CALL TO ORDER/ROLL CALL – C h a i r M c P h e e called the r e gu l a r meeting of the Emergency Medical Services

Council (EMSC) to order at 3:30 PM.

I. APPROVAL OF AGENDA – MSC – McPhee added a presentation by Kerrie Austin, with Dispatch Health, to public

participation. (Greenstein/Oliva) move to approve the agenda as amended, and this carried.

II. PUBLIC PARTICIPATION – Kerrie Austin provided information on how Dispatch Health works.

III. REVIEW AND APPROVAL OF MINUTES

A. EMS COUNCIL – July 17, 2019 (Hambly/Greenstein) move to approve, and this carried.

B. OPERATIONS COMMITTEE – August 1, 2019 (informational only)

IV. COMMITTEE REPORTS

A. OPERATIONS COMMITTEE: VanCamp reported: 1) A report was provided by the Training Advisory Committee for

2020. 2) Ops has recommended to remove SORT from the Special Project application. 3) Bid farewell to Chief Wright. 4)

Small group of the Chiefs visited with Chief Peterson, who was injured in a motorcycle accident, and he is improving.

B. WEST REGION: Report was handed out.

C. STAFF REPORT: Staff report is included in the packet. 4,261 citizens trained in CPR to date which exceeds the total number

for 2018.

D. COMPREHENSIVE PLAN: No official report, however Chief VanCamp said the plan is getting much closer for an EMSC

review.

V. OLD BUSINESS

A. Fiscal Analysis of Reimbursement for Fire Agency Transport with Paramedic – At the July EMSC meeting, a

councilmember asked for a fiscal analysis on the cost of reimbursing public agencies for ALS transport. In 2018

there were 11 private agency transports and 0 public agency transports. Year-to-date in 2019 there have been 7

private agency transports and 1 public agency transport. Each pay out is less than $500, per current CMS rates.

(Greenstein/Edwards) move to approve reimbursing public agencies at the CMS rate that was previously

established for private agency transports.

B. BLS Funding Agreement – (Hambly/Gleckler) move to recommend approval of the BLS Funding Agreement.

VI. NEW BUSINESS

A. 2nd Quarter 2019 TYD Budget Review – The overall budget, year-to-date is 40% expended (Admin – 46%, ALS –

41%, BLS – 53%, ER&R – 0%).

B. Remove SORT from Special Projects Application – It was decided at Ops that SORT does not need to be a part of

the Special Projects application process because the SORT team has never been denied the Medic One budget of

$5,000. (Hambly/Greenstein) move to suspend the EMSC rule, which asks for a discussion at an EMSC meeting the

month before asking for an approval on a budget item, and this carried. (Ricks/Slater) move to approve removing

SORT from the Special Projects application, and this carried.

C. ALS Cardiac Monitor Replacement – Included in the meeting packet is an Executive Summary for Medic One

cardiac monitor replacement. Miller-Todd explained that Medic One is formally recommending the purchase of

Physio Control LIFEPAK 15 cardiac monitors. This will come back to the Council in September for a

recommendation to the BoCC.

VII. PUBLIC PARTICIPATION – None

VIII. GOOD OF THE ORDER – 1) There will be a retirement party for Chief Wright at OFD, Thursday, August 29th at

noon. 2) Chair McPhee recommended Council to contact staff with questions on agenda items, before the meeting.

The packet is sent out at least 5 days before the meeting which is ample time for review. 3) Starting September 16th

Ben Miller-Todd will be working (4) ten-hour shifts, Tuesday thru Friday, as he will be finishing up his master’s degree

in public health.

V. COMMITTEE REPORTS

A. WEST REGION – 1) At the last meeting there was a presentation by Dolly Fernandez, DOH, on the American

College of Surgeons report and the next steps the State is going to take. There will be four seminars put on

across the state and DOH will put those dates out. 2) The 2020 conference will be in March. 3) The strategic

plan was changed and reoriented towards different goals. Kathy said it just looks more streamlined.

B. SUBCOMMITTES

1. Equipment Committee (EqC) – Miller-Todd reported: 1) New pediatric restraint systems will be deployed

to all medic units. 2) There continues to be a drug shortage nationwide on epinephrine, sodium

bicarbonate, and D50. As a result to this, an edit to the protocol for D50 has been made.

2. Mass Casualty Incident (MCI) Committee – LaVielle reported: MCI committee will meet September 26th

at 1:30 at TFD. The committee will be reviewing AAR’s from the MCI drills over the summer.

3. Training Advisory Committee (TAC) – Jim Brown reported: 1) The committee has been working on

preliminary subjects for the curriculum for 2020. There will be a retreat on the 19th.

4. Transportation Resource Utilization Committee (TRU) – Brooks reported: TRU has been combined with

the Hospital Diversion committee and there has not been a meeting since the last Ops meeting. Dr.

Fontanilla added, since the last diversion committee meeting, it has been obvious that providers in the field

may not understand completely the processes, hence a letter went out about this. If there are questions

about diversion, providers are encouraged to ask.

5. Staff Report – Staff report is included in the packet.

VI. OLD BUSINESS

A. EMS Council Action Report – August meeting minutes are in the packet.

B. Special Projects Application & Matrix – A revised matrix and application was included in the packet to reflect

the removal of SORT (as discussed and approved at the last EMSC meeting), and the proposed change of

adding “alternate funding” and removing “volunteer training”. Chief Brooks will present at the next Fire

Chiefs Association meeting, and present back to Ops in November.

C. BLS Contract Update - A meeting is scheduled for September 19th at 0900 to discuss the BLS Funding

Agreement renewal for 2020.

VII. NEW BUSINESS

A. 2020 OTEP –Anna Lee Drewry provided a presentation on 2020 Online Training & OTEP. TAC continues to

evaluate/compare online platforms. So far users prefer 24/7 for ease of use, relevant/professional content, and

the ability to add Thurston County specifics. Subjects in OTEP 2020 will include Death &

Dying/POLST/Advanced Directives; Documentation; Airway; Behavioral Health of Provider (online only); MCI;

and Neurological Emergencies. Situational awareness will be added to each subject.

B. Cardiac Monitors – A decision has been made to recommend Physio vs. Zoll as the ALS cardiac monitor. This

is scheduled to go before the BoCC on October 22, 2019.

C. Staff Update – Ben Miller-Todd’s schedule will change this month to (4) 10’s, Tuesday – Friday, as Ben finishes

his master’s in public health. Also, the Information & Quality Coordinator position Medic One has been trying

to fill has been flipped over to a Business Applications Technician II position. This position will be posted once

the requisition has been approved.

VIII. GOOD OF THE ORDER – 1) EMS night is October 29th at the SPSCC Lacey Campus, beginning at 5:00 pm. 2)

Chief Brooks introduced Jennifer Schmidt, LFD’s new Deputy Chief of Operations. 3) Medic One will be moving

forward with purchasing the budgeted 45 AEDs for Thurston County law enforcement. 4) Staff has been working for

some time on setting up a health data exchange with PSPH, and as of today PSPH has agreed to put this interface in

at St. Peter’s and Providence Centralia.

EMS COUNCIL STAFF REPORT FOR 09/18/2019

ALS Update:

• Thurston County Medic One is reworking the job description for the Information

and Quality Coordinator position. Please keep your eyes peeled for a posting in

early 2020.

• The BAT II position is scheduled to be posted as soon as the position is approved

by the Board of County Commissioners.

• Contract negotiations are underway with Stryker for ALS Cardiac Monitors. We

are planning on finalizing the contract by the end of September to bring to the

BoCC in mid-to-late October.

BLS Update:

• Training continues work with our MPD, Dr. Fontanilla, to update BLS Protocols.

• There are currently 30 students enrolled in the 2019-2 EMT Class.

• The TAC annual all day planning session for 2020 will be September 19th at

station 81.

• Training will be hosting a Patient Workshop on September 24th for all responders

wanting to play patient for Initial and Ongoing Training. Notification went to all

Departments for this training event

• Reminder of WREMS Conference at Ocean Shores March 27-29.

CPR Update:

• 4,404 citizens have been trained in Hands Only CPR as of September 11th, 2019.

WEST REGION EMS & TRAUMA CARE COUNCIL, INC. AND

THURSTON COUNTY, WASHINGTON

SERVICE AGREEMENT- FY20 & FY21

THIS AGREEMENT is made and entered into in duplicate originals by and between West Region EMS & Trauma Care Council, a non-profit corporation, hereinafter referred to as the "COUNCIL", and Thurston County, Washington, a municipal corporation, hereinafter referred to as the "SERVICE PROVIDER";

WITNESSETH:

WHEREAS, the COUNCIL desires to have certain services and/or tasks performed as hereinafter set forth requiring specialized skills and other supportive capabilities; and

WHEREAS, sufficient COUNCIL resources are not available to provide such services; and

WHEREAS, the SERVICE PROVIDER is qualified and possesses sufficient skills and the necessary capabilities, including technical and professional expertise where required, to perform the services and/or tasks set forth in this agreement.

NOW, THEREFORE, in consideration of the terms, conditions and performance contained herein, the parties hereto agree as follows:

1. SCOPE OF SERVICES

The SERVICE PROVIDER shall perform such services and accomplish such tasks as are identified anddesignated as SERVICE PROVIDER responsibilities throughout this Agreement and as detailed inEXHIBIT A attached hereto and made a part hereof.

2. TERM

The term of this Agreement shall begin on July 1, 2019, and shall terminate on June 30, 2021, unlesssooner terminated according to the provisions herein or if funding for this contract, through DOH contractEMS24281 is withdrawn, reduced, or limited in any way after the effective date of this Agreement andprior to normal completion. COUNCIL may terminate the Agreement under the “Termination” clause,subject to renegotiation under those new funding limitations and conditions.

3. COMPENSATION AND METHOD OF PAYMENT

A. TOTAL AMOUNT OF THIS CONTRACT NOT TO EXCEED $ 18,640.00

B. Payments for services provided hereunder shall be made following the performance of such services,unless otherwise permitted by law and approved in writing by the COUNCIL.

C. No payment shall be made for any service rendered by the SERVICE PROVIDER except for servicesidentified and set forth in this Agreement. The COUNCIL shall pay the SERVICE PROVIDER forwork performed under this Agreement as detailed in EXHIBIT A.

D. The SERVICE PROVIDER shall submit to the COUNCIL a voucher or invoice for services describedin Exhibit A.

E. The COUNCIL shall initiate authorization for payment after receipt of said approved voucher or invoice and shall make payment to the SERVICE PROVIDER within thirty (30) days thereafter.

4. ASSIGNMENT/SUBCONTRACTING The SERVICE PROVIDER shall not assign its performance under this Agreement. 5. INDEPENDENT CONTRACTOR RELATIONSHIP A. The parties intend that an independent CONTRACTOR/COUNCIL relationship will be created by this

Agreement. The COUNCIL is interested primarily in the results to be achieved; the implementation of services will lie solely with the SERVICE PROVIDER. No agent, employee, servant or representative of the SERVICE PROVIDER shall be deemed to be an employee, agent, servant or representative of the COUNCIL for any purpose, and the employees of the SERVICE PROVIDER are not entitled to any of the benefits the COUNCIL provides for its employees. The SERVICE PROVIDER will be solely and entirely responsible for its acts and for the acts of its agents, employees, servants, or representatives during the performance of this Agreement.

B. In the performance of the service herein contemplated the SERVICE PROVIDER is an independent

contractor with the authority to control and direct the performance of the details of the work, however, the results of the work contemplated herein must meet the approval of the COUNCIL and shall be subject to the COUNCIL'S general rights of inspection and review to secure the satisfactory completion thereof.

6. TREATMENT OF ASSETS The COUNCIL shall become the owner of the work product and other documents prepared by the

SERVICE PROVIDER pursuant to this Agreement. 7. COMPLIANCE WITH LAWS The SERVICE PROVIDER, in the performance of this Agreement, shall comply with all applicable federal,

state or local laws, ordinances and regulations. 8. NONDISCRIMINATION A. Nondiscrimination in Employment. In the performance of this Agreement, the SERVICE PROVIDER

will not discriminate against any employee or applicant for employment on the ground of race, creed, color, national origin, sex, marital status, age, or the presence of any sensory, mental or physical handicap; provided that the prohibition against discrimination in employment because of handicap shall not apply if the particular disability prevents the proper performance of the particular work involved. Such action shall include, but not be limited to: application for employment, employment, upgrading, demotion or transfers, recruitment or recruitment advertising, layoff, or termination, rates of pay or other forms of compensation, and programs for training including apprenticeships. The SERVICE PROVIDER shall take such action with respect to this Agreement as may be required to ensure full compliance with Chapter 49.60 Revised Code of Washington, Law Against Discrimination.

B. Nondiscrimination in Services. The SERVICE PROVIDER will not discriminate against any recipient

of any services or benefits provided for in this Agreement on the grounds of race, creed, color, national origin, sex, marital status, age, or the presence of any sensory, mental or physical handicap.

9. POLITICAL ACTIVITY PROHIBITED None of the funds, materials, property or services provided directly or indirectly under this Agreement

shall be used for any partisan political activity, or to further the election or defeat of any candidate for public office.

10. PROHIBITED INTEREST No member, officer, or employee of the COUNCIL shall have any interest, direct or indirect, in this

Agreement or the proceeds thereof. 11. TERMINATION A. Termination for Convenience. Upon mutual agreement, either party may terminate the Agreement, in

whole or in part, by at least thirty (30) days written notice to the other party. The SERVICE PROVIDER shall be paid costs for work performed up to the time of termination. The SERVICE PROVIDER shall promptly submit a termination claim. If the SERVICE PROVIDER has any property in its possession belonging to the COUNCIL, the SERVICE PROVIDER will account for the same and dispose of it in the manner directed by the COUNCIL.

B. Termination for Cause. If the SERVICE PROVIDER fails to perform in the manner called for in this

Agreement, or if the SERVICE PROVIDER fails to comply with any of the provisions of the Agreement, the COUNCIL may terminate this Agreement for cause. Termination shall be effected by serving a notice of termination on the SERVICE PROVIDER setting forth the manner in which the SERVICE PROVIDER is in default. The SERVICE PROVIDER will only be paid for services performed in accordance with the manner of performance set forth in the Agreement.

12. ATTORNEYS FEES AND COSTS If any legal proceeding is brought for the enforcement of this Agreement, or because of an alleged

dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the prevailing party shall be entitled to recover from the other party, in addition to any other relief to which such party may be entitled, reasonable attorney’s fees and other costs incurred in that action or proceeding.

13. JURISDICTION

A. This Agreement has been and shall be construed as having been made and delivered within the State of Washington, and it is agreed by each party hereto that this Agreement shall be governed by the laws of the State of Washington, both as to interpretation and performance.

B. Any action of law, suit in equity, or judicial proceeding for the enforcement of this Agreement or any

provisions thereof, shall be instituted and maintained only in any of the courts of competent jurisdiction in the State of Washington.

14. SEVERABILITY A. If, for any reason, any part, term or provision of this Agreement is held by the court to be illegal, void

or unenforceable, the validity of the remaining provisions shall not be affected, and the rights and obligations of the parties shall be construed and enforced as if the Agreement did not contain the particular provision held to be invalid.

B. If it should appear that any provision hereof is in conflict with any statutory provision of the State of

Washington, said provision which may conflict therewith shall be deemed inoperative and null and void insofar as it may be in conflict therewith, and shall be deemed modified to conform to such statutory provision.

15. ENTIRE CONTRACT The parties agree that this Agreement is the complete expression of the terms hereto and any oral

representations or understandings not incorporated herein are excluded. Further, any modification of this Agreement shall be in writing and signed by both parties. Failure to comply with any of the provisions stated herein shall constitute material breach of contract and cause for termination. Both parties recognize time is of the essence in the performance of the provisions of this Agreement. It is also agreed by the parties that the forgiveness of the nonperformance of any provisions of this Agreement does not constitute a waiver of the provisions of the Agreement.

I. SERVICES

A. The SERVICE PROVIDER shall deliver services in the form of meetings, training, expertise, counsel, recommendations, evaluation and similar services directed at the accomplishment of the Thurston County Ongoing Training & Evaluation Program (OTEP).

B. The SERVICE PROVIDER shall be responsible for providing OTEP training to the following agencies: Bucoda FD, Thurston Co FD 13, SE Thurston Fire Authority, West Thurston Regional Fire Authority, Lacey FD 3, McLane/Black Lake FD, Thurston Co FD 17 & Bald Hills FD, City of Olympia FD, Tumwater FD, Thurston Co FD 8, Thurston Co FD 6 and South Thurston Fire & EMS.

C. The maximum amount of reimbursement to the SERVICE PROVIDER for providing OTEP to the Thurston County EMS agencies listed above is $9,320.00 per fiscal year.

I. REIMBURSEMENT AND PAYMENT SCHEDULE

A. To receive payment, the SERVICE PROVIDER shall email the signed Invoice Report form (Exhibit B) and the appropriate Deliverables on the due date listed below to the COUNCIL business office.
