PROJECT DESCRIPTION

STAFF RECOMMENDATION

Conditionally approve the Alcohol Use Permit.

BACKGROUND

The proposed wine bar (R&D wine bar) will occupy a suite near the middle of the building that fills the parcel located at the corner of East Main Street and South California Street in the center of Downtown Ventura. This suite has had an alcohol license since 2005, the most recent occupant being the "Vin Tura Tasting Room and Wine Rack". There is no previous use permit for the location and the prior tenants enjoyed a "deemed approved" status. STAFF ANALYSIS

The purpose of this Alcohol Use Permit is to consider whether the necessary findings to permit the use can be made, and if so, to adequately condition the project in a way to minimize potential negative impacts to the health, safety and general welfare of the community, residents, and surrounding properties.

The Police Department has reviewed the Alcohol Use Permit application for R&D located in Reporting District 31, and has provided the following crime statistics for the reporting district in comparison to the citywide average:

Reporting District 31 is in the center of downtown Ventura, densely populated with businesses, vehicular traffic, residents and visitors. It is also host to a large vagrant population. Downtown is an area of focused enforcement, which contributes to the high number of calls for service. Although R&D is located in a reporting district with a high crime rate, VPD concluded those incidents are not related to the proposed use and the business is not expected to contribute to it.

Conditions of Approval

The business is subject to Conditions of Approval including the Operational Standards, which describe the strategies to strictly comply with the Alcohol Beverage Control Act. . To support the Operational Standards, staff recommends the standard Conditions of Approval for Type 4 7 alcohol licenses. Should the establishment fail to comply with their Operational Plan or their Conditions of Approval, the Planning Commission can revoke this Alcohol Use Permit. Recommended operational conditions of approval are included in the draft Administrative Order and are typical of what is required for other Type 47 licenses in Downtown.

ADMINISTRATIVE ORDER NO. AH0-2020-APPROVING AN ALCOHOL USE PERMIT

PROJECT NO.: 14178 CASE NO.: AUP-1-20-54108

IT IS HEREBY ORDERED by the Administrative Hearing Officer, designated by and acting on behalf of the Community Development Director of the City of San Buenaventura, as follows:

SECTION 1: An application has been filed by Nicole Valdivia pursuant to the City of San Buenaventura Municipal Code, for an Alcohol Use Permit allowing an ABC License Type 42 (On-Sale Beer and Wine) for R&D wine bar located at 14 S. California Street, in the Urban Core (T6.1) zone within the Downtown Specific Plan (DTSP), also commonly referred to as Assessor Parcel Number 073-0-042-010.

SECTION 2: All proceedings having been duly taken as required by law, and upon review of the information provided in the staff report and consideration of the testimony given at the public hearing, as well as other pertinent information, the Administrative Hearing Officer hereby finds the following:

Alcohol Use Permit Findings

1. "The proposed alcoholic beverage establishment conforms to the general plan and is consistent with the purposes and requirements of this zoning ordinance." SBMC Section 24.460.240.C(1).

The alcoholic beverage establishment is located within the T6.1 (Urban Core) zone which allows commercial activity, such as restaurant use and allows restaurants to obtain an ABC License Type 42 (On-Sale Beer and Wine) subject to an Alcohol Use Permit pursuant to SBMC Chapter 24.460 ("Alcoholic Beverage Establishments - Use Permits"). The wine bar is consistent with the General Plan and requirements of the SBMC which encourages the activation of downtown by incorporating a range of commercial uses to establish around-the-clock activity and promote tourism.

2. 'The proposed alcoholic beverage establishment will not contribute to an undue concentration of alcohol establishments in the area, unless a finding of public convenience or necessity is made." SBMC Section 24.460.240. C(2).

The Ventura Police Department analyses alcohol license applications taking into account the alcohol license type, location of the premises, intended operating

business plan, hours of operation, type and location of existing alcohol premises, and whether the applicant premise provides a public convenience or necessity. Crime statistics of the applicable Reporting District (RD 31) are taken into consideration, as well as calls for service at the specific premises and the immediate area surrounding it. Through this analysis the Ventura PD determined the Type 42 alcohol license for the wine bar will not contribute to an undue concentration of alcohol establishments in this area; therefore, this finding is met.

3. 'The proposed alcoholic beverage establishment will not detrimentally affect nearby neighborhoods considering the distance of the alcohol beverage establishment to residential buildings, churches, schools, hospitals, playgrounds, parks, and other existing alcoholic beverage establishments." SBMC Section 24.460.240. C(3).

The wine bar is in the center of downtown Ventura which is establishment is located in the urban core of downtown Ventura that is intended to be activated by a combination of commercial, residential and institutional uses and it is not anticipated to result in unreasonable secondary effects to any churches, schools, hospitals, playgrounds, or parks. The ABC License Type 42 license will not detrimentally affect nearby neighborhoods because the wine bar will contribute to the commercial and entertainment vitality of the downtown area. The Police Department and has created safeguards, such as hours of operation, employee training, alcoholic beverage sales limitations, property upkeep, and security measures that would minimize detrimental effects. Finally, conditions of approval, including abiding by the operational plan, are included to ensure that less than significant detrimental effects will occur.

4. "The proposed alcoholic beverage establishment will be compatible with existing uses, or the general character of the surrounding vicinity, and be consistent with the public health, safety, or welfare, due to hours of operation, generation of pedestrian or vehicle traffic, lighting, noise, vibration, odor, security, or other factors." SBMC Section 24.460.240. C(4).

Existing uses in the general area around the site generally include commercial uses, such as retail, restaurants, theater, and commercial uses. The wine bar is compatible with the diverse uses and restaurant uses found within the Downtown Specific Plan area (Chapter 2.10.020). R&D wine bar is neither a bar nor a nightclub but a higher end tasting room experience in the downtown urban core.

The proposed alcoholic beverage establishment will not adversely impact or be detrimental to surrounding uses and buildings in the vicinity because conditions of approval state the tenant space and other facilities, or features associated with the alcohol beverage establishment be located and maintained substantially as shown on the plot plan. The project does not propose alterations to the building, and

therefore the proposed use will not adversely affect uses, buildings, or structures in the surrounding vicinity.

The proposed operational plan has been reviewed and approved by the Police Department and has been created with safeguards, such as hours of operation, employee training, alcoholic beverage sales limitations, food service with alcoholic beverages, property upkeep, and security measures to minimize detrimental effects to neighboring uses.

5. 'The proposed alcoholic beverage establishment is not located in what has been determined to be a high-crime area, or where a disproportionate number of police service calls occur, unless it can be shown that the proposed alcoholic beverage establishment will not significantly add to the crime rate of the area or contribute to a disproportionate number of police service calls." SBMC Section 24.460.240. C(5).

According to the Ventura Police Department, R&D is located in Reporting District 31 and provides the following crime statistics for the district:

• In 2017 RD 31 had 336% more reported crimes than the average number of reported crimes.

• In 2018 RD 31 had 297% more reported crimes than the average number of reported crimes.

• In 2019 RD 31 had 296% more reported crimes than the average number of reported crimes.

The majority of the calls for service are assaults/batteries, burglaries, thefts, stolen vehicles, domestics, subjects disturbing, drugs, suspicious circumstances, trespass and vandalism. Reporting District 31 is in the center of Downtown. Downtown Ventura is densely populated with businesses, vehicular traffic, residents and visitors. It is also host to a large vagrant population. Downtown is an area of focused enforcement which contributes to the high number of calls for service as well.

Although R&D Wine Bar is located in a reporting district that has a high crime rate, those incidents are not associated with the proposed premise. Further, R&D Wine Bar operational standards and training will ensure they do not overserve alcohol to customers; they will police their property to ensure it is free of litter and graffiti and will ensure their staff attends the responsible beverage service training course. The business will not operate with alcohol service beyond 11 PM any day of the week. The owners previously managed two other wine businesses, The Cave and · Ventura Wine Club, and they did not have any significant calls for service; it is anticipated they will continue their strong management ethic.

Based on the aforementioned there is no indication the proposed alcoholic beverage establishment will significantly add to the crime rate of the area or contribute to a disproportionate number of police service calls.

SECTION 3: California Environmental Quality Act

The project is Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA), under Section 15301 (Class 1, Existing Facilities) of the CEQA Guidelines because the ABC Type 42 license- On-Sale Beer and Wine - will allow beer and wine sales in a commercial suite that has had wine sales for several years prior. Therefore, no further environmental review is required.

SECTION 4: Based on the above findings, Use Permit Case No. AUP-1-20-54108 as described above)s HEREBY APPROVED, subject to the following conditions:

Planning Conditions

1. This approval is granted for sales and service pursuant to a Type 42 license (ON-Sale Beer and Wine) for an alcohol beverage establishment on the site (APNs 073-0-042-010) as described in the application and any attachments thereto, and as shown on the plans labeled Case No. AU P-1-20-54108 Exhibits "A-B" dated April 30, 2020, and the Operations and Training Plan labeled Case No. AUP-1-20-54108 Exhibit "C-D" dated April 30, 2020 attached hereto and incorporated herein.

2. The tenant space and other facilities or features associated with the alcohol beverage establishment shall be located and maintained substantially as shown on the plans labeled Case No. AUP-1-20-54108 Exhibits "A-B" dated April 30, 2020, attached hereto and incorporated herein.

3. Prior to obtaining the new State ABC license and/or within 15 days hereof, the applicant and property owner shall file with the Community Development Department written acknowledgment of the conditions stated herein on forms provided by the Planning Division, and all public notices posted onsite are to be removed.

4. Unless the use is inaugurated no later than 12 months after this approval is granted and is diligently pursued thereafter, this approval will be subject to revocation pursuant to Chapter 24.570 of the City's Municipal Code. However, if the approved project remains unchanged (except as allowed under Municipal Code Chapter 24.570), the Community Development Director may grant one additional 12-month extension of time for the Use Permit, provided the initial 12-month period has not already expired.

5. If an employee/manager/owner of R&D sells, furnishes, gives or causes to be sold, furnished, or given away any alcoholic beverage to any person under the age of 21, the City of Ventura will suspend this alcohol use permit for a period of 10 days for the first offense, and 20 days for a second offense, and will initiate revocation proceedings for a third offense within a 3-year period. The Chief of Police or his or her designee will determine the suspension date.

6. All requirements of any law, ordinance, or regulation of the State, City of San Buenaventura, and any other governmental entity shall be complied with, including, without limitation, the "Operation Standards and Training

· Requirements" set forth in Article 4 of Chapter 24.460 of the City's Municipal Code as it may be amended from time to time.

7. A copy of these conditions must be maintained by the licensee on the premises and made available upon the demand of any peace officer at all times.

8. Approval is subject to the applicant paying all fees and assessments to the City of San Buenaventura as required by the zoning regulations.

9. The applicanUowner agrees to hold harmless and indemnify, and, at the City's request, defend the City, its officers, officials, employees, agents, representatives and volunteers from and against any and all claims, demands, actions, damages, expenses, suits, accidents, injuries, liability, or proceedings of any character whatsoever (including without limitation, attorney's fees), brought for or on account of, or resulting from or arising out of, or in connection with, any act, negligence, wrongful conduct, or other action by applicant, applicant's employees, agents or representatives, or any of applicant's lessees or subcontractors in connection with the Use Permit.

10. In the event the City determines that it is necessary to take legal action to enforce any of the provisions of these conditions, and such legal action is taken, the applicant shall be required to pay any and all costs of such legal action, including reasonable attorney's fees, incurred by the City, even if the matter is not prosecuted to a final judgment or is amicably resolved, unless the City should waive said fees or any part thereof. The foregoing shall not apply if the permittee prevails in the enforcement proceeding.

A. This Use Permit is granted for an unlimited period of time but shall be subject to revocation or reevaluation if the applicant fails to comply with the above conditions at any time. If at any time the Community Development Director, or his or her designee, or the Planning Commission determines that there has been, or may be, a violation of the findings or conditions of this Use Permit, or of the Zoning Ordinance, a public hearing may be held to review the Use Permit. At said hearing, the decision-making body may

amend or add other conditions, recommend enforcement actions, or revoke the Use Permit entirely, as necessary to ensure compliance with the Zoning Ordinance, and to provide for the health, safety and general welfare of the Community.

B. The Police Chief or his or her designee may immediately suspend operation of the uses approved by this permit pending a hearing on the revocation or reevaluation of this permit if the Chief finds that there have been significant violations of the use permit conditions and/or ABC license, or there is a single serious violent crime or single significant incident to which multiple police units or multiple jurisdictions respond associated with the operation of this use, which the Chief determines is detrimental to the public safety, health, or welfare. The Chief shall immediately inform the Planning Manager of the suspension and the manager shall schedule a hearing on the revocation or reevaluation of the permit to be held no more than thirty (30) days after the suspension begins.

C. If complaints are received regarding excessive noise, parking availability, lighting, building access, and the like, associated with the establishment, the City may, at its discretion, take action to review the use permit, including, without limitation, amending conditions or revoking the permit following a hearing conducted as described above.

Alcohol License Type 20 (Off-Sale Beer and Wine)

11. Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 10:00 AM and 11 :00 PM daily.

12. Sale, service or delivery of larger volumes of alcohol, such as in pitchers, carafes, buckets, or similar containers, shall only be provided by the licensee to serve two or more customers at one time.

13. Lite food service shall be available to patrons at all times alcoholic beverage sales and service are exercised.

14. There shall be no advertising of alcoholic beverages visible to the outside of the establishment, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

15. Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee shall be removed or painted over within forty-eight (48) hours of being applied.

16. The licensee shall be responsible for maintaining the premises or areas adjacent to the premises over which he or she has control, free of litter.

17. There shall not be any amplified music or live bands unless the licensee has a valid entertainment permit issued by the City of Ventura.

18. The licensee shall post a prominent sign or signs stating, "Valid ID is required to purchase alcoholic beverages" and "No person under 21 will be sold alcoholic beverages."

19. A copy of these conditions must be maintained on the premises and made available upon the demand of any peace officer at all times.

20. If complaints are received regarding excessive noise, parking availability, lighting, building access, and the like, associated with the establishment, the City may, at its discretion, take action to review the use permit, including, without limitation, adding conditions or revoking the permit.

21. The licensee shall regularly police the area under the licensee's control in an effort to prevent the loitering of persons about the premises.

22. All employees must be certified in Responsible Beverage Service Training Course within 90 days of employment.

23. The consumption of alcoholic beverages on any property adjacent to the licensed premises and under the control of the licensee(s) is prohibited.

24. The licensee shall have readily identifiable personnel to monitor and control the behavior of customers in and around the premises.

25. The parking lot and adjacent areas of the premises under reasonable control of the licensee (including rear of business) shall be equipped with lighting of sufficient power to illuminate and make easily discernable the appearance and conduct of all persons in or about the area.

26. Upon any individual transfer (person to person) of the subject Alcoholic Beverage Control License, the City reserves the right to review the existing CUP and apply or remove conditions as appropriate to mitigate existing or potential problems.

27. Prior to commencing the sale of alcoholic beverages permitted by this Alcohol Use Permit, security cameras shall be installed to monitor the premises and be positioned to monitor at minimum the entry/exit, all points of sale, and the areas

immediately surrounding the exterior of the business. The camera system shall comply with the following minimum standards:

A. The cameras shall be high definition color cameras, made by a reputable manufacturer and maintained to current industry standards. They shall have low light capability and be capable of identifying persons conducting transactions at the store's registers or entering/exiting the business.

B. The system shall utilize a Digital Video Recorder (DVR). The use of videocassette recorders (VHS and other formats) is prohibited. The DVR shall allow recording, live viewing and playback or recorded video for a period of at least 30 days. DVR shall perform all recording, viewing (local and remote), playback (local and remote), queries, and backup functions simultaneously, without interruption of any other function.

C. During normal business hours, the licensee shall provide access to the digital recordings for any and all enforcement purposes as determined by the City of Ventura.

28. There shall not be any amplified music or live bands unless the licensee has a valid Entertainment Permit issued by the City of Ventura, pursuant to Municipal Code Chapter 10.450

SECTION 5: This Alcohol Use Permit shall be subject to revocation if the applicant fails to comply with the conditions listed herein at any time. If, at any time, the Community Development Director or Planning Commission determines that there has been or may be a violation of the findings or conditions of this action, or of the Zoning Regulations, a public hearing may be held before the Planning Commission to review this Permit pursuant to Zoning Regulations Chapter 24.570. At said hearing, the Planning Commission may add conditions, or recommend enforcement actions, or revoke the Permit entirely, as necessary to ensure compliance with the Zoning Regulations, and to provide for the health, safety, and general welfare of the community.

Operation Standards and Training Plan

R&D - 14 South California Street Ventura, CA 93001

Sec 24.460.410 Operational Standards

R&D shall be operated in conformance with the following operations standards:

1. Compliance with the state's Alcoholic Beverage Act

R&D will operate in strict compliance with the State's Alcohol Beverage Control Act, together

with the conditions of our license issued by ABC to the establishment pursuant Act.

2. Nuisance conditions:

R&D will take reasonable steps to discourage and correct object_ionable conditions that

constitutes a nuisance in parking areas, sidewalks, alleys, and areas surrounding our building and

adjacent properties during business hours if directly related to patrons of R&D. R&D will call local police

department in a timely manner to prevent and discourage those engaging in such activities that are

considered a nuisance, unless personal safety would be threatened by said patrons.

3. Litter and Graffiti:

The exterior of R&D, including signs and accessory building and structures, shall be maintained

free of litter and graffiti. R&D will provide a daily removal of trash, litter and debris from the premises

and within 20 feet of the building. Graffiti shall be removed within 48 hours following receipt of written

notice of violation.

4. Mode of Alcoholic Beverage Sales:

Alcoholic beverage sales from drive-up or walk-up service will not be permitted at any time.

Patrons must enter the premises and present a valid government issued ID verifying legal age to

purchase and consume alcoholic beverages at all times.

5. Signs:

All signs required by Alcoholic Beverage Control shall be posted as required by ABC at R&D in

plan and clear view to all patrons.

Section 24.460.430 Operational Standards - On sale Alcoholic Beverage Establishments

R&D shall comply with the following additional operation standards:

1. Selling of alcoholic beverages for the consumption off the premises containing the establishment is

prohibited except where alcoholic beverages are sold for consumption on an adjoining sidewalk

pursuant to a permit issued in a manner provided by chapter 34.477 of this division.

2. Any entertainment permit issued pursuant to chapter 10.450 of this code shall not be audible more

than 50 feet from the boundary of the property containing the establishment unless otherwise

expressively authorized by the permit and local authorities.

Section 24.460.440- Training Requirements

All managers and employees of R&D who are engaged in the sale or service of alcoholic beverages, or

that otherwise control the sales or service of such alcoholic beverages shall successfully complete a

certified training program in responsible methods and skills for selling and serving alcoholic beverages

within 180- days of the issuance of a certificate of occupancy authorizing the occupancy and operation

of the establishment, whichever occurs last. All new employees will complete this training within 30

days of their formal employment offer acceptance. Our local program is known as Responsible Beverage

Service training and conducted by the Police Department.
