1. General information on ATA Carnet This Information Guide has been designed with the purpose to
familiarize the Participants of the International Specialized Exhibition EXPO 2017 in Astana (hereinafter referred to as Astana EXPO 2017) on the operation of the ATA Carnet system in the territory of the Republic of Kazakhstan.
In December 1961 in Brussels, the Customs Co-operation Council (GATT) adopted the “Customs Convention on ATA Carnet for temporary importation of goods.” In June 1990, the “Convention on Temporary Admission with Annexes” was adopted. There are currently 75 countries which
have joined the ATA Carnet. ATA Carnet is an international customs document that replaces customs
declarations and allows for the simplified and accelerated processing of temporary import and export of goods in connection with the exhibitions and fairs, as well as for transportation of commercial samples, professional equipment and some other categories of goods across the border.
The need for temporary import and export of goods and equipment
according to ATA Carnet arises when organizing a tour for music and circus troupes abroad, cultural events and various exhibitions in other countries.
It should be noted that the use of the ATA Carnet for temporary import of goods is not mandatory. The Participants of the Exhibition (Declarants) decide on their own – whether to use ATA Carnet or to pass the procedures for customs clearance of goods under the national rules of the Republic of Kazakhstan or transit countries.
2. Advantages of using ATA Carnet
• It replaces the customs declaration and exempts the Declarant from the need to submit an electronic declaration;
• It provides accelerated customs clearance, which main idea is that the customs officer makes special notes on the appropriate sheets of the ATA Carnet;
• It exempts the Declarant from payment of customs payments, including customs clearance fee and security to pay the customs payments;
• It is an international financial guarantee to pay the customs payments; it is the guarantor of specially authorized organizations;
• It provides opportunity to visit up to 10 countries during the entire period of validity of the document (one year);
• The possibility to visit an unlimited number of countries. Allows to use one type of document throughout the entire route, regardless of the number of crossed borders (provided that the countries on the route are parties to the Convention on Temporary Admission).
The Participants need to know that the use of the ATA Carnet does not exempt from the obligation to submit permits for imported goods. Therefore, you can apply to the Kazakh competent authorities for obtaining relevant permits. It is recommended to sign beforehand a Customs Declaration Agreement with the customs representative (broker) at the point of destination (delivery) in the territory of Kazakhstan. The customs broker at the destination will ensure the documents preparation and the customs clearance.
3. ATA Carnet in Kazakhstan
The Republic of Kazakhstan has ratified the Convention on Temporary
Admission, done at Istanbul on 26 June 1990, by Act No. 346-IV ZRK dated 3 November 2010 (hereinafter referred to as the Convention).
The goods covered by ATA Carnet, which are allowed to Kazakhstan for temporary duty-free import, are set out below in the annexes to the Convention on Temporary Admission dated 26 June 1990:
Annex A: concerning temporary admission papers (ATA Carnets and CPD Carnets);
Annex B.1: concerning goods for display or use at exhibitions, fairs, meetings or similar events;
Annex B.2: concerning professional equipment; Annex B.3: concerning containers, pallets, packings, samples and other
goods imported in connection with a commercial operation; Annex B.4: concerning goods imported in connection with a
manufacturing operation; Annex B.5: concerning goods imported for educational, scientific or
cultural purposes; Annex B.6: concerning travellers’ personal effects and goods imported
for sports purposes; Annex B.7: concerning tourist publicity material; Annex D: concerning animals with the following reservations:
“The Republic of Kazakhstan does not consider itself bound by the provisions of paragraph 1 of Article 4 in Annex D and paragraphs 12 and 13 of the Appendix in Annex D.”
Please note that Kazakhstan has not acceded to the Convention in the following annexes:
1) Annex B.4: concerning goods imported in connection with a manufacturing operation;
2) Annex B.8: concerning goods imported as frontier traffic; 3) Annex B.9: concerning goods imported for humanitarian purposes; 4) Annex C: concerning means of transport; 5) Annex E: concerning goods imported with partial relief from import
duties and taxes. In accordance with the provisions of the Convention, there are the
following restrictions: it is not allowed to lease or otherwise use for fee, or export from the venue the goods imported according to ATA Carnet.
The Participants to the Exhibition must get the information on possible restrictions on the importation of certain categories of goods and equipment in advance from the chambers of commerce and industry in the country of departure or the guaranteeing organization of the country of temporary admission.
4. Use of ATA Carnet for Astana EXPO 2017 If you import goods to Kazakhstan from the country issuing ATA Carnet,
you can use a number of advantages during customs clearance of goods that are temporarily imported to Astana Expo 2017 Exhibition. The use of ATA Carnet will simplify the customs clearance of goods in countries en route to Kazakhstan, provided that such countries also recognize ATA Carnet.
The ATA Carnet is an international customs document that is issued for a fee by the national chambers of commerce or other national associations authorized by the customs authorities in the countries that are parties to the relevant international convention. The ATA Carnet replaces standard customs papers required for the import and export of goods.
The ATA Carnet is valid for temporarily imported goods (for a period of up to one year) which can be fully exempted from customs payments for temporary importation. Its effect does not apply to expendables. The Participants to Astana EXPO 2017 are recommended to import such goods under the Special Customs Procedure and they will have customs privileges: exemption from payment of import customs duties and taxes, without the application of non-tariff and technical regulating measures. Detailed recommendations are contained in the document titled Logistics Guide for EXPO 2017.
Currently, there is a Special Customs Procedure in Kazakhstan approved by the Decision of the Commission of the Customs Union No. 329 dated May 20, 2010 and Decision of the Government of Kazakhstan No. 522 dated July 15, 2015, in relation to foreign goods imported to Kazakhstan and intended for the organization and holding the International Specialized Exhibition EXPO 2017 in Astana. This procedure does not affect the provisions of the Convention on the Temporary Admission (Istanbul Convention) of goods and
does not prevent the import of goods intended to hold Astana Expo 2017 events using ATA Carnet.
The goods intended for commercial activities will undergo a standard procedure for customs clearance with payment of all customs duties and compliance with import requirements.
If the goods stay in the territory of Kazakhstan longer than the validity period of the ATA Carnet (but no more than one year), it is necessary to apply to the organization that issued ATA Carnet with a request for reissuance of a new ATA Carnet book. A new ATA Carnet book shall be presented to the customs authority at the border crossing point to the customs territory of the Customs Union (hereinafter referred to as the Customs Union), which carried out the customs clearance of temporary admission.
We advise to indicate in the shipping documents accompanying the goods, as well as in Section C Intended Use of Goods of the ATA Carnet, that the goods are intended for holding Astana EXPO 2017 Exhibition with the address and its Organizer:
“Exhibition goods for Astana EXPO 2017, Kazakhstan;”
Organizer: Astana EXPO 2017 NC JSC. Notwithstanding that the presentation of a Letter of Guarantee from the
holder of the ATA Carnet on the intended use of goods and assumed duration of the location of goods on the customs territory of the CU is not mandatory; such letter can help to speed up the customs clearance. It should be borne in mind that the Organizer of Astana Expo 2017 does not issue any guarantee letters for goods imported according to ATA Carnet.
The organization that issued the ATA Carnet book may charge a fee for its issuance and must require the owner to provide guarantees or other security to ensure that the goods will be exported from the country of importation.
5. Organization granting and issuing the ATA Carnet books in the territory of the Republic of Kazakhstan
In most countries, the ATA Carnet books are issued by chambers of commerce and industry. In the Republic of Kazakhstan, the guaranteeing association, which executes and issues ATA Carnets, is the Foreign Trade Chamber of Kazakhstan, which is a wholly owned subsidiary of the National Chamber of Entrepreneurs of the Republic of Kazakhstan “Atameken.”

6. Customs control when applying the ATA Carnet procedure
We advise to carry out all customs operations related to the import of foreign goods and delivered for participation in Astana Expo 2017 Exhibition in the city of Astana. The territorial subdivision of the customs authority in the city of Astana will perform customs clearance of the goods arriving at the customs clearance point, which will be located on the territory of the Logistics Center, close to the Exhibition pavilions.
The Declarant is exempted from providing a security to pay the customs payments during import of goods only after reimport procedure (exportation of previously imported goods).
Annex 1 contains the names of territorial customs authorities of the Republic of Kazakhstan, which will carry out customs operations with ATA Carnet books while transporting the goods across the customs border of the Customs Union.
By accepting the ATA Carnets, the customs authorities of the Republic of Kazakhstan verify its compliance with the established rules. Particular attention will be made to the possibility of using ATA Carnets in relation to imported goods, the validity period, proper filling-in of the General List of Goods, the registration of counterfoils and loose-leafs. The customs authority accepts the ATA Carnet if all requirements are met.
It is not allowed to make any changes or additions to the document after the acceptance of the ATU Carnet by the customs authority. This will require the written consent of the customs authority in the form of a resolution to the appeal of the holder of the ATA Carnet book.
As a rule, the ATA Carnet books are filled in English or in French. The customs authorities of the Republic of Kazakhstan reserve the right to demand translation of the ATA Carnet to the state or Russian language.
Therefore, when entering the customs territory of the Eurasian Economic Union, we recommend to enclose translation into Russian of the pages in the ATA Carnet that have any records. The documents designed in such way will accelerate the customs procedure at the border. All pages should be filled-in in the same way, since they must contain the same information as the cover, which, together with additional pages, is further signed by the holder of the ATA Carnet indicated in column A. All other pages
are filled-in in the course of customs clearance in the countries participating in the international ATA system.
In case of loss, theft, destruction of goods or the ATA Carnet itself, the holder must notify the customs authority, which controls the loose-leaf.
7. Application of the ATA Carnet procedure on the territory of the Eurasian Economic Union
Kazakhstan, having ratified the ATA Convention on Temporary Admission at the end of 2010, has now completed the procedure on joining this system. The World Chambers Federation of the International Chamber of Commerce (ICC WCF) has sent to all members of the international guarantee chain a notice that the Foreign Trade Chamber of Kazakhstan which is the organization that guarantees and issues ATA Carnets in the territory of the Republic of Kazakhstan, has become the 76th member of the international ATA guarantee chain of the ICC WCF. The ATA system will be applied in Kazakhstan from April 2017.
Currently, the Chambers of Commerce and Industry and customs authorities of Belarus, Kazakhstan and Russia are working on the agreement on the use of ATA Carnets in the territory of the Customs Union. These states are members of the Eurasian Economic Union (hereinafter referred to as the EAEU). One of the main problems is the issue of partition of the responsibility of the Chambers of Commerce and Industry of the EAEU countries to the customs authorities in case the holder of the ATU Carnet violates the regime of temporary importation of goods.
Based on the analysis of the scope of accession of the EAEU member states to the Convention, it follows that Kazakhstan, in comparison with other EAEU member states, has joined the largest number of Annexes of the Conventions totalling 8 Annexes (including 1 with reservations), while Russia have joined 6 Annexes including 1 with reservations), and Belarus have joined 5 Annexes. The Republic of Armenia and the Kyrgyz Republic, members of the EAEU, are not parties to the Convention on Temporary Admission.
The various scopes of accession of the said EAEU members to the Convention can lead to difficulties, in particular, the movement of foreign goods through the territory of Russia with ATA Carnet books according to customs transit procedure (by road) for participation in Astana Expo 2017 Exhibition.
In this connection, we strongly recommend to get detailed consultation on movement of goods through the territory of the Eurasian Economic Union from the organizations guaranteeing and issuing the ATA Carnet books, from freight forwarding companies that transport with the ATA Carnet books prior to shipment of the goods for Astana Expo 2017 Exhibition.
