• The marine service provider transition is an industry lead effort. • It is industry’s responsibility to ensure full compliance at all times.• It is not appropriate for ADEC to weigh in on industry

contractual matters. • This transition will have an effect on the Shippers and VMT

Contingency Plans.• ADEC will continue working to ensure that the Shippers and

Alyeska remain in compliance.

ADEC’s role is to oversee and enforce Regulations as outlined in 18 AAC 75 and

Alaska Statute Title 46.

ADEC is the authority who is responsible for presiding over and enforcing the regulations from a neutral point

of view.

ADEC will make a determination on the proposed system through the formal contingency plan amendment process once the plan holder submits their application package.

Procedures to apply for oil discharge prevention and contingency plans; plan amendments; 18 AAC 75.415

• Application for an amendment to an contingency plan is submitted • Reviewed as a major amendment (18 AAC 75.455) if there is:• a change in the amount or quality of prevention, response resources,

or training • a change that affects the response scenarios

• ADEC determines if the application package is sufficient for review• If the application package is determined to be insufficient, the

applicant is notified in writing. The applicant must update and re-submit the application package.

• ADEC notifies the applicant in writing when the application package is sufficient and directs the applicant to:• publish a public notice • distribute the application package to review participants

• Public comment period of 30-45 days.• If more information is needed, ADEC sends

out an request for additional informational (RFAI) notice to the applicant. • Applicant responds back to the department

with requested additional information.• The public comment period is extended 10

days for the additional information received from the applicant.

engineering consulting firm to assist us in evaluating the proposed system.
