Minutes of the December 20, 2012 Regular Meeting of the

Fayetteville Board of Education

The meeting convened at 5:00pm in the Adams Leadership Center with President Tim Hudson presiding. A moment of silence was held to remember the school and families affected by the school shooting in Newtown, Connecticut. Superintendent Vicki Thomas reported on the steps the district is taking to ensure the safety of students and staff in our schools. The Pledge of Allegiance was led by students from Fayetteville High School. Roll Call The roll was called and board members Justin Eichmann, Steve Percival, Tim Hudson, Susan Heil, Jim Halsell, Bryn Bagwell and Traci Farrah were present. Recognition Charity McCartney, art teacher at McNair Middle School, received a Recognition of Outstanding Achievement Award for being named the inaugural winner of the Dr. Barbara Teague Award for Leadership in Education by the Arkansas Association of Art Educators. Adam Simmons, child nutrition director, received a Recognition of Outstanding Achievement Award for receiving the Thelma Flanagin Award from the School Nutrition Association. The Fayetteville High School football team received a Recognition of Outstanding Achievement Award for winning the 2012 7A state championship, their second consecutive championship. Austin Allen, Fayetteville High School senior, received a Recognition of Outstanding Achievement Award for multiple awards received during the 2012 football season, including being named the 2012 Arkansas Gatorade Player of the Year. Brooks Ellis, Fayetteville High School senior, received a Recognition of Outstanding Achievement Award for multiple awards received during the 2012 football season, including being named the 2012 7A Defensive Player of the Year for the second consecutive year. Reece Fitchue, Fayetteville High School senior, received a Recognition of Outstanding Achievement Award for being named a 2012 Brandon Burlsworth Award winner. Daryl Patton, Fayetteville High School head football coach, received a Recognition of Outstanding Achievement Award for being named the 7A Coach of the Year for the second consecutive year. Consent Agenda The Board voted 7-0 to approve the consent agenda. Bryn Bagwell made the motion, which was seconded by Jim Halsell. Bond Refunding The Board voted 7-0 to approve the resolution authorizing the issuance of refunding bonds in order to achieve economic savings for the district. With an interest rate of 1.648%, a savings of $1.2 million will be realized. Bryn Bagwell made the motion, which was seconded by Justin Eichmann. Revisions to 2013-14 District & CLC Calendars The Board voted 7-0 to approve the revisions to the 2013-14 district and CLC calendars. Ginny Wiseman, associate superintendent for administration, noted that the changes were recommended by CIAA so all teachers could participate in common scoring of assessments. PPC has approved the revisions. Steve Percival made the motion, which was seconded by Susan Heil.

FHS Update Phil Jones from Nabholz Construction reported that the structural steel work on the northwest quad is almost complete and exterior framing is underway. Also, the only work remaining on the indoor athletic facility is the installation of the turf, landscaping and paving. John Coleman from Viridian reported that the south and north buildings of Fayetteville High School will be certified for LEED separately. Phase II is tracking higher due to additional energy efficiency and reuse of part of the existing high school facility. He also noted that, by utilizing low-flow faucets and toilets, Phase I will save over 600,000 gallons of water a year, which results in an annual savings of $1,500. Executive Session The Board adjourned to Executive Session at 5:47pm for consideration of an employment matter. Open Session and Adjournment The Board returned to open session at 6:17pm. The Board voted 7-0 to deny reinstatement to Mr. Kenneth Bates to his former position as food service substitute. Bryn Bagwell made the motion, which was seconded by Steve Percival. Authorization to Intervene in Litigation

TO: Board of Education FROM: Lisa Morstad County Judge Marilyn Edwards recently ruled that the University of Arkansas is responsible for paying property taxes on parcels of land, houses and property on which commercial retail centers are located. The university has filed a notice of appeal of Judge Edwards’ ruling to the Circuit Court. The university is asking that they not be responsible for paying property tax on these properties.

The Fayetteville Public School District stands to lose a minimum of $135,000 per year in property tax if the University of Arkansas prevails.

Administration recommends that the Board authorize the District to intervene in the lawsuit in order to protect the fiscal interest of the school district.

PROJECT UPDATE

2013 01 24 | Fayetteville High School

Commissioning STATUS UPDATE:

1. Viridian and Harrison Energy Partners completed functional testing of mechanical equipment on Phase I including roof top package units, chillers, and boilers, and is currently working with the project team to address remaining issues.

2. Viridian walked through Phase II and observed progress being made on the duct installation. We will continue to track installation of mechanical equipment in the coming weeks.

Commissioning (Cx) is a systematic process for ensuring that all building systems perform interactively, according to design intent and the owner’s operational needs. This includes design review, pre- and post-functional testing, and coordination meetings. Leadership in Energy & Environmental Design (LEED) STATUS UPDATE:

1. LEED design credits that apply to both Phase I and Phase II were submitted for approval in November. Viridian received comments back on December 11th from GBCI and provided additional information as necessary. The remaining Phase I LEED credits are currently under review.

2. Phase II is still tracking at 60 points. This increase over Phase II is found primarily in additional energy efficiency gains and the reuse of part of the existing high school facility.
