Compliance Assistance Flashback

2001, AAPCO and EPA created an e-commerce compliance advisory. The advisory: Ø Explained what is classified as a pesticide. Ø Provided examples of products that are pesticides

such as cockroach baits, rodent poisons, flea and tick collars, mold and mildew controls etc.

Ø Explained while there can be some exceptions, most pesticides require registration with the EPA and with any state in which they are sold or distributed.

Ø Explained what can be considered against the law.

Compliance Monitoring Flashback

2003, as part of the Farm Security and Rural Investment Act of 2002 EPA responded to a Congressional request. The response stated: Ø How EPA is applying FIFRA to e-commerce

pesticide transactions. Ø Summarized cooperation with states & tribes. Ø Provided an overview of activities. Ø Summarized concluded enforcement actions.

Enforcement Flashback

2003, EPA issued an enforcement alert. At the time of publishing we included 13 stop sale orders that had been issued associated with unregistered or misbranded products.

2017, EPA’s Office of Inspector General issued a report stating, EPA Can Better Reduce Risks from Illegal Pesticides by Effectively Identifying Imports for Inspection and Sampling
