ThevirtualAmericanAssociationsWeek(AAW)willengageourcommunity inacollectiveresponsedesignedtoinformlegislatorsandCapitolHillstaff abouthowtheCOVID-19pandemichasseverelytestedAmerica’s501(c)(6) organizations,themyriadwaystheyareassistingstrugglingindustriesand professionsduringthepandemicandtheurgentneedforCongresstoincludetheminthePaycheck ProtectionProgram(PPP)inthenextCOVID-19reliefpackage.
AmericanAssociationsWeekwillserveasafree,virtualeducationandadvocacyeventforassociationsafterASAE’sAmericanAssociationsDayhadtobepostponedduringtheinitialspreadofthecoronavirus intheU.S.backinMarch.
IfyouhaveeverwonderedwhetheryourvoicemakesadifferenceonCapitolHill,looknofurtherthan thebipartisanspendingandtaxpackageenactedlastDecember,whichincludedaprovisiontorepeal asectionofthe2017taxlawthatrequiredassociationsandothertax-exemptorganizationstopay unrelatedbusinessincometax(UBIT)onthevalueofemployeebenefitssuchasparkingandtransportation.RepealingthistaxwasASAE’stoplegislativepriorityfortwoyearsandwasthekeyissuethatAmerican AssociationsDayattendeeslastyearsharedwithcongressionaloffices.Withoutquestion,thepatience,persistenceandconsistentmessagingfromASAE’smembersonthisissuewascriticalingettingrepealacrossthefinishline.Repealingthistaxenablesnonprofitgroupstofocusonfulfillingtheirtax-exemptmissionswithoutundueburden.Thisisaclearexampleofwhatourpoliticalprocessaffordsusall– passionateandinformedadvocacygetsresults.
Asweallknow,however,thepoliticalwheelsarealwaysturning,andeachyearbringsnewchallengesandopportunitiestoinfluencelegislationthatimpactsourcommunity.AssociationsimpactedbythepandemicneedaccesstoemergencyfederalassistancetocontinuetosupporttheindustriesandprofessionsthatwillputtheU.S.andworldeconomybacktoworkwhenthiscrisisabates.
AsweaskCongresstoprioritizeandproducesensiblesolutionstothenation’smostpressingissues, wealsohaveanopportunitytodemonstrateahallmarkofallassociations–findingconnectionsandacommonpurposewithothers.Asstakeholdersinthepoliticalprocess,associationsarestrongbelievers inputtingasidedivisionsandbuildingonourcommonbondstoachieverealresults.Wewantmembers ofCongressandtheirstafftoknowthatassociationsstandreadytoworkwiththemtotranscend “politicsasusual;”toengageinconstructive,civildiscourse;andtofindsolutionsonissuesthatmatter toallAmericans.

Now,morethanever,wemustdemonstratetoCongressthenonprofitassociationcommunity’s positiveimpactonAmericaneconomyandsociety.Associations,alongwithbusinesses,othernon-profitsandworkersacrossthecountry,arereelingfromthedevastatinghealth,safetyandfinancialeffectsofCOVID-19.Associationsand501(c)(6)organizationswereleftoutofaflagshiprelief program,thePaycheckProtectionProgram(PPP),andthusarewithoutaccesstothiscriticalmeansoffinancialaid.

Further, we urge you to support and immediately pass the Pandemic Risk Insurance Act of 2020 (H.R. 7011) and, per proposed amendment, the Skills Renewal Act of 2020 (H.R. 7032 / S. 3779).
Inaspanofroughlyfourmonths,2020haspresentedournationwithhealth,safety,civilandeconomic calamitiesunseenfor100years.And,whilerecoveryremainsdaunting,yourswiftleadershipand actiontoprovideAmericanworkers,nonprofitsandbusinessestrillionsofdollarsofreliefhave provencriticaltoshieldoureconomyandcollectivelivelihoodsfrompermanentdamageorfailure. OurcommunityisextremelygratefulforyourpassageoftheCoronavirusAid,ReliefandEconomicSecurity(CARES)Act(P.L.116-136)andotherrelieflegislation,whichnodoubthelpedpreservethesafetyandwelfareofmillionsofAmericans.Weweredisappointed,however,thatnonprofitassociationsandotherswereexcludedfromeligibilityunderthePPP,evenasapreviousdraftoftheCARESActmadesuchentitieseligible.
Nonprofitassociationsofallsizes,variedfunctionsanddisparateindustriescompriseSection501(c)(6).Morethan62,000501(c)(6)organizationsacrossthecountryplayacriticalroletoprovideeducationandprofessionaldevelopmentforAmerica’sworkforce,createproductandsafetystandardsfor everythingfromfoodpackagingtonewbuildingconstruction,defineandadvancestandardsfor professionalcertificationandcodesofethicsinawiderangeofprofessionalfields,andorganize communityassistanceprogramsintimesofgreatestneed,suchasafternaturaldisastersor catastrophicevents–includingthecurrentCOVID-19pandemic.
TohighlightsomeoftheincredibleworkourcommunityhasdonetohelpAmericansthroughoutthiscrisis,followingarequotesdirectlyfromnonprofitassociations:
United Fresh Produce Association – Washington, D.C.“InresponsetotheCOVID-19pandemic,theUnitedFreshStartFoundationhasinfusedthefresh produceindustrywith25$1,000RapidResponseFRESHGrantstoincreaseaccesstofreshfruits andvegetablesforchildrenandfamiliesinneed,whilealsocreatingopportunitiesforfoodservice distributorsexperiencinglostmarketsduetotherestaurant,hospitalityandschoolshutdowns. Companiesusedthesegrantstosupportfreshproducedonationstofoodbanks,schoolsandhungerrelieforganizationsintheirlocalcommunities.”

Texas Rural Water Association – Austin, TX“94percentofwaterutilitiesnationwideareruralorsmallmunicipalsystemsservingpopulationsoflessthan10,000.InTexas,thousandsofruralwatersuppliersarescatteredacrossthestateservingsmallcommunitiesfaroffthebeatenpath.TheTexasRuralWaterAssociation(TRWA)isa501(c)(6)nonprofitassociationthatservestheseruralandsmallwatersuppliersbyprovidingthemavariety ofsupportservicesthatenablethemtoensurethesafewatersupplyofmillionsofTexans.Thereis noquestionthatcleanwaterplaysanimportantroleinpreventingthespreadofCOVID-19,andthattheessentialemployeesofthesewatersuppliersareneededtokeepoursocietyfunctioning. Byextension,theworkTRWAdoestosupportthesesystems–whichincludesprovidingrequiredtrainingtowaterandwastewateroperators,on-siteandremotetechnicalassistance,legalservices,employingtrainedemergencyresponders,andcommunicatingrapidlychanginginformationina heavilyregulatedindustry–isalsoessential.”
Despitenonprofitassociations’collectiveeffortstohelpsustainAmericaamidadversity,mostare ineligibleforsignificantreliefofferedthroughthePPP.AccordingtoaJune5surveyof501(c)(6) executivesbytheAmericanSocietyofAssociationExecutives(ASAE)ResearchFoundation, 72 percent of respondents anticipate using up to half of reserve funds to offset estimated revenue loss, while four percent anticipate using more than half of reserves and four percent anticipate insufficient reserves to cover estimated losses.
Asthesedatademonstrate,manynonprofitassociationshavelittleornofinancialcushiontocarrythemthroughthisdevastatingtimeandthusdesperatelyneedaccesstothePPP.Forexample, INSERTANECDOTE1,ifapplicable–KansasHomeCareandHospiceAssociation–callon6/8
InCalifornia,theCarlsbad Village Association(CVA)isanonprofit501(c)(6)thatsupportsnearly 400smallbusinessesinitsdowntownarea.AnaffiliateofMainStreetAmerica,CVAemploysthreepeople–twoofwhomhavebeenfurloughedsinceApril1.Thatmonth,onlydaysafterPresidentTrumpsignedtheCARESActintolaw,CVAreportedthefollowing:
“Ourmainsourceofincome,aweeklyfarmers’market,iscurrentlyshutdownatanetfinancial lossof$10,000permonthtoourassociation.Oneofourbiggestevents,the22ndannualArtin theVillage,willmostlikelybecanceled,causingusanetlossofanadditional$15,000.Weare keepingourdoorsopenandarecommittedtorunthrougheverypennyofourreservestokeep ourassociationgoinginordertosupportourdowntownbusinessesduringthiscrisis.Itwouldbe atremendoushelpifwetoocouldqualifyforthePaycheckProtectionProgram,likethebusinesses wesupport,sothatourstaffcouldstayemployedtoworkontheirbehalf.Theremightonlybe threeofusatourassociation,butwerepresentandsupportnearly400stakeholders.Helpuskeep ourassociationstrongforthem.”
InIllinois,theAmerican Academy of Pediatric Dentistry,whichadvancesoptimaloralhealthforall children,hasexperiencedgravefinancialharm:
“Ourassociationhadtocancelour2020AnnualSessionthatwasscheduledforMemorialDay weekend,whichwillresultin$2-3millioninlostrevenue.Wealsohadtocancelanin-person ContinuingEducationcoursescheduledforlateMarch.Thefinancialimpactforcedourassociation tolayofffivestaff(approximately20percentofourworkforce),instituteahiringfreeze,andcancel twosummerinternshipprograms.”

Thisbillisessentialforthenonprofitassociationcommunitywhoselifebloodcoursesfromin-personmeetingsandevents.AccordingtotheProfessionalConventionManagementAssociation,conferencesandotherin-personeventsaccountforanaverageof35percentoftotalannualrevenuefornonprofitassociations.And,accordingtotheASAEResearchFoundationsurveymentionedabove:
• 86percentofrespondentsfaceupto$1,000,000inestimatedrevenuelosses–whilesixpercent willface$1,000,000-$2,000,000inestimatedlosses–justtoeventcancellations; • 80percentofrespondentsfaceupto49 percentofestimatedrevenueloss–whilesevenpercent faceupto75percentinestimatedloss–justtoeventcancellations; • 40percentofrespondentsdonotexpecttoresumein-personmeetingsandeventsuntilat least January 2021; • 47percentofrespondentsreportzero insurance coverageforeventcancellation,whileonlyfive percentreportfullcoverage;and • 63percentofrespondentsstatedtheyarelikely or very likelytopurchasePRIAcoverageif madeavailable.
ModeledaftertheTerrorismRiskInsuranceAct,PRIAwouldestablishapublic-privatecost-sharingpartnershipbetweengovernmentandinsurersforprospectiveclaims.BeginningJanuary2021,oncetotalclaimsforanindividualpandemicorpublichealthemergencyreach$250million,thegovernmentwouldcover95percentofallprospective,relatedclaims.Andwhileinsurersarenotrequiredtoofferthiscoverage,earlyadopterswillprosper,asPRIAwouldempowernonprofitassociationstofurtherbenefittheeconomyandhelpournationrecoverfromCOVID-19.Asanexample,ASAEconvened5,000nonprofitassociationprofessionalsatitsannualmeetinginChicagoduringAugust2018.AsofMay2019,thissingleeventdirectlyproducedatleast$147millionindownstreameconomicimpact.
PRIAoffersthesecuritynonprofitassociationsneedtofullyreigniteourcommunity’sfar-reaching economicimpactthroughindustry-focusedconferences,workforcedevelopment,educational programmingandothercriticalservices.Forthesereasons,westronglysupportH.R.7011.

IfamendedasproposedbytheProfessionalCertificationCoalition,Americanscouldusethecredit topursueindustrycertificationsandotherprofessionalcredentialsthatwouldhelpthemmorefully accesstheeconomyandcontributetoadynamicmarketplacethroughincreasedcompetitionandconsumerchoice.Thiswillundoubtedlysupportnonprofitassociationsandotherswhoofferworkforcedevelopmentprograms.Forthesereasons,westronglysupportH.R.7032/S.3779.
