximum of90 days) You must notify Your Brokerbefore You leave and pay anyadditional premium that is required. Wewill not provide cover for any period inexcess of 90 days.

Your policy provides cover while YourCar is in transit (including loading andunloading) between any countries towhich this policy applies, but any seatransit must be by a scheduled searoute.

We will also pay the foreign customsduty that You must pay as a result ofloss or damage to Your Car insured bythis policy preventing its return to theUK.

7.3 Other charges

We will insure You against generalaverage contribution, salvage and sueand labour charges, arising from thetransportation of Your Car, betweenany countries to which this insuranceapplies.

8.1 In the event of no claim being madeor arising under this policy the premiumfor renewal will be reduced inaccordance with the scale applicable atthe renewal date.

If You make a claim under this policythe No Claims Discount will be reducedin line with the scale applicable atrenewal date. If two or more claims aremade in any one Period Of Insurancethe No Claims Discount will be deletedin full.

Details of the No Claims Discount scaleare available on request.

Any No Claims Discount to which Youare otherwise entitled will not bedisallowed as a result of a claim:

1. solely for repair or replacement ofglass in the windscreen, side or rearwindows of Your Car;

2. under 2.4 of Section 2 (EmergencyTreatment Fees) of this policy;

3. solely for the replacement of keysand locks on your car.

The No Claims Discount is nottransferable to any other person.

8.2 Protected No Claims Discount

If You have paid to protect Your NoClaims Discount and if 3 fault oroutstanding claims are made within any5 consecutive years, the No ClaimDiscount will reduce in accordance toOur step back scale applicable at therenewal date.

If You accept payments as part of acar sharing agreement for social orother similar purposes, these paymentswill not be regarded as payments forhire or reward provided:

(a) Your Car is not designed to carrymore than seven passengers;

(b) the passengers are not beingcarried in the course of a businessof carrying passengers;

(c) the total contributions received forthe journey concerned do notinvolve any profit.

Policy CoverSection 11 – Replacement Keys and Locks

If the keys, lock transmitter or entrycard for a keyless entry system of thecar are lost or stolen, We will pay up to£200 towards the cost of replacing:

(a) all entry locks that can be openedby the missing item;

(b) the lock transmitter, entry card andcentral locking system and

(c) the ignition and steering locks; aslong as We are satisfied that anyperson who may have Your keys,transmitter or card, knows theidentity or garage address of thecar. We will also pay the reasonablecost of protecting the car,transporting it to the nearestrepairers when necessary anddelivering it after repair to Youraddress. A claim under this sectiononly will not affect Your no claimsdiscount.

What is not covered

We will not pay any claim where thekeys, lock transmitter or entry card areeither:

(a) left in or on the car at the time ofthe loss; or

(b) taken without Your permission by amember of Your immediate familyor a person living in Your home.

This policy does not cover

Exception 1 – Use and driving

Any accident, injury, loss, damage orliability while Your Car, or any other carfor which insurance is provided by thispolicy, is being:

(a) used to Your knowledge for anypurpose not permitted by theCertificate Of Motor Insurance;

(b) driven to Your knowledge by anyperson not described in theCertificate Of Motor Insurance;

(c) driven by You unless You hold alicence to drive such vehicle orhave held and are not currentlydisqualified, from holding or obtaining such a licence;

(d) driven with Your consent by anyperson who to Your knowledgedoes not hold a licence to drivesuch a car, unless such person hasheld, and is not currentlydisqualified from holding orobtaining, such a licence;

(e) driven by any person who holds aprovisional licence, unless theycomply with the condition of thatlicence in relation to an accompanying full licence holder;

(f) driven by any person convicted ofdriving while under the influence ofdrink or drugs at the time of theaccident. Our liability will berestricted to meeting Ourobligations as required by the RoadTraffic Act.

Exception 2 – Agreements

Any liability You accept by agreementor contract unless liability would haveapplied in any event.

Exception 3 – War Risks

Any consequence of war, invasion, actof foreign enemy, hostilities (whetherwar is declared or not), civil warrebellion, revolution, insurrection ormilitary or usurped power other than isnecessary to meet the requirements ofthe Road Traffic Acts.

Exception 4 – Earthquake or Riot

Any accident, injury, loss or damagearising from, or in consequence of:

(a) earthquake;

(b) riot or civil commotion other thanin Great Britain, the Isle of Man orthe Channel Islands.

Exception 5 – Nuclear Risks

Loss, damage, accident or liabilityresulting or arising from, or directly orindirectly caused by, or contributed toor arising from:

(a) ionising radiations or contaminationby radioactivity from any nuclearfuel or from any nuclear wastefrom burning nuclear fuel;

(b) the radioactive, toxic, explosive orother hazardous properties of anyexplosive nuclear assembly ornuclear part of such assembly.

Exception 6 – Sonic Booms

Pressure waves caused by aircraft oraerial devices travelling at sonic orsupersonic speeds.

Exception 7 – Airport Risks

Any loss, damage, injury or liability whileYour Car is in, or on, any part of anaerodrome, airport or airfield used:

(a) for the take-off or landing ofaircraft, or for the movement ofaircraft on the surface;

(b) as aircraft parking aprons includingthe associated service roads andground equipment parking areas.

The policy and Schedule shall be readtogether. Where a particular word orexpression has been given a specificmeaning, this meaning or expressionwill apply wherever the word orexpression appears.

1. Claims procedure andrequirements

(a) in the event of any accident, injury,loss or damage, You or Your legalrepresentative must at Your ownexpense:

(i) give Us full details, as soon aspossible, after any event whichcould lead to a claim underthis policy by phoning MMAMotor Care Line on 0844 9022220;

(ii) send to Us any letters ordocuments You receive inconnection with the eventwithout replying to them;

(iii) inform the police of theft ormalicious damage;

(iv) send to Us upon receipt anywrit summons or other legalprocess issued or commencedagainst You;

(v) notify Us of any impendingprosecution, coroners inquestor fatal accident enquiry, or of

the intended issue of any writ,summons or other legalprocess by You or on Yourbehalf;

(vi) supply all estimates,information and assistance asmay be required by Us andOur appointed agents.

(b) We shall be entitled to:

(i) take and keep possession ofYour Car and to deal with thesalvage in a reasonablemanner;

(ii) negotiate, defend or settle inYour name or on Your behalf,any claim made against You;

(iii) prosecute in Your name, forOur benefit, any claim againstany other person in respect ofany amount paid or payable.

(c) You must not:

(i) abandon any property to Us;

(ii) negotiate or repudiate anyclaim without Our writtenconsent.

2. Reasonable precautions

You must take all reasonableprecautions to avoid injury, loss ordamage and maintain Your Car in asafe and roadworthy condition.

3. Changing Your Car

(a) if You change Your Car, We will notbe liable under this policy, exceptas required by the Road TrafficActs, until We have been advised ofthe change. Once You have advisedUs, We will notify You of anychange in Your premium or termsof cover.

(b) the Certificate Of MotorInsurance issued with this policyspecifies Your Car by itsregistration mark. No cover appliesto any additional or replacementcar until a covernote to that effecthas been issued by or on behalf ofThe Company except for courtesycars arranged under the MMAapproved repairer scheme.

4. Cancellation

(a) if You cancel Your policy within 14days of the latter of either:

(i) the inception or renewal date;

(ii) the date from which Youreceive the contractual termsand conditions;

You are entitled to a proportionatereturn of premium less £25 servicecharge. This applies even if You havemade a claim providing it is notdeemed a total loss.

If Your car is declared a total lossfollowing a claim then We will notcontinue to insure it. Any continuationof cover following a total loss claim willbe considered on an alternativereplacement vehicle.

If We have paid for the total loss of thecar, You must pay the full annualpremium and You will not be entitled toany refund.

If You cancel Your policy after 14 days,You will be entitled to a proportionatereturn of the premium less the servicecharge of £25, if no claim has beenmade. If a claim has been made thenYou will not be entitled to any return ofpremium.

The service charge will be applied oncancellation or Your policy.

Cancellation of any direct debitinstruction does not mean You havecancelled Your policy.

In either case, the Certificate of MotorInsurance must be returned to Us inorder to cancel the insurance policytogether with written notification ofYour intention to cancel the policy.

(b) We or any intermediary appointedby Us and acting with Our authoritymay at any time cancel this policyby giving You 7 days notice inwriting, by recorded delivery letter,to Your last known address. Onreturn of the Certificate of MotorInsurance, We will refund that partof Your premium that applied tothe rest of the Policy.

(c) if You pay the premium for thispolicy by Our instalment plan andany of Your monthly instalmentsare not paid by the due date, thebalance outstanding shall becomepayable. We will give You 7 dayswritten notice and if the balanceoutstanding remains unpaid, thepolicy will be cancelled on expiry ofsuch notice and You must returnYour Certificate of MotorInsurance to Us immediately.

5. Information Supplied

We will only provide the coverdescribed in this policy if:

(a) all the terms and conditions of thispolicy so far as they apply havebeen met by You or any oneclaiming under this policy;

(b) the declaration and informationprovided by You, and on which thiscontract is based, is complete and correct as far as You know.

6. Right of Recovery

If the law of any country in which Yourpolicy operates requires Us to settle aclaim which We would not otherwisehave paid, We have the right to recoverthis amount from You or from theperson who incurred the liability.

7. Sharing of Claims

If You are insured by any other policyfor loss or damage which results in avalid claim under this policy, We shallnot be liable to pay more than Ourrateable proportion. Nothing in thiscondition will impose on Us any liabilityfrom which We would have beenrelieved by 2.6 in Exceptions toSection 2.

8. The Motor Insurance Database

It is a condition of the policy that Yousupply such details of the Vehicleswhose use is covered by the policy asrequired by the relevant law applicable inGreat Britain and Northern Ireland forentry to the Motor Insurance Database.

Information relating to Your insurancepolicy will be added to the MotorInsurance Database (“MID”) managed bythe Motor Insurers‘ Bureau (“MIB”). MIDand the data stored on it may be used bycertain statutory and/or authorisedbodies including the Police, the DVLA, theDVLANI, the Insurance Fraud Bureau andother bodies permitted by law forpurposes not limited to but including :

i) electronic licensing;

ii) continuous insurance enforcement;

iii) law enforcement (prevention,detection, apprehension and orprosecution of offenders);

iv) the provision of government servicesand or other services aimed atreducing the level and incidence ofuninsured driving.

If You are involved in a road trafficaccident (either in the UK, the EEA orcertain other territories), insurers and orthe MIB may search the MID to obtainrelevant information.

Persons (including his or her appointedrepresentatives) pursuing a claim inrespect of a road traffic accident(including citizens of other countries)may also obtain relevant informationwhich is held on the MID.

It is vital that the MID holds Your correctregistration number. If it is incorrectlyshown on the MID You are at risk of havingYour vehicle seized by the Police. Youcan check that Your correct registrationnumber details are shown on the MID atwww.askmid.com

9. Fraud

If any fraudulent means includinginflation or exaggeration of any claim orsubmission of forged or falsifieddocuments are used to obtain benefitby You or anyone acting on Yourbehalf, all benefit under the policy shallbe forfeited.

We shall not be liable while Your Car isbeing driven by, or is in the charge of,the person named in the Schedule.

5. Driving Other Cars Excluded

2.1E of Section 2 is deleted.

6. Driving Other Cars Transferred toNamed Person

Cover under 2.1E of Section 2 istransferred to the person specified inthe Schedule.

7. Protected No Claim Discount

If You have paid to protect Your NoClaims Discount and if 3 fault oroutstanding claims are made within any5 consecutive years, the No ClaimDiscount will reduce in accordance toOur step back scale applicable at therenewal date.

8. Master Motorist – ComprehensiveCover

The limit under Section 4 is increasedto £100.

The limit under Section 5 is increasedto £5000/£10000 in total.

The limit under Section 6 is increasedto £200.

1.1 and 1.2 of Section 1 are extended toapply to a luggage trailer owned by You.The amount payable by Us in respectof any claim for loss of, or damage to,the trailer shall not exceed £250.

We will not be liable for:

1. loss of, or damage to, propertybeing conveyed by the trailer;

2. loss or damage occurring while thetrailer is attached to any vehicleother than Your Car.

16. Overnight Location

We will not be liable for the first £500,in addition to any other excesses,under 1.2 of Section 1 of this policy,unless the car is kept overnight asspecified in the Schedule, if within thevicinity of the home address.

17. Compulsory Overnight Location

We will only be liable under 1.2 ofSection 1 of this policy when the carhas been locked in a secure garageovernight, if within the vicinity of thehome address.
