1.' The delezations representing the Aeronautical Authorities of the Republic "_~f India and the Ki~lgdom of Saudi Arabia met in Jeddah on 23 January, 2008 for the purpose of reviewing the air services matters; The negotiations were conducted in a friendly and cordial atmosphere. A list of the members of the two delegations is given at Appendix 'A'. 2. Both delegations agreed as follows> To amend Para (1) of Article III of the Air Services Agreement (ASA) to read as follows: . "Each Contracting Party shall have the right to designate in writing to the other Contracting Party one or more airlines for the purpose of operating the agreed services in accordance with the Route Schedule", The new provision for multiple designation shall enter into force in accordance with Article XV of the ASA. The two delegations shall urge their respective competent authorities for the ratifications. (li) Capacity Entitlements: The designated airlines of each Contracting Party shall be entitled to operate a total of 20,000 seats per week in each direction with any aircraft type to/from the points specified in their respective Route Schedule, subject to a limitation of 75 frequencies per week. (iii) Route Schedu.le: Bangalore, Calicut and Lucknow shall be granted as additional points of call for the designated airlines of Saudi Arabia, and Medinah shall be granted as an additional point of call for the designated airlines of India. Accordingly, a revised Route Schedule was drawn up which is given at Appendix 'B).

2. Both delegations agreed as follows>

To amend Para (1) of Article III of the Air Services Agreement(ASA) to read as follows: .

"Each Contracting Party shall have the right to designate in writingto the other Contracting Party one or more airlines for the purposeof operating the agreed services in accordance with the RouteSchedule",

The new provision for multiple designation shall enter into force inaccordance with Article XV of the ASA. The two delegations shallurge their respective competent authorities for the ratifications.

The delegation of Saudi Arabia confirmed that the capacityoperated by the designated airlines of India to / from Dammamshall be covered by the open sky policy declared by theGovernment of Saudi Arabia and shall not be counted against thecapacity entitlements available to them under this Memorandum ofUnderstanding.

The designated airlines of Saudi Arabia and India shall be entitledto operate any number of all-cargo services between each other'sterritory with any type of aircraft with full 3rd and 4th freedomtraffic rights.

(vi) Review of Air Services Agr.eement

In the wake of developments which have taken place in theaviation industry during the past few years, the existing AirServices Agreement between the two countries needs to be updatedand modernized. The Indian side handed over a copy of the draftof the Air Services Agreement (Appendix 'C') for theconsideration of the Saudi Arabian delegation. Itwas agreed thatthe two sides would progress the matter through correspondenceand meet at a mutually convenient date to fmalise the text of therevised Air Services Agreement.

Pending the review of the text of the ASA, it was agreed toincorporate in the ASA provisions relating to 'Code ShareArrangements' and 'Aviation Safety'. The text of these provisionsis given inAppendix 'D' and 'E', respectively.

(viii) Charter Operations:

The charter flights shall be carried out based on the requestof the designated as well as the non-designated airlines ofone Contracting Party to the aeronautical authorities of theother Contracting Parties in accordance with its laws andregulations.

The charter flights shall be operated in accordance with thenational legislation of both Parties,

3. Entry into Force:

'Ihe provisions of this Memorandum of Understanding shall beimplemented with immediate effect and shall supercede and replace theprevious MOD dated 30 December 2002.

'* Operations by the designated airlines of India to Madinah shall be subject toimplementation of the Airport Capacity Expansion Plan at Madinah Airport. Untilsuch time, the designated airlines of India can operate Haj and Umrah flights toand from Madinah on charter basis.

Section II!

1. Any intermediate or beyond point may be served by the designated airlines ofeach Contracting Party without 5th freedom traffic rights between such points andany point in the territory of the other Party.

2. Two or more points in the territory of one Party shall not be served on the sameflight by the designated airline(s) of the other Party.
