DVR serves the people with the most serious limitations due to disability first. This is required by Federal Law

Workforce Innovation and Opportunity Act Signed into law by President Obama on July 22,

2014 What programs does WIOA cover?

Employment and Training Programs: Adult, Youth, Dislocated Worker, Wagner Peyser

Adult and Technical Education Vocational Rehabilitation

Title IV of WIOA reauthorizes the Rehabilitation Act of 1973 – governs the VR program

WIOA includes a strong emphasis on transition services to students with disabilities

DVR, in collaboration with the LEA, shall provide or arrange to provide Pre-employment Transition Services (PETS) to high school students with disabilities.

What are PETS? 1) Job exploration counseling 2) Work-based learning experiences 3) Counseling on opportunities for transition or

post-secondary educational or higher education programs

4) Workplace readiness training to develop social skills and Independent Living

5) Instruction in self-advocacy, which may include peer mentoring

DVR must annually expend 15% of its federal grant amount on PETS – effective NOW

DVR counselor time spent on this activities, i.e. counseling can be counted

Collaboration with DVR and schools to provide these types of services, continue to use the Transition Action Guide as a tool, cost share needed services, building on to existing services the schools already provide

DVR and schools continuing to outreach to parents and students – referring students at least 2 years prior to graduation

This section limits the use of paying sub-minimum wage

Requires that in 2016 a series of steps be taken before an individual under the age of 24 can be placed in a job paying less than minimum wage, i.e. pre-vocational services at rehabilitation facilities

Also prohibits schools from contracting with sub-minimum wage providers

What is the intent? To stop the flow of youth going from high school to sub minimum wage work

Individuals age 24 or younger may not begin work paying subminimum wage (less than Federal minimum wage) unless the person has completed the following actions: Received pre-employment transition services

or transition services under IDEA, and Applied for DVR services and has been found

ineligible for services or has been determined eligible for DVR services but has not been successful and has been provided career counseling and information/referral to other resources designed to assist the person in attaining competitive/integrated employment

Students who may have opted to go directly from high school to a sheltered type of work situation paying subminimum wage will no longer be able to do so unless the requirements described on the previous slide have been met. They will need to work with DVR first

Student and families should be educated about these changes

This is not a WI DVR policy change it is a Federal Law requirement.
