Grading

Five for Florida

Economic Freedom

The Economic Freedom Scorecard includes more than 2,500 individual votes on twenty-seven legislative issues. Each of Americans for Prosperity-Florida’s (AFP-FL) legislative priorities is included on this scorecard, as well as any additional issues that we communicated support or opposition for during the 2014 session.

One point is awarded for each vote cast in support of a pro-economic freedom issue or against an anti-economic freedom issue. Each vote carries the same weight, regardless of the issue or whether the vote occurred in committee or on the floor. If a legislator voted on an issue twice and voted in favor of our position both times he or she received a score of 2/2. If he or she voted against our position both times they received a 0/2. We also award one point for prime sponsorship of a priority bill we supported, and deduct a point for sponsorship of a bill we opposed.

In 2012, AFP-FL released the Five for Florida plan. Five for Florida outlines five policies that elected officials can address now to encourage free market principles and government accountability, in order to make Florida number one for families, businesses and entrepreneurs. The Five for Florida plan is used to develop our legislative priorities. Each member of the Florida legislature received information on our legislative priorities as well as the Five for Florida plan. Read more about the plan at www.FIVEforFLORIDA.com.

Five for Florida is based on the principle of economic freedom and outlines policies that make a state more economically free. At its simplest, economic freedom is the freedom to choose how to produce, sell and use your own resources, while respecting others’ rights to do the same.1 A more economically free government has low taxes, a limited scope and size of government and government spending, limited government regulations, protects individual rights and prefers free markets over cronyism.

States with more economic freedom have higher economic growth, less debt per GDP and lower unemployment rates than less economically free states. However economic freedom is not only about the economy; it affects every aspect of our lives. Economic freedom leads to higher incomes, lower poverty, longer life expectancies, cleaner environments, improved equality and more happiness -- it leads to greater opportunity and an improved quality of life.

HB 61 / SB 156Vehicle Registration Fee CutSponsored by Rep. Hill & Sen. NegronThese bills lowered the amount charged to Florida vehicle owners to register the automobiles, reversing an increase put in place in 2009. This passed as SB 156 and was signed into law.

HB 134Corporate Income Tax CutSponsored by Sen. HukillThis bill increased the exemption for the corporate income tax from $50,000 to $75,000. The bill did not have a House companion and was not voted on in the House.

HB 195 / SB 188Education Data PrivacySponsored by Rep. Raburn & Sen. HukillThese bills protect Florida students from having personal and biometric information collected by school districts. This passed as SB 188 and was signed into law.

HB 243 / SB 800Memorial Opposing Federal Renewable Fuel StandardsSponsored by Rep. Geatz & Sen. EversThese Memorials asked Congress to repeal the Federal Renewable Fuel Standards. Neither bill was voted on in the House or Senate, but credit was given to the bill sponsors.

SB 266Communications Services Tax CutSponsored by Sen. HukillThis bill decreased the tax on telephone, cellular and cable services in Florida. The bill did not have a House companion and was not voted on in the House.

HB 751Expansion of TelehealthSponsored by Rep. Cummings & Rep. Mia JonesThis bill created the regulatory framework to support the increased use of remotely provided healthcare services for treatment of Florida patients. AFP did not support the Senate version of the bill and therefore did not include the Senate votes on the scorecard.

HB 847 / SB 712Taxes on Prepaid Cell PhonesSponsored by Rep. Davis & Sen. GalvanoThese bills clarified that prepaid cellular services are taxed at the standard sales tax. This passed as part of HB 5601, a larger bill that AFP did not key vote, and was signed into law. HB 847 was not voted on in the House, but credit was given the bill sponsor.

HB 875 / SB 1100Education Spending AccountabilitySponsored by Rep. Diaz, Rep. Fresen & Sen. FloresThese bills created a system to analyze return-on-investment for education spending in K-12 public schools, and what programs and spending created the best value for students. The Senate bill was not voted on, but credit was given to the bill sponsor.

HB 921 / SB 864Local Control of Educational MaterialsSponsored by Rep. Gaetz & Sen. HaysThese bills give local school districts the ability to review and select educational materials for K-12 schools. This passed as SB 864 and was signed into law.

HB 1103 / SB 1270Transparency for Economic Incentive ProgramsSponsored by Rep. Rodriguez & Sen. SobelThese bills increased the transparency in Florida’s economic development incentive programs. Neither bill was voted on in the House or Senate, but credit was given to the bill sponsors.

HB 1389 / SB 1618Open Market for Car Hire ServicesSponsored by Rep. Grant & Sen. BrandesThese bills prohibited local governments from restricting access to operate as a hired car service.

HB 391 / SB 482Florida CAT Fund ReformsSponsored by Rep. Hagar & Sen. HaysThese bills decreased the assumed risk of the Florida Hurricane Catastrophe (CAT) Fund, which is government run and backed by taxpayers. The bills were substantially, unfavorably amended in their first committee hearings, and therefore votes were not counted on the scorecard. However, credit was given to the bill sponsors.

HB 5103Florida Personal Learning AccountsSponsored by Rep. BilecaThis bill established the Florida Personal Learning Accounts program for students with disabilities. This passed as SB 850 and was signed into law.

BradleyThese bills established a uniform Charter School contract to be utilized by all Florida school districts and allow Charters to utilize unused school district buildings. The Senate bill was unfavorably amended in its first committee hearing, therefore votes on SB 1528 were not counted on the scorecard. However, credit was given to the bill sponsor.

HB 7099 / SB 1620Corporate Income Tax Scholarship ProgramSponsored by Rep. Manny Diaz & Sen. GalvanoThese bills expanded Florida’s Corporate Income Tax Scholarship Program, allowing more children to participate. The Senate bill was not voted on, but credit was given to the bill sponsor. Portions of this bill passed as SB 850 and were signed into law.

HB 7167 / SB 850School ChoiceSponsored by Rep. Fresen, Rep. M. Diaz & Sen. Legg BradleyLanguage from HB 7099 and HB 5103 was amended onto these bills, creating the Florida Personal Learning Accounts Program and expanding access to the Corporate Income Tax Scholarship Program. SB 850 was a larger education bill that was not key voted prior to being amended to compare to HB 7167. Therefore only votes taken after the language from HB 7167 was added to the bill are counted on the scorecard.

DetertThese bills extended the Entertainment Industry Financial Incentives Program and provided $300 million in taxpayer-funded incentives for the television and film industry. HB 7095 / SB 1216Incentives for Professional Sports TeamsSponsored by Rep. Patronis & Sen. LatvalaThese bills created an application process for professional sports teams that are renovating or constructing stadiums to receive taxpayer-funded handouts, it increased the amount of handouts given to spring training teams and allowed projects already under construction to circumvent the newly created approval process. This passed as HB 7095 and was signed into law.
