Credit Labor's1996 victories at the polls for enactment of 10new pro-worker laws in 1997. There is little doubt that our coordi-nated election campaign made it happen.

The resulting 43 to 37 Democratic majority in the Assemblygave us the edge we needed for successful passage of our bills.This in stark contrast to the prior two years of Republican controlwhen only one labor bill was enacted in 1995, and two in 1996.

Governor Wilson's attempts to reappoint Robyn Black and SyedAlam to the Industrial Welfare Commission met disaster in theSenate as a result of Labor's perseverance to make it responsiveto workers, the Commission's original purpose.

Other hand-picked candidates for the IWC, Agricultural LaborRelations Board and Labor Commissioner's office were aban-doned when the Governor realized the confirmation votes were notthere.

Inevitably the 1997 session produced 15 vetoes of Federation-supported bills, a grim reminder that we are still vulnerable to PeteWilson's anti-worker bias as he begins his final stretch asGovernor The message is clear-Labor must go all out in the1998 campaign to elect a Democratic Governor who will sign ourbills to get what working people need out of state government.

Legislative advancements are only part of the Sacramento pic-ture. Attacks on the prevailing wage and the eight hour day reflectRepublican failures in the Legislature. What they could not getthrough the legislative process, they tried to achieve administra-tively through Wilson's agencies.

The road map to victory is laid out before us. We have the mostvaluable of resources-people, in every community of the state.We also have the program in place for mobilizing them. The rest isup to us.

Federation-SupportedBills EnactedEDUCATION

1. SB 187 (Hughes) requires each school to establish a school safetyplanning committee to develop a comprehensive school safety plan.

2. SB 629 (Kamette) provides increased death benefits for schoolemployees whose deaths were a direct consequence of violent acts arising out ofand in the course of their official duties.

HEALTH

3. AB 38 (Figueroa) prohibits health care plans from restricting benefitsfor inpatient hospital care to less than 48 hours for normal childbirth and less than96 hours following caesarian section.

HOUSING

4. SB 548 (Solis) requires landlords to provide tenants with deadbolts andwindow locks, as well as outdoor security lighting in larger apartment buildings.

LABOR LAW ENFORCEMENT

5. AB 1448 (Floyd) increases the civil penalty for a second violation ofminimum wage requirements.

PREVAILING WAGE

6. ACR 171 (Bustamante and Lockyer) declares the Legislature'sintent to retain the modal rate method for determining prevailing wage rates.

SOCIAL INSURANCE

7. SB 212 (Burton) permits acupuncturists to continue to provide treat-ment to injured workers within the state's workers' compensation system.

TRANSPORTATION

8. AJR 81 (Honda) memorializes the U.S. Congress and the President tomaintain current truck size and weight standards.

9. SCR 541 (Lockyer) declares actions taken by the IWC to repeal dailyovertime pay are contrary to the intent of the Legislature.

10. AB 47 (Murray) prohibits an employer with 25 or more employeesfrom firing or discriminating against an employee who takes time off work toparticipate in their children's day care or school activities.

1. SJR 41 (Haynes) would have memorialized the U.S. Congress to pro-pose a Constitutional Amendment that would require a balanced budget.

SAFETY & HEALTH

2. AB 1311 (Bordonaro) would have authorized a study of so-called dis-paraging criticisms by unions, consumer groups and environmentalists regardingthe use of pesticides on farm produce, thus making it easier for growers to sue forliable.

SOCIAL INSURANCE

3. SB 429 (Hurtt) would have required an employee to be treated by aphysician of the employer's choice or a facility of the employers choice, for oneyear, rather than 30 days, from the date the injury is reported.

4. SB 964 (Knight) would have imposed a private industry disability ben-efit plan on unorganized workers in place of the State Disability Insurance pro-gram as the result of a simple majority vote of all the employees instead of thecurrent super majority

Federation-OpposedAppointments Defeated

Confirmation of Governor Wilson's reappointment of Robyn Black and SyedAlam to the Industrial Welfare Commission were refused by the State Senate.

Recognizing insufficient support in the State Senate for confirmation,Governor Wilson decided not to nominate Trice Harvey to the Agricultural LaborRelations Board and Carolyn Arnold to the Industrial Welfare Commission.

Recognizing insufficient support in the Senate Rules Committee for RobertaMendonca's confirmation to the office of Labor Commissioner, Governor Wilsonrequested no vote be taken.

Federation-SupportedBills VetoedCIVIL RIGHTS

1. AB 257 (Villaraigosa) would have included sexual orientation asunlawful discrimination within the provisions of the Fair Employment and HousingAct.

HEALTH

2. AB 794 (Gallegos) would have prohibited HMOs from denying care toa patient without disclosing the basis for their decision or even administering aphysical examination.

3. AB 1354 (Davis) would have allowed a woman receiving obstetricaland gynecological treatment to see a participating physician without first goingthrough an HMO's "gatekeeper," usually a lesser trained doctor.

HOUSING

4. SB 682 (Sher) would have allowed tenants who cannot afford a rentincrease to remain an extra 30 days at their old rent level tofind and move to newhousing.

PREVAILING WAGE

5. AB 1568 (Floyd) would have clarified the intent of existing law thatbars subcontractors from public works jobs for up to three years for willfully violat-ing prevailing wage provisions.

6. AB 958 (Washington) would have prohibited employers from requir-ing reimbursement from firefighters for expenses incurred during their hiring ortraining.

PUBLIC WORKS

7. AB 494 (Migden) would have used the penalties employers paid forfailing to comply with public works labor law and applied them to enforce thoselabor laws.

SAFETY AND HEALTH

8. AB 140 (Baca) would have required the Division of Occupational Safetyand Health to develop recommendations for establishing standards for trainingflag people to better control dangerous traffic situations.

9. AB 1015 (Knox) would have increased penalties on employers whowillfully violate OSHA standards and cause the death or serious injury of anemployee.

SOCIAL INSURANCE

10. SB 202 (Solis) would have speeded up payments of unemploymentinsurance benefits by basing eligibility on a claimant's most recent work experi-ence.

11. AB 1153 (Escutia) would have made eligible for disability insurancebenefits those undocumented immigrants who have already contributed moneythrough payroll taxes to the state Unemployment Compensation Disability Fund.

WORKER PROTECTIONS

12. SB 447 (Greene) would have prohibited employers from charging jobapplicants for processing their applications.

13. SB 680 (Solis) would have preserved the eight-hour day while allowingfor some employee choice of alternative workweek schedules.

14. AB 1167 (Floyd) would have enabled restoration of daily overtime reg-ulations repealed by the Industrial Welfare Commission by providing that a majori-ty vote of either house of the Legislature could overturn any IWC action takenafter January 1, 1997.

15. SB 48 (Solis) would have expanded eligibility for employment trainingfunds and allocated up to 20 percent of the annually available funds of theEmployment Training Panel to people thrown onto the job market by welfare"reform".
