Graphical User Interfaces

The interface between an apparatus with any form of display

and its user.

Enables interaction with devices through graphical elements.

No requirement of typing complex text commands by the users,

thereby it enables faster and real-time interaction, resulting in

higher productivity.

2017 Study Question of Protection of graphical user interfaces:

Study Question studied the issue of whether and how the GUIs

may be protected by traditional IP rights namely patents, design

rights, copyright and trademarks.

The Reporter General has received 39 reports from the National

Groups and Independent Members of AIPPI.

The reports provide a comprehensive overview of national and

regional laws and policies relating to protection of GUIs by various

IP rights.

GUIs should generally be capable of protection by the

traditional IP rights, such as

patents

design rights

copyright; and

trademarks.

Patents:

Involvement of a user’s mental activities in an interaction with a

GUI should not preclude the patentability of the GUI.

It should not be a prerequisite that a claim to a GUI includes a

physical feature.

No specific claim format should be required for patent protection

of GUIs.

Designs:

Movements and transitions in a GUI should generally be capable of

protection by design rights.

A GUI should generally be capable of protection by design rights without

requiring any connection to a physical device.

Copyright:

The fact that GUIs are computer generated should not exclude their

eligibility for copyright protection.

The threshold for copyright protection of GUIs should not be higher than

for other works.

Trademarks:

Movements and transitions in a GUI should generally be capable of

protection by trademark rights.

A GUI should not be required to acquire distinctiveness through use to be

capable of protection as a trademark. Where a GUI is not inherently

distinctive, acquired distinctiveness should be required.

Other forms of protection:

Having regard to the IP rights that should be available for

protection of GUIs as set out in paragraphs 1), 5), 8) and

11) above, sui generis protection for GUIs should not be

necessary.
