Dear Fellow Conservative,
The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the Florida Legislature. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).
Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress.
The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in 2010. With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”
It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES
ACU researched and selected a range of bills before the Florida Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Florida’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 436 Religious Freedom. This bill prohibits a school district from discriminating against students, parents or school personnel on the basis of religion and prohibits penalties for a student’s religious expression in coursework or artwork. ACU supports the constitutional rights of students and others to practice freedom of speech and the right to practice their religion and supported this bill. The Senate passed the bill on March 23, 2017 by a vote of 23-13.
2. HB 221 Ridesharing Regulations. This bill supersedes municipal ridesharing regulations, and establishes a uniform regulatory framework to authorize ridesharing services to operate across the state of Florida. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation's Family Prosperity Index. ACU supports increased competition in ridesharing services and supported this bill. The Senate passed the bill on April 19, 2017 by a vote of 36-1.
3. HB 849 Concealed Carry. This bill creates an exception to the statewide ban on guns in schools by allowing the concealed carry of a firearm on the grounds of private schools that have a religious institution on the property. ACU supports the founder’s belief in the Second Amendment and supported this bill. The Senate passed the bill on April 26, 2017 by a vote of 22-13.
4. HB 21 Tax Limitation. This bill proposes a constitutional amendment that ensures that property tax assessments on non-homestead/secondary homes are capped at 10 percent. ACU supports restrictions on tax increases and supported this bill. The Senate passed the bill on April 26, 2017 by a vote of 35-0.
5. SB 616 Concealed Carry Regulations. This bill expands the rights of an individual with a concealed carry permit to temporarily store a weapon with courthouse security when entering a courthouse and retrieve the weapon when leaving the courthouse. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on April 28, 2017 by a vote of 19-15.
6. HB 599 Government Contractor Regulations. This bill prohibits local governments from setting wage or benefit requirements for employees of government contractors, controlling their staffing, or forcing them to hire or train workers from a single source. ACU opposes wage and benefit mandates that drive up the cost of government projects for taxpayers and supported this bill. The Senate passed the bill on April 28, 2017 by a vote of 20-17.
7. HB 7047 Occupational Licensing. This bill eliminates or greatly reduces the training and education requirements for occupational licensing in a number of occupations, including hair-braiders, barbers, manicurists and boxing timekeepers. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation's Family Prosperity Index. ACU opposes the proliferation of licensing requirements that are primarily designed to restrict competition and supported this bill. The Senate passed the bill on May 3, 2017 by a vote of 36-0.
8. HB 15 School Choice. This bill expands access and eligibility to school choice programs, including the Florida Tax Credit Scholarship that benefits lower income families and the Gardiner Scholarship Program that benefits special needs children. Educational attainment is an important cultural value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation's Family Prosperity Index. ACU supports the expansion of school choice and supported this bill. The Senate passed the bill on May 5, 2017 by a vote of 27-11.
9. HB 775 Motor Vehicle Manufacturer Mandate. This bill results in higher consumer costs by interfering in contract agreements between vehicle manufacturers and dealers, and forcing manufacturers to pay for warranty repairs that are recommended by dealers. ACU opposes government interference in the right for businesses to contract with one another, which ultimately raises the cost to purchase a new vehicle, and opposed this bill. The Senate passed the bill on May 5, 2017 by a vote of 36-0.
10. SB 106 Alcoholic Beverage Sales. This bill eliminates the requirement for a “wall of separation” between grocery stores and their attached-but-separate liquor stores. ACU opposes flagrant government overreach that infringes upon the rights of businesses and supported this bill. The Senate passed the bill on March, 23 2017 by a vote of 21-17, but was later vetoed by the Governor.
11. SB 128 Expands Legal Defense for Use of Lethal Force. This bill clarifies the “Stand Your Ground” law so that, during pre-trial hearings, prosecutors bear the burden of proof and must disprove defendants' claims of self-defense through "clear and convincing evidence" once that claim has been made. ACU supports strong self-defense laws and supported this bill. The Senate passed the bill on May 5, 2017 by a vote of 22-14.

12. HB 7109 Tax Relief. This bill makes a 0.2 percent reduction in the tax on business in 2018 while also initiating special sales tax “holidays” for school supplies and disaster preparedness items. Reducing tax burdens increases economic growth, which increases family prosperity, as illustrated by the ACU Foundation's Family Prosperity Index. ACU supports major reductions in the business rent tax as Florida is the only state in the nation with such a tax and supported this bill as a step in the right direction. The Senate passed the bill on May 8, 2017 by a vote of 34-4.
13. SB 7022 Pension Reform. This bill makes comprehensive reforms to the state "employee benefit plan" that limit future taxpayer liability. Among other provisions, future state employees will be enrolled in a "defined contribution", 401k-style pension plan, instead of a traditional government defined benefit plan. ACU supports pension reform to avoid massive liabilities for future generations of taxpayers that we see in many states and supported this bill. The Senate passed the bill on May 8, 2017 by a vote of 24-13.
14. HB 5501 Government Accountability. This bill requires an audit of the Florida Tourism Industry Marketing Corporation by the Department of Revenue and Auditor General and requires the audits be shared with the governor and the legislature. ACU opposes taxpayer-funded promotion programs for certain businesses that include million-dollar music videos that should be funded by the businesses they benefit and supported this bill as a first step in reigning in these programs. The Senate passed the bill on May 8, 2017 by a vote of 29-8.
15. HB 7069 Fair Competition Between Public and Charter Schools. This comprehensive education bill creates a Schools of Excellence Program, makes charter schools eligible for government capital improvement funds, and encourages charter schools to be set up in and compete with areas with low performing schools among other provisions. Educational attainment is an important cultural value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation's Family Prosperity Index. ACU supports strengthening and expanding school choice and supported this bill. The Senate passed the bill on May 8, 2017 by a vote of 20-18.

1. HB 21 Tax Limitation. This bill proposes a constitutional amendment that ensures that property tax assessments on non-homestead/secondary homes are capped at 10 percent. ACU supports restrictions on tax increases and supported this bill. The House passed this bill on March 23, 2017 by a vote of 110-3.
2. HB 77 Land for Sports Stadiums. This bill requires professional sports franchises to purchase rather than lease government land at market value for the purpose of stadium construction. ACU supports limiting the amount of land owned by the government and supported this bill. The House passed the bill on March 30, 2017 by a vote of 82-33.
3. HB 479 Government Transparency. This bill requires the results of "government entity audits" (e.g. departments and authorities) be reported to the legislature, requires auditors to determine that municipality financial reports match financial statements, and requires local governments to post their proposed budgets online, among other provisions. ACU supports increased government transparency and taxpayer accountability and supported this bill. The House passed the bill on March 30, 2017 by a vote of 91-23.
4. HB 11 De-Certification of Labor Unions. This bill automatically decertifies a labor union if they fail to collect dues from over 50% of the employees they represent and requires them to be certified through a new election. ACU supports common-sense labor law reform and supported this bill. The House passed the bill on March 30, 2017 by a vote of 75-41.
5. HB 221 Ridesharing Regulations. ACU supports strong self-defense laws and supported this bill. The House passed the bill on April 5, 2017 by a vote of 74-39.
7. HB 849 Concealed Carry. This bill creates an exception to the statewide ban on guns in schools by allowing the concealed carry of a firearm on the grounds of private schools that have a religious institution on the property. ACU supports the founder’s belief in the Second Amendment and supported this bill. The House passed the bill on April 5, 2017 by a vote of 76-35.
8. HB 23 Welfare Work Requirements. This bill requires the state Department of Economic Opportunity and the Department of Children and Families to develop a plan to "restore work requirements" for able-bodied adults who receive welfare assistance (these requirements were dramatically weakened by the Obama administration). Under the bill, individuals will have to work at least 30 hours or attend job training or educational programs in order to receive government assistance. Families and the economy do better when people are employed, benefiting from the dignity of work, as illustrated by the ACU Foundation's Family Prosperity Index. ACU believes that all welfare programs should be designed to help people become self-sufficient rather than creating greater dependency and supported this bill. The House passed the bill on April 19, 2017 by a vote of 82-38.
9. HB 7 Certificates of Need for Hospitals. This bill eliminates a state requirement that hospitals get approval from the government before they can build additional facilities or add programs. ACU opposes "certificates of need" that are primarily designed to restrict competition and drive up the cost of health care and supported this bill. The House passed the bill on April 19, 2017 by a vote of 75-42.
10. HB 599 Government Contractor Regulations. This bill prohibits local governments from setting wage or benefit requirements for employees of government contractors, controlling their staffing, or forcing them to hire or train workers from a single source. ACU opposes wage and benefit mandates that drive up the cost of government projects for taxpayers and supported this bill. The House passed the bill on April 19, 2017 by a vote of 77-40.
11. SB 106 Alcoholic Beverage Sales. This bill eliminates the requirement for a “wall of separation” between grocery stores and their attached-but-separate liquor stores. ACU opposes flagrant government overreach that infringes upon the rights of businesses and supported this bill. The House passed the bill on April 26, 2017 by a vote of 58-57, but was later vetoed by the Governor.

12. HB 7047 Occupational Licensing. This bill eliminates or greatly reduces the training and education requirements for occupational licensing in a number of occupations, including hair-braiders, barbers, manicurists and boxing timekeepers. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation's Family Prosperity Index. ACU opposes the proliferation of licensing requirements that are primarily designed to restrict competition and supported this bill. The House passed the bill on April 26, 2017 by a vote of 86-30.
13. HB 139 Tax Increase Ballot Initiative. This bill requires local governments to gain approval of sales tax surcharges through approval of 60% of voters in a referendum. ACU supports measures that make it more difficult for government to raise taxes and supported this bill. The House passed the bill on April 26, 2017 by a vote of 93-23.
14. HB 775 Motor Vehicle Manufacturer Mandate. This bill results in higher consumer costs by interfering in contract agreements between vehicle manufacturers and dealers, and forcing manufacturers to pay for warranty repairs that are recommended by dealers. ACU opposes government interference in the right for businesses to contract with one another, which ultimately raises the cost to purchase a new vehicle, and opposed this bill. The House passed the bill on April 28, 2017 by a vote of 116-0.
15. HB 697 Sanctuary Cities. This bill requires state and local government agencies to comply with federal immigration law and creates penalties for communities and elected officials who refuse to comply. ACU supports the enforcement of federal immigration laws and supported this bill. The House passed the bill on April 28, 2017 by a vote of 76-41.
16. SB 436 Religious Freedom. This bill prohibits a school district from discriminating against students, parents or school personnel on the basis of religion and prohibits penalties for a student’s religious expression in coursework or artwork. ACU supports the constitutional rights of students and others to practice freedom of speech and the right to practice their religion and supported this bill. The House passed the bill on May 5, 2017 by a vote of 103-12.
17. HB 15 School Choice. This bill expands access and eligibility to school choice programs, including the Florida Tax Credit Scholarship that benefits lower income families and the Gardiner Scholarship Program that benefits special needs children. Educational attainment is an important cultural value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation's Family Prosperity Index. ACU supports the expansion of school choice and supported this bill. The House passed the bill on May 5, 2017 by a vote of 101-11.
18. HB 7109 Tax Relief. This bill makes a 0.2 percent reduction in the tax on business in 2018 while also initiating special sales tax “holidays” for school supplies and disaster preparedness items. Reducing tax burdens increases economic growth, which increases family prosperity, as illustrated by the ACU Foundation's Family Prosperity Index. ACU supports major reductions in the business rent tax as Florida is the only state in the nation with such a tax and supported this bill as a step in the right direction. The House passed the bill on May 8, 2017 by a vote of 109-3.
19. HB 5501 Government Accountability. This bill requires an audit of the Florida Tourism Industry Marketing Corporation by the Department of Revenue and Auditor General and requires the audits be shared with the governor and the legislature. ACU opposes taxpayer-funded promotion programs for certain businesses that include million-dollar music videos that should be funded by the businesses they benefit and supported this bill as a first step in reigning in these programs. The House passed the bill on May 8, 2017 by a vote of 74-34 but it was vetoed by the governor.
20. HB 7069 Fair Competition Between Public and Charter Schools. This comprehensive education bill creates a Schools of Excellence Program, makes charter schools eligible for government capital improvement funds, and encourages charter schools to be set up in and compete with areas with low performing schools among other provisions. Educational attainment is an important cultural value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation's Family Prosperity Index. ACU supports strengthening and expanding school choice and supported this bill. The House passed the bill on May 8, 2017 by a vote of 73-36.
21. SB 7022 Pension Reform. This bill makes comprehensive reforms to the state "employee benefit plan" that limit future taxpayer liability. Among other provisions, future state employees will be enrolled in a "defined contribution", 401k-style pension plan, instead of a traditional government defined benefit plan. ACU supports pension reform to avoid massive liabilities for future generations of taxpayers that we see in many states and supported this bill. The House passed the bill on May 8, 2017 by a vote of 72-37.
