Summary

Bristol City Council has a duty to divide the authority area into polling districts and to designate a polling place for each polling district. A review is being held now due to a change to the timing of the compulsory reviews that directed that one must be completed before 31 January 2015.

The significant issues in the report are:

Neither the boundaries of parliamentary constituencies nor the local ward boundaries are part of the review The Local Government Boundary Commission of England (LGBCE) is currently undertaking a separate review of Bristol City Councils ward boundaries. That review is on-going and does not apply to this review. Upon completion of the LGBCE ward boundary review, another polling district and polling places review will be held in autumn 2015 to adjust the polling districts/places to meet any subsequent ward boundary changes. It is considered expedient to designate polling places as polling districts thus ensuring that the Returning Officer is able to properly exercise her statutory discretion in the identification of polling stations within those areas, though prior to major elections the Returning Officer will advise political parties of the situation of the actual polling stations used, and will consider any comments made. Policy 1. There is no specific Council policy applicable to this report. Consultation

A six week public consultation was held between 01 September 2014 and 12 October 2014. In addition to this public consultation the following internal and external persons were directly consulted:

2. Internal 2.1 All Bristol City Council councillors. 2.2 Bristol City Council Party Group offices. 2.3 The Mayor of the City and County of Bristol. 2.4 The Acting Returning Officer for all four constituencies. 2.5 Bristol City Council – Equalities and Social Inclusion Team.

3.1 All MEPS for the authority area. 3.2 All MPs for the authority area. 3.3 The Police and Crime Commissioner. 3.4 Political parties active within the authority area 3.5 Eighteen disability and age related equality organisations within the authorities area. 3.6 VOSCUR.

Context 4. 4.1. Under the Representation of the People Act 1983, Bristol City Council

has a duty to divide the authority area into polling districts and to designate a polling place for each polling district. A review is being held now as The Electoral Registration and Administration Act 2013 introduced a change to the timing of compulsory reviews for UK Parliamentary polling districts and polling places and directed that one must be completed before 31 January 2015

4.2. The principle reason for conducting a review is to ensure that polling is accessible for all electors.

4.3. The Council must:

seek to ensure that electors have such reasonable facilities for voting as are practicable in the circumstances,

seek to ensure that so far as is reasonable and practicable, polling places are accessible to all electors including those who are disabled.

4.4. Bristol comprises 35 wards, each of which is divided into polling districts.

The wards are currently divided into 159 polling districts.

4.5. It is the responsibility of local authorities to divide their areas into polling districts for the purpose of Parliamentary elections, and to designate a polling place within each district. Local government polling districts are based on Parliamentary polling districts

4.6. A polling place is defined as the area or building within which a polling station is selected by the Returning Officer. Currently, the polling places in Bristol are defined as the area of each polling district. The Returning Officer has responsibility at each election for selecting the polling station within the area of the polling place/district.

4.7. The public consultation was delivered via an e-consultation at www.bristol.gov.uk/pollingreview and ended at midnight on Sunday 12 October 2014. It resulted in 24 valid responses being received, details of which have been attached to this report in appendix C.

Proposal 5. Five proposals have been made as a result of the public consultation and

subsequent review of responses. Knowle: Rename polling district “KEA1” to “KEA” (to standardise

naming) Horfield: Amalgamate polling district HDE1 into HDE (no effect on

polling station used) Lockleaze: Amalgamate polling district LZD1 into LZD (no effect

on polling station used) Eastville: Create a new polling district EEE, to include properties

and electorate from existing districts EEA and EEB Accept the schedule of polling places and polling districts as

attached in appendix A, which includes the 4 changes above.

5.1. KNOWLE: RENAME POLLING DISTRICT “KEA1” TO “KEA” 5.1.1. A standardised naming convention is in place at Bristol Council

for all 159 polling districts, with the exception of one; KEA1 in Knowle. 5.1.2. The standard naming format of polling districts is 3 letters. The

first 2 indicate the ward (AY=Ashley; AH=Avonmouth; BR=Bedminster; etc). The last letter indicates the polling district within the ward. Within the ward, all polling districts run alphabetically from A. (A, B, C, etc).

5.1.3. By implementing all the proposals of this report, the polling district naming convention will become consistent; historical exceptions that have no practical use will be removed and thus the identification of the polling districts will become clearer and more intuitive.

5.1.4. This change does not affect the polling station used by the electorate of KEA1.

5.1.5. A map of the affected area has been included in appendix D.

5.2. HORFIELD: AMALGAMATE POLLING DISTRICT HDE1 INTO HDE 5.2.1. Currently polling district HDE is split into two (HDE and HDE1). 5.2.2. The combined electorate as at 01 July 2014 is 1,360 with only

1,138 voting at the polling station. 5.2.3. For all elections to date both these polling districts share the

same polling station, and the same staff and effectively operate as a single entity.

5.2.4. The reason for the split of HDE into 2 parts was historically to allow part of the area of Horfield to vote in Bristol West constituency, rather than Bristol North West as it currently is.

5.2.5. Amalgamating these two polling districts will make the polling districts match the reality on the ground, improve the naming convention of polling districts and reduce unnecessary election set up work by electoral services.

5.2.6. This change does not affect the polling station used by the electorate of HDE and HDE1.

5.2.7. A map of the affected area has been included in appendix E.

5.3. LOCKLEAZE: AMALGAMATE POLLING DISTRICT LZD1 INTO LZD 5.3.1. Currently polling district LZD is split into two (LZD and LZD1).

5.3.2. The combined electorate as at 01 July 2014 is 2,356 with only 1,948 voting at the polling station.

5.3.3. For all elections to date both these polling districts share the same polling station, and the same staff and effectively operate as a single entity.

5.3.4. The reason for the split of LZD into 2 parts was historically to allow part of the area of Lockleaze to vote in Bristol West constituency, rather than Bristol North West as it currently is.

5.3.5. Amalgamating these two polling districts will make the polling districts match the reality on the ground, improve the naming convention of polling districts and reduce unnecessary election set up work by electoral services.

5.3.6. This change does not affect the polling station used by the electorate of LZD and LZD1.

5.3.7. A map of the affected area has been included in appendix F.

5.4. EASTVILLE: CREATE NEW POLLING DISTRICT EEE 5.4.1. Currently Eastville is split into four districts. 5.4.2. A request was received to create a new polling district EEE.

This would facilitate meeting the ARO’s (Acting Returning Officers) desirable criteria of ensuring that polling stations are within 1 mile safe walking distance.

5.4.3. The initial change proposal requested an alteration to the ward boundary. This is outside the scope of this review as ward boundaries are part of the current Local Government Boundary Commission for England’s review.

5.4.4. The new district EEE includes the east part of the current district EEA, and a small part of current district EEB to include the area round Bristol Metropolitan Academy. It will consist of 681 properties representing 1,112 electors who vote at the polling station.

5.4.5. A map of the affected area with a list of streets to move into the new polling district EEE has been included at appendix G.

5.5. ACCEPT THE SCHEDULE OF POLLING PLACES AND POLLING

DISTRICTS 5.5.1. The schedule of polling places and polling districts is detailed in

appendix A. 5.5.2. Upon review of the public consultation responses, it was

identified that only the changes listed in section 5.1, 5.2, 5.3 and 5.4 be implemented. No other change has been made to the existing schedule of polling places and polling districts.

5.5.3. It should be noted that polling station changes have also been made but that they are the responsibility of the Returning Officer and are therefore outside the scope of this report. For information, a list of current polling stations and changes for the 7 May 2015 elections have been

included in appendix B. Other Options Considered 6. A public suggestion was made to enable the Portakabin at Dunbridge

playing fields (EGC) to be replaced with a permanent building (St Aidan’s Church Hall). This suggestion is being reviewed but cannot be completed within the timescale of this review without risking a substantial increase in the number of voters using the Portakabin at a UK Parliamentary election. This would happen if the suggested replacement is either unsuitable or unavailable and the boundary was moved in advance. Therefore this suggestion to extend the boundary of polling district EGC into EGB and to replace the Portakabin with a building within the new boundary of EGC will be reviewed with a view to implementing it, if practical, in the 2015 polling district and polling places review that follows the Bristol City Council ward boundary review.

Risk Assessment 7. The Polling Places and Polling Districts Review represents the Council’s

statutory duty to ensure that polling is accessible for all electors. The risk is that not pursuing the actions may lead to the review not being completed by the statutory deadline of 31 January 2015.

Public Sector Equality Duties 8a) Before making a decision, section 149 Equality Act 2010 requires that

each decision-maker considers the need to promote equality for persons with the following “protected characteristics”: age, disability, gender reassignment, pregnancy and maternity, race, religion or belief, sex, sexual orientation. Each decision-maker must, therefore, have due regard to the need to:

i) Eliminate discrimination, harassment, victimisation and any other

conduct prohibited under the Equality Act 2010. ii) Advance equality of opportunity between persons who share a

relevant protected characteristic and those who do not share it. This involves having due regard, in particular, to the need to -- - remove or minimise disadvantage suffered by persons who share

a relevant protected characteristic; - take steps to meet the needs of persons who share a relevant

protected characteristic that are different from the needs of people who do not share it (in relation to disabled people, this includes, in

particular, steps to take account of disabled persons' disabilities); - encourage persons who share a protected characteristic to

participate in public life or in any other activity in which participation by such persons is disproportionately low.

iii) Foster good relations between persons who share a relevant

protected characteristic and those who do not share it. This involves having due regard, in particular, to the need to –

- tackle prejudice; and - promote understanding.

8b) As set out earlier in the report, the purpose of this review is to ensure

that polling is accessible for all electors and thus that polling places and polling districts are set up to enable the Returning Officer to identify polling stations that meet this aim.

Legal and Resource Implications

Legal Section 18 of the Representation of the People Act 1983 requires the Council to review the way it divides its area into polling districts and to identify a polling place for each district. When reviewing polling districts, the authority must seek to ensure that all electors in a constituency in its area have such reasonable facilities for voting as are practicable in the circumstances. When designating polling places, the following rules apply; (a)the authority must seek to ensure that all electors in a constituency in its area have such reasonable facilities for voting as are practicable in the circumstances; . (b)the authority must seek to ensure that so far as is reasonable and practicable every polling place for which it is responsible is accessible to electors who are disabled; (c)the authority must have regard to the accessibility to disabled persons of potential polling stations in any place which it is considering designating as a polling place or the designation of which as a polling place it is reviewing; . (d)the polling place for a polling district must be an area in the district, unless special circumstances make it desirable to designate an area wholly or partly outside the district; . (e)the polling place for a polling district must be small enough to indicate to electors in different parts of the district how they will be able to reach the polling station.

I propose a change to the existing polling station. I vote at St.Barnabas in Ashley. When we vote, the school closes for the day. I

understand that this is very frustrating for the school and for parents of kids at the school (I know, we used to have the same challenge at Colston's Primary School). I think we should do everything we can to enable the school to remain open for the day. If this means finding an alternative location, then we should do so. It's really not fair on people for the school to have to close for the day. We should seek to find a location that doesn't interfere with our children's education.

I propose a change to the existing polling station I am a staff member on Polling Day usually at the Blenheim Scout Hut. As the local

electorate never fail to remind me, why has the polling station moved here from the primary school? They complain about access, parking, the road not being wide enough, lighting and other matters. Bedminster Down secondary / senior school is already used as a polling station, so why not move this one back from the scout hut into the primary school where it seems it had been located for many years?

ELECTORAL SERVICES COMMENT o In 2012 the polling station was moved from the Primary School to the Scout

Hut in order to avoid the closure of the school on polling day. This meets one of the desirable criteria for selecting polling stations.

o The Scout Hut is a high quality venue that is viewed as one of the better venues within the authorities area.

I propose a change to the polling district boundary The area of Cotham that lies between Cotham Brow and Stokes Croft that was

included into Cotham ward at the last boundary change should be returned to what is now the Cabot area. The streets that I refer to are: Fremantle Road (between Clare Road and Cotham Brow) Clare Road Victoria Walk Victoria Gardens Sydenham Hill Sydenham Road (between Nugent Hill and Cotham Brow Gibson Road Arley Hill (Between Cheltenham Road and Cotham Brow) Cotham Brow (South side from Cheltenham Road to Fremantle Road. This would return these streets to a natural policing boundary that existed before the last ward changes and relate them to the rest of the Kingsdown area.

ELECTORAL SERVICES COMMENT o This proposal is aiming to alter the ward boundary by moving streets from

Cotham ward into Cabot ward. o Ward boundary alterations are outside the scope of the polling district review

Consultation Responses affecting this ward Eastville

I propose another change Proposal to create a new polling district (EEE) at Bristol Metropolitan Academy

Eastville Ward has been making submissions for an additional polling area (EEE) as far back as 2009 and a firm proposal was submitted at a meeting of the Election and Democracy Committee meeting 13.12.2011 which was backed by Council officers but dismissed by the EDC. Council officers identified almost 600 properties where residents live more than 1 mile from their polling station at the Stapleton Church Hall (EEA), including the Trendlewood Estate, Meadowsweet Estate, Small Lane and Snowdon Road. Officer suggestions at that time was to move all properties from Wickham Hill to Fishponds Road, (including Shannaways Court. Snowdon Close and Channons Hill, currently in EEB), to the new polling area (EEE) with a polling station at the Bristol Metropolitan Academy. As part of the current Ward boundaries review, Eastville Ward has submitted a proposal that the student halls of residence ( Glenside Campus currently in the Frome Vale Ward) should move to Eastville. This would increase the electorate in this area by around 250. We still believe that this proposal makes sound sense and would allow us to engage more closely with the local student population and to encourage more people to partake in the democratic process. Just to add, an email from the Electoral Services Manager prior to the December 2011 meeting of the EDC stated “that our proposal for a new polling district, EEE, if accepted, makes perfect sense”.

ELECTORAL SERVICES COMMENT o Ward boundary alterations are outside the scope of the polling district review

as they are the responsibility of the Local Government Boundary Commission for England.

o This proposal includes the requirement for properties and electorate to move from Frome Vale ward to Eastville ward.

o Whilst we cannot undertake the changes to the ward boundary, we are proposing to create a new polling district EEE.

o This would facilitate giving electors the potential to visit a polling station within 1 mile of their home.

Consultation Responses affecting this ward FVC/FVB

I propose a change to the existing polling station The proposed polling station is right on the edge of the polling district (FVC) and can

be difficult for some electors to reach. A polling station at the Vassall Centre or Little Hayes Nursery would be much more central and easily accessible. Fishponds Library is shut but it is still marked on the map as a polling station can. If Robinson House is the alternative then again it is right on the edge of the FVB and not easily accessible for some voters.

ELECTORAL SERVICES COMMENT o FVB: Whilst the former Fishponds library is shut for general public use, it is

still usable as a polling station. Therefore an alternative is not required. o FVC: Two suggestions for change were given for FVC. The Vassall Centre is

unusable as it is out of polling district. It is located in FVD. The second suggestion is Little Hayes Nursery. There are two Little Hayes Nurseries, both located at the far edges of the polling district. Therefore we will continue to use the Little Hayes Nursery in Frenchay Road.

I propose a change to the existing polling station I propose another change At the recent election the proposed Kersterman Rd polling station was abandoned at

short notice; people were asked to travel to another location at Redland Green. This was difficult for many elderly residents, caused lengthy walks or double bus journeys and may have discouraged voting. A proper replacement site for the missing RDC site needs to be found and fixed. The doubled up site at RDA was congested, caused queueing and people pushing past each other, and was inadequate for two districts to fit into. At a General election this would be worse.

In addition the RDD site at St Andrews park was scene of confusion and irregularities: people voted in the wrong elections (wrong ballot papers had to be removed from the boxes at the count!) and many more people tried to attend the wrong location for Ashley, I witnessed, before being put right outside or within the polling station. Signage needs to be improved and messages on voting cards needs to be clarified. Also voting registers were not up to date initially at open of poll at sites in Redland - this needs to be put right for all future elections

ELECTORAL SERVICES COMMENT o The short notice loss of a polling station at Kersterman Road was due to

problems outside of the control of the Returning Officer. This review has not brought to my attention any new buildings suitable to use. We are therefore continuing to acquire a suitable venue within the polling district.

o RDD: The comments made are outside the scope of this review but will be investigated ahead of the next ordinary election on 7 May 2015.

Gareth there were major problems in the dark nights at the Fonthill Polling station D box. The lighting goes off early, and it’s a very lonely place with youngsters collecting behind the rear of the this old school. Also to enter last time there were stairs and seemed to be no provision for elderly or disables. Polling station down a long corridor with very little notices.

ELECTORAL SERVICES COMMENT o An investigation is currently being undertaken to ensure that the polling

station is held in a suitable room within the venue and matches the requirements agreed with the venue.

Although I have ticked for no change, the issue for many in Southville is the lack of public transport. I use a mobility scooter, so I am able to get to the Southville Centre. However many older or disabled voters cannot access the building due to the lack of a bus service. Even the use of postal voting is not an option that many older residents feel comfortable with. As to on line voting, many older residents do not use the internet. They cannot access the computer at the library etc due to the lack of buses.

ELECTORAL SERVICES COMMENT o This comment relates to SEB. Due to the lack of bus services, options for

alternatives have been reviewed. Unfortunately there aren’t any better locations available within the polling district.

I propose a change to the polling district boundary I propose a change to the existing polling station I note that currently EGC has a much lower number of voters than EGB (845

compared with 3,101). This could be made more balanced by including houses to the west of the Air Balloon Rd / Nags Head Hill/ Nicolas Lane line in EGC. St Aidan's Church Hall would then be within EGC and would be a much more convenient polling station than the current portacabin that is not even placed within the polling district. If you are going to use a portacabin then at least put it in our polling district, eg the Council owned land adjacent to 173 Crews Hole Rd.

ELECTORAL SERVICES COMMENT o Time does not allow for a thorough review of this complex recommendation

within the life of this review. o Therefore this suggestion will be thoroughly investigated ahead of the 2015

review to ensure the change can be properly implemented.
