Arbor Day is a holiday celebrated in April to encourage planting of trees. There are many benefits of trees, from health and psychological effects to environmental impact. Studies show that people with green ambience out their windows heal faster and with less difficulty or complications. Trees clean the air by absorbing pollutants and providing oxygen. They cool our homes and provide homes and food for birds, bees and other wildlife. They also control noise pollution and act as windbreaks. All these benefits should inspire us to make every effort to save our trees and make them stronger. This is especially important since we live in an area prone to hurricanes. When it is time for you to prune your trees, be sure to use a certified arborist. If you hire an uninsured worker, and he is injured on your property, you are exposing yourself to possible litigation. Below are pictures of illegal pruning which is a violation in Palm Beach County and subject to fines.

The Significance of the "55 or Over Housing Exemption" Recently several issues have come before your HOA board involving homeowners not in compliance with the governing documents of our organization. The most severe of these is the failure of several owners to comply to Section 7 the "55 or over housing exemption" of our documents found in the Declaration section on page 23 -24 Section 7.1-7.3. I will try to answer the questions raised, the consequences of non compliance and the HOA remedies to correct the problem. The 55 or Over exemption is found in Title 24. Housing and Urban Development. 1.Subtitle B. Regulations Relating to Housing and Urban Development 2.Chapter I. OFFICE OF ASSISTANT SECRETARY FOR EQUAL OPPORTUNITY, DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT 3.Subchapter A. FAIR HOUSING 4.Part 100. DISCRIMINATORY CONDUCT UNDER THE FAIR HOUSING ACT 5.Subpart E. Housing for Older Persons 6.Section 100.304. Housing for persons who are 55 years of age or older. It grants an exemption to a housing facility or community for the discriminatory practices spelled out in the Fair Housing act. HOAs are specifically listed as being an exempt community. It exempts HOAs from the provisions regarding familial status stating that it shall not apply to housing intended and operated for persons 55 years of age or older. "Familial status” means one or more individuals (who have not attained the age of 18 years) being domiciled with (a) A parent or another person having legal custody of such individual or individuals; or (b) The designee of such parent or other person having such custody, with the written permission of such parent or other person." The bottom line for all of this means that the HOA can refuse to allow a homeowner to sell a unit to persons having children under 18 years of age without fear of being sued for discriminatory practice. Our documents specifically exclude children under the age of 18 from residing in Delray Villas 4/5 on a permanent basis and allows the HOA to terminate the residency through legal action if necessary, with the homeowner bearing the entire cost of the litigation. Many of our owners choose to purchase in Delray Villas 4/5 because of this restriction and we all need to be respectful of that.

MONTHLY MAINTENANCE UPDATE

• Finish pruning shrubs, mulching and fertilizing if not completed in March

• Treat palms for environmental and nutritional disorders

• Clean out veggies and annuals that are showing signs of stress

• Divide bulb clumps, ornamental grasses or perennials to rejuvenate garden

RAISIN’ CANE TOUR – sponsored by the After 6 Club By Betty Brownell

Sugarland, as they call it. The price was $15 for the tour, lunch and tips for our 2 guides, Chauncy and Ralph and Raymond the bus driver. Worth every penny. It was almost entirely a bus tour. The only times we got off the bus during the day-long tour were for bathroom breaks, lunch and in the sugar field to get sugar cane samples. The first thing Chauncy spoke about was not sugar but about the sugar industry’s $25 per acre contribution for water conservation projects, particularly the Stormwater Treatment Areas (STAs). STAs were specifically built by the State of Florida to reduce phosphorus in water generated through farming and bring it to acceptable levels before it enters the Everglades. Chauncy really got my attention when he started talking about the agricultural techniques used to improve the quality and quantity of sugar and renew the soil. Sugarcane takes 12 to 15 months to grow and they can get 4-5 years out of each plant on average. Then the cane roots are removed and rice, hemp, green beans, corn or a variety of produce is planted in its place. This benefits the land by helping to restore nutrients the sugar has depleted and has resulted in the Everglades Agricultural Area becoming the “winter vegetable capital of the world”. This was the most impressive fact to me – the world can do without sugar but not without winter vegetables. The sugar industry is very proud of their continuing efforts to reduce air pollution as well. The sugar cane stalk is used to generate power to refine the sugar. Chauncy explained when we saw the steam coming out of a chimney, that smoke leaves a trail, but steam goes a short distance and then dissipates. The steam is reused and the excess power is sold back to the grid. Speaking of air pollution, why was the cane burned? He said the only reason was to get rid of the leaf detritus before harvesting. The bus pulled into the unloading dock for the sugar and we watched it unload from a rail car. From there, it goes inside a big building to be chopped, processed, refined and packaged for sale. We did not go inside. As we were getting on the bus for our return trip, we were handed a bag with 2 pounds of organic sugar, a bottle of OJ, a baseball cap, some measuring spoons and a Protect Farmland sticker. I gave my hat to Rich and said we really got a lot for our money. He said that’s how Big Sugar has changed laws in the US and Florida, by influencing one person at a time. Us homeowners, for a favorable view of their practices; legislators to get beneficial laws and tariffs.

The lawn company is now up and running efficiently and our lawns are looking like those on a golf course. The complaints ratio for the lawn problems we've had in the past has gone down considerably, which means they are doing a good job. Hopefully you've noticed that the hedges have gotten smaller and narrower. It was noted that it was difficult to walk around the sidewalk and we decided that something should be done about this. I hope this is making your trek around the subdivision a lot easier. In addition, if you don't want your hedges trimmed by our landscaping people, please leave a note in the white mailbox in the Rec Center parking lot to the attention of “Russ”.

Also, I'd like to let you know that in April the dates for the lawn cutting will be as follows: April 8th and 9th and April 22nd and 23rd.

If you have thought about having your sidewalks power washed, it must be done before the end of April. Please put a request in the mailbox at the back of the Rec Center parking lot. Please note that ALL POWER WASHING IS FREE!

Please remember that if you are going to be putting “bulk items” (large appliances, cabinets, furniture, etc.) out for pickup, this can ONLY be put out on Tuesday evening for the Wednesday pickup. On Friday, recycle and garbage is the only thing that should be put out.

New Waste Collection Guidelines Effective October 1, 2019

What to Expect: Palm Beach County is going Automated.

Customers will receive a new cart prior to October 1, 2019 that will be serviced by specialized trucks equipped with cart tipping equipment. You will not incur any additional expense and the hauler will be responsible for the repair/or replacement of the cart.

• All garbage must be placed inside the cart to be collected.

• Garbage collection will be provided 2 days a week.

• Do not use your new cart before October 1, 2019.

• Detailed cart and collection guidelines will be attached to your new cart for your review. Bulk Service will be provided 1 day per week and limited to no more than 3 items.

• Bulk items include appliances, furniture and other large household items

• Bulk service will be provided on 1 of your regular collection days.

• If you have more than 3 items, contact SWA Customer Service at 561-697-2700 for an estimate. Construction and Demolition Debris (C&D) will be limited to 2 cubic yards per week.

• C&D will be collected on your scheduled Bulk Service day.

• C&D must be containerized (in cans or bags) weighing less than 50 pounds.

• Containerized C&D material exceeding 2 cubic yards will be tagged and not removed.

• When you hire a contractor, make sure they include removal in their quote!

New Yard Waste Collection Guidelines Effective October 1, 2019

What to Expect:

• Debris other than palm fronds and tree branches should be containerized.

• Tree branches and palm fronds should be neatly stacked in a pile not to exceed 6 cubic yards. Branches must be cut into pieces not to exceed 6 feet in length, 6 inches in diameter and weigh no more than 50 pounds.

• Palm fronds can be any length.

• Piles that exceed 6 cubic yards will be tagged and photographed and the information sent to SWA Customer Service. It will be your responsibility to arrange removal by contacting SWA Customer Service at 561-697-2700 or making other arrangements.

• When you hire a commercial landscaper, make sure they include removal in their quote!
