    Dear Mr. Carson:

    On March 13, 2015, the Board received your complaint regarding Susan Kent for Senate. A two-stepprocess must be completed before the Board may investigate the allegations raised in your complaint.

    First, a prima facie determination must be made within 30 days after the date that the Board received thecomplaint. A prima facie determination is a determination that a complaint filed under section 10A.02,subdivision 11, is sufficient to allege a violation of chapter 10A or of those sections of chapter 211B listedin section 10A.02, subdivision 11, which are under the Board's jurisdiction. This determination is made bythe Board chair or another Board member designated by the chair.

    The subject of the complaint has 15 days to submit a written statement addressing the prima facie issue.You will be notified of the Board's prima facie determination.

    Because it appears that the filed reports do not properly track the committee's unpaid bills, staff plan torecommend that the Board find that the complaint alleges a prima facie violation of chapter 10A.

    If a determination is made that the complaint does not allege a prima facie violation, the complaint will bedismissed. You will be notified of the reasons why the complaint did not allege a prima facie violation. I fa determination is made that the complaint alleges a prima facie violation, the Board chair will schedulethe matter for a probable cause determination at an upcoming Board meeting. The probable causedetermination must be made within 45 days of the prima facie decision.

    If a probable cause determination is scheduled, you will be given notice of the meeting date and anexplanation of your right to appear before the Board at that meeting.
