Pledge of Allegiance to the Flag of the United States Mayor Johnson recognized the passing of former Mayor Ann Feeney and spoke about her numerous contributions to the community and of her legacy. WAVE (Western Washtenaw Area Value Express) – WAVE Board President, Jim Carson presented an annual report including information regarding ridership and transportation cost allocation. He thanked City Council for the years of partnership for providing mobility for residents. Public Comments 1. Thirteen Chelsea City and Township residents commented. Residents expressed their
support of City officials for engaging with and listening to the residents regarding the protests. Residents also expressed concerns regarding the police response to the Friday night youth protest and support a second listening session.
2. Fire Chief Arbini provided information for classes offered to residents regarding cultural awareness and anti-bias training.

Mayor Johnson is requesting City Council, the Police Department and City Staff hold a second Community Listening Session. The format would be same as the first session held on July 15:
MOVED Albertson SECONDED Iannelli to set the second Community Listening Session for Wednesday, August 12, 2020 at 6:00pm with two changes to the agenda as noted by Mayor Johnson: add item 2(b) title ‘Q&A’ and change item 1(e) to read ‘City may not be able to….’ instead of ‘City cannot...’. 2. Planning Commission Appointment (submitted by Mayor Johnson)

MOVED Feeney SECONDED Albertson to appoint Laura Lake to the Planning Commission for a term to expire 6/30/2023. Roll Call Vote. All Ayes. Motion Carried.
3. Ranked Choice Voting for Council Appointed Seats (submitted by Council Member Iannelli) In an effort to make the appointment process more equitable and to ensure candidates have to win a majority of the votes to be appointed to fill vacant council seats, commission positions, and any other council appointed seats, I am suggesting Council consider a switch to Rank Choice Voting. A brief explanation from https://rankmivote.com/ In ranked choice voting, councilmembers rank as many candidates as they want in order of preference. If any candidate has a majority (more than half) of the first preference votes, then that candidate is elected. Otherwise the ranked choice voting process builds a majority by eliminating the least-supported candidates and transferring ballots cast for the those eliminated to the voters’ next preference. Ranked choice voting ballots are counted in a series of rounds. First, all the first choices are counted; if any candidate has a majority of votes, (more than 50%) that candidate wins. Otherwise, the last place candidate (the candidate with the fewest votes) is eliminated and any votes cast for that candidate are transferred to the voter’s next preference. (if the voter chose to rank more candidates) After each round of counting, we check again to see if any candidate has won a majority. If not, again, the candidate with the fewest votes is eliminated and there is another round of counting. Candidates continue to be eliminated after each count until one candidate has won the majority.
MOVED Pacheco SECONDED Iannelli to direct staff to utilize ranked choice voting where council members rank candidates on their ballots in order of preferences for any appointment process made by the council, if no candidate receives majority support of first place vote, ballots are counted as an instant run off election until someone earns 50% of the vote; with two modifications by Mayor Johnson; 1. run as a pilot first and 2. modify to reflect which appointments are allowed by law, this was ACCEPTED by Pacheco and Iannelli. Roll Call Vote. 2 Ayes, 4 Nays (Johnson, Albertson, Feeney, Wiseley). Motion NOT Carried.
4. Chelsea POP Final Design Plan (Discussion) (submitted by City Manager Hanifan) The Transportation Working Group, in conjunction with Washtenaw Area Transportation Study (WATS) has completed the design plan for traffic calming demonstration project

5. Request for Purchase of Tractor and Attachments (submitted by DPW Superintendent Bollinger) We are requesting the purchase of a new 4 x 4 tractor with attachments to support public works maintenance operations. We have requested and received 3 quotes:
1. Boullion Sales – Kubota F2690 tractor with broom and snow blower: $35,332.62 2. Napolean Lawn – John Deere 1575 with broom: $40,946.10 3. Napolean Lawn – John Deere 1585 with broom: $42,960.60
MOVED Albertson SECONDED Wiseley to approve the purchase of the Kubota F2690 tractor and attachments as quoted from Boullion Sales for the cost of $35,332.62. Roll Call Vote. All Ayes. Motion Carried.
6. Request for Purchase of Ride On Spreader (submitted by DPW Superintendent Bollinger) We are requesting the purchase of a new ride on spreader in support of Public Works maintenance operations. We have requested and received 3 quotes:
1. Superior Industrial – Ferris Model XC-FS1100: $5,849 2. Weingartz – Spyker S270: $7,759 3. Weingartz – ExMark Z-Spray: $11,119
MOVED Feeney SECONDED Albertson to approve the purchase of the Ferris model XC-FS1100 from Superior Industrial Sales for a total cost of $5,849. Roll Call Vote. All Ayes. Motion Carried.
Staff Reports
• City Manager Hanifan reminded everyone to vote on Tuesday, August 4th at the Washington Street Education Center. Polls are open from 7:00am to 8:00pm. Mr. Hanifan reported on the Zoning Ordinance Community Engagement session on Saturday, August 1st where they received over 150 comments. An on-line engagement tool is available on the City Website under ‘Planning & Zoning’. Various streets will have scheduled crack fill applied. Parks Commission will meet on Tuesday, August 4th at 9:00am via Zoom.

• Council Member Iannelli said the Human Rights Commission will meet on Wednesday, August 5th at 6:00pm via teleconference. The agenda and meeting information is on the City website. WWRA will meet on August 26th. WWRA is welcoming new member Pam Byrnes of Lyndon Township.
• Council Member Wiseley watched the Planning Commission meeting. He hopes that the Council vacancy candidates are following and watching the council meetings.
• Council Member Pacheco was not able to attend the August 23rd Transportation Working Group. Ms. Pacheco will send information for the next CAPT / DART meeting as soon as it is available to be posted on the city calendar.
• Council Member Albertson said Mr. Hanifan already covered the information regarding the Zoning Ordinance Community Engagement session.
• Mayor Johnson reported on the Transportation Working Group meeting. Mr. Hanifan and WATS were in attendance. They reviewed findings from the POP public engagement and surveys. The Chelsea POP Final Design Plan was discussed earlier in the council meeting. Mayor Johnson met remotely with CAFA and Mr. Hanifan regarding CAFA’s articles of incorporation which will be reviewed and presented to council. On July 28th, Mayor Johnson had a pre-audit meeting with the auditors.
On July 30th, Mayor Johnson remotely met with County Manager Dillard and Commissioners Maciejewski and Morgan regarding some security concerns at the courthouse in Chelsea. The Parks Commission meets on August 4th. The State Primary Election is August 4th and the polls are open until 8:00pm to vote in person. Absentee ballots can be dropped off until 8:00pm. SEMCOG RRC meets on August 6th where they will look at grant funding. Mayor Johnson said Washtenaw County Board of Commissioners will be voting to add a public health and senior millage to the November ballot. She recommends contacting your County Commissioner if you would like more information. Mayor Johnson said City Council is always open to listening to residents. There is always an opportunity for engagement by phone and by email. City Council contact information is listed on the city website. Opportunities for engagement are also available through City Council meetings which are public, open and known. Mayor Johnson congratulated Thompson’s Pizza for their 50th anniversary. She wished them continued success.

Explanation of Agenda Item: A complaint was filed (Complaint #20-3) against the Chelsea Police Department regarding conduct of the department on Friday, July 31st. Because the complaint concerned the Chief and the department, it is not advisable for the Department to review the complaint internally.

City Manager Comments/Recommendation: City Council has three options:
1) Assign City Staff to review the Complaint
2) Review the Complaint as a Council. City Charter, Section 6.8:
Section 6.8 INVESTIGATION INTO CONDUCT OF OFFICE, EMPLOYEE, ETC; POWER TO SUMMON AND COMPEL ATTENDANCE OF WITNESS AND PRODUCTION OF EVIDENCE.
a) The council or any person or committee authorized by it for the purpose, shall have power to inquire into the conduct of any department, office, officer or employee of the city and to make investigations as to matters in which the municipality has an interest. The council, for the purposes stated herein, may summon witnesses, administer oaths, and compel the attendance of witnesses and the production of books, papers, and other evidence.
b) Failure on the part of any officer to obey such summons or to produce books, papers, and other evidence as ordered under the provisions of this section shall constitute misconduct in office. Failure on the part of any employee to obey such summons or to produce books, papers, or other evidence as ordered under the provisions of this section, shall constitute a violation of this charter and such employee when found guilty of such violation by a court with proper jurisdiction may be punished by a fine of not to exceed five hundred dollars, or imprisonment not to exceed ninety days, or both, at the discretion of the court.
c) It is provided further that, in case of failure on the part of any person to obey such summons or to produce such books, papers, and other evidence as so ordered, the council may invoke the aid of the Circuit Court of Washtenaw County in requiring obeyance of such summons or production of such books, papers, and other evidence.
3) Request an outside agency review the complaint. This could be Washtenaw County Sherriff, Michigan State Police or a private audit or legal firm.
Because the complaint concerned the Chief and the “department”, it is not advisable for the Department to review the complaint internally.

In accordance with the schedule for filling the vacancy, City Council should schedule interviews for Monday, August 24th. Staff is recommending interviews start at 6pm and be held every half hour. Staff is recommending Zoom interviews be held and that each candidate is asked a standard set of questions.

The Chelsea Human Rights Commission (HRC) is requesting permission to release the attached policy statement. Appointed boards and commissions do not have the authority to issue individual statements. Policy formulation is the role of City Council.
From the City Charter: Section 3.2 CITY COUNCIL COMPOSITION AND P OWER
“……The council shall constitute the legislative and governing body of the city and shall have the power and authority to adopt such ordinances and resolutions, as it shall deem proper in the exercise of its power.”
It is appropriate - subject to the limitations of the City ordinance or Council Resolution that created the board or commission - for a board or commission to:
• make recommendations to request City Council issue statements, or re-statements of City policies;
• request Council take action;
• or request Council permission to take action;
Nothing would preclude the City Council from issuing a similar statement if it desires

Proposed Statement on Racism
August 2020
Responding to the ongoing protests and public discussion regarding racism and Black Lives
Matter, the Chelsea Human Rights Commission would like to re-affirm its dedication to the spirit
and substance of Chelsea's Non-Discrimination Ordinance. Racism in any form is not acceptable
whether that comes from an individual, a group, an institution or a government agency. The
Human Rights Commission was created to study complaints of violations of the Non-
Discrimination Ordinance in our town and to actively "research and formulate programs of
community education with the objective of discouraging and eliminating racial tensions and
prejudice or discrimination against any group or persons". We encourage peaceful protests and
the continued Community Listening Sessions that raise our awareness of the depth of the
problem. We will work with area groups and citizens to understand, highlight and eliminate
personal and institutional racism.
