1.0 Introduction

1.1 Objectives:

The objective of this document is to guide and assist the members of the Pecan Grove Plantation Homeowners Association (HOA) Board of Directors (BOD), the Management Company staff, and the Pecan Grove Plantation homeowners in the use of the Pecan Grove Plantation common area commonly known as the Boat Ramp/House/Parking Area. The specific objectives of the Rules of Usage are:

To provide approved rules and restrictions for the use of the limited parking space.

To provide approved rules and restrictions for the use of the Boat House.

1.2 Authority:

1.2.1. The authority and responsibility for maintaining and establishing rules for use of common property in Pecan Grove Plantation HOA is founded in ref (a) which is part of the deed to every lot in Pecan Grove Plantation. As a result, all lot owners and property owners in Pecan Grove Plantation are subject to the restrictions described in the references and this document. �

1.2.2. The information in these rules supersede all previous written documentation with respect to restrictions and limitations of these common areas. �

2. Rules of Use

2.1. Description of the Common Area:

The Pecan Grove Plantation Boat House Facility is located along the Intracoastal Waterway at the end of Lewis Road. It is flanked by a public boat launch facility to the South, and a private dry storage/docking facility to the North. The Boat House is multi-purpose tin structure that serves as: a) a place for owners to conduct pre and post launch checks on their boats and, b) a place for owners to store kayaks in community provided storage racks. The Boat House has running water but does not have lavatory facilities. Access to the Boat House is gained by use of an access device provided to owners from the Management Company.

The Pecan Grove Plantation Boat Ramp is co-located with the Boat House and allows for the launch or recovery of 1 boat at a time. To support launching and recovery of boats the ramp has a floating dock. Boats may be temporarily secured to either side of the dock while waiting for trailers to pull boats out of the water. The ramp and dock are accessed via the Boat House by using the same access device provided by the Management Company. The dock is accessible through a separate gate.

The Pecan Grove Plantation Boat Ramp Parking Facility is co-located with the Boat House. It is an open air, grassy plot of land bordered by railroad ties. The access point to this parking facility is an open gate (no lock) that faces the Boat House. There is parking for approximately 10-15 vehicles with trailers depending upon the size of the trailer. 2.2. Rules and Regulations:

2.2.1. Pecan Grove Plantation HOA is not responsible for any theft, damage or vandalism which may occur to any vehicle/trailer/boat/other conveyance or injury to person while using these common areas. Use of these facilities is done at the owners own risk.

2.2.2. Only Pecan Grove Plantation owners with their guests may access and use these common areas. Guests must be accompanied by a Pecan Grove Plantation owner. Guests may not use the Pecan Grove Plantation common areas addressed in this document to launch a boat, park a vehicle/trailer, or store any items within the boat house.

2.2.3. All trailers parked in the Parking Facility must have a current year BLUE Pecan Grove Plantation identification sticker. All vehicles parked in the Parking Facility without a trailer must have a current year RED Pecan Grove Plantation identification sticker.

2.2.4. The Boat House is to be used expressly for:

2.2.4.1. Preparing boats for launching 2.2.4.2. Upon recovery securing the boat for transportation 2.2.4.3. Storing kayaks in designated kayak storage racks 2.2.4.4. Launching and recovering kayaks

2.2.5. Overnight storage and/or unattended watercraft are not permitted at the floating dock.

2.2.6. There is to be no maintenance of vehicles, boats, trailers or other conveyance in any of the common areas addressed in this document.

2.2.7. Should there be an inadvertent spill of petroleum, lubricants, oil, or fuel within any of the common areas addressed in this document it is the owner’s responsibility to clean the spill, and to notify Pender County of the hazardous material incident.

2.2.8. No hazardous material will be stored in the Boat House.

2.2.9. The Boat House/Boat Ramp facilitate the launch or recovery of one vessel at a time. Owners waiting to launch a boat should wait along Lewis Road until the current launch is complete and the vehicle/trailer is parked in the Parking Facility. Owners waiting to recover their boat may use either side of the dock to tie up to while waiting their turn to trailer their boat. �

2.2.10. Owners are responsible for removing all trash they are responsible for in these common areas.

2.2.11. Owners will be responsible for ensuring the large bay doors to the Boat House and the access gate to the Dock are secured when they have completed launch or recovery.

2.2.12. Due to limited parking within The Parking Facility owners are asked to use best parking practices to allow the maximum number of vehicles or vehicle/trailer combinations to park at any one time.

2.3. Removal of Vehicles:

2.3.1. Any vehicle stored on the Pecan Grove Plantation Parking Facility that is in violation of these rules is subject to being towed or otherwise removed from the HOA property to an impound location at the expense of the owner(s) of the vehicle.

2.3.2. Pecan Grove Plantation has contracted the services of Atlantic Recovery, Inc Towing Company to assist in the timely removal of non-Pecan Grove Plantation Owner property from the Parking Facility. Owners who identify a non-Pecan Grove Plantation vehicle/trailer parked at the Parking Facility may call 910-471-2286 to initiate removal.

3. Obtaining a Pecan Grove Plantation Identification Sticker:

3.1. Types of Stickers:

3.1.1. Blue stickers are intended to be placed on trailers. An example is provided in Section 4.

3.1.2. Red stickers are intended to be placed on motor vehicles (i.e. cars, trucks) and provide parking access for non trailered activities at the Pecan Grove Boat Launch facility, and Gazebos. An example is provided in Section 4.
