JAMMU, Sept 5: High Courthas stayed the Governmentorder whereby State DentalCouncil was constituted in termsof Section 21 of the DentistsAct, 1948.

The stay was granted in apetition filed by Dr BhupinderSingh and others.

Advocate Parag Sharmaappearing for the petitionerssubmitted that in a previousround of litigation, High Courtby virtue of judgment and orderdated May 6, 2017 had directedthe State to hold the electionsand constitute the DentalCouncil within two months.

"However, much before theprocess of election could be ini-tiated and completed, theGovernment passed the orderdated May 31, 2017 constituting

the State Dental Council interms of Section 21 of theDentists Act, 1948", he furthersubmitted.

He vehemently urged thatthe order impugned was per seillegal inasmuch as without con-ducting an election in terms ofJ&K Dental Council (Election)Rules, 1997 as ordered by theHigh Court, the respondentscould not have constituted theState Dental Council.

After hearing the counsel forthe petitioners, Justice DhirajSingh Thakur stayed the opera-tion of impugned order.

SRINAGAR, Sept 5: Stronglyrejecting Jammu and Kashmir for-mer Governor Jagmohan's demandfor removal of Article -35 -A, sen-ior Congress leader and formerMinister Tariq Hameed Karra hassaid that a hostile situation wasbeing created deliberately acrossthe country against the special sta-tus of the Jammu and Kashmir andthe latest seminar and documentaryrelease was part of that nefariousdesign .

In a statement, Karra said thatRSS and BJP were working over-time to create a wedge between thepeople of Jammu and Kashmir andrest of the country to gain politicalmileage and Article 370 was beingused as a tool to achieve that desireof the saffron brigade. He addedthat a well thought out plan hasbeen worked out by BJP and RSS

to use the Kashmir Issue for garner-ing support in the upcoming Gujratand other State Assembly electionsand people like Jagmohan werepart of that game plan.

The former minister remindedJagmohan of his 'misrule' and 'mis-adventures' he practiced as a part ofhis experiments with the people ofthe Jammu and Kashmir asGovernor of the State. He remindedJagmohan that he too was appoint-ed as Governor by the Presidentialorder and said if Jagmohan was soconcerned about the 'legality' of theArticle 35-A and knew the 'provi-sions introduced through the consti-tutional Order of 1954 were doneunconstitutionally,' why did not hemake attempts to abrogate then?

He said BJP has purchased asection of media also to propagateits designs and create a situation ofrhetoric and hostility in the countryonly to fulfill its designs.

SRINAGAR, Sept 5: ChiefSecretary B B Vyas todaychaired the 5th meeting of StateLevel Committee on CropInsurance (SLCCI) of PradhanMantri Fasal Bima Yojna at theCivil Secretariat here.

The meeting was attended byFinancial Commissioner,Revenue, Lokesh Jha, PrincipalSecretary, AgricultureProduction, Sandeep KumarNaik, Principal SecretaryFinance, Navin KumarChoudhary, Principal Secretaryto Chief Minister, Rohit Kansal,CGM NABARD, S KMajumdar and other officers ofFinance, AgricultureProduction, Revenue and otherallied departments.

During the meeting, theChief Secretary was told that theinsurance scheme has alreadybeen kicked off with more than86000 farmers insuring theircrops such as Maize, Paddy,Oilseed and Mango in Jammuregion while the scheme hasn'tbeen launched in Kashmir divi-sion where the insurance compa-nies are quoting very high pre-

mium.According to officials, a pri-

vate insurance firm has soughtaward cost of Rs 326 crore forone calendar year coveringMaize, Paddy, Oilseed, Appleand Saffron crops in three dis-tricts of Ganderbal, Budgam andKupwara alone with total sumassured of Rs 1027 crore.

"There's no way the Statewill go ahead with the tender (ofprivate firm) unless the funda-mentals are settled. We mustfirst establish a standardizedcost of production and scale offinance for crops grown in bothJammu and Kashmir regions,such as Maize and Paddy, tounderstand the disparity in pre-miums," the Chief Secretarysaid.

He directed the officials tocompile the list of incidences ofcrop damage or production inJammu and Kashmir and alsosuggest an ideal or possible rateof premium, "We can also con-sider involving central insurancecompanies for a period of twoyears. The state will write to theCentre to extend the deadline ofthe scheme," he said.

DDC orders action against 62 unauthorized absent employeesExcelsior Correspondent

SRINAGAR, Sept 5: DistrictDevelopment Commissioner(DDC) Kupwara Khalid Jahangirtoday ordered action against 62Government employees, whowere found unauthorized absent.

On the instructions of KhalidJahangir, DDC Kupwara, a teamheaded by AssistantCommissioner (Rev) Kupwaraconducted a surprise inspection ofthe various Government offices inKupwara.

The offices inspected includeCEO's Office Kupwara, ACD'sOffice Kupwara, BDO's OfficeKupwara, Municipal CommitteeKupwara, REW's Office KupwaraPHE Division Kupwara andIrrigation Division Kupwara.

During the inspection, 62employees were found unautho-rizedly absent from their offices.

Accordingly concerned

District and Sectoral officers weredirected by the DDC Kupwara totake action against the absenteesfor their un-authorized absence asper Civil Service and ConductRules and furnish action takenreport within a week's time.

JAMMU, Sept 5: DivisionalCommissioner, Jammu, Dr.Mandeep Bhandari chaired themeeting of the ExecutiveCommittee of Indian Red CrossSociety Jammu, here today.

IGP Jammu, Dr. S. D Singh,Deputy Commissioner, Jammu,Rajeev Ranjan, DeputyCommissioner Samba, SheetalNanda, Deputy Commissioner,Kathua, Ramesh Kumar, DeputyCommissioner Reasi, RavinderKumar, Honorary Secretary RedCross, R. C. Puri besides seniorofficers of the concerned depart-ment were present in the meeting.

Divisional Commissionerheld detailed review of the actiontaken on the decisions taken inthe last meeting of the committeeand also of the activities carriedout by the society.

Stressing the need to makeRed Cross activities more mean-ingful, Divisional Commissioneremphasized that the need of thehour is to build a large pool ofvolunteers for ensuring participa-tion of people from the grass rootlevel.

Also the Red Cross is con-ducting four days First AidTraining Programmes for theCommercial Vehicle Driversbefore issuing of licence by theRTO.

‘Ganapati Visarjan’ held afterimpressive Shobha Yatras

JAMMU, Sept 5: In connec-tion with Ganesh Chaturthi,impressive Shobha Yatras weretaken out for Ganapati Visarajan(immersion of the Lord Ganesh'sidols) in Tawi, Chenab and otherwater bodies.

Amidst beating of drums andsinging of Bhajans in praise ofLord Ganesha, these ShobhaYatras were taken out from differ-ent parts of the Jammu region andpassed through adjoining areasbefore immersion of LordGanesha idols with proper rituals.

Elaborate arrangements weremade by local administration forsmooth Ganesh Visarjan Yatras.Special prayers were held by peo-ple on the occasion.

An impressive Shobha Yatrawas taken out by the devotees ofLuxmi Narayan Temple at DhakkiSarajan today to bid adieu to LordGanesha (Bappa), who wasinstalled in the temple sinceGanesh Chaturthi. BJP State vice

president Yudhvir Sethi was espe-cially invited by JammuSwarankar Association andMaratha Swarankar Association,who had made elaborate arrange-ments for the Shobha Yatra beforeGanesh Visarjan in river Tawi. TheShobha Yatra passed through JainBazar, Purani Mandi, VinayakBazar, Parade, Chowk Chabutra,Lakhdatta Bazar, Kachi Chawniand Mubarak Mandi.

The procession comprised ofelephants and bands brought fromGujarat. Tableaux were receivedby people of different faiths andreligions enroute.

Similar Ganapati Visrajan tookplace at river Chenab in Akhnoorwhere a large number of devoteesreached in the form of impressivereligious processions and thenimmersed Lord Ganesh idol in theriver water.

During the 10-day festival,devotees performed Puja at thetemples and had beautifully deco-rated 'pandals' where Ganeshaidols were installed.

The delegation appealed forGovernor's urgent intervention inrestoring trade on the Poonch-Rawalakot route which hasremained suspended for the pastover 8 weeks, leading to large loss-es to the traders.

Government's order of 31-05-2017which prescribed measures tostreamline the trade; revisiting theapplication of GST on LoC trade sothat LoC trade is taxed at a minimalpercentage which too can be reim-bursed on the same pattern asapplies to the incentives being givenfor the promotion of industry inJ&K; in the light of the recent NIAraids, corrective measures need tobe taken to ensure that there is nonexus between the various agenciesand the unethical traders at the LoCpoints; to ensure against emergenceof vested interests no officer of anyagency posted at the LoC TradeFacilitation Centre should continuefor more than 6 months at a stretch.The delegation said that a dedicated

SRINAGAR, Sept 5: HighCourt today came down heavilyon Commissioner SecretarySocial Welfare Department andobserved that he has poorunderstanding of JuvenileJustice Act and its Rules.

After perusal of the statusreport of CommissionerSecretary SWD, High Courtreturned the same and said thesame is inadequate and does notaddress the issues and concernsin terms of Juvenile Justice(Protection and Care ofChildren) Act and its Rules.

High Court on last date alsohad said the affidavit filed doesnot specify the requirementsenvisaged in Juvenile JusticeAct for orphanages and directedfor filing of fresh affidavit indi-cating there-in the plan ofaction to meet all deficiencies.

Today when the fresh affi-davit was placed before theDivision Bench of Chief JusticeBadar Durrez Ahmad andJustice Ali Mohammad, thesame was out-rightly rejectedand returned. The DB grantedfinal two weeks for overcomingthe deficiencies.

DB said that once the Acthas been in place and the Rulesmade thereunder, thenGovernment cannot take excuseof non-availability of funds.

Even on last date of hearingCommissioner Secretary(SWD) was taken to task by thecourt for his failure to appearbefore it.

Court had directed theCommissioner Secretary to filehis affidavit by next date indi-cating there-in the action ofplan to meet the deficiencies inOrphanage homes across theState. But the affidavit wasfound unsatisfactory.

JAMMU, Sept 5: ChiefJudicial Magistrate JammuAshwani Sharma today rejectedthe bail application of Dr BodhRaj Kundal, Head of NeurologyDepartment of GovernmentMedical College Jammu, who isaccused of molesting a patient.

After hearing CPO AshishRathore with Senior PO M AAlmansoor and PO ArvindManhas for the Police whereasAdvocate Rajesh Gupta for thedoctor, CJM observed, "it is truethat bail is rule but jail is excep-tion. However, present case fallswithin the exception because theprofession of doctors is a verysacred one".

"If the doctors themselvesindulge in such type of crimesthe faith of the general publicparticularly the women folkshall be shaken. There is no rea-son to implicate the accused by

the prosecutrix in false case",the court further said whilerejecting the bail application.

Meanwhile, City JudgeJammu extended the policeremand of Dr Bodh Raj Kundaltill September 9.
