Prospective BIDDERs may collect the Tender Documents from the NIAB or download the Tender Documents from website: www.niab.org.in
1. The tender documents are in two-bid system (Technical and Commercial/Financial).
2. The technical bid will be opened on 21/05/2013 AT 3.00 PM in the presence of vendors or their authorized representatives.
3. Financial bids shall be opened only in respect of eligible tenderers on 22/05/2013 AT 2.00 PM

Instructions
Eligibility Criteria of Intending bidders:
(Proof/supporting documents to be enclosed for the points mentioned below:
1. The firm should be having PAN (Permanent Account Number) allotted by the IncomeTax Department; document proof of the same has to be enclosed.
2. The firm/Agency should be regular member of the “Good offices committee” Government
of India, of the Federation of Publishers & Book sellers Association of India or any other
national association of book sellers and proof to this effect has to be enclosed.
3 Enclose a list of agencies (Government/Statutory bodies/Professional, educational institutions/State /central universities) along with annual sales turnover for the last three years. .
4. Any book suppliers found blacklisted by any government of India/state institutions/universities/autonomous institutions during the last five years would not be eligible for empanelment. An undertaking in respect of this has to be enclosed that the book supplier are not blacklisted by any government institutions in the last (five) years as annexure with tender for supply of books.
5. The period of contract would be for one year from the date of award of contract and it may be further extended for another one year on the satisfactory performance of supplier.
Note: “Technical Bid and Financial bid” in the prescribed proforma along with Terms and Conditions duly signed and dated with office seal should be quoted separately and placed in separate sealed envelopes superscripted accordingly in bold letters, both these envelopes be enclosed in a BIG envelope.
Terms and Conditions for Supply of Books 1. Bill: The pre-prescribed bills should be quadruplicate drawn in the name of NIAB The original Bill(s)
should be duly stamped . The bill should also contain the order number and date. The body of the bill should the following certificates:
a. The books supplied are latest edition and original publication by the publisher and are not
remainder titles.
b. Correct prices as per Publisher Catalogue has been charged
c. Conversion rates have been charged as per Good Offices Committee rates.
2. The bill must contain the item number of the order against the title supplied. 3. Delivery: The supplier has to execute all the supplies within stipulated time period of 30 days from the
issue of this order. However, it may please be noted that at times the supplies will be required to deliver the books against instant orders.
4. Right Reserved by the Institute: The institute reserves the right to accept or reject any tender or part
thereof without assigning any reasons and shall also be subject to the availability of budget.
5. If more time is required for supply of ordered title(s), the supplier has to inform to the undersigned office timely. If no communication is received from the vendor, then he supply order will automatically stand cancelled after stipulated time.
6. Books should be delivered at NIAB premises. Transportation, postal and any other charges, if any, will
be borne by the supplier. Supplier should preferably make the delivery by registered post/courier service or through messenger.
7. Books must be in good condition. Mutilated, soiled books if supplied have to be replaced without charging any extra cost.
8. Damaged books, books with missing pages shall have to be accepted back by the supplier even after they have been stamped for accessioning.
9. The supplier shall have to furnish the price proof of the books along with a latest GOC copy. In case of any price manipulation detected at any stage, the supplier shall be responsible for the same and the excess amount charged shall be refunded to the Institute in one installment.
10. The supplier should be able to display the listed books from all leading National/International publishers/Government/World Bank/IMF/ILO/UNO and other agencies/Public agencies along with their latest catalogue, once in a month. If the supplier is not able to display the latest books as mentioned in the Para, the contract will be terminated.

12. Packing: The packing list giving full particulars of the books must be kept in packing list. The particulars of the order number and date should also be there.
13. Payment: Payment will be made in Indian rupees only through account payee cheque within reasonable time i.e. 30 days from the receipt of the consignment, if the books are in good condition and there are no discrepancies of any nature.
14. Sub-letting of the Contract: The successful applicants shall be responsible for full execution of the contract and shall not in any case assign or sublet ordered books or part thereof to any other party which will otherwise attract penalty of 10 per cent of the total value of the order and even debarring and black listing of the successful applicants.
15. Undertakings: The supplier has to give undertaking that the books supplied are of latest edition and original books published by the publisher.
16. Penalties: In the event of the supplier failing, declining, neglecting or delaying the supply or in the event of any damage occurring or being caused by supplier, the Institute shall without prejudice to any other party remedy available to it under the law for the time being in force in the AP state.
a. Terminate the supply order after 15days notice, and or b. Recover the amount of loss caused by the damage, failure or default (including the consequential
damage). c. Impose a penalty up to 10% of the total value of the order . d. The delay in the supply and imposition of penalty shall be subject to “Force Majeure” and
“Arbitration” clauses of the contract.
17. Penalty Clause: Supply forms the crucial part of the order and therefore, if the supply is not completed in the stipulated time as prescribed in this document or supplier fails to deliver the goods within the delivery schedule as agreed upon; a sum equivalent to 2.5% (two and half per cent) of the Contract Value of each week of delay or part thereof until subject to maximum deduction of 10% (ten per cent) of the contract value. Once the maximum is reached, termination of the contract may be considered.
18. The institute reserves the right to accept or reject any tender fully or partly at any time prior to the
award of the contract.
Other Terms and Conditions:
1 All books supplied should be as per bibliographic specification supplied, if the books are not found
satisfactory, the same will be sent back and the expenditure will be borne by the supplier. 2. The institute has right to accept or refuse the supply in parts or full or cancel the order without assigning
any reason. 3. Contract can be terminated at any time in case the services are not found satisfactory. 4. The publications, which cannot be supplied at our approved rates and terms, should be referred to us
for our approval for the higher rates otherwise the books will be accepted at our approved rates. 5. Please note that Indian Edition of books available in the market should be supplied even if foreign
edition is mentioned in our order unless otherwise specified. 6. Net payable price will be the publisher‟s price minus discount offered. 7. In the case of foreign publications, the original prices in the foreign currently shall be mentioned in the
bill along with the prices in rupees charged in accordance with the approved rate of exchange. 8. No banned book(s) should be supplied and if any such book is supplied it would be forfeited. 9. The supplier undertakes to refund the amount if charges in excess than the prices of books. 10. Only one copy should be supplied unless stated otherwise. 11. In case you are unable to meet 70% supply of our ordered books you cease to have preference for
future order. 12. Books reviewed in Times Literary Supplement, Biblio, The book Review, The Economic & Political
Weekly and other prominent Social Sciences/Humanities periodicals are to be supplied on approval basis.
13. Transit Insurance will be borne by supplier till the supply reaches the destinations. 14. Any legal disputes that may arise out of the contract shall be subject to the jurisdiction of a court in
Kokrajhar, Assam, India.
I agree to all the terms and conditions mentioned in the tender document of the Institute.
IMPORTANT NOTICE
Tenderers responding to this enquiry shall be deemed to be agreeable to the terms and conditions herein contained. These terms and conditions shall be binding on the successful tenderer. Conditional tenders are liable to be rejected. The institute will process the tender as per the NIAB standard procedures. The Institute reserves the right to reject any or all or part of tender without assigning any reason and shall also not to be bound to given any clarifications to the agencies whose bids are rejected.
