President’s Message
September/October Newsletter As I write up this message we have had our most successful dinner meeting in years and all because of the timely booking by the Education Committee of Gov Hutchinson, Assistant Legal Counsel for CAR, who talked about the changes to the re-designed CAR Residential Purchase Agreement. If you were not able to come, we have put up a draft of the RPA on our website, thanks to our web guru, Miriam Brown. Here is the link: http://easgv.org/images/educationdocs/2014%20RPA-FINAL%20DRAFT.pdf Like the California Escrow Association, our regional EASGV tries very hard to bring changes, issues and events of importance to our members, either in the dinner meetings or in this newsletter. Things happen though, through the days between one newsletter to another, so that is why we use this handy tool called an “E-Blast” to alert our members. Whether from CEA or EASGV, please give these E-Blasts your attention when they pop up in your Inbox. Our Escrow Revolution Summer Seminar was very well attended and we all came away with the education we needed. This event was not easy to schedule and we thank Vanessa, Phil, Josette, Elia, Lili Setiowati, and other committee members for putting it together. Our “Wine Tasting under the Stars” event was a rousing success! We made over $6,000 and this will be our donation to the City of Hope Family Resource Center. Our grateful thanks to: Greg, Phil, Loretta (Phil’s wife), Jana, Lupe, Debbie and Becky of East West Bank, Elia, all the other members of the committee as well as the silent auction sponsors and purchasers. What a job this was, and done so beautifully! 2015 dues are coming up! It’s time to start saving. Remember, if you started at the beginning of the year, one less Starbucks each week and you will have your dues ready to go by November. We are going into the final quarter of the year. Supposedly, the busy season is behind us, but I am grateful that I don’t see that yet. We need to make hay while the sun shines, even when the sun has been shining so HOT that it is cooking us physically.
Achievement seems to be connected with action. Successful men and women keep moving. They make mistakes, but they don’t quit.

Social Media Marketing: Jump In or Stay Away?

The growth of social media, in less than a decade since it first emerged, has been nothing short of
remarkable. The statistics regarding Facebook usage alone are staggering: There are now a total of 1.4
billion Facebook users worldwide, which equates to 11 percent of the population of planet Earth. And
the average Facebook user spends more than 15 hours a month on the site. On Twitter, meanwhile,
about 190 million tweets are sent every day. And on YouTube, 490 million visitors are accessing 92
billion page views every month.
Given such staggering statistics, it’s not surprising that many businesses have rushed to add social media
use to their marketing and advertising mix. Should yours? For many self-employed individuals and solo
entrepreneurs, the answer is a most definite "maybe."
A Concrete Strategy
Why the qualification? No business should embark on a social media marketing campaign without a
concrete strategy in place.
Many businesses today jump head-first into social media marketing for no reason other than it's the
latest hot marketing and advertising fad and "everybody else is doing it." "We've got to get our
Facebook page up and start getting our customers to 'like' us," the thinking often goes. Or, "We've got
to start tweeting out daily messages to all of our customers and prospects."
The business then proceeds to invest in social media, without a clear idea of what they’re going to get
out of it. Here are its primary benefits:
It gives businesses a greater ability to build and strengthen relationships with its customers and
prospects.
Social media is also a great way to monitor customer feedback to your company's products and
services and to your brand in general. Many customers will share feedback — both good and
bad — with you via social media that they wouldn’t share face-to-face. This gives you an
opportunity to respond quickly to criticism and complaints and try to make things right with
unhappy customers, which can help strengthen customer loyalty.

Establish Realistic Measurements
Social media doesn’t necessarily translate into greater sales or higher profits. A realistic social media marketing goal for
a self-employed professional or professional services firm might be "to increase awareness of and interest in our busi-
ness among customers and qualified prospects."
This could be measured by tracking clicks to your website from your social media pages, or monitoring your 'likes' and
feedback on your Facebook page or the LinkedIn recommendations you receive. “Increasing sales by X percent" is prob-
ably an unrealistic social media goal for most self-employed and professional services firms.
"Who's Going to Do It?"
Many big companies are hiring employees and building entire departments around social media marketing, but that’s
probably not feasible for your small business.
The good news is that social media marketing really isn't rocket science. There are certainly some do's and don'ts and
best practices to follow, but you can probably create a basic social media marketing plan by doing some research on
your own.
A final word of caution: Whatever social media marketing strategy you decide to pursue, be consistent and stick with it.
Launching a half-hearted campaign that doesn’t include regular updates to your social media accounts is worse than no
campaign at all.
It demonstrates a lack of follow-through on the part of your business and could actually damage your relationships
with clients and prospects.

Education Committee Report
August was a busy month for the EASGV in the education department! We had our very successful Annual Summer
Seminar, an Escrow Revolution, and we want to thank everyone who supported the event: the committee members,
goodie bag contributors, speakers, and participants.
There were two concurrent sessions, one for the newbies and one for the oldies but goodies. The newbies were
walked through changes to the new CAR contract, clearing the Preliminary Title Report, and taking and acing their CET
exams! Elia Fuentes’ presentation was well received by the newbies, and they are that much closer to achieving their
PD dreams. The advanced sessions began with a presentation by our very own Josette Loaiza. Thank you so much for
your hard work on heading up the commercial sessions, Josette! We were walked through “The Long and Winding
Road” of endorsements and title policies, and then ended with a really accomplished, diverse escrow panel.
We came together to hear keynote speaker Lee Wilson of First American Title share lessons from his life, which was
anything but typical. We all benefited from his dry humor and inspiring message to all fledgling title and escrow pro-
fessionals: we make mistakes and learn from them… and share the worst mistakes of them all at EASGV with those
who can commiserate! We hope that you enjoyed the seminar, and please let either of us, Phil and/or Vanessa, know
if you have any ideas for our upcoming educational meetings, input is appreciated!
We were honored to have C.A.R.’s Assistant General Counsel, Gov Hutchinson, join us for our September meeting
to go over the changes in the new C.A.R. contract. It’s always a pleasure to have Gov come to our association so
that we can be aware of current legal issues and changes to the CAR Residential Purchase Contract we deal with
day in, day out. And don’t forget to join us Thursday, October 16 as David C. Swedelson, Esq. of Swedelson &
Gottlieb Community Association Attorney, speaks to us about homeowner’s association documents and forms
and new regulations concerning the escrow process.

Also in October is CEA’s Annual Education Conference, October 23-25! Hopefully everybody at EASGV will be making
the trek down to Costa Mesa for the party, as the theme is “Don’t Stop Believing”. The Mark Coniglio Memorial Golf
Tournament is October 23 at Black Gold Golf Club in Yorba Linda, and registration opens that night for the conference
at the Hilton Hotel in Costa Mesa. The next day is when the education starts with updates on the CFPB, Economics
and, back by popular demand, a Tax Update from Michael Haas. Friday night you should dance down to Studio 59’s
Disco Lounge for cocktails, hor d’oeuvres, music and prizes. On the business side of things, there are a ton of sessions
that sound promising…
Keep in mind for your escrow support staff and junior escrow officers that there are two separate concurrent ses-
sions with them in mind, since the Boot Camp last year was so successful! Our own Tricia Vagt is presenting a session
on Saturday about setting up new files and going through the contract for information pertinent to our transaction.
And, EASGV veteran Teresa Shaver is teaching at the concurrent session about tax prorations, which all assistants
need to be able to do to pass their CET test.
For the more seasoned escrow professional, we have Rose Pothier’s much anticipated legal update, the FTB and
changes to Notary standards from Bill Anderson of the National Notary Association, subjects that influence all of us in
the industry. Plus, there will be speakers from the Board of Equalization & EDD on Bulk Sales.
As always, let us know if you have any ideas for upcoming meetings or seminars, and remember we would be so glad to have you in the Education Committee with us. In fact, EASGV will be looking for new volunteers to serve on the upcoming committee for 2015 soon and anyone is welcome to. Plea let us know if you are interested. Education is key to the mission of EASGV, and we look forward to perpetuating that goal into the next year with the new board as we continue to pay it forward. Our mid-August meeting was a combined review of the pending bills and the status of identified bills. The 2014 California Legis-
lative Session concluded 8/31/2014. If a bill was to be considered by the governor to become law, it had to pass both houses
(Assembly and Senate) and formally be enrolled before that timeframe concluded.
I am going to give you a quick synopsis of those bills that have been signed (Chaptered) by Governor Brown as of September 11,
2014.
AB 1770: Assembly Bill 1770 requires that when a lender receives a written request to terminate a HELOC from an authorized
person, including a title company, the lender must terminate the HELOC and apply sums subsequently received to the HELOC.
The written request to terminate the equity line must contain at least the name of each borrower, the account number and the
street address of the property. A written request to terminate the HELOC must be provided to the borrower and be accompanied
by a statement set forth in the bill explaining the reason for the termination and the rights and responsibilities of the borrower
AB 1858: In an attempt to correctly identify debtors for UCC search, this law would require that the name of a debtor on UCC
financing statement correspond to the debtor’s name on his or her driver’s license.
AB 1888: Provides that the documentary transfer tax is a public record and eliminates placing the amount of transfer tax paid “on
the back” of a recorded instrument or on a separately filed document.
AB 2136: Provides that a text or other electronic message of an ephemeral nature that is not intended to be a document of a
permanent nature is not subject to records retention statues that otherwise might apply to real estate brokers.
AB 2430: Requires an association, upon written request, to provide the owner a copy of specific documents relating to transfer
disclosures that the owner is required to make to purchaser. That act authorizes the association to collect a reasonable cost for
delivery of those documents; but prohibits any additional fees for electronic delivery. This bill authorizes the cost to be separate-
ly stated and billed from other charges that are part of sales transaction.
SB 827: For LA County ~ This bill extends thru January 1, 2020 the authorization to mail notification to homeowners regarding
the recording of deeds, quitclaim deeds, deeds of trust. The timeframe for notifications regarding a Notice of Default or Notice of
Sale has been reduced from 20 days to 14 days.
SB 1050: Provides for a change in the form of a notary acknowledgement certificate or jurat to include a notice at the top of the
certificate in an enclosed box stating: A notary public or other officer completing this certificate verifies only the identity of the
individual who signed the document to which this certificate attached, and not the truthfulness, accuracy, or validity of that docu-
ment.” The purpose is to reduce the opportunity for criminals to pass deceptive legal documents claiming a false right to money,
authority or real property by suggesting or stating that the notary’s seal and signature constitute an official endorsement of au-
thenticity.
SB 1051: Provides for the indefinite extension of the Buyer’s Choice Act which was scheduled to sunset January 1, 2015.
SB 1306: This bill repeals statutory provisions as they relate to recognizing a marriage between a man and a woman.
There are other bills pending the Governor’s review and approval. He has until September 30, 2014 to veto, sign or just allow
the bill to become law. Register for Conference . On Saturday the final session will be hosted by Mike Belote and Lexi Howard.
They will give a complete overview of the bills made law. The session is the final session of the day.

Leadership/Membership committees:
All our efforts to bring in new members midway through the year has been successful. We increased mem-
bership May through July by 49, of which 19 were new members under the discounted price. However, we
are still short 171 from our goal for this year. We all have to continue to work hard at this.
The selling point now for membership is to ask “non paying members” (which is what one association calls
non-members!) to join now and get the considerably reduced member Conference sign up rate.
We also want to make sure that those who signed up this year will continue and renew for next year. The
Presidents are tasked to call these new members individually and make sure that they will renew.
The committee put forth a motion, which was approved by the Executive Board and the whole membership,
as to the 2015 membership dues. All dues will stay the same, except the Individual Active Membership shall
be increased by $5.00 to $280.00 and the Individual Associate Members (for affiliates) will be reduced from
$300.00 to $280.00.
There was much discussion on finding a way to make it easier for our members to pay the yearly dues. Vari-
ous options were discussed: monthly payment plans, automatic debit from account, etc. Presidents were
tasked to ask their membership whether a monthly payment plan would be an option that would help.
Conference was very much on the agenda and the individual regions will need to help defray some of the
costs by contributing some funds, bring door prizes, and even donate things towards the Goodie Bags to be
given to the attendees at Boot Camp.
The Tip of the Month has received outstanding comments, so we want to keep on doing this. If our regional
members have tips themselves, have them send it to their Presidents to be forwarded to the committee.
Committee members to have the right to tweak, add or change wording on said tip as it comes in.
Professional Designation committee:
The new Bulk Sale test and Mobilehome test will be rolling out at Conference! We are all very excited. The
test is similar to the CEO test, with a problem based on the CAR contract, multiple choice, true false, and
orals. The cost for taking this test will be the same at $195.00. This is a stand-alone test and will not require
a CEO or CSEO designation beforehand to take.
Next on the agenda is the updating of the PD Workbook, making available sample tests for all designations,
and upgrading the CET test.

The Governance committee, after much heated discussion through the months, brought forth a motion to
change part of the Bylaws, which motion was approved by the Executive Board. This motion will go to vote
at the November Board meeting to all Directors and if it passes, then to all CEA members at large there-
after:
Article IV, Section 1, C – any Director of the Association, having a minimum of 10 years as an Escrow
Officer for the past 15 years in the escrow profession can serve on the Board. (The requirement for
being professionally designated was hereby removed).
Article IV Section 1, C item 5 – Portfolio chairs can be any member who served as committee chair
for 1 full year within the past 5 years.
Tip of the Month and the CEA Mike Belote video clip were very well received. Our members are asked to
submit their tip of the month if they have one to the regional Presidents so that we have a continuous
source through the years.

Conference
No Regrets Policy is the newest addition to Conference this year. If you have not attended
a conference in the last three years with full registration and you are not completely satis-
fied with conference you can receive a full refund of the conference registration. Cookies
are back look for Cookies on the mezzanine. The appetizers served in the Disco Lounge will
be more hands friendly this year.
CEA News
If you hear a speaker on a wonderful exciting topic please ask them to write an article for
our CEA news. We had William Anderson from National Notary Association, I asked and
he has provided an article. We will find it in the Next issue of CEA new. It never hurts to
ask.
Governance
The motion passed to eliminate the PD requirement from the bylaws to be on the Executive
Board of CEA. The vote was 9 to 7. The next vote will be at the Nov. 8th Board of Directors
Meeting the entire Board of Directors will vote. If it passes then the members would be giv-
en the opportunity to vote. We need to consider the future of CEA. The argument that
there is not new blood to serve is incorrect there is 20 or so willing to serve that are new to
the board of directors in the past few years. The few pushing the change actually said “If
you do not like it, change it back in five years”. The PD began 45 years ago and shortly
after became a requirement to be on the Executive Board. AEA now has a certification pro-
gram and is voting on the AEA Board members to have their certification to serve. How
does the President of CEA without a PD govern the PD ? Would she have to leave the room
in some discussions ?

National Affairs/ American Escrow Association Committee
Rosanna Medeiros, Portfolio Chair, called the meeting to order.
AEAs new board is now in effect and they are listening to us. The AEA’s planning retreat will be held in Gettysburg and the direc-tors will be setting goals for the new fiscal year. They want CEA members to know that they do acknowledge California as their largest member and as such they are very interested to know our concerns and what topics or speakers CEA would like them to include in next year’s conference. The 2015 AEA Conference will be held in New Mexico on June 10-14, 2015 (NEW DATE!)
CEA Members do not need to be AEA Directors to get involved. Committees have meetings by phone where members are wel-comed to listen in. Committees and meeting times are posted on the AEA website and most take place once a month, Monday-Thursday around 7pm PST. It is recommended that you email the committee chair that you are interested and they will provide you with a phone access code to join in.
As a reminder, you do not have to run a desk to be on AEAs executive board, however, AEA is leaning towards having executive board members obtain National Certification, not this year but in the near future. Each state has its own limits and requirements as far as professional designations go. Currently, CEA requires its members to both have a professional designation to be on CEAs executive board and to obtain the national certification offered by AEA. So if you are thinking of joining the executive board you are encouraged to obtain your PD as soon as possible so that you can then qualify to apply for the national certification.
Education Committee Teresa Shaver, CEA Director Chair reported.
The Committee meeting began with discussion of the possibility of video recording sessions at the CEA conference in October. Boot Camp sessions 2B, “You Do the Math” and 3A, “CPL & the Prelim” were two sessions that were agreed on to be videotaped. Other video recordings will be worked on including Notes & Deeds of Trust, where Linda Hamilton will add what to do with a Sell-er Carry Back. Webinar classes were also explored, with a presentation on the new C.A.R. Residential Purchase Agreement and a class for transaction coordinators with training possibly offered at a special reduced price for members. Sponsorship opportuni-ties will be made available to Affiliates who will be given a 90 second to 2 minute advertisement plug for approximately $250 split between the beginning and end of the video to help offset the cost of production.
CEA is constantly looking for new ways to educate and give back to its members. And so discount pricing to conference attendees on Escrow I, II & III books was proposed at $20 each or $50 for all 3 books and IT PASSED! Pricing will be available through October 25th, the end of the CEA conference.

DID YOU KNOW???
Legislative updates: SB 1051 passed California legislature. If you remember the 2009 Buyer’s Choice Act, this bill
removes the previous expiration date of Jan. 1, 2015. This is good news for escrow companies
and for Buyers because this piece of legislation states that REO lenders of residential properties
cannot force the Buyer to use their exclusive escrow or title company, thereby taking away the
consumer’s right to choose. With the passing of SB1051 the Buyer’s Choice Act is here to stay
AB 1888 passed California legislature. This bill was designed to do away with portions of the
Revenue and Taxation Code which allowed the transfer tax not to show on the Grant Deed,
thereby hiding the purchase price of the property. Effective Jan 1, 2015 this can no longer be the
case. County Recorder’s offices may no longer accept documents that do not show transfer tax.
Please be sure you advise your clients correctly, particularly for transactions taken at the end of
the year that will close at the beginning of 2015.
AB 2416 (California Wage Theft Recovery Act) was a huge problem legislation that was opposed by both the real estate industry and the escrow industry, among others, not of the concept itself, but of possible consequences of a badly written bill. After major discussions and amendments on the floor and despite the backing of California’s labor unions, this bill did not pass. If passed, this bill would have allowed employees to file a wage lien against an employer’s real and personal property without any review of the validity of the wage claim by the courts or the Labor Commissioner. The potential for damage to innocent employers is huge. The bill may not have passed this year, but there is little doubt that the labor unions will probably re-word and re-submit it for the next legislative year. CEA’s legislative advocate will keep us apprised.
The new CAR RPA
We sure got the nitty gritty on the CAR RPA from Gov Hutchinson on September 18th
at our
dinner meeting. That was quite a bit to absorb, and that new cancellation and deposit
disbursement clause (14.G) really is worrisome. But like Gov said, this contract needs to
withstand the tests of time and reality. If you were unable to come to our meeting, you can find

My only comment is: How will the real estate professionals manage to remember all these form
designations?” They start out with the easily identifiable RPA, but then they have the BUO,
CCA, BIA, SBSA, SSIA, CR, CC, FVAC, AS, QS, TIP, RLAS, SPQ, SSD, RCSA, RID, SCO,
SMCO, BCO, RR, RRRRoar……. ? They should not complain when we ask for the SI and the
PCOR!

EASGV By Laws Changes Report
“If you don’t succeed, try, try again” Tricia Vagt and Terri Fabbri were tasked with project of going over our By-Laws and making certain
changes to make it more commensurate to the By Laws of the California Escrow Association. After two
dinner meeting we were able to garner sufficient votes to make the changes. Here they are as follows, in
summary. A full By-Laws copy will be put on the website for members to access at any tim.:
Article IV - Membership and Regulations Change and/or additions to membership descriptions to match CEA application.
Individual Active Member – Individual Active members shall be a person currently in the escrow settlement profession with a Regional membership or a person formerly in the escrow settlement profession, with a Regional membership, who currently holds a CEA Professional Designation. This category shall allow for full voting privileges at the Regional level, in the California Escrow Association and the American Escrow Association. They are eligible to hold office and sit on the Board of Directors.
Individual Support Staff Member – An Individual Support Staff Member shall be a person that participates in the escrow or settlement process as a secretary, assistant, or any other position that is clerical and/or entry level. This category of membership is not available to an escrow officer or any other person in a management or supervisory position. This category of membership provides for no voting rights in the California Escrow Association and no membership in the American Escrow Association. This category allows for Regional membership. They are eligible to sit on the Board of Directors and hold an office.
Dual Membership: A Dual Membership is defined as a member of the California Escrow
Association, in any category, but not with a Regional Membership with the Escrow Associates of San Gabriel Valley. Dual Membership provides for no voting rights in the Escrow Associates of San Gabriel Valley and no membership in the American Escrow Association. The purpose of this Dual Membership is for those that are already a member in the California Escrow Association and would like to receive the member discount for dinner meetings and access to our newsletter. Dual Membership is based on a calendar year, on an individual basis, and is non-transferable. The dues amount to be charged shall be determined by the board of directors annually.
Article VI -Finance
Delete mention of purchasing fidelity bond.
Add: The Bank account of Escrow Associates of San Gabriel Valley shall require two signatures on all checks written against the account, as follows: The President, President Elect and/or Vice President, Treasurer, Secretary and Site and Reservation Director.
Article VIII – Board of Directors
The number of Directors of the Association shall be ten (10), including elected Officers. Affiliate members, not to exceed two (2) in number, may be elected to serve as a Director of the Association. "Grandparents Scam". #PPD
“Grandparents Scam”
One of the latest trends Pasadena and the surrounding communities have been experiencing
lately is called the “Grandparent’s Scam” also known as the “Emergency scam.”
In the typical scenario, a grandparent receives a phone call from a scammer claiming to be one of
his or her grandchildren. Callers go on to say that they are in some kind of trouble and need
money immediately. They claim to have been in a car accident, are having trouble returning from
a foreign country or they need bail money. You may get a call from two people, one pretending
to be your grandchild and the other pretending to be either a police officer or a lawyer. They will
ask questions prompting you for personal information. You will be asked to wire money through
a money transfer company or to buy some pre-paid debit cards and are asked to give up the card
numbers so they can be funded by the scammer.
Often, victims don’t verify the story until after the money has been sent. In some cases,
scammers pretend to be your old neighbor or a friend of the family. Generally, the emergency
scam is directed at the elderly in our community.
If you or someone you know is being scammed please have them contact the Pasadena Police
Department, Financial Crime Unit at 626-744-4576. If the money has not yet been wired or
funded, cease all communications with the scammers and do not send the money, then contact
the police.
