A. All the Work of the Contract Documents shall commence at the time to be specified in the Notice to Proceed and the Contractor shall achieve Substantial Completion no later than March 29, 2019.

VI. Summary of the Work A. The Project consists of interior renovations to Buildings 62, Basement through 4th floors; building
62A 1st floor; and Building 79 1st floor. This project is phased to allow various programs to be relocated during construction. The facility will be fully operational throughout construction. In addition to the renovation work, there will be a secure outdoor recreation area added between buildings 62 and 79. Minor ACM abatement is also anticipated related to the foundation tar and roof mastic at the front entrance of building 62. The renovation work will include all related general construction, plumbing, mechanical, electrical, fire protection, empty conduit and raceways for fire alarm, security, data, and telephone; site work upgrades and improvements. A new elevator is also being installed. Cabling and devices for fire alarm, security, data and telephone are to be provided by others through OMH Contracts.

PRE-BID MEETING OUTLINE OF M/WBE PARTICIPATION REQUIREMENTS
1. Contractors performing work on contracts funded by the Dormitory Authority must comply with the requirements (the “Requirements”) of Article 15A of the Executive Law, Article 20 in the General Conditions and Executive Law Article 17B, Service-Disabled Veteran-Owned Businesses. The Requirements include, among other things, compliance with Minority-and Women-Owned Business Enterprise (MWBE) and Service-Disabled Veteran-Owned Business (SDVOB) participation goals.
2. The MBE goals established for this contract are _18__% and the WBE goals are _12__ %. SDVOB_ 3%_.The goals are mandatory and are an integral requirement of the contract to be awarded for this project. In the process of preparing bids Contractors must consider the strategy and approach that will be used to achieve, at minimum, the required level of MWBE participation. Bids submitted by Contractors for this project must satisfy these goals. It is required that Utilization Plans must include a combination of MWBE/SDVOB subcontractors and suppliers.
3. Utilization of a certified MBE or WBE, SDVOB as a pass through or conduit for payments only, is strictly prohibited. Payments to certified M/WBE’s shall not be counted toward achievement of the established goals, if the Contractor and the alleged M/WBE subcontractor or supplier cannot clearly demonstrate that such M/WBE’s provided services essential in the performance of the Work of the Contract. Additionally, such services must be among those explicitly identified in the NYS Empire State’s Product/Sic Report for the applicable MBE or WBE.
4. Bidders must explore opportunities for MWBE/SDVOB participation for the full scope of work for the proposed project. The MWBE/SDVOB participation goals may not be satisfied utilizing only material suppliers.
5. Within 72 hours of receiving the Pre-Award Notification letter, the apparent-low bidder must submit a Statewide Utilization Management Plan (Utilization Plan) via the NYS Contract System (NYSCS). Hard copies of the Utilization Plan will no longer be accepted and no award can be made without an approved plan. The apparent-low bidder will receive an email with a link to the Utilization Plan assigned to it for the proposed contract. The Utilization Plan must list all proposed subcontracts and material purchases; including identification of the MWBE’s and SDVOB’s the Contractor intends to use; a description of the goods and/or services to be provided; a Scope Verification Form for each subcontractor that is signed by the prime and subcontractors; and includes the dollar value of the goods or services. Submission of an acceptable Utilization Plan is a contract award requirement.
6. To ensure you are prepared to submit the Utilization Plan within 72 hours of receipt of apparent low bidder notice, Contractors submitting bids for this project should solicit bids and/or quotes from MWBE/SDVOBs prior to submitting their bid.
7. Only the value of contracts or purchase orders awarded to firms that are certified with New York State by Empire State Development (ESD) count toward meeting the project MWBE participation goals. A firm must be certified for the type of work it is proposed to undertake on a contract. Please refer to the ESD Commodity Codes and the NAICS Codes included in the ESD’s certification of a firm to confirm the type of work for which it is certified/approved to perform.
8. Only the value of contracts or purchase orders awarded to firms that are certified by the New York State Office of General Services (OGS) count toward meeting the project Service Disabled Veteran-Owned Business (SDVOB) participation goals. A firm must be certified for the type of work it is proposed to undertake on a contract. Please refer to the NAICS codes included in OGS’s certification of a firm to confirm the type of work for which it is certified/approved to perform.
9. Brokers, Suppliers, Manufacturer’s Reps and Trucking Firms: The value of contracts and purchase orders awarded to MWBE firms certified by ESD as Brokers, Suppliers, Manufacturer’s Reps and Trucking Firms will be credited toward meeting the project participation goals as follows:
• Brokers: Only the monetary value of fees, commissions or mark-up percentage paid • Suppliers: 60% of the value of any contract or purchase order awarded • Manufacturer’s Rep: Credited the same as Brokers • Trucking Firm: 100% of the value of any contract or purchase order awarded
10. DASNY’s rules and regulations do not allow the value of a contract or purchase order awarded to a dual-certified firm to be split between the project’s MBE and WBE goals, the full value must be allocated to one goal or the other.
11. DASNY cannot grant waivers of the MWBE goals established for any project. If DASNY is satisfied that the Contractor has fully complied with all good faith efforts guidelines, to achieve the MWBE and SDVOB goals established for this contract, it can recommend a partial or total waiver of the MWBE and SDVOB goals to a third party that has the authority to grant or deny the requested waiver.

SECTION 079200 - JOINT SEALANTS
PART 1 - GENERAL
1.1 RELATED DOCUMENTS A. Drawings and general provisions of the Contract, including General and Supplementary Conditions
and Division 01 Specification Sections, apply to this Section.
1.2 SUMMARY
A. Work Included: 1. Sealants for exterior joints in vertical surfaces and nontraffic horizontal surfaces. 2. Sealants for exterior joints in horizontal traffic surfaces. 3. Sealants for interior joints in vertical surfaces and nontraffic horizontal surfaces. 4. Sealants for interior joints in horizontal traffic surfaces. 5. Sealants for security areas. 6. Other joints as indicated.
1.3 PERFORMANCE REQUIREMENTS
A. Provide elastomeric joint sealants, with proper industry standard aspect ratios, that establish and maintain watertight and airtight continuous joint seals without staining or deteriorating joint substrates. All elastomeric joint sealants shall be chemically compatible with their substrate assemblies.
1.4 SUBMITTALS
A. Product Data: Provide data indicating sealant chemical characteristics, performance criteria, substrate preparation including required primers, temperature and humidity limits, color availability and cure time.
B. LEED Submittals:
1. Product Data for Credit IEQ 4.1: For sealants and sealant primers used inside the weatherproofing system, documentation including printed statement of VOC content.
2. Laboratory Test Reports for Credit IEQ 4: For sealants and sealant primers used inside the weatherproofing system, documentation indicating that they comply with the testing and product requirements of the California Department of Health Services' "Standard Practice for the Testing of Volatile Organic Emissions from Various Sources Using Small-Scale Environmental Chambers."
C. Schedule: Submit a Schedule of Joint Sealers to be used for the project. Include interior and exterior
sealants applied in the field and, where appropriate, applied in the shop. For each sealant listed, include sealant type, applicable substrates, and sealant number (as indicated in the specification).
D. Samples: Submit three (3) samples, 6-inch long illustrating sealant colors for selection. E. Manufacturer's Installation Instructions: Indicate special procedures, surface preparation, perimeter
conditions requiring special attention, recommended backer rods, and requirements for curing.
1.5 QUALITY ASSURANCE
A. Maintain one copy of each referenced document covering installation requirements on site.

B. Manufacturer Qualifications: Company specializing in manufacturing the Products specified in this
section with minimum three years documented experience. C. Applicator Qualifications: Company specializing in performing the work of this section with
minimum five (5) years documented experience, and approved by manufacturer.
D. Preconstruction Field-Adhesion Testing: Before installing elastomeric sealants, field-test their adhesion to joint substrates as follows:
1. Notify Architect seven days in advance of dates and times when test joints will be erected. 2. Arrange for tests to take place with joint sealant manufacturer's technical representative
present. 3. Test joint sealants by hand-pull method test or methods recommended in ASTM C 1193. 4. Do not use sealants that fail to adhere to joint substrates during testing. 5. Sealant joints in mockups of assemblies specified in other shall be tested in accordance with
this Section.
E. Preinstallation Conference: Conduct conference at Project site with Contractor, Architect, sealant manufacturer, sealant contractor, wall cladding contractor, curtain wall and window contractor to discuss sealant locations, colors, installation procedures, compatibility of sealants with substrates, co-ordination between trades and scheduling.
1.6 DELIVERY, STORAGE AND HANDLING
A. Materials shall be delivered to the site, in original unopened containers, clearly indicating manufacturer's name, brand name, and other identifying information.
B. Materials shall be stored in a dry location, off the ground and in such a manner as to prevent
freezing, damage and the intrusion of foreign matter. C. Materials which have become damaged or otherwise unfit for use during delivery, or storage, shall
be replaced at the expense of the Contractor.
1.7 PROJECT CONDITIONS
A. Environmental Conditions: Do not proceed with installation of joint sealers under the following conditions:
1. When ambient and substrate temperature conditions are outside the limits permitted by joint
sealer manufacturers. 2. When joint substrates are wet due to rain, frost, condensation, or other causes.
B. Joint Width Conditions: Do not proceed with installation of joint sealers where joint widths are less than allowed by the joint sealant manufacturer for the application indicated.
C. Joint Substrate Conditions: Do not proceed with installation of joint sealers until contaminants
capable of interfering with their adhesion are removed from joint substrates.
1.8 MOCK-UP A. Provide mock-up of sealant joints in conjunction with window, wall, and copings under provisions
of Division 01 Section “Quality Assurance”. B. Construct mock-up with specified sealant types and with other components noted.

1.9 COORDINATION A. Coordinate the work with all sections referencing this section.
1.10 WARRANTY A. Division 01 Section "Warranties". B. Correct defective work within a five (5) year period after Date of Substantial Completion. C. Warranty: Include coverage for installed sealants and accessories which fail to achieve watertight
seal, discolor, exhibit loss of adhesion or cohesion, or do not cure.
PART 2 – PRODUCTS 2.1 MATERIALS, GENERAL
A. VOC Content of Interior Sealants: Sealants and sealant primers used inside the weatherproofing system shall comply with the following limits for VOC content when calculated according to 40 CFR 59, Subpart D (EPA Method 24):
1. Architectural Sealants: 250 g/L. 2. Sealant Primers for Nonporous Substrates: 250 g/L. 3. Sealant Primers for Porous Substrates: 775 g/L.
B. Low-Emitting Interior Sealants: Sealants and sealant primers used inside the weatherproofing system shall comply with the testing and product requirements of the California Department of Health Services' "Standard Practice for the Testing of Volatile Organic Emissions from Various Sources Using Small-Scale Environmental Chambers."
C. Liquid-Applied Joint Sealants: Comply with ASTM C 920 and other requirements indicated for each liquid-applied joint sealant specified, including those referencing ASTM C 920 classifications for type, grade, class, and uses related to exposure and joint substrates.
1. Suitability for Immersion in Liquids. Where sealants are indicated for Use I for joints that will be continuously immersed in liquids, provide products that have undergone testing according to ASTM C 1247. Liquid used for testing sealants is deionized water, unless otherwise indicated.
D. Stain-Test-Response Characteristics: Where sealants are specified to be nonstaining to porous substrates, provide products that have undergone testing according to ASTM C 1248 and have not stained porous joint substrates indicated for Project.
E. Suitability for Contact with Food: Where sealants are indicated for joints that will come in repeated contact with food, provide products that comply with 21 CFR 177.2600.

2.13 JOINT-SEALANT BACKING
A. General: Provide sealant backings of material and type that are nonstaining; are compatible with joint substrates, sealants, primers, and other joint fillers; and are approved for applications indicated by sealant manufacturer based on field experience and laboratory testing.
B. Cylindrical Sealant Backings: ASTM C 1330, of type, size and density to control sealant depth and
otherwise contribute to producing optimum sealant performance:
C. Elastomeric Tubing Sealant Backings: Neoprene, butyl, EPDM, or silicone tubing complying with ASTM D 1056, nonabsorbent to water and gas, and capable of remaining resilient at temperatures down to minus 26 deg F (minus 32 deg C). Provide products with low compression set and of size and shape to provide a secondary seal, to control sealant depth, and otherwise contribute to optimum sealant performance.
D. Bond-Breaker Tape: Polyethylene tape or other plastic tape recommended by sealant manufacturer
for preventing sealant from adhering to rigid, inflexible joint-filler materials or joint surfaces at back of joint where such adhesion would result in sealant failure.
F. Compressible Rod (Filler Type 1): Types as shown, or as required for proper performance of the
sealant in the specific joint, which is compatible with sealant, as recommended by sealant manufacturer. One of the following:
1. Closed Cell Polyethylene Foam Rod: One of the following:

2.14 ACCESSORIES
A. Primer: Non-staining type, recommended by sealant manufacturer to suit application. B. Joint Cleaner: Non-corrosive and non-staining type, recommended by sealant manufacturer;
compatible with joint forming materials.
PART 3 - EXECUTION
3.1 EXAMINATION A. Verify that substrate surfaces and joint openings are ready to receive work. B. Verify that joint backing and release tapes are compatible with sealant.
3.2 PREPARATION A. Remove loose materials and foreign matter which might impair adhesion of sealant. B. Clean and prime joints in accordance with manufacturer's instructions. C. Perform preparation in accordance with manufacturer's instructions and ASTM C1193. D. Protect elements surrounding the work of this section from damage or disfiguration.
3.3 INSTALLATION A. Joint widths shall designed for anticipated movement but shall be a minimum of 3/8 inches wide. B. Perform installation in accordance with sealant manufacturer's requirements for preparation of
surfaces and material installation instructions. C. Perform installation in accordance with ASTM C1193. D. Perform acoustical sealant application work in accordance with ASTM C919. E. Measure joint dimensions and size joint backers to achieve width-to-depth ratio, neck dimension,
and surface bond area as recommended by manufacturer, except where specific dimensions are indicated.
F. Install bond breaker where joint backing is not used. G. Install sealant free of air pockets, foreign embedded matter, ridges, and sags. H. Apply sealant within recommended application temperature ranges. Consult manufacturer when
sealant cannot be applied within these temperature ranges. I. Tool joints concave unless otherwise indicated.

J. Precompressed Foam Sealant: Do not stretch; avoid joints except at corners, ends, and intersections; install with face 1/8 to 1/4 inch below adjoining surface.
K. Compression Gaskets: Avoid joints except at ends, corners, and intersections; seal all joints with
adhesive; install with face 1/8 to 1/4 inch below adjoining surface.
3.4 FIELD QUALITY CONTROL
A. Field-Adhesion Testing: Field-test joint-sealant adhesion to joint substrates as follows:
1. Perform 10 tests for the first 1000 feet (300 m) of joint length for each type of elastomeric sealant and joint substrate.
2. Perform one test for each 1000 feet (300 m) of joint length thereafter or one test per each floor per elevation.
3. Test Method: Test joint sealants by hand-pull method or tests recommended in ASTM C 1193.
4. Inspect joints for complete fill, for absence of voids, and for joint configuration complying with specified requirements. Record results in a field adhesion test log.
5. Inspect tested joints and report on whether sealants in joints connected to pulled-out portion failed to adhere to joint substrates or tore cohesively, whether sealants filled joint cavities and are free from voids, and whether sealant dimensions and configurations comply with specified requirements.
6. Record test results in a field adhesion test log. Include dates when sealants were installed, names of persons who installed sealants, test dates, test locations, whether joints were primed, adhesion results and percent elongations, sealant fill, sealant configuration, and sealant dimensions.
7. Repair sealants pulled from test area by applying new sealants following same procedures used to originally seal joints.
B. Evaluation of Field-Test Results: Remove sealants that fail to adhere to joint substrates during
testing or to comply with other requirements. Retest failed applications until test results prove sealants comply with indicated requirements.
3.5 CLEANING
A. Clean adjacent soiled surfaces.
3.6 PROTECTION OF FINISHED WORK A. Protect sealants until cured.

A. JS-1 - Exterior joints as follows: 1. Joints in stone panels. 2. Joints in cast stone panels. 3. Joints in metal panels. 4. Butt joints for insulated glazing units. 5. Structural silicone glazing to adhere insulated glazing units to mullions of curtain wall and
