The project activity that will lead to people being moved is the construction, extension and repair of the highway, together with the construction of associated building works, such as drainage systems, bridges, intersections and similar constructions. A right of highway is necessary to use the latter, and as this is intruded upon, it involves these inhabitants being moved.

Although the stretch of the segments that have most been affected has been modified, in reducing the number of people to be moved, two significant sites remain to be re-settled: Rositter and Manolos.

At the site identified as Rositter, its people mostly live in extreme poverty, only enjoying the basic services of drinking water, electrical energy and public transport. Hence, they do not have schools, churches, health clinics, markets and banks. The Ministry of Housing and Human Settlement (MIHAS) and the Housing Mortgage Bank (BANMHO), have identified two possible relocation sites. One is a residential estate at Desamparados and the other at Alajuelita. Both of these cantons belong to the province of San José, which form part of the metropolitan-urban center, and since they are residential estates, it is implied that they have the basic services such as: drinking water and electrical energy.

The policies that govern entities such as MIHAS, BANMHO and MSAI are also included. These institutions were crated by the State in order to solve the country’s needs in the planning, housing and re-settlement sector, For further information concerning the goals, polices, procedures, processes, etc. Of these institutions, please visit the following web sites:

No legal vacuum was found between this legislation and banking policy. The rules sets out the state’s interest [and the adaptation to the law) in improving or at least equaling the site re-settlement conditions in contrast to those that are currently occupied. The people moved in this way furthermore have legal resources to object to the re-settlement or to the site of the new location. 4- Census and socio-economic review of the assets, families and/or business affected → Table 1. In general terms, the impact on the populations affected are considered to be favorable, since most of those affected live in informal housing conditions (on sufferance and in slums), intruding on the right of highway, and they totally or partially lack public services.

In most cases, of not all of them, the re-settlement is not involuntary. It is clear that there will be benefits to their living conditions, sine they are being given a property and a house with access to all of the necessary basic services. 6. Proposal to assist the re-settled families

The re-settlement alternatives that the Grantor Authority is handling are as follows:

6.1. Full Vouchers: the families affected are awarded a property [lot] and a dwelling. 6.2. Full Vouchers with Credit: the lot and the dwelling are awarded under a credit modality, that is to say, that they have to pay a sum agreed for the assets awarded.

6.3. Re-location of elderly adults into permanent accommodation (Such as senior citizens residences). 6.4. Alternative homes for people with disabilities 6.5- Financial help for those people that do not qualify for the voucher (through the MSAI or similar institutions) 6.6. Compensation paid through the Trust Fund, when the case so merits this.

Most of the people who are to be re-located do not earn income arising from their locations. The people and the families who qualify for the re-settlement and for the voucher will receive help in the form of a voucher for the housing, and will be located in residential estates with basic services..

Special attention will be paid to senior citizens or the disabled or those who

need special help in moving their furniture. The State has legislation to assist such people.

As far as the basic services are concerned, the re-settlement sites will have all of the following: drinking water, electricity, public transport, municipal services, amongst others. Re-settlement by means of a housing voucher will be done in areas that make it possible to have access to these services..

We do not have a description of the social network. As far as possible, the re-

settlements will be carried out in groups, that already exist, in such a way that the same people will be in close contact with each other, if they want to be.

It is not expected that the “host” groups are going to find themselves negatively affected by the arrival of their new neighbors. This is because these people come from similar social classes and are located in recently-built residential centers, where no feelings of appropriation or territoriality are assumed and where new families often arrive.. → Table 5. The project owner is the Ministry of Public Works and Transport (MOPWT),

through the National Concession Council (NCC), which in turn undertakes the Re-settlement Scheme through the Ministry of Housing and Human Settlements (MIHAS), the Mortgage Housing Bank (BANMHO) and the Mixed Social Assistance Institute (MSAI).

In this regard it should be stressed that these institutions were created by law

in order to solve the planning and housing development problem. The are covered in the laws, decrees and guidelines concerning slum clearances, expropriations and re-settlements.

The polices end procedures of the bodies responsible for consolidating the

undertaking of the Plan are attached. 8. Source of the budget and evaluation of costs

In the first instance, the matters involved in the studies, preliminary census and evaluation of the possible affectations are carried out using the Expropriation and Compensation Trust Fund established in the Contract of Concession on the instructions of the project management. The institutions involved included the entries for financing within their budgets that made it possible to specify the studies and the definition of the candidates for relocation, until they are fully re-settled and re-established.

Table No. 6, the Re-settlement Organizational Chart, sets out the costs

The responsible body is the Grantor Administrator being run by the Project Management.

The monitoring of the setting underway of the Plan will be carried out by the

same entity through the Project Management, the supervisory body and the institutions involved which will continue with their particular polices for overseeing their re-settlement programs. 11. Evaluation

This work will be carried out within the deadlines that are set in the bank policies. In these cases, the ability of the families to become re-established in their new settings and their everyday lifestyle will be monitored. If this is not the case for some or all of the people moved, future assistance will be provided by the Mixed Social Assistance Institute (MSAI).
