BACKGROUND AND INTRODUCTION
Anglo American Coal South Africa (AAC) intends on developing the proposed Setlabotsha coal mine located
near Standerton in the Mpumalanga Province. The proposed Setlabotsha project will involve extraction of
coal resources by means of underground mining methods. The coal resource will be accessed by two new
shafts and coal will be transported via new overland conveyors to AAC’s existing New Denmark Colliery,
where the coal will be washed and processed.
Prior to the development of the proposed project, AAC requires a mining right and environmental
authorisation, both to be granted by the Department of Mineral Resources (DMR). AAC appointed SRK
Consulting as the independent Environmental Assessment Practitioner (EAP) to manage and facilitate the
environmental authorisation process.
LOCATION OF PROPOSED PROJECT
AAC’s proposed Setlabotsha project is located close to the town of Standerton in the Mpumalanga Province
and falls within the Lekwa Local and Gert Sibande District municipalities. Setlabotsha is situated adjacent to
AAC’s existing New Denmark Colliery. Refer to Figure 1 for the locality map.

PROJECT DESCRIPTION
AAC proposes to develop two shaft complexes, namely East and West shafts for the Setlabotsha project.
Each shaft complex will consist of an incline shaft for material and coal extraction, as well as a vertical shaft
for personnel and small material access. An office complex will be situated between the East and West
shafts. Associated with each shaft complex, will be an overburden stockpile, pollution control dam, silo,
ablution facilities and associated sewage treatment plant, access roads and other surface infrastructure.
Only the No. 4 coal seam will be mined, which is on average approximately 189 m below surface with an
average thickness of 2 m (varying between 1.0 – 4.4 m). Coal will be extracted by means of bord and pillar
underground mining methods, however, longwall mining will be considered and investigated during the
feasibility phase. The proposed underground mining area is approximately 160 ha. The planned life of mine
will be approximately 40 years.
Coal will be transported from the shaft complexes via a 26 km overland conveyor belt to AAC’s existing New
Denmark Colliery, where the coal will be washed and processed.

LEGISLATIVE REQUIREMENTS
AAC is submitting a mining right application in terms of the Mineral and Petroleum Resources Development
Act (Act No. 28 of 2002) (MPRDA) to the Department of Mineral Resources (DMR) for the proposed
Setlabotsha project. The proposed mining right area is indicated in Figure 1. Before the mining right is
granted, AAC must undertake an environmental authorisation process in terms of the National Environmental
Management Act (Act No. 107 of 1998) (NEMA).
This environmental authorisation process comprises three phases, namely:
1. Pre-application 2. Scoping phase 3. Impact assessment
The purpose of the pre-application phase is to introduce the project to stakeholders (including alternatives
considered) and provide stakeholders with an opportunity to raise comments early in the process, in order to
inform and influence the design of the project and inform the environmental authorisation process. During
scoping, issues for investigation during the impact assessment phase are identified by the EAP and through
engagement with stakeholders. This results in developing the scope of studies to be undertaken during the
impact assessment phase. This information is compiled into a Scoping Report, which will be available for
public comment. Once comments from the stakeholder engagement process are received, the Scoping
Report will be finalised and submitted to the competent authority (DMR) for decision-making with regards to
the remaining process for impact assessment phase.
During the impact assessment phase, potential environmental and social impacts are investigated assessed by specialists and the EAP. Measures to manage and/or mitigate negative impacts and positive impacts are proposed. An Environmental Impact Assessment and Environmental Programme (EIA/EMP) will be compiled and made available for public comment. Again, comments stakeholder engagement process will be incorporated into the updated EIA/EMP for submission to The DMR will, in consultation with other commenting authorities, make a decision about the project.
Figure 2 provides an overview of the environmental authorisation and associated stakeholder engagement
processes for each phase.

The overall timeframe for the environmental authorisation process from the submission of the environmental
authorisation application to receipt of the Record of Decision from DMR is approximately 300 days.
STAKEHOLDER ENGAGEMENT
The stakeholder engagement process, undertaken as part of the environmental authorisation process, is
conducted in terms of NEMA (as amended) which provides clear guidelines for stakeholder engagement
during an environmental authorisation process. Chapter 1 of the NEMA outlines the principles of
environmental management, several pertaining to stakeholder engagement. Chapter 6 (sections 39 - 44) of
the NEMA Regulation GN R982 (promulgated in December 2014) specifies the minimum requirements for
stakeholder engagement for an environmental authorisation process.
This process offers stakeholders the opportunity to be informed about the project, raise comments or queries
and make suggestions for enhanced project benefits. The technical specialists and project team will evaluate
relevant issues and suggestions during the EIA process. Figure 2 provides an overview of the stakeholder
engagement activities associated with this environmental authorisation process.

AGTERGROND EN INLEIDING
Anglo American Coal Suid-Afrika (AAC) is voornemens om die beoogde Setlabotsha-steenkoolmyn naby
Standerton in die Mpumalanga Provinsie te ontwikkel. Die beoogde Setlabotsha-projek sal die ontginning
van steenkoolhulpbronne deur middel van ondergrondse mynboumetodes behels. Toegang tot die
steenkoolhulpbron sal deur twee nuwe skagte verkry word en steenkool sal met nuwe oorlandvervoerbande
na AAC se bestaande New Denmark-steenkoolmyn vervoer word, waar die steenkool gewas en verwerk sal
word.
Voordat die beoogde projek ontwikkel word, benodig AAC ’n mynreg en omgewingsmagtiging wat albei deur
die Departement van Minerale Hulpbronne (DMH) toegestaan moet word. AAC het SRK Consulting as die
onafhanklike Omgewingsbepalingspraktisyn (OBP) aangestel om die omgewingsmagtigingsproses te
bestuur en te fasiliteer.
LIGGING VAN BEOOGDE PROJEK
AAC se beoogde Setlabotsha-projek is naby die dorp Standerton in Mpumalanga geleë en val onder die
Lekwa Plaaslike Munisipaliteit en Gert Sibande Distriksmunisipaliteit. Setlabotsha is aanliggend aan AAC se
bestaande New Denmark-steenkoolmyn geleë. Verwys na Figuur 1 vir die liggingskaart.

BESKRYWING VAN DIE PROJEK
AAC is voornemens om twee skagkomplekse, naamlik ’n oostelike en westelike skag, vir die Setlabotsha-
projek te ontwikkel. Elke skagkompleks sal uit ’n hellingskag vir materiaal en die ontginning van steenkool
bestaan, asook ’n vertikale skag vir toegang van personeel en klein materiaal. ’n Kantoorkompleks sal
tussen die oostelike en westelike skagte geleë wees. ’n Bolaag opgegaarde voorraad, besoedelingsbeheer-
dam, silo, ablusiegeriewe en verwante rioolsuiweringsaanleg, toegangspaaie en ander oppervlak-
infrastruktuur sal met elke skagkompleks gepaard gaan.
Slegs die Nr. 4-steenkoollaag sal ontgin word, wat gemiddeld ongeveer 189 m onder die oppervlak is met ’n
gemiddelde dikte van 2 m (wisselend tussen 1.0 en 4.4 m). Steenkool sal deur middel van kamer-en-pilaar
ondergrondse mynboumetodes ontgin word, maar strookafbouing sal gedurende die haalbaarheidsfase
oorweeg en ondersoek word. Die beoogde ondergrondse myngebied is ongeveer 160 ha. Die beplande
lewensduur van die myn sal om en by 40 jaar wees.
Steenkool sal vanaf die skagkomplekse met ’n 26 km- oorlandse vervoerband na AAC se bestaande New
Denmark-steenkoolmyn vervoer word, waar die steenkool gewas en verwerk sal word.

WETLIKE VEREISTES
AAC sal vir die beoogde Setlabotsha-projek ’n aansoek om mynreg by die Departement van Minerale
Hulpbronne (DMH) indien, soos bepaal deur die Wet op die Ontwikkeling van Minerale en Petroleum-
hulpbronne (Wet 28 van 2002) (MPRDA). Die beoogde mynreggebied word aangedui in Figuur 1. Voordat
die mynreg toegestaan word, moet AAC ’n omgewingsmagtigingsproses onderneem kragtens die Wet op
Nasionale Omgewingsbestuur (Wet 107 van 1998) (NEMA).
Hierdie omgewingsmagtigingsproses bestaan uit drie fases, naamlik:
1. Pre-aansoek 2. Omvangbepalingsfase 3. Impakbepaling
Die doel van die pre-aansoekfase is om die projek (insluitend alternatiewe wat oorweeg word) aan
belanghebbendes bekend te stel en hulle ’n geleentheid te gee om vroeg in die proses kommentaar te lewer.
Dit sal die ontwerp van die projek inlig en beïnvloed en sal die omgewingsmagtigingsproses inlig. Kwessies
wat gedurende die impakbepalingsfase ondersoek moet word, word tydens omvangsbepaling deur die OBP
en deur middel van skakeling met belanghebbendes geïdentifiseer. Dit lei tot die ontwikkeling van die
omvang van studies wat gedurende die impakbepalingsfase onderneem moet word. Hierdie inligting word
saamgevat in ’n Omvangbepalingsverslag wat vir openbare kommentaar beskikbaar gestel sal word. Sodra
die kommentaar van die belanghebbende-deelnameproses ontvang word, sal die Omvangbepalingsverslag
afgehandel en by die bevoegde owerheid (DMH) ingedien word vir besluitneming oor die oorblywende
proses vir die impakbepalingsfase.
Gedurende die impakbepalingsfase word potensiële omgewings- en maatskaplike impakte deur en die OBP ondersoek en geëvalueer. Maatreëls vir die bestuur en/of versagting van negatiewe
die bevordering van positiewe impakte word voorgestel. ’n Omgewingsimpakbepaling en bestuursprogram (OIB/OBP) sal saamgestel en vir openbare kommentaar beskikbaar gestel word. Kommentaar van die belanghebbende-deelnameproses sal weereens by die bygewerkte OIB/OBP
geïnkorporeer word vir indiening by die DMH. Die DMH sal, in oorleg met ander owerhede, ’n besluit oor die beoogde projek neem.
Figuur 2 bied ’n oorsig van die omgewingsmagtiging- en gepaardgaande belanghebbende-
deelnameprosesse vir elke fase.

Die algehele tydraamwerk vir die omgewingsmagtigingsproses, vanaf die indiening van die aansoek om
omgewingsmagtiging tot die ontvangs van die Rekord van Besluit van die DMH, is ongeveer 300 dae.
BELANGHEBBENDE-DEELNAME
Die belanghebbende-deelnameproses wat as deel van die omgewingsmagtigingsproses onderneem word,
vind plaas ingevolge NEMA (soos gewysig), wat duidelike riglyne stel vir die deelname van
belanghebbendes tydens ’n omgewingsmagtigingsproses. Hoofstuk 1 van die NEMA omskryf die beginsels
van omgewingsbestuur, waarvan heelwat met belanghebbende-deelname verband hou. Hoofstuk 6 (artikel
39 - 44) van die NEMA Regulasie GN R982 (gepromulgeer in Desember 2014) bepaal die minimumvereistes
vir belanghebbende-deelname in ’n omgewingsmagtigingsproses.
Hierdie proses bied aan belanghebbendes die geleentheid om ingelig te word oor die projek, kommentaar te
lewer of vrae te vra en om voorstelle te maak om die voordele van die projek te versterk. Die tegniese
deskundiges en projekspan sal tydens die OIB-proses die relevante kwessies en voorstelle evalueer. Figuur
2 bied ’n oorsig van die aktiwiteite rondom belanghebbende-deelname wat met hierdie
omgewingsmagtigingsproses verband hou.
