“Suit for an injunc-tion in which HediSchoop, sculptress, com-plained that a formeremployee had copied her lineof statuettes, figurines, andother bric-a-brac tocompete against hercommercially wasdecided in her favoryesterday bySuperior Judge ArthurGuerin.
“The court granted MissSchoop an injunctionrestraining MissKatherine Schuefftan,described as the formeremployee, from display-ing and selling the linewhich Miss Hedi Schoopcomplained is like or verysimilar to hers.
“Originally, Miss HediSchoop also had asked for$10,000 damages, but the mone-tary plea was dropped during thetrial.”
It may not have been front-page news, but this early 1940slawsuit, pitting one Californiaceramist against another, had allthe drama of All About Eve, (atleast in the decorative arts world.)An established design diva spoutsfire when an up-and-comer, (evenworse, a former employee),attempts to make inroads on herhome turf? What a conversation-starter at the next giftware-buyersgathering!
The adversaries: ethereal, andwildly popular ceramics queenHedi Schoop, versus her formerprotégé, the equally talentedKatherine Schuefftan, (knownprofessionally as Kay McHugh,releasing ceramics under themarkings “Kaye” and“Kaye of Hollywood”).
As they say on thoseTV shows, “the litigantsare on their way into thecourtroom—right now!”
The Plaintiff: MissSchoop
Hedi Schoop couldhave been a ‘40s film star.She had an unusual firstname, pronounced just likeHedy Lamarr’s. She hadsultry cover-girl looks, reminis-cent of Lauren Bacall. She had anexotic overseas background, onthe order of Marlene Dietrich.There were even glamorousHollywood connections: her sis-ter was acclaimed ballerina TrudiSchoop, her husband, famedmovie composer FrederickHollander. (Among his hits: thelanguid “Falling in Love Again”.)
Instead, Schoop opted for lifeas a ceramics designer. And,while her come-hither personalappeal no doubt caused dowdiercontemporaries to shake theirbunned heads in dismay, it wastalent that made Schoop one ofthe most popular (and most imi-tated) ceramic artists of the 1940sand ‘50s.
Born in 1906 inSwitzerland, Schoop spent her
earlyy e a r s
s t u d y i n gsculpture, fash-ion design, andacting. With
Hollander, shefled Nazi Germany in
the early 1930s, settling inHollywood, where his composingcareer flourished.
In her new environment, Hediamused herself by creating plasterdolls, which she then painted anddressed in fashions of the day. Asuccessful showing of the dolls at aLos Angeles department storeprompted Schoop to adapther ideas to a more perma-nent medium: ceramics.Early slip-cast figures soldwell from her smallworkshop, and alarger, NorthHollywood facility,Hedi Schoop ArtCreations, openedin 1940. Theimpact wasimmediate, asevidenced by thepraise lav-i s h e d
on Hedi that year in a Los AngelesTimes ad for Barker Bros.:
“We searched out the creator ofthese appealing flower and candleholders, and found a young ladyfrom Switzerland, looking remark-ably like her own wistful littleflower girls. Her name is HediSchoop, and she creates the mostcharming pottery figures we’veever seen. She tells us she not onlydesigns the pieces, but does all themolding and coloring, so that everypiece is very much her own execu-tion. Very whimsical and smart!”
Many Hedi Schoop figurinescame equipped for secondary uses— from flower-holders and wallpockets, to candlesticks and soapdishes. Hedi was perhaps the mostcommercially successful California
ceramics designer of the postwarperiod, and certainly the most
ubiquitous. If a Schoopfigure proved popularwith consumers, anentire line of accom-panying décorobjects, such asplanters, bowls, ash-trays, and candydishes, would be
built around it. At itsbusiest in the late
1940s, the studio pro-duced over 30,000 gift-
ware items peryear, and employedover fifty workers.

The Defendant: Miss McHughUnfortunately, the broadly
drawn features, soft colors, and rip-pling garments of Schoop’s over-size figurines and planters madethem easy to copy. During theheight of her career, similar designswere turned out by a variety ofother California ceramic firms,usually run by former Schoopemployees. The mostnotable: one-timeSchoop decorator KayMcHugh (KatherineSchuefftan). It wasMcHugh’s line ofceramics, firstmarketed as“ K a y eF i g u r i n e s ” ,which resulted inthat 1942 courtinjunction.

years, KayMcHugh’s repu-
tation as a ceramist has suffered,not only because of the Schoopcontroversy, but also because of aninferior line of ceramics produced
by her ex-husband PeterSchuefftan in the late
1940s. ( Schuefftan usedMcHugh’s designs forthese figurines, releasedunder the name “KimWard Ceramics”.)
McHugh’s own originali-ty and distinctive style, pre-sent in both her “Kaye”, and
later “Kaye of Hollywood” fig-urines, have too often been over-shadowed by those long-agolegal machinations. She’sbeen relegated to the
role of furtive copy-ist, rather thanbeing recognized
as a tal-e n t e dartist in
h e ro w nright.
Her son, editor and authorKim Schuefftan, offered thesecomments on his mother’s career,the Schoop lawsuit, and its after-math:
“The Schoop incidentremains somewhat mysterious, asdoes the early relationshipbetween Hedi Schoop and myparents, Peter Schuefftan and
Kay McHugh.“Hedi Schoop start-
ed out in partnershipwith them, making
pottery at alocation onV e n t u r aB o u l e v a r dn e a rC o l d w a t e rCanyon in theS a nF e r n a n d oValley. Tothe best ofmy knowl-edge, nei-ther mymother orf a t h e rw o r k e d‘for’ HediS c h o o p .
Rather, asnoted, the three had some kind ofpartnership. However, I have noidea who financed that first,short-lived pottery effort, solegally Hedi might possibly havebeen ‘boss’. Around 1940, thepottery moved to 5004 Vinelandin North Hollywood. Shortlythereafter, Schoop sued McHughwho, with Schuefftan, was pro-ducing a line of ceramics underthe name ‘Kaye Figurines’.
“My parents then divorced.Peter Schuefftan moved toFletcher Road and started his ownpottery, ‘Kim Ward Ceramics’,unfortunately naming it after hisson (me), and using McHugh’sdesigns. The ‘Kim Ward’ designschanged somewhat, as the oldplaster molds wore out. ‘KimWard Pottery’ ceased operationsin about 1950, when my fathertook employment as a salesmanwith Metlox.
“Kay McHugh renamed herpottery ‘Kaye of Hollywood’,
moved the plant toBurbank after the
war, then sold it inabout 1948. New
and rather tackydesigns wereadded afterthat.
“As for thecopying problem
that was the basisof HediSchoop’s law-suit, at thispoint there
seems lit-tle means
of determin-ing its validity.

class of the Art Center School— a trained painter and sculp-tor. She was uncompromis-ingly independent (later inlife, she stomped out of apainting class withKokoschka when he put hisbrush to her canvas).Although I was very youngwhen she was active as a pot-ter, and my memories are lim-ited accordingly, I clearlyremember her pondering cos-tume history and designbooks, and modeling the‘Kaye of Hollywood’ fig-urines in plasticine.
“The designs were origi-nal – yet some of my moth-er’s designs and Hedi
Schoop’s have clear similari-ties, particularly in poses andslip-color decoration. Thefaces, however, are very dif-ferent. I am convinced thatKay McHugh did not copyHedi Schoop, (and viceversa). But how to explain thesimilarities? That remains a
problem. There were manylines ofquaint/decorative/charming
middle-class kitsch figurinesbeing produced in southernCalifornia during the 1940sand after, but that is not reallyan explanation. However, Ihope my little narrative atleast sheds some light on thehistory and background of thepotteries.”
Closing ArgumentsThe case of “Hedi versus
Kay” was definitely a rarity.Since artistic design infringe-ment is so difficult to prove,there are literally no docu-mented contemporary casesavailable for comparison.Particularly unusual is theoutcome. Despite a basic sim-ilarity in style, the “Kaye”figurines were in no senseout-and-out copies of HediSchoop’s. And why was KayMcHugh singled out?Ceramics by other formerSchoop employees whoachieved independent suc-cess, (such as Yona Lippin),were equally Hedi-influ-enced, yet no lawsuits resulted.
“Kaye of Hollywood” fig-urines, in particular, show offMcHugh’s design innova-tions, easily setting her workapart from that of her one-time mentor. Molded (ratherthan painted) flowers are aMcHugh signature, adding alively dimensionality to herwork. Also notable: the use ofapplied “lace” for shawls,scarves, and the like, con-trasting with the otherwisesmooth ceramic. (“That‘lace’”, notes KimSchuefftan, “was nothingmore than dishcloths soakedin slip and fired.”)
Had the Schoop/McHughcase been heard several yearslater, the results might havebeen different. FollowingWorld War II,the UnitedStates giftwaremarket wasawash inimported look-alikes. Usually,there was littleattempt to dis-guise the origi-nal source.Overseas manu-facturers, (pri-marily inJapan), castmolds fromactual figurines( i n c l u d i n gHedi’s and

This week we valued a SteiffBlack and White Cat, dating
from after 1950. The cat is 8 inches tall.Steiff was founded in
1877 by Margarete Steiff tomake underskirts andchildren’s clothes.Animal toys wereintroduced to therange of products in 1880.
Margarete Steiff’snephew Richard joined thecompany in 1897 andexperimented with jointedbear design between 1902and 1905. The companywas made famous by itsteddy bears and its trademarkof the button-in-ear. Theybecame the leadingexporter of bears fromGermany, with theUnited States and Britain
being their biggest cus-tomers.
To this day, Steiffcontinues to

huge range of
replica bears based on earlyclassics.
Without being able to seethe button or label moreclosely, it is difficult to datethis cat more precisely.However, the “Steiff” nameappears to be in a cursivescript, which would indicatea date after 1950. Your fami-ly history may be able to datethis, but I would suggest per-haps 1960s/1970s. EarlySteiff animals (not onlyteddy bears) can realize veryhigh prices, but in recentyears Steiff has producedlarge quantities of animals(not all of the highest quali-ty). Your cat appears to be inrelatively good condition, butvalue is modest.
We valued it at around$60.

After collaborating fora time with “The CaliforniaCleminsons” on their line ofdecorative housewares,Schoop retired from ceramicdesign, focusing instead onpainting.
Kay McHugh, notes KimSchuefftan, “attempted anoth-er ceramic foray in the early1950s. She briefly producedspongeware bowls and the

McHugh a copyist, today anyreal verdict rests only in theeyes of collectors. We canview and appreciate Kay’sfigurines on their own merits,at a point far removed fromthe legal wranglings that orig-inally surrounded them.While Hedi Schoop broughtunique talents to the design offigural ceramics, so did KayMcHugh. And, so did themany other designers whowere influenced, whetherconsciously or unconsciously,by Hedi’s artistry. The feud
has ended. A colorful, capti-vating legacy lives on.

Mikkelson’s collectionhas nearly 1,000 toyboats and miniatureoutboard motors,
plus more than 30 other fullsize vintage boats. But there’seven more. The collection
has over 200o u t b o a r dm o t o r sincludingover 100t h a th a v eb e e ncarefullyrestored.T h o s e10,000 lakeshad wildlife aswell. SoMikkelson’s collection alsoincluded duck decoys. Nearly300 will be offered alongwith a treasure trove ofadvertising and dealerrelated
literature and signs. RichPenn said, “We were honoredthat Paul chose us to helpwith this important auction.We’ve been working withhim for months now andwe’re looking forward toMay. This is a great collec-tion and it’s going to be a funauction!”
The Auction Event willbe held in Paul’s hometownof Willmar, with the Saturdayand Sunday sessions being at
the Willmar CivicCenter. Friday’s uncata-
loged session will be atMikkelson’s 10,000 squarefoot storage building. The
building is full ofboats, motors andparts that were allpart of his restora-tion plans.
According to Paul,“Time just never
allowed me to get it alldone.” The Friday ses-sion will be just for thosein attendance. There

Paul’s historyin Willmar is deep and rich.He grew up there, married,raised his family and collect-ed there. The lakes, water andboating were a part of his lifefrom the time he was a child.T h a t ’ s

widelyrecognized as being the best,most complete collection ofthe classic speed boats in theworld.

motor boats. Theywere built with a
canvas skin over anoak structure and cedar
body. Their styling was time-less and captured the spirit of“Flight.” Mikkelson tried tocollect enough Falls Flyers totell the story of the boat’slegacy in chronological order.He did achieve that.
