AGREED ABATEMENT ORDERPREMONT ISD

The Texas Education Agency (“Agency”) and Premont Independent School District (“Premont

ISD”) (collectively “Parties”) agree as ollo!s"

(#) $n %ovem&er #' *#+ the ,ommissioner o Education (“,ommissioner”) assignedPremont ISD an accreditation status o %ot Accredited-.evo/ed and ordered Premont

ISD to &e closed eective 0uly # *#12

() Premont ISD re3uested an inormal revie! o the ,ommissioner4s proposed order as

permitted &y #5 Texas Administrative ,ode (TA,) 6#+'2##72

(7) The inormal revie! !as conducted &eore the ,ommissioner on Decem&er *#+2

(8) The ,ommissioner has not issued a inal decision in response to the Decem&er *#+

inormal revie!2

(+) At this time the Parties agree that it !ould &e appropriate to a&ate the inormal revie!

process until preliminary academic and inancial accounta&ility ratings are released &y

the Agency2

(1) Premont agrees that a management team !ill &e appointed eective immediately to the

district2 The role o the management team !ill include &ut is not limited to !or/ing !ith

the &oard o trustees to"

• $versee the inancial management and governance o the district to ensure the

district complies !ith state and ederal la!9

• Attend &oard meetings including executive session9 and

•

Direct the &oard to conduct a superintendent search and hire a permanentsuperintendent2 The management team must approve o any candidateidentiied as the inalist prior to extending an oer o employment to thecandidate2

(') Premont ISD agrees that in the event the district does not comply !ith directives issued

&y the management team or in the event the district receives a preliminary *#1

academic accounta&ility rating o Improvement .e3uired or a preliminary *#+-*#1

inancial accounta&ility rating o Su&standard Achievement the ,ommissioner !ill

appoint a &oard o managers to the district to exercise all o the po!ers and duties

assigned to a &oard o trustees o a school district &y la! rule or regulation2 The &oard

o managers !ill govern in the same manner as a &oard o trustees2a2 The po!ers and duties o the &oard o trustees o the district are suspended or

the period o the appointment2&2 The ,ommissioner !ill name the mem&ers o the &oard o managers in uture

correspondence2c2 The ,ommissioner !ill also appoint a superintendent during the term o the

&oard o managers2

(:) Premont ISD agrees that the ,ommissioner4s decision !ith respect to an appointment o

a &oard o managers !ill &e inal and not appeala&le2

(5) Premont ISD agrees that in the event it receives a inal *#1 academic accounta&ility

rating o Improvement .e3uired or a inal *#+-*#1 inancial accounta&ility rating o

Su&standard Achievement the ,ommissioner !ill assign an accreditation status o %ot Accredited-.evo/ed to Premont ISD and order its closure2 I Premont ISD receives

accepta&le academic and inancial accounta&ility ratings the ,ommissioner !ill re-

evaluate the *#+-*#1 accreditation status and notiy the district at a later date

regarding the status assignment2

(#*) Premont agrees that it !ill continue its relationship !ith Texas A;< =niversity->ingsville

and demonstrate as reported &y the university an accepta&le level o cooperation !ith

the o&?ectives and plans recommended &y the university2

(##) Premont ISD agrees that the ,ommissioner4s decision !ith respect to the inormal

revie! !ill &e inal and not appeala&le2 Premont ISD !aives its right under Section

752#+ o the Texas Education ,ode to challenge the ,ommissioner4s decision &eore

the State $ice o Administrative @earings2

(#) Premont ISD understands that the Agency may ta/e action at any time to determine

!hether Premont ISD has complied !ith this agreement identiy additional compliance

issues address threats to the health saety and !elare o Premont ISD4s students

implement availa&le sanctions and interventions and other!ise ensure compliance !ith

Texas la!2

(#7) Premont ISD urther understands that"a2 the ,ommissioner may in his sole discretion determine !hether Premont ISD4s

perormance under this agreement is accepta&le2&2 the ,ommissioner may in his sole discretion assign any accreditation status to

Premont ISD including a “%ot Accredited-.evo/ed” status &ased in !hole or in

part on his evaluation o Premont ISD4s perormance under this agreement9c2 Premont ISD4s compliance !ith this agreement in !hole or in part does not

prevent the ,ommissioner rom ta/ing any action authoried &y la! at any time9

andd2 the ,ommissioner is the ultimate decision ma/er !ith respect to Premont ISD4s

accreditation status and closure2
