Pursuant to Clause 11 of the University of the South Pacific Staff Union Constitution, notice is hereby given that the 43rd Annual General Meeting of the above Union will be held on Thursday April 2ih commencing at 12.00 noon at the University Gym.

7 2015 Annual Report 7. I The Secretary, Sis Litiana Waqalevu, went through the Annual Report for
2015 page by page. As there were no queries from the floor, the report was accepted. Moved by Bro John Rigamoto and seconded by Sis Litia Daulako.
8 Treasurer's Report 8. I The Treasurer, Bro Pradeep Prakash went through the report, then invited
questions from the floor. There were no queries.
8.2 The Treasurer then went on to explain briefly about the 'Disclaimer Statement \vhich is the norm practised now by financial accountants.
8.3 The Financial report was accepted; moved by Bro John Rigamoto and seconded by, Sis Susan Naco
9 GENERAL BUSINESS
9.1 Victimization by Management on Library staff Sis Litiana assured the Library staff that the Union was on standby to fight for its members. The Collective Agreement was in line with the ERP/CA and ILO.
9.2 Tenured Staff Management had promised 3-year renewable contracts for tenured staff, and this is being followed up by the union. Members were requested not to sign any contracts until this \\as resolved.

9.3 Funernl Expense $5,000 funera] expense is included in the BSP Medical Insurance package, plus $10,000 on your life.
9.4 2014-2015 Staff Review Appeals Members can appeal as provided for in the Staff Policy.
9.5 Medical Cards Those members who still have not been given a Medical Card should first check with Sis Luisa Mafi in HR office or contact the Union office.
9.6 Assistant Secretary position for USPSU Interested members may apply for Assistant Secretary position as it became vacant earlier 2016 when Sis Iliana Nasedra resigned. Note that election year is 2017, so members can start thinking about all union positions will be available, so please ensure you nominate members who can do the job as union otricia]s.

Annual Report 2016 -2017
Our sincere greetings to you all our loyal members of the USP Staff Union. A very special greetings to you our brothers and sisters in Lautoka, Labasa and Savusavu Campuses.
A very warm welcome to those of you who are present here today as new members and attending this Annual General Meeting for the first time. Welcome, and Ni sa Bula vinaka mai.
2017 is the second year in which the Fiji Elections Office will be conducting elections of our new Office Bearers who would take us through 2017 - 2019.

Executive Meeting
With the 2016/17 Executives it has always been a problem finding a day to have executive meetings as many Executives were taking part time studies and that their

classes were clashing with meeting days and times. The Executives were also affected with the resignation of the Union Assistant Secretary after she had retired from USP leaving us stranded with meeting minutes including other secretarial files. We were later informed that the Assistant Secretary was later recruited as "Consultant " again at FBE but the position did not last as there was insufficient time for her to hand over Union files before her demise.
Tropical Cyclone Winston
Fiji was devastated with a category 5 cyclone at the end of February 2016. There were major infrastructure damages all over Fiji. The University was closed for one week after the cyclone as there were fallen trees, broken power lines and flooded rivers and drains everywhere.
Our Health and Safety officers were on stand by for evacuations while our grounds man Maintenance staff cleaners and security guards were called into work to help clear the debris and bring about normalcy on Campus. The University Vice Chancellor Professor Rajesh Chandra called on staff and students to help through the Cyclone Appeal.. USP Staff Union members collected $253 and the Union topped it up to $500 which was acknowledged by the Vice Chancellor.

Collective Agreement 2016 - 2018 registered
The Collective Agreement between the Union and USP was implemented 1st January 2016 and officially registered with the Ministry of Labor on 23rd February, 2016.

The Union started off with 19 issues from the end of 2015 and they continue to drag them on up till to date. (2017)

The above were the main issues that were not resolved in 2015 and carried forward to 2016. Interestingly there are still some of the above issues that has not been resolved to date ( 2017)
After many false promises by USP that issues will be resolved, the Union was still not satisfied with the outstanding issues. We the Union Executives found that there was no urgency in resolving issues and we needed to show USP our equal desperation on the matters.
On Friday 21st October 2016 the members of the USP Staff Union staged a protest march on Campus in their bid to show USP Management their frustrations about the unresolved issues. A petition was handed to USP Management where the Union had requested that all Union outstanding issues be resolved by the 25/10/16. USP did not take heed of our request but instead had asked for the two parties to meet on the 25/10/17 to discuss and hopefully settle the issues. Because USP did not provide us with solutions to the cases the Union filed a 21 days strike notice with the Ministry of Labor. As of October 25th the unresolved issues have decreased from 19 to 12 as listed in the strike notice.

Labasa Issues Resolved The Union is happy to have resolved a few cases from Labasa and Savusavu. In Labasa our former member Ahmed Shah applied for a senior position, went through an interview and was selected. USP held back the position and made excuses that there was no money to recruit . The matter was reported to the Union and we are happy to see one of ourvery own members excell to a senior comparable position.

The second issue is two Admin ladies who took on the responsbilties of other staff namely Semi Drecala, Unaisi Bcinaivalu and Praneel who left Labasa for Laucala Campus. Their overtimes had accumulated and not paid. This was work done in 2015 and finally paid in 2016. The Union noted that a staff was working in Labasa for 17 years without any SRC remuneration. The Union also noted that the staffs' salary was not in line with similar positions on Laucala and Lautoka Campus. A complaint was lodged due to the fact that the case was a direct breach of workers rights to equal pay. We are happy that after serving the University for more than 17 years recognition has been finally granted to upgrade the salary from a Grade 2.1 to Grade 3.4 in line with others who have similar Job titles and Job Descriptions.
Retirement Benefits
As part of the 2016 Collective Agreement, we sincerely thank the Unversity for its financial assistance which helped out in the payment of retirement benefits to the 32 staff members who were retired in 2015/2016. As of today we still continue to pay out retirement benefits.
Ex Gratia Payments for Maintenance staff
Tropical Cyclone Winston devastated Fiji inFebruary 2016. At the height of the cyclone, the University was closed for a week. Debris were everywhere, broken power lines and overflowing drains. The Unversity depended on its Maintenance, Security and cleaners who were all called in to work. The Union had asked for an exgratia payment for all those who worked. This was only approved and paid out to all in December 2016. Everyone got a $200 exgratia payment in recognition of their help during the cyclone.
Demise of two Union Members
It was tragic to lose two of our Union members in 2016. They were Captain Netani Tulele and our very own Assistant Secretary, Sister Iliana Nasedra. Rest in Peace Brother Netani and Sister Iii, we remember you today as part of this big family of the USP Staff Union.
Library did not recognize Union
The Unversity Library is the only Department at USP that does not want to recognize the Union. It is the only Department in USP that make workers work under a Manual that is aligned to the USPSU Agreement and where clauses are copied and inserted into their Manual. The Union normally liases with HOD/Faculty in our attempt to resolve issues amicablly rather than having them inflated and to take more time and writing letters to resolve, especially with petty issues. The Union was not at all happy with the reaction it got and raised the issue in a meeting with VC. lnformaton for our members is that any intenal manual is your internal guideline that is signed only by your bosses. Our Agreement is much superior than any Manual and has working conditions and benefits for all union members. It has been signed by the VC for the University and by the Secretary and President of the Union for the Union, and registered with the Ministry of Labor as required by law for all registered Trade Unions.

Computers removed from security gates
Computers were removed from the University main gates by those in authority. The securities were blamed for playing games and locked into the social page whenever they man the gates. The Union was not at all happy with the decision as the computer was not there only for the bad purposes that they are being blamed for but a very important tool for communications vice versa, access of pay slips, applications on line such as annual leave and a source of educational tool for staff. HR as now offered to provide services to Securities who need to access their payslps or for any applications on line. On this note we thank the HR l&J staff who are being given added duties to access such needs for our security officers. What a shame, computers are supposed to be encouraged as a learning tool, but that is not to be it at USP.
Union Treasurer Resigned
Pradeep Prakash was elected in the 2015 Election as Treasurer. He served us until November 25 2016 and resigned from his position.
Security Meal Allowance
The issue about Security meal allowance was an itemtaken to Mediation on February 16 th , 2017. While discussion was taking place about the issue, the Union was informed by the University reps that they will pay for the meal allowances. The Union continued to write and even thretened USP that we will return the case back to the Ministry of Labor's Medation services. We receved a letter from the VPA confirming approval to pay effective from the Mediation date 16/2/17. The Union is not satisfied with the implementation date as there was no agreement done between the parties on this. To date there is still no confirmation on this payment. The Union will re file this caseas it should have been effective from January 11 2017.
Tenured Staff Contracts still not signed
All tenured staff who should have signed new contracts in 2016 are still with out valid contracts. As per our signed Agreement the parties agreed that the new contracts of tenured staff would have the words "renewable contract "inserted into their contract. After 2 years of negotiations with HR there was nothing positive coming from their end until such a time when the Union office was informed by two tenured staff that their USP ID card was no longer vallid when scanned at the USP Library. When this information was relayed to HR we were told that it wuld be immediately fixed. The President then asked for a copy of his contract which we found that contracts were already done up and dated December 2015 and it did not have the renewable contract stated. The excuse we were given from HR was that they did not know that contract letters were already done. When we questioned the validity of some of the cl uses in the contract, HR then referred the document for verification by the USP lawyers. We worked on the contract for a couple of weeks and finalised our bit and were satisfied with the final draft given to us. When we sent back our final approved draft to HR,
it did not find its way back neither to us or to the members concerned.
Director HR Resigned

In the middle of so many outstanding issues we agin were informed that the OHR has resigned. In his first year, the former Manager IR Jope Wainiqolo resigned and left a vacuum that has never been filled. In the interim the Union was trying to resolve Union issues directly with the OHR and in some occassions were grateful that DVC Professor Derrick Armstrong in his capacity as Acting VPA was on hand to help out. With no OHR and we have noted that USP has advertised for An internal staff to be seconded into the position of OHR for one year while the position is advertised, we also note that there is still no Manager IR recruited to date.
Contracts signed by Faculty Heads and Heads of Departments
We are concerned about staff who has been employed by USP for more than 5 to 10 years continuously and are now been offered 3 to 6 months contracts by their bosses. All staff who work contnuously for more than 12 months are reviewed by the Staff Review Coomiitee annually. The Staff Review Committee are empowered to terminate staff on non performance and also renew contracts for those whose performance have excelled during the 12 months review period. After the SRC cleaners at FBE, a painter at Commercials and a few l&J staff were given contracts by their HOD/Faculty to sign. On the same conrtracts, the same staff eceived letters from HR relaying the results of Staff Review Committee to them. In one particular case, SRC had renewed the contract for 3 years and two weeks later the HOD/F sent another contract to the same staff to sign a 3 months contract. We believe and understand that all staff contracts for established positions are recorded and signed at the HR office.
Staff Reviews for l&J and Horly Paid Staff
The 2016 Staff Review held in September was divided into four sets of Committees. FSTE Mere Yabaki Goundar sat in that Committee FALE FBE Rupeni Tawake sat in that Committee Central/ Non Faculty- Tarisi Vaca la sat in that Committee
In the three Faculties there was no appeals made against the decisions made by the SRC, while the Central/Non Faculty area received the most appeals. Thank you to those staff that sat in the SRC committee for upholding the SRC rules and policy. However the Union is not at all happy with the Central/Non Faculty Committee as the Confidential clause was breached by a member who released information to staff before the official notice came from HR. The Union raised its concern with the VC and the Chair of SRC that the release of confidential information is a clear breach of University Policy. VC's response on the breach is that disciplinary action is warranted and we are still awaiting to see that such disciplinary action is implemented.
$ value of the increment and bonuses for l&J and Hourly Paid Staff
After the Staff Review 2015, the Hourly Paid staff who received bonuses were very lucky that they collected $936 in one bonus. Some staff collected 2 or 3 bonuses which s a multiple of the $936 which amounted to some $1872 or $2808 respectively. There was no complaints when there was more $'s in your Bank Account. While the Hourly Paid was enjoying this mistake, the l&J staff bonus and

increments were $935. The chances of a double or triple bonus for l&J staff was very slim. Bonuses are one off payment of the incremental or bonus $value. Comes 2016 this was corrected and it brought about many disgruntled hourly paid workers. This has now been corrected through adjustments to the Staff review Policy.
Job Evaluation
The Union had been meeting regularly with HR in the preparation of workload and key Performance Indicators (KP(} for all l&J and Hourly Paid positions. Our aim was to have all these done by December 2016. In the meetings that we have had with HR all positions were identified and checks were done on the available Job descriptions for the positions. We were informed that out of the 180 positions selected for identified positions there were only 30 positions that had Job Descriptions . The Union and USP later met with Price Waterhouse on setting up a time line to identify, interview and make preparations for the Job Evaluation to take place. All these effort came to nothing after the Manager IR Jape Wainiqolo resigned from USP and left USP in December 2016. When the new Director Human Resources Manager, took up full responsbility, the Union reminded him of Clause 11.02 of the 2016- 2018 Agreement which reads:
The parties agree that by December 2016 Workload and KPl's for all Intermediate and Junior and Hourly Paid staff positions will be establised by the niversity. The initiative is linked to the completion of a Job Evaluation (JE) and JobDescription(JD) exercise and the roll out of the Staff Development (SDA) procedures and processes too for this category of staff. This exercise is now overdue and the Union has enquired about its continuity. The latest on this we are told s that all processes and correspondences on the matter have been lost and therefore the new Manager TA& M Ms Jayhotika Ram will continue from where Jape left.
The Union is grateful that the Manager TA&M have already begun with a workshop for all Union selected members with HR reps . This workshop was conducted by Price Waterhouse staff. The Union continues to request for a much faster pace in negotiations as we want the Exercise to begin at the earliest.
Properties and Facilities and mail room staff face major restructure
The Properties and Facilities and Mail room Staff with their respective Unions were given a 6 months notice that the University will undergo a major restructure. On the same letter talking about major restructure, the University had listed all Maintenance and Mail Room staff workers to be made redundant. The notice was given on September26th 2016. The Union raised the issue again with the VC as we were not clear as to what the University wanted to do. Was it restructure or was it redundancy. The answer we got from the VC was that all positions will be vacated and that all positions will be advertised and new staff will be recruited. USP, without any dialogue with the Union went further ahead and released a Press Release as attached.
The Union sought legal advice as we tried to understand Section 107 of the ERP which states:
If an employer contemplates termination of the employment by redundancy of workers for reasons of an economic, technological, structural or similar nature the employer MUST -

(a) Provde the workers, their representatives and the Permanent Secretary not less than 30 days before carrying out the terminations with relevant nformation including the reasons for the termination contemplated,the number and categories of workers likely to be affected and the period over which the terminations are intended to be carried out and
(b) Give the workers or their representatives as early as possible an opportunity for consultation on measures to be taken to avert or to minimize the terminations and on measures to mitigate the adverse effects of any terminations on the workers concerned, such as action to attempt to find alternative employment or retraining

Above is the press release put out by USP in September 2016. Even prior to this notice the University was already engaging private contractors to come in and perform the duties that belonged to Maintenance staff. The University also reduced overtime work for staff and made the outside contractors work seven days a week in trying to finish off all work that belonged to staff. After the above notice, staff work load was drastically reduced giving all opportunities to outsiders. As per the above notice, the University had planned to undertake a major restructure of its Properties and Facilities (P&F) section and will also seek to outsource its Mailroom Services. The Union noted with interest the procedures taken to restructure. As far as we are concerned there was no restructure. Most staff are still aware of how a restructure takes place in USP. First and foremost a Department Plan is drafted and staff fitted into the new structure according to their MQR and experience. After all are fitted in and there are still positions available than some of the multi skilled people are than moved or retrained to take up the remaining positions. Once this is completed than only we come to REDUNDANCY whereby the redundancy procedures available in our Agreement and the Employment Relations Promulgation comes into effect. The procedures include the following steps :
1. Volunteers - those who wish to be made redundant 2. Last in first out 3. Retirement - those nearing retirement age could be asked to be made to retire 4. Redeployment - staff could be redeployed to any other University Department pending
availability of similar positions within and possible retraining of staff 5. Exhausting all the above, the last option is redundancy where staff will be paid a redundancy
allowance as per the Agreement or the ERP
Redundant members marched up to VC's Office to deliver a letter requesting for an immediate payout of their redundancy pay. What USP did was not a restructure but trying to find a way to justify their need to remove all staff from their position, rename the Department and retitle the jobs on offer. I have been associated with USP since 1975 and never have I come across such Job titles as Porters, Fleet and Logistics Officer, etc. in a Department that serviced the needs of the University mostly in areas of unestablished positions.

All Maintenance staff were given 6 months redundancy notice effective 26 th September 2016 to 31'1
March 2017. Late February 2017 USP realized that it was a mistake to send staff on redundancy on the
31''1 March as this day was marked on USP Calendar for the first USP Graduation ceremony.
Because the process was so slow and that the parties have not met, all individuals were again issued
another letter to extend the expiry date of the redundancy notice from Friday 31 March to Monday 3 rd
April. Why such change to include the weekend Saturday and Sunday is a mystery that we did not
understand especially when the Maintenance staff were able to complete the removal of tents and
chairs from the Vodafone Arena by 8.00pm on the graduation day.
Monday 3 rd April and all staff turned up to work as required by the extension of date. The first thing
they noticed was that USP had put up a security guard at the entrance to monitor and check staff
movement at the Maintenance yard. There was no supervisor on sight to provide jobs for the day.
The Union resorted back to the assistance of the VC as staff waited for one full day (their final day) for
redundancy allowances to be paid. After 6 months of the notice the allowances was still not ready.
The Union sincerely thank the Vice Chancellor for his understanding and assuring us that all staff will
be paid by 5.00pm on Monday 3/4/17 which was done.
Due to the delays and slow negotiations, the Union was blamed for delaying the process. This was not
true as the Union was always waiting for consultations with USP and to try and mitigate on behalf of
its members. There was no such time for consultations or mitigations as USP drove their intentions well
beyond our reach.
On their final day of work staff were still not informed as to who have been retained and those who
will unfortunately leave. The Union got this information from HR via email at 11.30am on 3/4/17. We were equally frustrated with all the delays but they have become water under the bridge now.
On Tuesday morning 4/4/17 most of these redundant workers received phone calls again from USP asking them to return to work for an extension of 2 months contract.
Etonia Waqaevo was one who volunteered to return to replace someone that USP first called and
declined the offer. Etonia started work on the 4 th of April. Three weeks later on Friday 21 st April, he was
given his fixed term non- renewable contract letter of two months to sign.
By this date he had worked for 3 weeks without any pay.
He read the contract letter first and was surprised to find a clause in that 2 months contract that said:
(7) In accepting the offer, you also agree personally not to make any further claims on the
University on the redundancy package payable to you in light of the Restructure at the Properties & Facilities Division.
The Union wrote to HR demanding pay for the 3 weeks he has worked and informed them that Etonia
was not keen to sign the contract with the number (7) clause included.
Mail Room Staff

With all the happenings with the Maintenance staff the University extended the contract for another 2 months. By the 3/4/17 Esala Vatu also joined Maintenance staff and volunteered to take a redundancy pay. We now have 3 staff continuing to man the USP Mail Room.
The USP Mail Room was put out on Tender and only one vendor tendered. OHL has been given the opportunity to come into Campus and find out for themselves as to the everyday work of the USP Mail Room. Mail Room staff were told to help and assist OHL staff in any questions or needs about the Mail Room. When the Mail Room staff refused to help the DHL staff they were threatened to be sacked for insubordination. USP Procurement Office was holding meetings with DHL and a few selected staff who formed a Tender Committee which included the Mail Room Supervisor. On the day DHL was to make its presentation to USP, the Mal room supervisor was told to leave the room as her attendance may be seen as conflict of interest.
The Union have filed two Trade Disputes against the University for:
(1) For the noncompliance of Section 107 of the Employment Relations Promulgation (2) For redundant workers not paid to the end of their contracts.

Conclusion :
At the end of another two years, we sincerely thank you all for your support. It has never been an easy two years but with your loyal support we managed to resolve some issues, arrange for protests, file Trade Disputes , attend Mediations etc. The next two coming years would be a challenge for the new Executives as there are issues still to be resolved like:

FINANCIAL STATEMENTS FOR THE YEAR ENDED 31 st DECEMBER 2016 INDEPENDENT AUDIT REPORT
Scope We have conducted a financial audit of the financial statements, records and procedures of USP STAFF UNION and hereby submit a report on our findings.
Our audit has been carried out in accordance with the International Financial Reporting Standards for Small and Medium-sized Entities to provide reasonable assurance as to which the records are free from material misstatements.
Our procedures included examination on a test basis, of evidence supporting the amounts and other disclosures in the financial statements and the evaluations of accounting policies and significant accounting estimates. These procedures have been undertaken to form an opinion as to whether an all material aspects, the financial statements are presented in accordance with International Financial Reporting Standards for Small and Medium-sized Entities so as to present a view which is consistent with our understating of the Union's financial position and the results of its operations as set out in on Schedules 3 to 6.
Board and Management's Responsibility for the Financial Statements The board and management are responsible for the preparation and fair presentation of these Financial Statements in accordance with International Financial Reporting Standard for Small and Medium-sized Entities. This responsibility includes: designing, implementing and maintaining internal control relevant to the preparation and fair presentation of Financial Statements that are free from material misstatement, whether due to fraud or error; selecting and applying appropriate accounting policies; and making accounting estimates that are reasonable in the circumstances.

Auditor's Responsibil,ity
Our responsibility is to express an opinion on these Financial Statements based on our audit. We have conducted the audit in accordance with International Standards on Auditing. Those standards require that we comply with ethical requirements and pion and perform the audit to obtain reasonable assurance about whether the Financial Statements are free from material misstatement.
An audit involves performing procedures to obtain audit evidence about the amounts and disclosures in the Financial Statements. The procedures selected depend on the Auditor's judgment, including the assessment of the risks of material misstatement of the Financial Statements, whether due to fraud or error. In making those risk assessments, the Auditor considers internal control relevant to the Union's preparation and fair presentation of the Financial Statements in order to design audit procedures that are appropriate in the circumstances, but not for the purpose of expressing an opinion on the effectiveness of the Union's internal control. An audit also includes evaluating the appropriateness of accounting policies used and the reasonableness of accounting estimates made by management, as well as evaluating the overall presentation of the Financial Statements.
Audit Opinion
In our opinion;
a) Proper books of account have been kept by the Union as per our examination of those books.
b) The accompanying accounts have been prepared under the historical cost convention stated to the accounts give a true and fair view of the state of affairs of USP STAFF UNION as at 3l51 December 2016 and this results for the year ended on that date according to the best of information and explanation kept and supplied to us and shown by the books of the Union.
