I am a former Arise CSP and PF. I wanted you all to know about a lawsuit a number of CSPs have filed against Arise for wage violations. We believe that Arise has misclassified us as independent contractors when we are really its employees. Arise supervises our every movement, but then calls us independent contractors and charges us for all sorts of things that employees shouldn’t have to pay for. For example, as employees, we shouldn’t have to pay for our own training – and we should get paid for training. We shouldn’t have to pay for our own equipment. And we shouldn’t have to do work without getting paid for it, like spending hours waiting on customer calls with no pay.We filed the case as a class action lawsuit against Arise on behalf of all CSPs. (In California, a similar case settled and Arise paid back more than $1 million to the CSPs.) Because of an arbitration clause that Arise made us sign, the court in our case said that any Arise CSP who wants to challenge these wage violations has to bring a separate case in arbitration. The law firm Lichten & Liss-Riordan (a nationally recognized wage & hour employment law firm) is representing me and others in individual arbitration claims against Arise. I encourage you to bring this claim against Arise. Arise is counting on most CSPs not doing anything to challenge its wage violations. But, remember, there is a strength in our numbers.
