holder as stated in the contract within 24 hours of execution of this
document. Failure to deliver earnest money within 24 hours will be
considered default of this agreement with assignment reverting back to
Assignor without further documentation. In this event, Assignor may triple
the amount of the earnest money within 10 days of default.

E. Earnest Money can also be delivered to Assignor, his representatives,
agents or any way he designates, verbally, electronically or in writing,

F. Assignee understands that at the sole discretion of Assignor, Assignee
may be required to close and fund property 1 business day prior to

closing date on contract or subsequent amendments and or extensions.
Assignee will be given not less than 7 days prior to close if the closing
date is advanced or delayed from the original contract closing date.
Title Company will hold funds and not disburse until closing is completed.
G. If closing does not occur by fault of seller only, Assignee acknowledges
that Assignor is to be held without liability. If Assignee does not intend to
pursue litigation in case of seller default, contract will revert back to
Assignor if assignor so elects with all things of value tendered by
Assignee considered forfeited.
H. Assignor is not practicing brokerage with for assignee
I. If any real estate professionals are in any way working with assignee,
delivering documents, aiding or assisting assignee in concert with this
assignment, assignee acknowledge the rights they have by law under
state real estate agency brokerage.
J. Assignee may not assign this contract without written permission of
Assignor.
K. Assignee acknowledges that exists in this transaction are the following
documents: Colorado Contract to Buy and Sell Real Estate, Mandatory
Lead Based Paint Disclosure, Contract Assignment, Acknowledgment of
Contract Assignment.
L. It is not the duty or responsibility of Assignor to verify, guarantee or
inspect any condition or due diligence that may exist for this property.
Furthermore, Assignee is responsible for independent verification of
source of water and square footage.
M.As a contingent/conditional assignment, assignor requires that assignee
cooperate in obtaining signatures on necessary addendum/extensions
after this document is signed. Assignor will furnish any extensions or
addendums to Assignee within 24 hours of required signature date. It is
wholly the right of Assignor to obtain extensions for closing if required by
current contract law and to maintain rights and ability to enforce the
contract.
N. This document is void without a fully executed Contract Assignment.
O. In the event assignee fails to close by fault of assignees only, Assignees
agree to tender to Assignor $10,000.00 no later than 3 business days after
scheduled closing date. If Assignee does not close by fault of Assignee,
rights and interests revert back to Assignor.
P. The seller or assignor is to hold $5,000 back until possession is given to the
assignee. If the assignee has not had possession by 08/20/2020, the
assignee is to be give the $5,000
