CASE SUMMARY: SUP19-08-01 - requests a Special Use Permit to allow for used automobile sales with service at 2203 Shorter Avenue., Rome, GA, Floyd County Tax Parcel H13W405, zoned Community Commercial (C-C). Applicant/Owner: Rodrigo Barahona/Larry Martin
RECOMMENDATION: The subject property is currently an automobile service center that wants to be able to offer approximately eight used automobiles for sale.
ADJACENT USES AND ZONING:
Adjacent parcels to the north, east and west are all zoned Community Commercial (C-C) and consist of commercial businesses. Parcels to the south and southwest west are zoned Suburban Residential (S-R) and consist of single-family homes.
FUTURE LAND USE MAP:
H13W405 is designated as commercial on the 2018 Future Land Use Map.
AVAILABLE PUBLIC SERVICES:
Public water and sewer are available in the area.

The FIRM (2010) map shows that this parcel is not located within the flood plain.
HISTORIC:
This parcel is not located within a locally designated historic district.
STANDARDS FOR ZONING CHANGES per section 2.2.4a:
1. Is the proposed use or development consistent with the stated purpose of the zoning district? Mr. Barahona is currently operating an automobile service center that performs oil changes, tire rotations, etc. He desires to also be allowed to sell used cars on the property, which requires a Special Use Permit because the ULDC allows you to operate a used car lot, or a service center, but you cannot operate a used car lot that includes service without first obtaining a Special Use Permit. Currently there are multiple used car lots and automobile service centers along Shorter Avenue.
2. Is the proposed use suitable in view of the zoning and development of adjacent and nearby property? The proposed use should have minimal, if any, effect on surrounding properties given that the size of the parcel would only allow for a used car inventory of approximately 5 – 10 cars. The business will need two or three variances because the ULDC does not allow car dealers to park their inventory within the setbacks, of which the applicant would probably violate the front, rear and side (western side) setback requirements.
3. Will the proposed use adversely affect the existing use or usability of adjacent or nearby property? Is the proposed use suitable in the view of the zoning and development of adjacent and nearby property? There should be no adverse effect on neighboring parcels. The proposed use is consistent with other businesses in the area.
4. Is the proposed use compatible with the purpose and intent of the Comprehensive Plan? The 2018 Future Land Use Map designates this parcel as commercial.
5. Are there substantial reasons why the property cannot or should not be used as currently zoned? The parcel is small, 0.35 acres according to the parcel viewer, and has building already occupying a sizable portion of it. The fact that the proposed additional use could not feasibly happen without the elimination of multiple setbacks is a factor to consider.

6. Will the proposed use cause an excessive or burdensome use of public facilities or
service, including but not limited to streets, schools, water or sewer utilities, and police or fire protection? There should be no change in the use of public facilities and services.
7. Is the proposed use supported by new or changing conditions not anticipated by the comprehensive plan or reflected in the existing zoning on the property or surrounding properties? Yes.
8. Does the proposed use reflect a reasonable balance between the promotion of the public health, safety, morality, or general welfare and the right to unrestricted use of property? Yes.
