This cause came to be heard upon the Motion for Temporary Injunction filed by
Plaintiff, Crty of Jacksonville and State of Florida, ex ref. City of Jacksonville on June 11,
2004. After consideration of the evidence before this Court, the Court finds as follows:
1 . Section 360.40 7, Ordinance Code, authorizes the City to seek injunctive relief
in circuit court to restrain pm=sans from violating or continuing· to violate Chapter 362,
Ordinance Code.
2. Despite repeat~d demands and efforts from the City, the Defendants have
violated, and continue to vic,late the Florida Statutes, the Florida Administrative Code,

petroleum storage facility located at the Site.
3. Defendants BCX, Seven Out. and SOS, as owner and operators of the Site,
are directly responsible for compliance with all local and state requirements for operation
of its business.
4. After receiving testimony and evidence, this Court finds the requirements for
issuance of a temporary injunGtion have been met.
Upon consideration of the foregoing, it is hereby
ORDERED:
1. Plaintiffs Motion for Temporary Injunction is granted.
(a) Defendants, thei·officers, agents, servants and employees shall be required
to properly remove and dispm:e of all regulated petroleum products currently existing on
the Site in the containment structure within one (1) week from the date of this Order,
(b) Defendants, thei1· officers, agents, servants and employees shall be required
to property remove and disposf~ of all regulated petroleum products currently existing in the
storage tanks located on the Site within three (3) months from the date of this Order. Once
the storage tanks are emptiej, the Defendants shall not use or permit the use of the
storage tanks for any purpose.
(c) Defendants, their officers, agents. servants and employees shall sample and
analyze for the presence of petroleum contamination in all existing monitoring wells located
on the Site within three (3) we,~ks from the date of this Order;
{d) · Defendants, their officers, agents, servants and employees shall remove and
remediate all surficial petrolet..·m contamination around the exterior of the containment

structure; and
(e) Defendant shall 1= rovide proof of financial responsibilfty and proof of payment
of registration fees pursuant to Florida Administrative Code 62-761:
2. Subject to the time frames listed in paragraph 1. above, Defendants, their
agents, servants,- employees <md assigns, are temporarily enjoined from maintaining a
petroleum storage system on the Site in such a manner as to be in violation of Florida
Administrative Code 62-761 and Chapter 362, Ordinance Code.
3. Because this temporary injunction is issued on the pleading of ths City of
Jacksonville, a municipality, th.s Court, pursuant to Rule 1.61 0, Fla. R. Civ. P., finds that
a bond shall not be required.

Plaintiffs, City of Jacksonville ("City"), and State of Florida ex rei. City of Jacksonville
("State ex ref. City") sue Defendants, SCX Inc., ("BCX"), Seven Out, L.L.C. ("Seven Out"),
Petroleum Fuel and Terminal Company ("Petroleum Fuel"), S.O.S. Earth, Inc. ("S.O.S."),
and International ·processing Specialists, Inc. ("International") (collectively the
"Defendants"), and allege:
1. This is an action for injunctive relief and civil penalties in excess of Fifteen
Thousand Dollars ($15,000.00) as a result of the Defendants' failure to meet performance
standards for aboveground tanks installed after July 13, 1998, as required by Rule 62.,

2. The City is a political subdivision of the State of Florida.
3. Seven Out is a limited liability corporation registered with the Florida Division
of Corporations and is located at 1859 East Adams Street, Jacksonville, Duval County,
Florida. Based upon information and belief, Seven Out is the current owner of the real
property located at 1903 East Adams Street, Jacksonville, Duval County, Florida (the
"Site") and the petroleum storage systems located thereon.
4. BCX is a corporation licensed to do business in the State of Georgia and
maintains an office at 1859 East Adams Street, Jacksonville, Duval County, Florida.
Furthermore, BCX is the current co-operator of the petroleum storage systems located at
the Site, having taken over the operation of the facility from International Processing
Specialists, Inc ..
5. S.O.S. is a Florida corporation having its principal address as 1859 East
Adams Street, Jacksonville, Duval County Florida. S.O.S. is listed by the Florida Division
of Corporations as the owner of the fictitious named entity BCX, who is the current co-
operator of the petroleum storage systems located on the Site.
6. International is a Florida corporation that was administratively dissolved in
2002. Its principal place of business is 1903 East Adams Street, Jacksonville Duval
County, Florida, the Site. International was the-operator of the petroleum storage facility
at the time of the inspection which revealed the existence of the violations. International
shares the same principal place of business as BCX, Inc., Seven Out, and S.O.S ..
Additionally, International shared the same director, Mr. Ferrell Carden, with Seven Out.
7. Petroleum Fuel is a foreign corporation registered with the Florida Division-

of Corporations to do business in Florida. Petroleum Fuel is listed by the Duval County
Property Appraiser's Office as being the current owner of the Site and the petroleum
storage systems located thereon.
8. Pursuant to Section 403.182, Florida Statutes, the City's Environmental
Resource Management Department ("ERMD"), formerly known as the Regulatory and
Environmental Services Department, is an approved local pollution control program. FDEP
has the authority to enter into a contract with an approved local pollution control program
to carry out a petroleum storage systems compliance verification program.
9. Under the authority of Section 376.303, Florida Statutes, FDEP and ERMD
entered into a contract, wherein ERMD assumed compliance enforcement authority
previously held by FDEP over those petroleum storage tank systems existing in Duval
County, Florida, and regulated under Chapter 62-761, Florida Administrative Code
("F.A.C.").
10. Pursuant to Section 360.108(b) of the Ordinance Code of the City of
Jacksonville ("Ordinance Code"), the Jacksonville Environmental Protection Board ("JEPB")
adopted Rule 3.701, adopting and incorporating by reference Chapter 62-761, F.A.C ..
Chapter 62-761, F.A.C. provides standards for the registration, construction, installation,
operation, maintenance, repair, closure, and disposal of storage tank.systems that store
regulated substances, and to minimize the occurrence and environmental risks of releases
and discharges. Petroleum products are a regulated substance under Chapter 62-761,
F.A.C.
11. Section 60.05(1), Florida Statutes authorizes suit in the name of the State of
Florida to enjoin a nuisance, as defined in section 823.05, Florida Statutes. Section

823.05, Florida Statutes defines a nuisance in part as" ... any place which tends to ...
injure the health of the community ... or any place where a'!y law of the state is violated
.... " Section 823.05, Florida Statutes authorizes such places to be abated pursuant to
section 60.05, Florida Statutes.
12. On March 27, 2001, ERMD personnel conducted a site investigation and file
review with regard to the petroleum storage facility located at the Site, where BCX and
S.O.S. now operate.
13. During ERMD's site investigation and file review, it was determined that the
Site's petroleum storage tank systems failed to meet performance standards for exterior
coatings in violation of Florida Statute 403.161(1)(b); Florida Administrative Code 62-
761.500(1)(b) and JEPB Rule 3.701; failed to repair any component that has caused or
could cause a discharge or release in violation of Florida Statute 403.161 (1 )(b), Florida
Administrative Code 62-700(3)(e) and JEPB Rule 3.701; and failed to repair secondary
containment in accordance with 62-761 .500(1 )(e) in violation of Florida Statutes
403.161(1)(b), Florida Administrative Code 62-700(3)(e) and JEPB Rule 3.701. As a
result of the inspection, ERMD issued a Notice to Correct Source of PollutionNiolation
("Notice to Correct"), attached as Exhibit A and incorporated herein by reference. The
Notice to Correct required that the violations be corrected by June 27, 2001.
14. A followup inspection revealed that the violations had not been corrected, and
a Cease and Desist Citation HM-01-34, (the "Citation") attached as Exhibit B, was issued
July 5, 2001, to International, as operator of the facility. The Citation required the
correction of the violations noted above, a response to the citation in writing within 10 days
of receipt of the Citation and contacting Ms. Dana Brown, from ERMD, to discuss civil

penalties for the violations. A copy of the Citation is attached hereto as Exhibit B and
incorporated herein by reference.
15. In response to the Citation, Mr. J. Allen Bryson, CEO of BCX, contacted
ERMD personnel to discuss bringing the facility into compliance. After multiple
communications, the property remains out of compliance, and, in fact, the situation has
been exacerbated with the release of an estimated 1 0, 000+ gallons of waste oil into the
containment structure and into the environment.
16. On or about June 26, 2001, September 21, 2001, August 9, 2002, October
1, 2002, March 19, 2003, and June 3, 2004 ERMD personnel conducted subsequent site
investigations and file reviews with regard to the Site. As a result of that investigation,
ERMD personnel determined that no corrective action had been taken with regard to the
violations noted in the Citation and discovered new violations of the petroleum storage tank
rules. All relevant inspection reports are attached as Composite Exhibit C and
incorporated herein by reference.
17. Section 376.302, Florida Statutes, provides that the penalty provisions of
Section 403.141, Florida Statutes, to apply to those persons found to be in violation of the
FDEP's laws and regulations, including Chapter 62-761, F.A.C. Sections 403.121 and
403.182(7), Florida Statutes, provide for a continuing maximum potential penalty of ten
thousand dollars ($1 0, 000) per violation, with each day upon which a violation occurs being
a separate violation. Furthermore, Section 362.109, Ordinance Code provides that
violations of JEPB Rules constitute a Class D offense, punishable by a five hundred dollar
($500) fine, with each day the facility remains out of compliance constituting a separate
violation.

Count I Temporary and Permanent Injunctive Relief
The City adopts and incorporates herein by reference paragraphs 1 through 17
above.
18. Section 360.407, Ordinance Code, authorizes the City to seek injunctive relief
in circuit court to restrain persons from violating or continuing to violate Chapter 362,
Ordinance Code.
19. Despite repeated demands and efforts from the City, the Defendants have
violated, and continue to violate the Florida Statutes, the Florida Administrative Code,
JEPB Rules and the Ordinance Code, by continually failing to correct the violations at the
petroleum storage facility located at the Site.
20. Defendants BCX, Seven Out, and SOS, as owner and operators of the Site,
are directly responsible for compliance with all local and state requirements for operation
of its business.
21. If a temporary and permanent injunction is not entered forcing the
Defendants to correct the violations found at the Site and bring the facility into compliance,
the City is concerned about the health and welfare of the public due to the existing
discharge of waste oil onto the unprotected soil surface and the existing estimated 1 0,000+
gallons of untreated waste oil which has been released into the containment structure.
Given the Defendants' repeated and continued refusal to address or correct violations
identified in the Cease and Desist citation and the subsequent inspections and the
potential environmental disaster currently existing on the Site, the City is convinced the
only way it can obtain compliance from Defendant is through an injunction, and absent an

injunction, the City will be irreparably harmed, for which it has no adequate remedy at law.
The City has a substantial likelihood of success at trial and public interest considerations
favor the entry of a permanent injunction.
WHEREFORE, Plaintiff requests the Court grant the following relief to Plaintiff and
against Defendant:
(a) immediately require Defendants, their officers, agents, seNants and
employees, to properly remove and dispose of all waste oil currently existing
on the Site, both in the containment structure and in the existing storage
tanks, pursuant to Rule 62-761, Florida Administrative Code;
(b) immediately require Defendants, their officers, agents, servants and
employees, to _

employees, to file a Remedial Action Plan pursuant to Florida Administrative
Code Rule 62 to address ·remediation of soil and/or groundwater
contaminated by improper discharges of petroleum products at the Site;

(e) require Defendant to provide proof of financial responsibility and proof of
payment of registration fees pursuant to Florida Administrative Code 62-761; . .
(f) afford Plaintiff such other relief as this Court deems reasonable.
Count II Civil Penalties

22. Section 362.111, Ordinance Code, provides that civil penalties may be
assessed by judicial process in a civil action for violations of Chapter 362, Ordinance Code.
23. Section 403.161, Florida Statutes, provides that civil penalties may be
assessed by judicial process in a civil action.
WHEREFORE, Plaintiff, City of Jacksonville requests this Court:
(a) Pursuant to Section 403.161, Florida Statutes, Chapter 62-761, F.A.C., and
JEPB Rule 3.701, enter judgment imposing civil penalties against
Defendants BCX Inc., Seven Out, L.L.C. Petroleum Fuel and Terminal
Company, S.O.S. Earth, Inc., and International Processing Specialists, Inc.
of up to $10,000 per violation, with each day upon which a violation occurs
constituting a separate violation;
(b) In the alternative, pursuant to Section 362.109, Ordinance Code, enter
judgment imposing civil penalties upon Defendants BCX Inc., Seven Out,
L.L.C. Petroleum Fuel and Terminal Company, S.O.S. Earth, Inc., and
International Processing Specialists, Inc. of$500 per violation, with each day
upon which a violation occurs constituting a separate violation; and
©) Enter such other and further relief as this Court deems appropriate.
Count Ill Nuisance/Injunctive Relief
The State ex ref. City adopts and incorporates herein by reference paragraphs 1
through 17, and paragraph 21, above.
24. Due to the existence of the numerous violations of the petroleum storage tank

rules and the existence of an estimated 1 0,000+ gallons of untreated waste oil that has
currently been discharged into the environment and the facility's containment structure, this
Site has already injured the environmental health of the community and threatens to
severely impact the public health, safety and welfare. Furthermore, the Site is in violation
of Chapter 403, Florida Statutes. For these reasons, the property meets the definition of
a public nuisance, as described and defined in section 823.05, Florida Statutes.
25. Because this property is a public nuisance, the State ex ref. City is authorized
to seek an injunction to enjoin those activities on the Site that make it a nuisance.
WHEREFORE, Plaintiff, State ex ref. City, requests the Court grant the following
relief to Plaintiff and against Defendant:
(a) declare the Site a public nuisance;
(b) immediately require Defendants, their officers, agents, servants and
employees, to properly remove and dispose of all waste oil currently existing
on the Site, both in the containment structure and in the existing storage
tanks, pursuant to Rule 62-761, Florida Administrative Code;

employees, to
