I am writing to request that CHASE BANK US.A, N .A. launch an immediate investigate into what we believe were serious civil and criminal activities of a fonner employee of CHASE BANK USA, N .A during the 2004 thru 2006 timeframe. These allegations not only include the individual in question, Mr. Matthew Balin, but also his managers at the JP Morgan Chase branch at which he was employed. Matthew Balin, while employed as a Lending Specialist at the JP Morgan Chase Fort Washington, PA office along with the senior managers and others at this office, were in violation of a variety of state and federal laws including: o Fair Housing Act o State and Federal Predatory Lending laws o Equal Credit Opportunity Act o Home Mortgage Disclosure (HMDA) Act o Truth and Lending Act o Federal Trade Commission Act Section 5 - Unfair Deceptive Acts or Practices
« Additionally, my wife' s Civil Rights may have been violated by the Overt Discrimination, Disparate Treatment and/or Disparate Impact implied by Mr. Balin overt omission of marital status, race, and etlmicity on the 2004, and 2005 loan applications. My wife informed Mr. Balin of her desire to include the pertinent information in the race and ethnicity sections of the applications but Mr. Balin obviously had ulterior motives for not including this information.

••• "' Although I have always been the primary bread-winner of the family, Mr. Balin insisted that only my
wife's name and social security number appear on the Uniform Residential Loan Application, even though she had not worked between 1981 and 2003; and was in the process of re-entering the workforce on a part-time basis. Mr. Balin did include my name on the settlement documents but it was always proceeded and followed by three asterisks in the form of ***JAMES H BARNES***. My social security number did not appear anywhere on either the application or settlement documents. On documents were my social security number was required it was entered as 111-11-1111. There is absolutely no question that Mr. Balin 's action of only listing my wife as the mortgage holder on the account virtually destroyed any opportunity she had to apply for future credit because the mortgage payments grossly inflated her income to debt ratios.
We have not been able to acquire the HMDA data for this period but the fact that Mr. Balin was able to
get two different application that contained blatantly fraudulent information pass the auditor and
underwriters at CHASE BANK USA, N .A indicate that he discovered a flaw in tbeapplication review
and approval process, and repeatedly exploited it to avoid the scrutiny of the Company's Auditors and
Underwriters .. The fact that he voluntarily (or involuntarily) left CHASE BANKUSA, N .A at the end of
this period is highly suspicious.
The attached Uniform Residential Loan Applications contain some but not all of the fraudulent entries
made by Mr. Balin. These loan applications in addition to the Settlement Statements show that Mr. Balin
willfully and deceitfully circumvented the checks an~ bal<¥tces built into the both federal and state laws
2004, and was able to perpetrate the same thing agaill in 200~ . His fraudulent acts permanently damaged
our credit worthiness, and severely limited our ability to do obtain outside financing for our business . In
addition to the copies of the aforementioned Loan documents, we have a copy of all other documents we
receive from Mr. Balin, and other within the Fort Washington, PA office during this two year period.

The fraudulent information entered by;Mf. Balin includes, but is not limited to:
1. Not listing my wife 's tru~ income as being less than $1 ,000 per month ($610/month from Social Security, and approx.imafoly $400/month from working part-time for two different employers .)
2. Listing a grossly inflated amount for my wife ' s business incomes from a home-office business in which she was part owner. This occurred on both the 2004 and 2005 applications. (Incomes were listed as $15 000/month in 2004, and $12,500/month in 2005, and the J. H. BARNES & ASSOCIATES business in question actually lost money during both 2004 and 2005.)
1. Not listing my wife 's marital status as married on 2004 application, he subsequently listed her marital status as married on the 2005 applications but did now include my name or social security number on the application .)
4. Not listing husband 's name or social security number on the 2004 or 2005 loan applications. Husband' s name was shown on the closing documents with as ***James H. Barnes***, and his social security number was shown as 111-11-1111 .
5 . The fact that she was listed as the sole mortgage holder, made it virtually impossible for her to obtain credit of any type until the mortgage was paid off.
In addition to this questionable, and frequently fraudulent information, Mr. Balin explicated asked my wife not to change the race and ethnicity sections of the application. On both the 2004 and 2005

••• applications, he had placed a checked in the "I do not wish to furnish this information.", when just the opposite was the case. My wife and I are both African American and we "always" include this information on all applications. We now believe that if this information was included, it would cause the loan to be included in HDMA data, and thus the loan application may have been more scrutinized by JP Morgan Chase, HUD, and others.
We feel that Mr. Balin's actions caused us permanent damage to our financial status and business
reputation, and thus we are seeking the following remedies:
"'" The acknowledgement that the current first mortgage dated March 2005 was granted based-J.lpon fraudulent information supplied by Mr. Matthew Balin and is defective, and sh()uld eithe~ be modified or voided. The Acknowledgement that the line of credit loan application completed by Lending.specialist Mr. Larry Hipp was based upon the fraudulent information entered by Mr. Balin on the 2004 and 2005 loan applications, and based upon this, the line of credit loan is also defective , ~d should either be modified or voided. Award James H. Barnes and Susie M. Barnes suitable punitive mmtetarx_ damages for the destruction of their financial credit and business reputation between 2004 and 2013.-The assessment of these punitive damages should not just be restricted to Mr. Balin, but others at the Fort Washington branch including Mr. Balin ' s manager, auditors, and underwriters who were responsible for reviewing and approving this application. -

At the times that both the 2004 and the 2005 loans closed, we reviewed the closing documents and signed
these document as required, but did not review the Uniform Residential Loan Applications until the years
later after we were informed that civil money PetFllties can,, be awarded for predatory lending practices .
Frankly, we never had a need to review the loan application because we assumed that JP Morgan Chase
underwriters reviewed all loans applications before they are approved.
In summary, we realize that asking CHASE BANK USA, N.A to modify (or void) these loans, and pay us
punitive damages is an extraordinary, unprecedented request, but the permanent damage done to me and my wife by these actions warrants these actions. We believe that what happened at the Chase Fort
Washington, PA branch is not repi:esentative of the great name of JP Morgan Chase. It is clear that the
managers at this branch suffered~ "loss institutional control", and allow Mr. Balin, and others to
circumvent the checks and balances inherent in the mortgage lending industry.

Description of 2004/2005 Predatory Lending Practices of Chase Home Finance, LLC
Predatory Lending Issues
Below is a description of the fraudulent (and sometimes criminal) predatory lending practices of one or more employees of Chase Home Finance, LLC located at Fort Washington, PA branch of JP Morgan Chase Bank, NA These activities occurred between 2004 and 2006, and are microcosms of the corporatewide mortgage fraud that was then occurring at corporations such as AIG, Ameriquest, and others. While the actual predatory lending practices described herein are being attributed to Chase lending specialists at the Fort Washington, PA branch office of JP Morgan Chase Bank, NA, it is clear that the managers of this branch (and Chase underwriters) were aware of these practices; and at a minimum, allowed them to continue unabated. It is our contention that during the period of2004 through 2006:
• Chase lending specialists maintained a third-party relationship with a California-based 'fax spamming' company known as fax.com. This company sent the illegal spam fax to Susie M. Barnes that resulted in her contacting Chase Home Finance. This illicit advertisement claimed among other things that 'the lowest mortgage interest rates in history' were available by calling the 'The Mortgage Experts' number listed on the fax. The person(s) answering the toll-free telephone number in the fax (800-819-5252), directed Mrs. Barnes to call the Chase Home Finance branch in Fort Washington, PA (877-800-4405), and ask for Mr. Matthew Balin at extension (4749). It is important to note that after hundreds of complaints from virtually every state in the US for violating the Telephone Consumer Protection Act (TCPA), fax.com was shutdown by the FCC and the Attorney General of the State of California in November 2006. (Please see TAB ONE of the attachment for more details.)
• Chase lending specialists convinced Susie M. Barnes that rather than obtaining a second mortgage or Line-of-Credit (LoC), that it was in her best interest to obtain a new primary home loan that would enable her to pay off existing first and second home loans, as well as some high-interest credit card debts. Chase lending specialist assured her that because of her excellent credit score, that they would be able to get her an interest rate in the five to five and a half percent range. It was not until the actual closing of the loan that she discovered that what was actually obtained, was a loan rate of 7.825% for twenty years that included the highest discount points allowable (6%). The end result was that our mortgage payments increase by more than $800/month. When the independent closing agent explained the terms of the loan to Mrs. Barnes, she refused to close the loan. Later that day, after the Chase Home Finance lending specialist assured her that he would re-negotiate the loan in exactly twelve months; and promised to get much better terms; we felt that we did not have any other options, and we reluctantly allowed them to reschedule the loan closing for later that same week. It is important to note that although we were stunned at the subprime interest rate and high discount points, we were totally unaware of the fraudulent, factious information that had been entered on the 2004 loan application(s).
• Chase lending specialists created multiple Uniform Residential Loan Applications for Susie M. Barnes in 2004, and appending them to the loan closing documentation. Both applications were created on the same date and it is unclear how they were used:
o The first loan application was designated as for the Borrower' s copy, and; o The second loan application was apparently used by the Chase lending specialist and/or
Chase underwriters.
(There may well be a legitimate reason that the lending specialist created two loan applications rather than one, but even if this is the case, the majority of the information contained in both

applications is inaccurate and in some instances, fictitious.) A summary of the differences between these loan applications are shown below:

• Chase lending specialists did not list my Susie M. Barnes' true income on the loan application which at the time was approximately $1,000 per month ($610/month from Social Security, and approximately $400/month from working part-time as a healthcare employee for two different employers.) This process was duplicated in 2005, when Mr. Balin illegally 'flipped' the 2004 loan because of complaints from Mrs. Barnes regarding the subprime interest rate, maximum discount points, and disgraceful closing fees of the original loan. The terms of the 2005 loan were only marginally better, and there was still a three percent discount rate added to the loan at closing time. As in he had done in 2004, Mr. Balin created two different loan applications, one of which was noted as the Borrower' s Copy. (As with the original 2004 loan applications, there may be a legitimate reason that the lending specialist created two loan applications; but even if this is the case, the majority of the information contained in both applications is inaccurate and/or fictitious.) The following Table describes the difference between these loan applications:

• Chase lending specialists listed a grossly inflated amount for business incomes for Susie M. Barnes from a home-office business she co-owned with her husband. This occurred on one of the 2004 applications, this business income was listed at $10,000/month, and on the other 2004

loan applications this income was listed as $15,000/month. (The business in question, J. H. BARNES & ASSOCIATES actually lost money during 2003, 2004, and 2005.)
• Chase lending specialists listed Susie M. Barnes' marital status as single on both 2004 applications. However, he subsequently listed her marital status correctly on both of the ' flipped' 2005 applications. (We believe that listing the 2004 marital status as single, was instrumental to obtaining approval from the Chase underwriters for the 2004 loan.)
• Chase lending specialists did not list Susie M. Barnes' Race or Ethnicity on either the two 2004 applications, or the two 2005 applications. We subsequently obtained the JP Morgan Chase Bank, NA HMDA data for 2004 through 2006 from the FFIEC.gov website, and this data confirmed that the Phoenix/Scottsdale MSA loan approval rates for Whites (and when no race was specified), were as follows :
o 44% higher than those for Blacks/ African Americans in 2004. o 18% higher than those for Blacks/African Americans in 2005 . o 10% higher than those for Blacks/ African Americans in 2006.
We believe that a key element of Chase lending specialist' s "Stated Income Loan Scam" was not to specified race if the applicant was African American. He (and other lending specialists at this branch) knew that by specifying that the applicant was African American would subject the loan application to scrutiny by the Chase underwriting and HMDA compliance departments. (The HMDA charts in TAB TEN shows, the probability of African Americans being approved for a loan by Chase is markedly lower than either White Americans, or when no race is specified.
• Chase lending specialists created an illegal process for subverting the then accepted Stated Income Lending Process. Stated income loans were intended to enable honest small business owners to qualify for residential home loans, even if they could not verify their monthly income. The illegal process developed by the Chase lending specialists was even worse than the Liars Loans schemes that were prevalent at now defunct mortgage lending companies such as Ameriquest and AIG. (Although our primary concern is rectifying our injustices, we are convinced that the lending specialist and his Direct Team Six colleagues, perpetrated this scam on many other unsuspecting consumers in cities across the US. (We believe that potential applicants for mortgage loans were provided to these lending specialists by the now defunct fax.com company). As illustrated by the two applications for Susie M. Barnes, Chase lending specialists could enter virtually any information on the Uniform Residential Loan Applications and were extremely knowledgeable regarding income to debt ratios, and other information required to meet Chase underwriting requirements. It is apparent, that in addition to a loan application, the only other required documents was a letter from a CPA or tax preparer, and a property appraisal.
Additionally, during the past six months, our inability to obtain the HMDA data for the years 2004 through 2006 dramatically decelerated our attempts to prove that we were subjected to predatory lending practices during this period. I attempted multiple times to find this data on either the JP Morgan Chase Bank website, or on the Internet; and doing this time I was continually told by the Chase Home Finance HMDA department that this data was not available on the Chase website. I was never told that this data was available on the web. A consumer support specialist at the Office of the Comptroller of the Currency informed me that all HMDA data was available on the FFIEC website. Unfortunately, even after I found the HMDA data archive, I was only able to access the Chase 2004 HDMA data using the JP Morgan Chase Bank company name. The HMDA data for years 2005 through 2012 was stored under a different Chase naming scheme. When I requested help accessing this data from the Chase HMDA department, my requests were ignored. However, by using a assortment of JP Morgan Chase Bank names, I finally succeeded in the specified HMDA data by using the name JPMORGAN. After downloaded the HMDA data for the 2005 through 2012 period, I

was able to perfonn some rudimentary analysis on JP Morgan Chase Bank's home mortgage lending practices for African Americans in the Phoenix/Scottsdale MSA, and selected MSAs in Ohio and New Jersey. (The results of the Phoenix/Scottsdale MSA portion of this analysis can be found in the attached in TAB TEN.)
Servicing versus Ownership Issues
The final outstanding issue for me and my wife is to get a definitive answer from Chase Home Finance regarding the "so-called" Goodbye Letter. It is our belief that JP Morgan Chase Bank, NA is attempting to absolve itself of all damages regarding these clearly fraudulent mortgage loans by claiming that all issues related to these loans is now the responsibility of Select Portfolio Servicing (SPS), LLC. The socalled goodbye letter date October 21 , 2013 from JP Morgan Chase Bank, NA (See copy ofthis letter in TAB TWO of the attached) explicated state that only the servicing of our loan was transferred to SPS, and thus in our opinion, all issues regarding the predatory nature in which these loans were created must be mediated by JP Morgan Chase Bank, NA. In early November 2013, shortly after receiving the aforementioned letter; I personally called the Chase the toll-free number at (800) 848-9136 and requested clarification of the servicing aspects of this loan. I was told by the person answering my call that this was strictly a servicing issue, and that the servicing of thousands of other Chase Home Finance accounts were also being outsourced to SPS. If we had been told anything different, we would have immediately protested the outsourcing of our account, and would have pursued a much more accelerated path to resolving our predatory lending complaints. On March 17, 2014, I sent a letter to Mr. Rodney K. Reuscher in the Chase Home Finance Legal and Compliance Department, requested further clarification of this issue. To date, I have not received any response to this or any of the six requests that I have sent to the Chase Home Finance Legal and Compliance Department.
Summary We are troubled that the senior manager at Chase Home Finance, LLC, Chase Home Finance, Inc., and JP
Morgan Chase Bank, NA has allowed this problem to exist for more than six months without even
speaking directly to either my wife or myself. While I have spoken to liaisons on their staffs on three
occasions, there was never an attempt to understand this problem from our point-of-view. In the
instances when I have spoken to these liaisons, they only appeared to be interested in justifying the
actions of the Chase lending specialist who were responsible for these predatory lending practices. There is a prevailing theory of opinion of issues such as this, and it is that "the cover-up is generally
worst then the crime"; and while we are reluctant to say that this is the case, we believe that with the availability of underwriting logs, scanned applications, transaction logs, recorded conversations, etc., it
is a very simple, straight-forward process to determine if our actuations have merit or not. And further,
with the availability of this information, it should be easy to determine if what happened to Susie M.
Barnes was a one-time aberration, or a pattern of behavior that is continually repeated on a daily basis.

Using Fax.com to Advertising False and Misleading Home Mortgages
Key Provisions of the Telephone Consumer Protection Act (TCPA) Prohibits Junk Faxing
The Telephone Consumer Protection Act of 1991 (47 USC 227), or TCPA, among other things specifically outlawed junk faxing the use of any telephone facsimile machine, computer, or other device to send an unsolicited advertisement to a telephone facsimile machine.
1. The TCP A also requires a fax transmitter to identify the source phone number and transmitting organization or individual on each page. The process of war dialing to determine what phone numbers reach fax machines was also prohibited by the FCC rules under the TCPA.
2. The TCPA, in particular the junk fax provision, has been challenged in court on First Amendment grounds, but the law has withstood legal challenges.

Dear Mr. Meusel, This is the third Email that I have sent during the past two weeks, but I have yet to receive any response from you or your staff. The attachment is two loan applications that were prepared for my wife by a Chase Lending Specialist. My wife and I were both in our sixties during the 2004 thru 2006 timeframe, and neither of us understood the ramification of what was happening until it was too late. As I mentioned in my earlier messages, your department has responded promptly to my request for HMDA data, and
you may recall that I had a particular interest in the 2004 and 2005 HMDA data. This interest was
driven by my in-depth analysis of two home mortgage loans, and one line-of-credit loan that my wife (and I) obtained from Chase Home Finance during the 2005 thru 2006 timeframe. The vast majority of our dealing with Chase was with a Lending Specialist named Matthew Balin who was a member of the Direct Team 6 in your Fort Washington, PA office. At the time, I allowed my wife of forty-four years to handle all of the details for these loans, and I now know that I should have taken a much more active role in these activities. All of the loan details were handled by my wife and Mr. Balin via phone and Fax, because Chase Home Finance did not have a presence in the Phoenix metro area. Mr. Balin completed all of the required paperwork, and we did not even see the loan application until it was time to close the loan. At the time that these loans were made, we were in some financial difficulties but did not have any inkling that the real estate market would crash and burn, and make it impossible for us to sell our home for a reasonable profit. Mr. Balin caught us with our guard-down, and after the disastrous 2004 home mortgage loan, we were never able to recover. I have prepared a detail, chronological report that covers all of our dealing with Mr. Balin and other members of the Chase Fort Washington office, and will be mailing it to you before the ten-year anniversary of our dealing with Mr. Balin. To that point, our whole existence is divided into two periods; Before Chase and After Chase, And you would not recognize that we are the same family now, that we were before 2004. I will not continue this diatribe because anything else that I would say is included in the report that I will be sending by the end of the week. Again, I realize that we bear some of the blame for what happen with Mr. Balin, but frankly as you will see in the attachment, many of the things that he did were far beyond anything that Chase, or any other refutable financial institution would condone.

The attached reports show that while African Americans are approximately five percent of the population of the Phoenix/Scottsdale Metropolitan Statistical
Area (MSA), they submitted an average of one point three percent of the JP Morgan Chase Bank home mortgage applications during this five-year study
period that included 2004, 2005, 2006, 2009, and 2012. In addition to the fact that the loan applications from African Americans are far below the
statistical average of five percent, in four out of the five years in the study, their approval rate for the applications were substantially lower than that of White
Americans. Sadly this lack of an aggressive home loan marketing campaign by Chase to African Americans is not just a problem in the Phoenix/Scottsdale MSA,
this problem even exist in the Ohio and New Jersey MSAs, in which JP Morgan Chase Bank has headquarter facilities. The data contained in this document is
taken directly from Home Mortgage Disclosure Act (HMDA) data located on the FFIEC website at www.ffiec.gov/hdmaadwebreport/DisWelcome.aspx. This
