AFFIDAVIT

I, ANATOLIO BOHOL, of legal age, Filipino, single, and a resident of

Tagum City, Davao del Norte, Philippines, after having been duly sworn to in

accordance with law, hereby depose and state, THAT:

1. On September 23, 2011 at around 6:30 p.m., I arrived in the house

of MILITON LAGUILLES, located at Osmeña St., Tagum City

together with my employer, CRISTILYN LAGUILLES;

2. Since when we arrived, MILITON LAGUILLES, was in his sari-sari

store which was located in front of his house, CRISTILYN

LAGUILLES sat in the bench which was placed in front of the store

and I did the same;

3. At around 7:00 p.m., while we were talking about the sudden rise of

tuba price due to the price of gasoline, a neighbor who was later on

identified as ROMEO CAHINDO arrived and bought a tuba;

4. Upon seeing that ROMEO CAHINDO was already very drank and

knowing that ROMEO CAHINDO is a troublemaker when drank,

MILITON LAGUILLES who had known ROMEO CAHINDO for a

very long time as neighbor, refused to give him tuba;

5. ROMEO CAHINDO persisted but MILITON LAGUILLES calmly

refused and instead went out from the store and proceeded to the

yard, which was illuminated by the lights coming both from the

store and the house and just a meter away from the bench where I

was sitting, to pee;

6. ROMEO CAHIDO followed MILITON LAGUILLES and challenged

him to fight but MILITON LAGUILLES did not mind him with a

statement, “I will not fight you, don’t do it”;

7. While MILITON LAGUILLES was already urinating, ROMEO

CAHINDO approached him from behind and delivered a hacking

blows using a scythe held by his right hand, hitting the right

shoulder and the top of the head of MILITON LAGUILLES and the

latter immediately fell down to the ground and ROMEO CAHINDO

immediately ran away;

8. Though CRISTILYN LAGUILLES and I were shocked by what we

had seen, CRISTILYN LAGUILLES was able to shout for help and

after regaining my composure, I rushed and ran to fetch the

husband of my employer who was just near the City Hall of Tagum;

9. Within few minutes, we came back and we brought MILITON

LAGUILLES to Bishop Regan Memorial Hospital but he was declared

dead on arrival due to the wounds inflicted by ROMEO CAHINDO.

10. I am executing this Affidavit to attest to the truth of the

foregoing fact and to support the criminal complaint lodged by

CRISTILYN LAGUILLES against ROMEO CAHINDO for the crime of

murder defined under Art. 248 of the Revised Penal Code.
