VISTO: El Memorándum VMC/DGCE/DNNC/N° 0111 de fecha 23 de setiembre de 2019, de la Dirección de Normas y Negociaciones Comerciales, remitido a la Dirección General de Comercio Exterior, por el cual eleva a consideración la Resolución que apruebe el formato oficial del certificado a ser utilizado para el otorgamiento de la cuota de exportación de azúcar de caña concedida por la República de China (Taiwán); y

CONSIDERANDO: La Ley N° 904/1963, “Que establece las funciones del Ministerio de Industria y Comercio”, modificada por las Leyes Nros. 2.961/2006 y 5.289/2014.

La Ley N° 5932/2017, “Que aprueba el Acuerdo de Cooperación Económica entre la República del Paraguay y la República de China (Taiwán)”.

El Decreto N® 1522/2019, “Por el cual se faculta al Ministerio de Industria y Comercio a distribuir los cupos para la exportación de azúcar a la República de China (Taiwán), entre los ingenios azucareros”.

El Decreto N® 2147/2019, “Por el cual se modifica parcialmente el Decreto N® 1522/2019, Por el cual se faculta al Ministerio de Industria y Comercio a distribuir los cupos para la exportación de azúcar a la República de China (Taiwán), entre los ingenios azucareros”.

La Resolución N® 1051/2019, “Por la cual se determina la Modalidad de Distribución de la Cuota de Exportación de Azúcar de Caña de Producción Nacional concedida al Paraguay por la República de China (Taiwán).

La Decisión N° 3 del Comité Conjunto del Acuerdo de Cooperación Económica entre la República del Paraguay y la República de China (Taiwán) por la cual se otorga una cuota anual de 50.000 toneladas métricas de azúcar en bruto y 10.000 toneladas métricas de azúcar refinado libre de aranceles a ser exportadas de la República del Paraguay a la República de China (Taiwán).

Que, el Artículo 1° del Decreto N® 1522/2019, faculta al Ministerio de Industria y Comercio a distribuir los cupos para la exportación de azúcar a la República de China (Taiwán).

Que, según lo establece la Decisión N° 3 la República del Paraguay gestionará la asignación de cuota para el azúcar en bruto refinado a la que se le otorgaráentrada^ la República de China (Taiwán) libre 4e,^^el^'ádÚa^éros una vez que la Aduaimd:eTaRepú&áca de China (Taiwán) recibetó^'feeftiScái^^^gen y Certificado de Cuota^expedído por ^1 organismo gubernamental competente d^a R^júblka del Paraguay.

Que, es necesario establecer el formato oficial del certificado de cuota deexportación.

Que, la Dirección General de Asuntos Legales, tras la revisión del proceso administrativo de pago, recomienda la formalización de la presente Resolución, según Dictamen Jurídico N° 582 de fecha 01 de octubre de 2019,

POR TANTO, en ejercicio de sus atribuciones legales

EL MINISTRO DE INDUSTRIA Y COMERCIO

RESUELVE:

Artículo 1®. Aprobar el formato oficial del Certificado a ser utilizado para el otorgamiento de la cuota de exportación de azúcar de caña concedida por la República de China (Taiwán), conforme al formulario adjunto que forma parte integrante de la presente Resolución.

Artículo 2®. Aprobar el instructivo para la solicitud de los Certificados de cuota de exportación adjunto que forma parte integrante de la presente Resolución.

Artículo 3®. La validez del Certificado será desde el 1 de enero hasta el 31 de diciembre de cada año.

Artículo 4®. La presente Resolución, entrará en vigencia a partir de su promulgación.

INSTRUCTIONS FOR FILLING THE CERTIFICATE FOR SUGAR

UNDER TARIFF QUOTA

For purposes to obtain preferential tariff treatment this document shall be filled in legible

form and completed by the exporter of the good or goods, without scratches, blotches, amendments or writing between the lines and the importer shall keep it with him at the time

of presenting the import declaration. Please type or print the information. In case of

requiring additional space, the form must be numbered in a correlative manner.

The Certifícate for Sugar under Tariff Quota shall be completed by the exporter in English. The Certificates will be issued by the authorized entity and must respect a correlative order number.

The Certifícate will be issued in 4 copies, the fírst copy is for the Paraguayan Government entity that issues the fee certifícate; the second copy is for the exporter of Paraguay; the

third copy is for the importer of Taiwan and the fourth copy is for the Customs of the

Republic of China (Taiwan). The Paraguayan Government entity that issues the certifícate

shall deliver the fourth copy to the Republic of China (Taiwan) Embassy in order to

transmit to the Customs of the Republic of China (Taiwan) by diplomatic courier.

Field 06: Provide a complete description of each good. The description shall be sufficiently

detailed to relate it to the description of the good contained in the invoice, as well as with

the description that corxesponds to it in the ROC (Taiwan) Tariff Classification Harmonized

System (HS).

Field 07: Specify the quantity for each item of goods as shown on the Customs declaration

thereof.

Field 08: Indicate the Port of Loading.

Field 09: Indícate the Port of Discharge.

Field 10: Indícate the Date of Departure.

Field 11: Indícate the Date of Issue.

Field 12: In this field there shall be the signature of the authorized official and the seal from

the Certifying Authority, as well as the date of issue of the Certificate of Origin.
