The!intent!of!this!guide!is!to!help!current!and!future!meat!and!poultry!producers!understand!the!federal!

and!state!laws!that!apply!to!their!meat!sales!operations.!!The!guide!was!first!conceived!by!the!Meat!

Processing!Working!Group,!a!group!of!animal!farmers!working!to!expand!meat!processing!options!for!

West!Virginia!animal!farmers.!!The!guide!is!designed!to!answer!farmers’!questions!such!as:!!

Slaughter,!Processing,!and!Marketing!Requirements:!A!General!Overview!!!

This!section!provides!general!information!about!who!regulates!the!slaughter,!processing,!and!marketing!

of!meats!in!West!Virginia;!the!requirements!for!processing!and!marketing!in!order!to!sell!at!various!

marketing!outlets;!and!requirements!for!storage,!labeling,!and!sales.!

KNOWING!YOUR!REGULATORS!!

When!processing!and!marketing!meats,!producers!must!pay!attention!to!regulations!at!three!different!

levels:!!local,!state,!and!federal.!Depending!on!how!a!farmer!is!selling!(or!not!selling)!her!meats,!she!may!

or!may!not!need!to!deal!directly!with!all!three!levels!of!regulation.!For!example,!if!you!are!a!farmer!

processing!poultry!on!the!farm!and!selling!it!at!a!farmers!market!within!West!Virginia,!you!will!probably!

deal!with!county!regulators!(i.e.,!your!local!health!department)!and!occasionally!with!state!regulators!

(the!WV!Department!of!Agriculture),!but!you!may!never!need!to!deal!with!a!federal!regulator.!

!

Generally%speaking,!the!slaughter!(killing)!of!livestock!and!processing!(butchering)!of!meat!is!regulated!

by!United!States!Department!of!Agriculture!(USDA)!guidelines.!All!meat!processing!plants!in!West!

Virginia!are!licensed!and!inspected!as!either!USDA!(federallyHinspected)!plants!or!WV!Department!of!

Agriculture!(stateHinspected)!plants.!!WV!Department!of!Agriculture!plants!are!operated!under!the!same!

guidelines!as!USDA!through!the!Meat!Inspection!Division!of!WVDA,!though!different!rules!and!

restrictions!apply!to!where!meat!can!be!sold,!depending!on!the!type!of!inspection!at!the!slaughter!

and/or!processing!facility.!

Agencies!Involved!at!Each!Level:!

+• Federal:!!The!USDA!Food!Safety!Inspection!Service!(FSIS)!inspects!about!7!slaughterhouses!in!

WV.!!Meat%from!USDA%inspected%plants%CAN%be%sold%across%state%lines.%%++

• State:++The!WVDA!Meat!&!Poultry!Inspection!Division!inspects!12!commercial!slaughterhouses!

and!13!custom!slaughter!operations!in!WV!at!the!time!of!publication,!and!is!also!responsible!for!

regulating!onHfarm!poultry!processing!for!commercial!sale.!!Meats!from!WVDAHlicensed!

commercial!slaughter!and!processing!establishments!can!be!sold!commercially!within%West%Virginia%only,!while!meats!from!WVDAHlicensed!custom!establishments!generally!cannot!be!

offered!for!sale.!!!+

• Local:+Local!Health!Departments!may!regulate!how!you!store!and!sell!your!meat,!and!may!have!

special!requirements!for!those!selling!meat!at!farmers!markets.!+!

If!you!are!uncertain!about!which!regulations!apply!to!you!and!how!to!follow!them,!it!is!a!good!idea!to!

contact!your!regulators!directly.!This!can!help!you!to!avoid!surprises%down!the!road.!The!Meat!&!Poultry!

Inspection!Division!of!the!West!Virginia!Department!of!Agriculture!can!provide!resources!and!answer!

regulatory!questions.!If!you!are!selling!meat,!you!are!also!advised!to!communicate!with!the!local!health!

department!in!any!county!where!you!sell!meat.!Contact!information!for!federal,!state,!and!local!

authorities!are!included!at!the!end!of!this!document.!

In!the!following!sections,!we!give!more!info!on!each!level!of!government!regulation,!the!different!types!

of!slaughterhouse!inspection,!and!when!each!one!might!or!might!not!apply!to!you.!

!

FEDERALLY!REGULATED!SLAUGHTER!&!PROCESSING!!

As!mentioned!previously,!the!U.S.!Department!of!Agriculture!is!one!of!the!two!inspection!agencies!

(along!with!the!WV!Department!of!Agriculture)!from!which!WV!slaughterhouses!can!choose!to!receive!

their!licensing.!A+meat+product+must+be+both+slaughtered+and+processed+in+a+USDAUinspected+facility+in+order+to+be+sold+across+state+lines.++All!USDA!plants!in!West!Virginia!are!categorized!as!"commercial".!!

This!indicates!that!the!entire!process!of!slaughter!and!processing!is!done!under!direct!supervision!and!

inspection!of!a!USDA!meat!inspector.!!This!product!can!be!labeled!and!sold!anywhere!in!the!United!

States.!

!

Generally,!it!is!the!slaughterhouse!owners!and!managers—not!the!farmer—who!deal!directly!with!USDA!

inspectors.!However,!it!is!the!farmer’s!responsibility!to!make!sure!that!USDA!inspected!the!slaughter!

AND!processing!of!any!meat!products!that!he/she!is!selling!across!state!lines.!It!is!important!to!ask!the!

slaughterhouse!you!use!to!verify!that!it!is!a!USDAHinspected!facility,!and!to!ask!if!it!does!all!processing!in!

the!same!facility.!If!it!does!not!do!all!of!its!processing!inHhouse,!ask!who!does!the!processing,!and!find!

out!if!that!processor!is!USDAHinspected.!!!!!

!

Each!slaughterer!and!processor!is!required!to!register!with!USDA!and!receive!an!official!establishment!

number.!!When!you!receive!your!product,!make!sure!it!is!stamped!“Inspected!and!Passed”!and!shows!

the!official!establishment!number!of!the!slaughterer,!if!the!slaughterer!did!the!processing;!of!the!

processor,!if!different!from!the!slaughterer;!or!of!both!the!slaughterer!and!processor.!!USDA!inspection!

marks!look!like!this:!

STATE!–REGULATED!SLAUGHTER,!PROCESSING!&!MARKETING!+Most!slaughterhouses!and!meat!processors!in!West!Virginia!are!not!inspected!by!USDA!but!by!the!West!

Virginia!Department!of!Agriculture!(WVDA).!There!are!two!types!of!stateHinspected!slaughterhouses!and!

meat!processing!facilities:!commercial%and!custom%facilities:!!

• Commercial+meat!slaughter!and/or!processing!facilities!must!have!an!inspector!present!during!

operation,!and!the!inspector!must!inspect!each!animal!slaughtered!or!processed.!!As!with!USDAH

inspected!plants,!meat!processed!in!WVDA!commercial!plants!is!done!under!the!direct!

supervision!and!inspection!of!state!meat!inspectors!and!can!be!labeled!and!sold!–but!only!

within!the!state.!!!

!

• Custom+slaughter!and/or!processing!facilities!are!licensed!by!WVDA!but!do!not!have!an!

inspector!continuously!present!or!animalHbyHanimal!inspection.!!These!facilities!are!licensed!by!

the!state,!are!inspected!(usually!quarterly),!and!must!comply!with!food!safety!standards.!!

Custom!processed!product!cannot!be!labeled!or!sold!and!is!intended!for!the!personal!

consumption!of!the!customer!and!her!or!his!nonHpaying!guests.!!Every!custom!slaughtered!or!

processed!product!must!be!marked!“NOT+FOR+SALE.”!!!!

As!with!USDA!inspected!facilities,!it!is!usually!the!role!of!the!slaughterhouse!

or!processing!plant!manager—not!the!farmer—to!deal!directly!with!WVDA!

inspectors.!!!However,!you!are!responsible!for!making!sure!that!any!meat!

you!sell!was!inspected!and!is!labeled!for!commercial!sale.!!You!can!tell!by!

looking!at!your!finished!product!whether!it!was!slaughtered!and!processed!

in!a!WVDAHlicensed!commercial!facility.!!West%Virginia%inspected%commercial%meats%will%bear%this%stamp,%with%the%establishment%number%of%the%slaughterhouse%or%processor%in%place%of%the%digits%“000.”%%This%stamp%means%that%your%product%is%legal%to%sell%within&West&Virginia.%!

In!addition!to!regulating!slaughter!and!processing!facilities,!the!WV!Department!of!Agriculture!also!

regulates!the!marketing,!labeling,!and!sale!of!meat!products.!This!is!the!area!of!regulation!where!you!

are!most!likely!to!interact!directly!with!the!WV!Department!of!Agriculture.!!

LOCAL!REGULATIONS!ON!MARKETING!!

Local!health!departments!regulate!food!safety!where!food!is!prepared,!sold,!and!stored.!!Local!health!

departments!are!operated!by!the!local!Board!of!Health,!whose!members!are!appointed!by!the!County!

Commission!and!other!officials.!!(Some!areas!of!the!state!have!established!regional!health!departments!

that!include!multiple!counties;!you!can!look!up!details!for!your!area!at!!www.wvdhhr.org/phs/LHD.pdf.)!

Each!local!health!department!is!responsible!for!enforcing!the!health!and!food!safety!regulations!that!are!

required!by!state!and!federal!code.!Local!health!departments!are!antonymous!agencies!that!have!local!

authority!to!determine!enforcement!of!rules!and!code,!but!also!to!impose!some!additional!restrictions!

of!their!own,!within!legal!limits.!State!government!(via!the!WV!Bureau!for!Health)!provides!training,!

technical!assistance,!and!rule/Code!interpretations!to!local!sanitarians,!but!the!state!does!not!have!

direct!authority!over!local!health!departments!

!

It!is!important!to!find!out!if!the!activities!of!your!business!are!subject!to!local!health!department!

regulation.!In!all!likelihood,!you!are.!The!best!and!only!way!to!determine!is!by!calling!your!local!health!

department,!explaining!what!you!sell!and!how!you!sell!it,!and!asking!if!you!need!any!permits.!If!you!are!

selling!at!a!farmers!market,!operating!your!own!retail!site,!or!thinking!about!opening!a!restaurant!or!

concession!stand!to!sell!your!meat,!you!will!definitely!need!to!contact!your!local!health!department.!!For!

example,!to!sell!at!a!farmers!market,!you!will!probably!be!asked!to!purchase!a!Retail+Food+Permit.!This!permit!is!required!of!all!farmers!market!vendors!who!sell!potentially!hazardous!foods!like!meats,!dairy,!

and!eggs.!!Permits!generally!require!an!annual!fee,!which!includes!routine!inspections.!Permit!fees!may!

vary!from!county!to!county.!!Some!local!health!departments!have!additional!requirements,!such!as!a!

Food!Handlers!Card!or!Serve!Safe!Certificate,!which!is!why!it!is!important!to!ask!your!local!health!

department!about!requirements!before+you!start!selling!your!meat!products.!!

!

If!you!are!selling!at!farmers!markets!in!more!than!one!county,!you!should!expect!to!have!a!relationship!

with!the!local!health!department!in!each!county!where!you!are!selling.!Each!local!health!department!

may!interpret!the!Food!Code!differently,!and!you!will!probably!be!required!to!purchase!a!separate!Retail!

Food!Permit!in!every!county!where!you!sell.!Again,!this!is!because!each!local!health!department!is!an!

independent!agency!that!can!require!permits!of!anyone!who!is!selling!food!in!its!jurisdiction.!!!

If!you!are!doing!any!slaughter!or!meat!processing!on!the!farm,!and!especially!if!you!are!constructing!a!

facility!to!do!so,!you!will!need!to!consult!with!your!local!health!department!regarding!approved!

wastewater!disposal!methods.!Also,!be!aware!that!some!counties!have!zoning!regulations!that!affect!

where!a!meat!processing!facility!can!be!built.!!Contact!your!local!planning!authority!or!county!

commission.!
