Important Points

What is the FMLA? Who is eligible? When can it be used? How is it administered?

What is the FMLA?

Intended to balance the demands of the workplace with the needs of families

Provides up to 12 weeks of unpaid job-protected leave to eligible employees

Where applicable, used in conjunction with accrued leave and Sick Leave Bank

May be used in “blocks” or intermittently

Who is eligible?

An employee who has worked for the County for at least one year and…

Has worked at least 1,250 hours in the previous 365 days and…

Has not used all available FML from that rolling year and…

Meets the conditions of the FMLA

When can an employee use FML?

To care for a child after birth or placement in the employee’s home

To care for a spouse, child or parent with a serious medical condition

For the employee’s own serious medical condition

Serious Health Condition

An illness, injury, impairment, or physical or mental condition that involves:

Inpatient care or treatment in connection with inpatient care; or Continuing treatment by a health care provider

– Including incapacity of more than 3 consecutive days plus subsequent treatment two or more times

– Incapacity due to pregnancy or for prenatal care– Incapacity for a chronic serious health condition which requires periodic

visits (e.g. asthma, epilepsy)– Incapacity which is permanent or long-term (e.g. Alzheimer’s, terminal

cancer)– Absence to receive multiple treatments which would result in incapacity for

more than 3 days if not treated (e.g. chemotherapy, dialysis)

What should I do if I think an employee may need FML?

Talk with your employee; suggest they call their HR contact!

Runs concurrently with other leave programs (e.g., sick leave, Sick Leave Bank) for all County employees

Comp time may be used prior to start of FML leave Partial days do not count as whole days Legal notification requirements - Leave MUST be

accounted for on at least a monthly basis FML Leave Codes (80 series)

Special FML situations

New fathers may use one week of their own sick time (code 81) for bonding leave; must provide medical certification for further sick leave use

FML (Personal/Annual/LWOP—codes 82 or 85) used for adoptive or foster placement bonding leave
