• Remedial measures

(a) Scope of the Act

1. The Bihar Land Reforms Act, 1950

2. The Bihar Tenancy Act, 1885

3. The Bihar Privileged Persons Homestead Tenancy Act, 1947

4. The Bihar Bhoodan Yagna Act, 1954

5. The Bihar Land Reforms (Fixation of Ceiling and Acquisition of

Surplus Land) Act, 1961

6. The Bihar Consolidation of Holdings and Prevention of

Fragmentation Act, 1956

This act has overriding effect over above Acts.3

(b) Activities covered under the Act :-

i. Dispossession of Settlee

ii. Repossession of dispossessed Settlee

iii. Correction of entries made in Revenue Map and RoR(Record of Right)

iv. Dispute of boundary

v. Unauthorized construction

vi. Declaration of the right of a person

vii. Not involving substantive subject of Title

1. Can use power mentioned in CPC 1908 (V of 1908)

a) Evidence on affidavit

b) Issue summons to ensure presence

c) Compulsory presentation of documents

d) Ascertain local enquiry/documents

e) Examination of witnesses

2. Disposal of petition

a) Within 90 days from receipt of the application

b) Issue of Notices to the concerned parties

c) Examination of documents by applicants

1. Proceeding U/S 145 of Cr.P.C. and U/S 144 ofCr.P.C.

i. Report from any source

ii. Disputes related to land, water and boundary

iii. Land or water includes Building, Markets, Fisheries,Crops or other products of land

iv. Evidences to be recorded

v. Forcibly dispossession within two months

vi. No proceeding U/S 145 of Cr.P.C. for joint immovableproperty.

vii. Action is preventive and not punitive.

viii. Proceeding is barred when proceeding is pending inCivil Court. 6

ix. Action U/S 145 of Cr.P.C. are barred during thependancy of proceeding U/S 48E of BT Act, 1885

x. Simultaneous proceeding U/S 107 and U/S 145 ofCr.P.C. is permissible.

xi. Apprehension of breach of peace and dispute ofimmovable property

xii. Proceeding U/S 145 of Cr.P.C. and U/S 107 of Cr.P.C.can be converted into one another.

xiii. Crop and other products on the disputed land can beattached U/S 146 of Cr.P.C., if possession can not bedecided immediately.

1. Proceeding U/S 147 of Cr.P.C.

i. Pass prohibitory order

ii. Proceeding U/S 145 of Cr.P.C. may be converted intoU/S 147 of Cr.P.C.

iii. Within three months from the date of receipt ofpolice report.

iv. Right to worship in Mosque and Temple can beresolved under this section

v. Right to use of land and water of private land V/SGovernment/Common land.

Case Study -1

1. There was a way on the private land, commonly used by farmerssince last 10-12 years to reach their fields. The owner of theland has erected wall just to prevent farmers to use for theirparcels and houses. Other farmers started opposing this actionof owner of the field on which Kachha Road was available foruse. Review of BLDRA Cases:

• Monthly review done by the department in the State level ADM Monthly meeting.

• In each three month DCLR has to report DM for reviewing the BLDRA case progress in the DCLR court for their timely disposal.

• Divisional Commissioner is appellate authority for the BLDRA cases.
