Dear Members,

I am happy to share with you, the revival of Umarkhed and Panvel Branch. Umarkhed branch was

disturbed since 2015 is now revived in the Extra-Ordinary General Body Meeting held on 02.02.2019. I am

thankful to Shri B.J. Sarwar, Org. Secretary, Vidarbha area. Panvel branch was also disconnect since 2011.

The same is revived in the Extra-Ordinary General Body Meeting held on 31st March, 2019.

We were demanding for the Computerization of the Pension Management in DoP/ DOT, since Pension

Adalat held at Pune in Nov, 2012. We have presented the DEMO explaining the Problem faced in manual

Pension Management by the CCA Offices as well as pensioners and Need of the computerization in the

chamber of Member Finance, DOT on 14.03.2013. It’s a good news that, Comprehensive Pension Management

System (CPMS) under brand name of SAMPANN is launched by Hon’ble Prime Minister on 29th December,

2018. The Roll out of SAMPANN in Maharashtra / Karnataka Circle was planned from 1st March, 2019 but

now postponed due to the technical snag in the Package. I am hopeful that on implementation of CPMS the

pensioners will get hassle free and good service.

We had a meeting with DAP Nagpur on 31st January, 2019, which was successful in solving long pending

cases of Pension revision as per 7th CPC. DAP on implementation of Core System Integration( CSI), has

started crediting the monthly pension directly to the pensioner's SB Accounts. They covered 51 HPOs in

January and 10 HPOs in February 2019. We have received the complaints of delay in payment of pension in

January / February 2019. We have immediately brought into the notice of DAP Nagpur / CPMG to make

such necessary arrangement that will facilitate the pensioners to withdraw amount on last day of the

month(except March) as provided.

CGHS facilities are extended to retired BSNL /MTNL employees who are in receipt of pension from Civil

Estimates vide DOT OM No. 4-12(11)/2012-PAT(Part) dated 31.08.2016 published in the Bulletin for January,

2019. Pune branch has given the wide publicity and arranged the enrolment of members under CGHS.

Benefit of Grade Pay 4600 instead of Grade pay 4200 is extended to those who retired from pre-revised

Scale of Rs. 6500-10500. But the revised pension has unjustly been fixed as Rs. 8345,considering the Pre-

revised Pay Scale of 6500-10500. It should have been fixed as Rs. 9230 considering the Revised Pay scale

of 7450-11500. We have addressed the letter to Secretary, PG & Pensions to issue the revised order.

In respect of BSNL retitees, earlier we reported that Pension Revision will be delinked from the Pay

Revision of the BSNL Employees as mentioned in the AUAB note dated 03rd December, 2018. DOT, Vide OM

dated 27th December 2018, confirmed that the case was referred to DOP&PW to examine whether 3rd PRC

may be extended to combined service pensioners of BSNL/MTNL without implementing the same for serving

employees. DOP&PW sought clarifications as to How pension would be revised in case of pensioners who

are drawing pension in IDA pay scale. As per recent reply, it is intimated that according to Rule 37-A (4) of

CCS (Pension) Rules on taking permanant absorption in the PSU, such employees shall cease to be Govt.

servants. Pension Revision under 7th CPC is for Government retirees and it is not applicable for combined

service pensioners optee absorbed employees of BSNL / MTNL.

Sub : Revision of pension w.e.f. 1.1.2006 of Pre-2006 pensioners who retired from the 5th CPC

scale of Rs. 6500-10500/-

1. The undersigned is directed to say that as per Para 4.2 of this Department’s OM of even number dated

01.09.2008 relating to revision of pension of pre-2006 pensioners w.e.f. 1.1.2006, the revised pension w.e.f.

1.1.2006, in no case, shall be lower than 50% of the sum of the minimum of pay in the pay band and the

grade pay thereon corresponding to the pre-revised pay scale from which the pensioner had retired.

2. Instructions were issued vide this Department’s OM of even number dated 28.1.2013 for stepping up of

pension of pre-2006 pensioners w.e.f. 24.9.2012 to 50% of the sum of the minimum of pay in the pay

band and the grade pay thereon corresponding to the pre-revised pay scale from which the pensioner

had retired, as arrived at with reference to the fitment tables annexed to Ministry of Finance, Department

of Expenditure’s OM No. 1/1/2008-IC dated 30th August, 2008. A concordance table indicating the revised

pension/family pension of pre-2006 pensioners in terms of instructions contained in para 4.2 of OM dated

1.9.2008 read with the OM dated 28.1.2013 was also annexed to the OM dated 28.1.2013. Subsequently,

orders were issued vide this Department’s OM of even number dated 30.7.2015 that the pension/family

pension of all pre-2006 pensioners/family pensioners may be revised in accordance with this Department’s

OM No. 38/37/08-P&PW (A) dated 28.1.2013 with effect from 1.1.2006 instead of 24.9.2012.

3. In the aforesaid OM dated 28.1.2013 of Department of Pension & Pensioners’ Welfare, the grade pay

corresponding to the pre-revised pay scale of Rs. 6500-10500 was shown as Rs. 4200/- and the minimum

pension in terms of para 4.2 of the OM dated 1.9.2008 was shown as Rs. 8145/- (50% of minimum pay of

Rs. 16,290/- as per fitment table for the pre-revised scale of pay of Rs. 6500-10500, annexed to Ministry

of Finance, Department of Expenditure’s OM No. 1/1/2008-IC dated 30th August 2008).

4. Order were issued vide Ministry of Finance, Department of Expenditure’s OM No. 1.1.2008-IC dated

13.11.2009 that the posts which were in the pre-revised scale of Rs. 6500-10500 as on 1.1.2006 and

which were granted the normal replacement pay structure of grade pay of Rs. 4200/- in the pay band PB-

2, will be granted grade pay of Rs. 4600/- in the pay band PB-2 corresponding to the pre-revised scale of

Rs. 7450-11500 w.e.f. 1.1.2006.

5. Representations have been received in this Department for extending the benefit of grade pay of

Rs. 4600/- for revision of pension/family pension, w.e.f. 1.1.2006, in respect of Pre-2006 pensioners who

retired/died in the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission

periods. The matter regarding the amount of minimum pension/family pension in terms of para 4.2 of the

O.M. dated 1.9.2008 in their case has been re-examined in the light of the orders issued by Ministry of

Finance (Department of Expenditure) vide their OM No. 1/1/08-IC dated 13.11.2009 and decisions of

courts in certain cases. It has been observed that pay of all serving employees in the pre-revised pay

scale of Rs. 6500-10500/- has been fixed w.e.f. 1.1.2006 in the grade pay of Rs. 4600/- Therefore, the

grade pay of Rs. 4600/- can be considered as the grade pay corresponding to the pre-revised pay scale

of Rs. 6500-10500/-

6. Accordingly, it has been decided that, for the purpose of revision of pension/family pension w.e.f. 1.1.2006

under para 4.2 of the O.M. dated 1.9.2008, the Grade Pay of Rs. 4600/- may be considered as the

corresponding Grade pay in the case of pre-2006 pensioners who retired/died in the 5th CPC scale of Rs.

6500-10500/- or equivalent pay scale in the earlier Pay Commission periods

7. In accordance with the provisions of Rule 7 of the CCS (Revised Pay) Rules, 2008, the pay corresponding

to the pay of Rs. 6500/- in the pre-revised pay scale of Rs. 6500-10500/- would be Rs. 12090/- in the PB-

2. After adding the grade pay of Rs. 4600/-, the pay in the Pay Band + Grade Pay corresponding to the

pay of Rs. 6500/- in the pre-revised pay scale of Rs. 6500-10500 would be Rs. 16690/- (12090+4600).

Accordingly, the revised pension w.e.f. 1.1.2006 in terms of para 4.2 of OM dated 1.9.2008, for the pre-

2006 pensioners who retired from the pay scale of Rs. 6500-10500/- in the 5th CPC or equivalent pay

scales in the earlier Pay Commissions would be Rs. 8345/- Accordingly the entries at serial number 13 inthe annexure of this Department’s OM No. 38/37/08-P&PW (A) dated 28.1.2013 may be substituted bythe entries shown in the statement annexed to this O.M.

8. As provided in this Department’s OM dated 28.1.2013, in case the consolidated pension/family pensioncalculated as per para 4.1 of this Department’s OM No. 38/37/08-P&PW (A) dated 1.9.2008 is higher thanthe pension/family pension calculated in the manner indicated above, the same (higher consolidatedpension/family pension) will continue to be treated as basic pension/family pension.

9. In their application to the persons belonging to the India Audit and Accounts Department, those orders areissued in consultation with the comptroller and Auditor General of India.

10. All the Ministries/Departments are requested to bring the contents of these orders to the notice of Controllerof Accounts/Pay and Accounts Officers and Attached and subordinate Offices under them. They are alsorequested to revise the pension of the affected pre-2006 pensioners in accordance with the instructionscontained in this O.M. on a top priority basis.

The undersigned is directed to refer to this Department’s OM No. 42/06/2018- P & PW (G) dated 18.09.2018on the subject mentioned above and to state that the President is pleased to decide that the Dearness Reliefadmissible to Central Government pensioners / family pensioners shall be enhanced from the existing rate of9% to 12% w.e.f. 01.01.2019

2. These rates of Dr will be applicable to (i) Civilian Central Government Pensioners / Family Pensionersincluding Central Govt. absorbee pensioners in PSU/Autonomous Bodies in respect of whom ordershave been issued vide this Department’s OM No. 4/34/2002-P & PW (D) Vol. II dated 23.06.2017 forrestoration of full pension after expiry of commutation period of 15 years (ii) The Armed Forces Pensioners,Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv)Railway Pensioners / family pensioners (v) Pensioners who are in receipt of provisional pension (vi) TheBurma Civilian pensioners / family pensioners and pensioners/families of displaced GovernmentPensioners from Burma / Pakistan, in respect of whom orders have been issued vide this Department’sOM No. 23/3/2008 – P & PW (B) dated 11.09.2017.

3. The payment of Dearness Relief involving a fraction of a rupee shall be rounded off to the next higherrupee.

4. The payment of arrears of Dearness Relief shall not be made before the date of disbursement of pension/ family pension of march, 2019.

5. Other provisions governing grant of DR in respect of employed family pensioners and re-employedCentral Government Pensioners will be regulated in accordance with the provisions contained in thisDepartment’s Om No. 45/73/97 – P & PW (G) dated 2.7.1999 as amended vide this Department’s OMNo. F. No. 38/88/2008 – P & PW (G) dated 9th July, 2009. The provisions relating to regulation of DRwhere a pensioner is in receipt of more than one pension will remain unchanged.

6. In the case of retired Judges of the supreme Court and High Courts, necessary orders will be issued bythe Department of Justice separately.

7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. tocalculate the quantum of DR payable in each individual case.

8. The offices of Accountant General and authorized Pension Disbursing Banks are requested to arrangepayment of relief to pensioners etc. on the basis of these instructions without waiting for any furtherinstructions from the Controller and Auditor General of India RBI and the Reserve Bank of India in viewof Letter no. 528-TA, II/34-80-Ii dated 23/4/1981 of the Cmptroller and Auditor General of India addressedto all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all NationalisedBanks.

9. In their application to the pensioners / family pensioners belonging to Indian Audit and AccountsDepartment, these orders issue after consultation with the C & AG.

10. This issues in accordance with Ministry of Finance, Department of Expenditure’s OM No. 1/1/2019 – E.II (B) dated 27th Feb. 2019.

2. CGHS facilities were extended to retired BSNL / MTNL employees who are in receipt of pension from

31.08.2016 and OM No. 4-12(11) / 2012-PAT (Part) date : 18.10.2016. The matter has been examined in

the light of above orders and it is clear that CGHS facilities were extended only to the retired BSNL /

In view of the above, it is clarified that facilities mentioned in Ministry of Health mily Welfare OM dated

29.09.2016 are applicable only to those retired BSNL / MTNL employees who are in receipt of pension from

The undersigned is directed to refer to your section OM No. 24-04-2016 Sr dated 20.12.2018 vide which

status has been sought as above and to state that latest development status of the 2 issues pertaining to this

section is as follows.

(iii) Revision of Pension to BSNL retires w.e.f. 01.01.2017

The case was referred to DoP & PW to examine whether 3rd PRC may be extended to Combined Service

Pensioners of BSNL / MTNL without implementing the same for serving employees. In response, DoP&PW

intimated that the circulars issued for pension revision so far (based on 7th CPC) are applicicable to

Central Government Civiliam Pensioners who are drawing pension in the CDA Pay scales and hence

they had requested DoT to clarify as to how pension would be revised in the case of BSNL/MTNL pensioners

who are drawing pension in IDA pay scale. The clarifications sought by DoP&PW were replied vide this

office ID Note No. 47-63/2015-Pen (T) dated 27.11.2018 (copy enclosed) to further examine the issue.

Reply from DoP&PW is awaited in this regard.

Sub. : Representation regarding MACP Scheme.

The undersigned is directed to forward herewith a letter (in original) dated 12.10.2018 of Shri H. F.

Chaudhari (All India Central Government Pensioners Association) on the subject of MACP and to say that the

recommendations of the 6th CPC were accepted by the Government only on 29.08.2008 (30.08.2008 in case

of PBOR). The recommendations of the 6th CPC were required to be examined and a Scheme was to be

formulated in consultation with Department of Expenditure and the same took considerable time for its

implementation. Before implementation of the Scheme, a cut off date had to be decided / fixed. Accordingly,

the Government has taken a consicious decision for implementing the MACPS w.e.f. 01.09.2008. though the

MACPS come into existence only w.e.f. 01.09.2008, the benifits of the existing ACP Scheme of August,

1999, was allowed to the Government servants upto 31.08.2008.

2. VI Pay Comission recommended separate Schemes for Civilian and the Defence Personnel. After the

recommendations were considered and approved by the Cabinet, D / O Expenditure issued Resolution

dated 29.08.2008. In respect of civilian employees. Ministry of Defence issued resoluation dt. 30.08.2008

regarding extension of VI CPC benefits to Armed Forces Personnel. Thus the Civilian and the PBOR

personnel are governed by two different Resolutions / two different MACP Schemes.

3. The instant order of Hon’ble Supreme Court is in the context of MACP Scheme issued by Ministry of

Defence with regard to PBOR and hence the order of Hon’ble Apex Court is not applicable to the MACP

Scheme issued by DoP&T for civilian employees.

4. However, In case, clarification / interpretation of any of the rule position is required, the proposal may be

referred to this Department in accordance with the procedure laid down in this Department’s OM No.

43011/9/2014-Estt – (D) dated 28th October, 2015 through a self contained note giving full facts connected

with the case in a file and with the approval of Secretary of the Administrative Ministry.

The issue regarding methodology of calculation and payment of monthly pension contribution of BSNL

was taken up with the Department of Expenditure vide this office ID Note No. 40-32/2011-Pen (T) (Pt)

dated 30.11.2018 (copy enclosed) in reply to which DoE has sought clarification vide its ID Note No. 1

(2)/E-V/2014 dated 19.122018 (copy enclosed) regarding certain points on the instant issue. Since most

of these points pertain to BSNL same are being examined in consultation with BSNL for onward reply to

DoE for further examination.

Respected Sir,

1. The revised pension has unjustly been fixed at Rs.8345 vide Para 7 of DOP&PW OM dated 4-1-2019w.e.f. 1.1.2006, whereas the same should have been fixed as Rs.9230 in terms of para 4.2 of OM dated1.9.2008, for the pre-2006 pensioners who retired from the pay scale of Rs.6500-10500/- in the 5th CPCor equivalent pay scales in the earlier Pay Commissions @ 50% of the minimum Revised Pay of Rs.18460in the replacement Scale of Rs.7450-11500 with corresponding Pay Band of Rs.9300-34800 plus GradePay of Rs.4600.

2. a) Revised pay scale in 6th CPC for the 5th CPC scale of Rs.6500-10500 was Rs.7450-11500 withcorresponding Pay Band of Rs.9300-34800 and Grade Pay of Rs.4600 as per Para 3 of MOF DOE OMdated 13.11.2009.

b) While calculating the revised minimum Pension for Pre-2006 Pensioners who retired from 5th CPC scaleof Rs.6500-11500 (or its equivalent in earlier CPCs) only the Grade Pay of Rs.4600 & Minimum Pay ofRs.6500 has been considered instead of considering the minimum Revised Pay of the replacementscale of Rs.7450-11500 in Pay Band plus the grade Pay of Rs.4600, thus totally ignoring the orders forreplacement scale of Rs.7450-11500.

3) a) This is totally unjustified and against Para 4.2 of DOP&PW OM dated 1-9-2008 which has beenpartially adopted and cited in abstract merely to tailor make the results.

b) Para 4.2 of DOP&PW OM dated 1.9.2008, reads as under:

“4.2 The fixation of pension will be subject to the provision that the revised pension, in no case, shall belower than fifty percent of the pay in the revised pay band plus the grade pay corresponding to the pre-revisedpay scale from which the pensioner retired. In case of HAG + and above, this will be fifty percent of theminimum of the revised pay scale.”

4. Pre-2006 Pensioners have been denied the benefit of the following orders issued vide Para 3 of MOF DOEOM No.1/1/2008-IC dated 13.11.2009, which reads as follows,

"It has now been decided that the posts which were in the pre-revised scale of Rs.6500-10500 as on1.1.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the payband PB-2, will be granted grade pay of Rs.4600 in the pay band PB-2 corresponding to the pre-revisedscale of Rs.7450-11500 w.e.f. 1.1.2006. Further, in terms of provisions of CCS(RP) Rules, 2008, in casea post already existed in the pre-revised scale of Rs.6500-10500 it should be merged with the post in thescale of Rs.7450-11500.”

5. The benefit of this up-gradation was allowed to those in service with effect from 01-01-2006 and to thosewho retired after 01-01-2006. But the benefit of this up-gradation was not extended to the pre-2006pensioners. Thus, creating discrimination between the Pre & Post-2006 Pensioners - in violation ofsettled law by the Apex Court in D. K. Nakara’s case as well as in Major Genl. Bains Case.

6. This led to multiple litigations by the affected pensioners in various Courts wherein clear verdicts were

given against this discrimination. But the benefit of all the judgements on this issue was confined by the

Department concerned, to the Petitioners only thus depriving the same to other similarly placed pensioners

thereby creating another class between a homogenous class of Pensioners.

8. Keeping in view the orders of MOF dated 13-11-2009, CAT Bangalore in OA.No.170/00730/2017 in penultimate

para of its judgement dated 18-6-2018, reproduced below, has held that the concerned Pensioners who

retired from the pre-revised scale of Rs.6500-10500, were entitled to a minimum Pension of Rs.9230

from 1-1-2006.

9. CAT Ernakulam, in its judgement in dated 23-10-2018 in OA No. 180/01071/2017 concurred with the

above cited judgement of CAT Bangalore.

10. It is, therefore, requested that the minimum revised pension may please be fixed as Rs.9230 w.e.f. 1-1-

2006 for the pre-2006 pensioners who retired from the pay scale of Rs.6500-10500/- in the 5th CPC or

equivalent pay scales in the earlier Pay Commissions.

Sub: Revision of pension in respect of DOT employees absorbed in BSNL/MTNL.

Respected Sir,

1. DOT employees absorbed in BSNL and retired from BSNL are receiving their pension from the Government

of India under the provision of Rule 37-A of CCS(Pension) Rules 1972.

2. DOT allowed revision of pension for pre-2007 absorbed BSNL pensioners the benefit of merger of 68.8%

IDA, as per 2nd PRC vide OM dated 26.11.2008.

3. Further DOT extended the benefit of merger of 78.2% merger to old pensioners retired up to 09.06.2013

vide OM dated 18.07.2016. The benefit is given with effect from 01.01.2007.

4. Now the revision of pension is due from 01.01.2017. The pay revision is not being done in BSNL due to

restrictions imposed by the affordability Clause of 3rd PRC recommendations as accepted and notified by

the Govt. of India.

5. As per para 2(b) of DOT OM dated 20.07.2016, 100% liability of paying pension/family pension lies with

Government of India and BSNL do not have any role in this matter. Therefore, we have pleaded to delink

the issue of pension revision from pay revision

6. In the meeting of AUAB held on 3rd December, 2018 It is assured by Hon’ble Minister of State of

Communication and Secretary Telecom, that Pension Revision of BSNL retirees is delinked from the pay

revision of the serving employees.

7. DOT has referred the case to DOP&PW to examine whether 3rd PRC may be implemented to BSNL/

MTNL pensioners without implementing the same for service employees without giving the appropriate

proposal.

8. DOP&PW has sought clarifications. DOP&PW has clearly stated that let DOT state how do they carry

out pension revision after delinking from pay revision so that DOP&PW can examine the proposal in its

entirety.

9. We feel that if the DOT send the appropriate proposal to DOP&PW, the issue of delinking of pension and

revision of pension of DOT employees absorbed into BSNL/MTNL can be sorted out.

Sir, In the above background, we earnestly appeal to your kind honor to personally intervene in the

matter so that the concerned pensioners aged between 63 to 80 years, do get their pension revised, without

further delay.

retired BSNL/MTNL employees who are in receipt of pension from Central Civil Estimates on payment of

Estimates) residing in Non-CGHS areas can also avail the benefits of CGHS by registering themselves in the
